Girlfriend Thought He Was Cheating And Stabs Him, Wonders Why She's Going To Jail
Description
Watch this police interrogation with intense raw interrogation from the interrogation room as police conduct a full interrogation of a suspect. This raw interrogation footage captures every moment of the suspect interview, complete with deception detection techniques, and criminal psychology in true JCS style interrogation. The Background Lindsay Rae Shelltrack-Miller (then 40) and Justin Allen Berge (36) had been in a romantic relationship since 2019. The relationship was described in court records as volatile. On the night of April 18–19, 2021 they argued by text; she later said she believed he was cheating. Texts from her that night included statements such as “I want to hurt you now” and “You’re dead.” Both had methamphetamine in their systems; she had not slept. On the morning of April 19, Berge went to her residence in the 1500 block of 9th Avenue North, St. Cloud. They argued inside. When he went outside he found his tires slashed and accused one of her friends. She then drove him to an auto-parts store so he could buy supplies to fix the tires. The Crime Date and place: late morning of April 19, 2021, in the alley behind her duplex. After they returned, a silent home-security video recorded the sequence: She squirted/poured water on him multiple times. She punched him, then pulled out pepper spray/mace. He retreated toward his vehicle and later ran across the alley; she chased him. He threw a Fix-a-Flat can and later a soda can that struck her head. She grabbed him from behind; he pulled her to the ground. While he tried to collect items he had dropped, she kicked him and sprayed mace. She unzipped a fanny pack, took out a folding knife, and stabbed him once in the left chest. The wound passed through the third intercostal space, into the pericardial sac, and through the left coronary artery. She called 911 and told the dispatcher she had stabbed him. Officers found him gasping in the alley; he was pronounced dead at St. Cloud Hospital at 12:22 p.m. The medical examiner ruled the knife wound the sole cause of death and excluded his weight, heart condition, and drugs as causes. The Investigation She remained at the scene, told arriving officers “Yes, Officer” when asked if she had stabbed him, and pointed out the knife on a car trunk. A neighbor who saw her chasing Berge and later found him on the ground also heard her admit she stabbed him. The Night Owl security video from her own property contradicted parts of her later account that she had only been defending herself after he pinned her. Court findings: she initiated and repeatedly escalated the physical confrontation (water, punch, mace, chase) and was the first to introduce a weapon. She did not withdraw from the fight in a way that would restore a self-defense claim. She was charged with one count of second-degree unintentional murder while committing a felony (second-degree assault). Conviction and Sentencing She waived a jury trial. A week-long bench trial before Judge Nathaniel Welte ran October 25–29, 2021. On December 9, 2021 the court found her guilty of second-degree unintentional murder (Minn. Stat. § 609.19, subds. 1 and 2(1)). Self-defense was rejected because she was the initial aggressor and never clearly withdrew. Sentencing: April 26, 2022. 128 months in prison (10 years 8 months), the bottom of the presumptive range, with 373 days credit for time served. Restitution of approximately $13,907 was also ordered. A request for a downward departure was denied. The Minnesota Court of Appeals affirmed both the conviction and the sentence on July 17, 2023.
