Okay. So, she wanted to hit your mom, >> right? >> And I got in the middle of it and she hit me with a rock. >> It's my house, so I am not trespassing. I lived here for more than 5 years, so I can come and get my mail whenever I want. >> Yeah, cuz she did um threaten me that she was going to kill me with a >> I always carry a rock in my bag because she has me outside where I can get where there's bugs, where there's tarantulas. >> I am not going to have this argument. DO YOU UNDERSTAND? SIT DOWN. ON September 27th, a distressed mother called 911 after one of her family members [music] tried barging into her home and assaulted her. The culprit, Jessica, has a history of mental health issues and [music] came to demand money from her family, but when turned away, decided to take a more physical approach. When officers arrive, the fight breaks up, but the [music] screaming continues. >> She just hit me with >> Okay, we'll figure this out. Give me just a sec. >> Okay, stand over here. Hold on. Stand over here. Stand over there. STAND OVER THERE. I AM NOT GOING TO HAVE THIS ARGUMENT. Do you understand? SIT DOWN. >> SIT DOWN. [screaming] >> WELL, figure this out. >> He's telling you to sit down. >> Talking to you. No, you stop. >> Okay. >> Focus on me. >> Okay. She hit me with a potato WHEN I WENT DOWN. >> PUT your hands behind your back. >> Are you listening to what I'm saying? >> Not right now because you're not going to tell me how to do my investigation. >> I was saying she hit me with a potato. Hit me on the cement. >> Please get my bag. That's my >> walk over here. I will get it. >> You're not going to tell me how to do my job. >> You lied about something. >> Get inside. >> That's what happened. >> So, I want to report her for prostitution. >> Talk with her. There's a young man that was also trying to figure this out. We'll figure it out. >> Were you involved in the fight? >> She hit me with a rock. Okay, we'll figure that out. So, I just want you to take a deep breath. Okay. >> All right. Just do me a favor. Just go ahead and sit down on that curb over here. Okay. >> Just sit down on the curb. Okay. >> Can I just stay standing? I'm not going to do nothing. >> No, just sit down on the curb for me. If you're chill with me, I'm not going to put you in cuffs and detain you. Okay. >> Okay. What's going on today? >> Okay. So, >> just take a deep breath first. >> Just Just focus on me. Okay. >> Um, she came to my house. She's been okay. She's my niece. Mhm. >> And she hasn't been mentally there for like years. >> Okay. >> So, she said we owe her money, but she came in my house and she already hit my mom and when I went outside, she hit me. >> Is that your mom that was standing over there? >> Yes. She hit me with a rock and I have the big old bum to prove it. >> Okay. So, she she came into your house. >> Yeah. She hit me with like a rock. >> Hey, just just deep breath. Okay. Just deep breath. We can we can talk as adults. Like I said, I'm trying to figure things out. Okay. So, she came into your house and hit your mom. She's your niece. You said she's not mentally stable or anything like that. >> She's saying crazy stuff like crazy. Crazy. She's talking about witchcraft and stuff. >> Okay. So, she wanted to hit your mom >> and I got in the middle of it and she hit me with a rock. >> So, like they were verbally fighting and then you got in the middle and you were like, "Hey, get lost." >> So, I'm going to tell you the real argument about this, >> please. Yeah. >> Okay. So, her father raised me as his own. Okay. We're originally from Michigan. We've been here like about almost 15 years ago. >> Okay. >> And um she um she had an abortion when she was about like 20 something and after that she like went completely crazy. >> Okay. >> So he left money on her behalf. He left money for everybody. >> Your dad did. >> Well, he was like my dad. Yeah. >> Who was it? >> She wasted her money and went back to Michigan and God knows what she did. >> The niece did. >> My niece. >> Your niece. Okay. So now that she's out of money and she didn't buy a house, she didn't buy nothing. I came to New Mexico, I bought this house with the money that my brother left me. >> Mhm. >> And of course, I put her under my mom's name and under mine. >> Okay. >> And now that she doesn't have money, she like But after the abortion, she like something mentally just like >> Okay. >> switched up. And I mean, my brother died. >> I don't mean to interrupt you on this, right? I I understand that you said, >> but I'm giving you the So, she comes >> Okay. >> out of nowhere. And right now, she just said she was gonna me and she did have a rock. And of course, if she's gonna hit my mother, I'm gonna approach. I'm not I'm going to get in front. She hit me with a rock. >> So, where did she grab the rock from? Did she knock on the door? >> She had it. No, >> I know. That's what I'm trying to figure out. Did she barge barge into the house? Like, where did >> she outside of the door? >> Okay. So, here, just to give you a second, I'm just going to grab your information from you first. Okay. Just so that way you can breathe, kind of catch your breath. >> Okay. Is it okay if I take a look at your head really quick? >> Yes. Okay. >> All right. Is it okay if I part your hair really quick just to kind of see? >> Yeah. Okay. >> She hit me hard, but I mean, >> can you kind of point to where she hit you? >> Right here. >> Okay. Here, I'm going to move your hair around. Okay. Just that way I can kind of get a better view. Yeah. You've got a little mark there. Can I take a photo with that? >> Yeah, go ahead. Okay. >> Did she hit you in the face or where all did she Was that the >> No, she hit me in the face. >> Did she pull your hair or anything like She pulled my hair and she hit me with the rock and I kind of overpowered her >> even though she I fell and then I was able to overpower her >> and then [clears throat] we stopped and then she tried again and then she was running around. >> Okay. Just cuz you've got a cut here on your face and then you've got >> No, that was from the dirt bike. >> Okay. All right. >> I'm not going to put my So, if you just want to face towards me, just leave your clothes as they are just so that way I can kind of get a whole thing. Okay. >> After getting Maya's initial statement, officers turned to the core witness, her son, [music] who apparently witnessed the entire thing. Young man, will you talk with me, please? >> Thank you, bud. I appreciate it. What's your first name? >> Santiago. >> Santiago. Can we just talk right here, >> sir? >> Thank you. How old are you, young man? >> I'm 13. >> You're 13? Holy smokes. You're a big 13-year-old? >> Yes. My dad came from Europe. >> Oh, okay. >> Yes, >> sir. >> So, what happened? >> So, I was just in my room, right? And I was hearing some banging on my doors. And I was like I was like, there ain't no way. So, I came out, right? because there isn't no like father or anything here. >> I'm sorry. >> Yeah, it's okay. So, I come out cuz in the way I'm like the man of the house. So, I came out. Okay. >> And I just see. So, I'm like, "Oh." So, I go back inside cuz I want to get my siblings like in the room so they don't witness nothing. And then I hear my little brother yell at me >> cuz I made sure my little sister is okay cuz she's barely three. My little brother, he's old enough. >> I don't think it'll affect me. But, >> you don't know. M. Yeah, I he'll be he should be good though. >> Okay. >> He's He's a strong little kid. >> So, who is this girl? >> The >> the one that I put in my police car with the dark hair that was fighting with this young lady. >> Oh, yeah. That was my mom right there. >> With your mom? Who Who's that girl that was fighting with your mom? >> She's some like she's my cousin, but she's some crazy >> She's a cousin. >> Yeah, but she's crazy. She thinks this house is hers just cuz it was paid with her uh my uncle my dead uncle's money when it's not hers. See once this the money that was paid for it was my grandma's and my mom's. >> The family's money. >> Yeah. Basically that he left to them. >> Okay. Real quick cuz when I got here you took off to the side real quick and everything else. You don't have any weapons on you, right? >> Uh no sir. I was just making sure my little siblings were out there cuz I heard like >> they came to the side. You thought maybe? >> Yeah. That's why I went running. I was like I hope they're not out here. >> So did you see who punched who or what? Like the girl and you have in the cop car what I know hit my mom with the rock back. >> No, my little brother saw me. >> Okay, >> I don't want to get him involved in this. And my grandma even said that. >> Do me a favor, Mr. Garcia. I appreciate you talking with me. I need to figure out what else I'm dealing with. >> I appreciate it. Can you just hang out with your siblings inside unless I something else comes up? And again, thank you for for talking with me. Okay. >> So, yeah. So, like like my supervisor was saying, right, the >> the main reason we want to document this is God forbid something escalates. >> She did um threaten me that she was going to kill me with a gun. >> Yeah. >> Because I don't I know this is going to sound tough, but if she comes with a gun, I'm I'm It does not scare me. >> Does she have a gun? >> I don't know, but I do have But right now, I did not pull out No. Okay. >> Because at the end of the day, she is my family. >> And you don't want to pursue charges? >> No, but I do want to get her for trespassing. You want to crimally trespass on this property? Okay. Who all who all lives here at this home? >> It is me, my mom, and my children. >> You, your mom, my she doesn't live here or anything like that? >> No, she does not been here, but she hasn't been here since, >> let me see, I would say like 200, >> I don't know, maybe 15. >> Okay. Does she have any property inside the house? That's more so what I'm >> Nothing. >> Okay. I don't I haven't spoken to her in years and she and she does this like every so often. >> Okay. And that's exactly how we're documenting it is just so that way if you change your mind on charges later if you look it up I have pressed like a restraining order of her like they gave me a number to call if she ever came back or something like that. I don't know. See you. No, no, no. Uh, no. her daughter wants her trespass, but but we want to make sure she wants her trespass. >> That's what she's saying cuz she have that one right there and she's saying that it actually is hurting. I already took pictures of it and she's saying that actually like she got scratched from her but she doesn't want to press charges either. She wants her trespass. But he is saying that that they already did it and didn't work before. So I'm not sure if she's being trespassed or not. >> Well, we will put a warrant on her so she doesn't come around the property. >> Well, we didn't she doesn't really know the legal. We already called the cops before because she continuously comes like I explained to him. >> Yeah. >> She honestly mentally she's not there. >> Gotcha. >> So she says like really crazy stuff. So that's why I kind of don't want to do nothing. But I mean if she's going to she tried she had a rock and I wasn't going to let her to hit my head and she hit me in my head. >> But I mean I mean come on now. If it's your mother, you're gonna let them whether they have a gun or head, you're gonna get in them. >> Yeah. >> You know, and I don't want to hit my knees, but >> what what is your It's Ashley. What is her last name? >> Um, she had an abortion and ever since she had that abortion, something mentally just messed up in her legacy. >> Do you know if she's a homeless or >> I have no idea >> a couple years before? Like, how long ago was it? Because I didn't have like 6 years ago. >> Like six years ago. Is she leaving with you? >> She called um Yeah. >> No, like 7 years ago. She called the cops on me >> and said that I was abusing my children like out of nowhere. >> Okay. >> And um I cut her off since that day. >> Like I completely cut her off cuz I used to help help her with money. >> Like one time cuz we're originally we moved here from Michigan a lot. >> Your mom explained that already. >> And I used to even get money from my cousins over there to borrow and give them to her. >> Yeah. And but the moment she called the cops and said things about him, I cut her off. >> Well, that's understandable. My kids. Yeah. >> Do you guys know if she's being diagnosed specifically with anything? >> I know. I think she has gone to Missia Valley. Okay. >> And I know she's not there. And I mean there's a lot of things that has happened in our life. Her dad um did come >> and he killed his wife. >> So I mean that that's a lot. So I know that mentally she's not strong. She's something's wrong deeply in there. This is her bag too, right? >> And she hasn't been inside my house for years, so there's nothing there that belongs to her. >> Okay. Yeah. If you guys can the video, I mean, you can go ahead and, you know, grab that. I mean, that would be great, too. So, at least we can have it there. >> To the police department. >> No, they can send the link, right? >> Yeah. Yeah, I can see the link. Like, if I send the link, you know, you just got can just blow it right away. >> After collecting statements from the [music] entire family, the officer finally shifts his attention to our aggressor and asks for her version of the story. All right. So, what is your version of events that occurred today? >> Okay. So, first of all, that house, she bought it with my money. >> Let's start there. It's not her house, it's my house. So, I am not trespassing. I lived here for more than 5 years, so I can come and get my mail whenever I want. She tried to trespass me. You cannot. I never signed paperwork, so I'm not considered a trespasser. Second of all, she's lying to that criteria, which is my baby cousin, Santiago. He's getting older now. He's hitting puberty, but I took care of him as a kid and I have videos to prove that. I came up to her to ask her, "Hey, Ma, they're saying a lot of horrible things about you. They're saying that you're incestral with my brother, low key, and I think we should talk about it. Like, I'm not mad and stuff because when I was 4 years old, I was touched by a cousin and she knows that." And I was hit and my dad knows that. Um, so I tried talking to her about it and instead she rushed at me. She rushed at me and started hitting me. >> And then my grandma comes outside and while she throws me on the floor, hits my head super hard on the floor. Um, she tried to say that I hit her with a rock. I don't even know if I hit her with the rock or not. I don't remember. But I always carry a rock in my bag because she has me outside where I can get where there's bugs, where there's tarantulas. airport. >> She threw me on the floor and it was either my grandma or it was my little cousin that hit my rib >> very very hard. >> Super hard to the point I almost cried. And then she just keeps rushing at me. She keeps rushing at me, trying to hit me. And she says, "My grandma hits me again and she says, "Stupid bitch." She starts slapping me while I'm on the floor. And then she shows me her veins. I guess she just got operated. And I was like, "How come they didn't tell me that you just got operated?" And she's like, "What's wrong with you? You're the one that's not right in the head. You're my family." And all this other stuff. Okay, Midas. So, if I'm your family, why did you leave me in the street? Why did you leave me in the street before there was all these claims, all this other stuff? You have me overthinking your life. You have me overthinking you, my dad, everything. But you left me in the street to get you know that me and this other friend of mine have been getting into it every once in a while and that he has punched my mouth and not once did you come to help me find my car. Not once have you helped me with anything. She's like you [ __ ] I'm not helping you and I'm not giving you none of your money. Get the out of my house. It's my property. And I said you know what? It's not your property mida. You paid that that house with me, my brother and my sister's money. So guess what? It's not just your house. and you best believe that there's going to be courts. >> Okay. So, a couple of simple questions. I'm not trying to be rude or ugly or anything of that nature. I just want to make sure that I'm covering all my bases. Okay. >> First off, what city are you in right now? >> Well, let's go. >> Who's the president of the United States? Even if you do not like who it is, >> um, what is his name? He's white. >> It's um, he's a funny one. Uh, I forgot how to say his name. It's a name with a D or something like that. It's a He talks like that. I forgot his his name, but yeah. >> Okay. What colors are the United States flag? >> It's red, white, um, dark blue. >> Yeah. >> Red, white, dark. >> Stars and lines. Red, white, red, white are the lines. It's dark blue flag. White stars. She But are you going to arrest her? >> Uh, for what crime? Okay, I'm still taking you to court. Dude, did you not just hear what I just said? She rushed at me. She hit me. My grandma kicked my rib. My cousin hit me. And so did my grandma at the same time. They need to be arrested. >> Okay. So, I will also tell you that there's cameras here on the property >> and I don't give a [ __ ] I was hit. >> Will you let me talk cuz you talking over me? That's fine. Please do. >> Okay. >> Mr. Baker, what is your name? Mr. Reynolds. >> Reynolds and Porus. Okay. >> Okay. If you don't take me to court, I'm going to take you to court. That's all I know. >> Okay. And it's just a citation. >> After listening to her go on and on about how she is the victim and wants to [music] press charges against everyone, there is still one key piece missing. The CCTV footage. So, one of the officers goes up to the family to review it. >> Thank you. >> You sure? >> Okay. There you go. There you go. There she is. >> She's knocking. >> I don't see the >> Well, she's knocking, but she hit me around with the rock right there. >> Okay. Okay. So, she didn't have the rock at the beginning. >> Um, I honestly do think she had a rock. >> Yeah, she mentioned that she usually have a rock with her all the time. So, >> and you don't have her on the other camera, though. >> Let me see. I mean, it it'll come. >> What? Baby, >> can I have another cookie? >> Yeah, baby. >> So, I can see her. Oh, yeah. She have the the rock in there. >> Yeah. And of course I was going to get into >> Okay. Yes. Gotcha. >> She had the rock on their hand. Got it. >> I don't ever want you. Okay. That's not That's not >> Oh my god. They don't even know her. Santiago >> ever so >> yes you got scared or >> so you saw me run out there >> something. >> Okay. My son. >> Yeah, she's claiming that. So that that's the part that she wants to press charges on it, too. >> What? My son hitting him? >> No. >> I mean, he's 13, but >> I know. Um, keep keep going. >> Okay. Yeah, cuz I'm recording this. >> And that's when I let her get up and then she starts trying to hit me again. >> Okay. Yeah. >> And that's when you guys came cuz I was running after her. >> Yeah. All right. So, I got everything on here. >> Um if you can get me like the time frame, you know, cuz I didn't have it on this one. And then if you can see, >> it was about um 6:30. >> 6:30. Yeah. Then if you can if you can just um >> a little bit longer. see the water camera just to get a better angle. >> I did it. It didn't get >> We're just going to a different unit. Okay. Um actually, I was wondering if you can send me to an ambulance because what for? My wip hurts. She really just if anything they have the nursing out there, you know, at the DC and the detention center. >> Yeah, but it feels like it's fractured. A little bit fractured. >> Okay. Well, I'm not a doctor. So, just give me one second. >> I want you just go ahead lean back for me and I want you to look. >> Can we call the ambulance, please? Cuz I just I was punched on my on my rib and fractured. >> Just lean back for me and then I want you to look the most that I go, dude. >> Okay. I'm just putting your seat belt on. Okay. >> So, how is the battery result if I don't live here? >> So, definition of a household member isn't you live in the house. It's a family member. Okay. So, >> everything's going to be on your Everything's going to be on your charging paperwork. And if you want to argue it, you can argue it. >> Let's take a picture. >> Having enough of her argumentative nature, the officer shuts the door and drives Jessica [music] to the station. She was arrested for criminal trespass and aggravated battery. But we're not done yet. Since the 13-year-old [music] boy decided to kick her while she was down, this now turns into a domestic issue where he might be going to juvie. >> Since you're a juvenile, you know, we can't take you into jail, you know, due to the fact. So, we we do like what is class three. So, technically what that means is like, yeah, you're under arrest, but you get released your dad, your dad or your mom, you know, >> you just wait. So, I have to go to juvenile. >> You have to go. Yes. >> Oh, just like a regular. >> Yeah. every other one. >> Yeah. >> So, JPO is just a juvenile probation officer. >> Yes. >> What I'm going to do is I'm going to the citation, right? I'll just document everything in there. Mom signed. You signed. I just turn it over and then it will be a phone number in there that they need to call. >> Huh? >> Do I have to house arrest or something? >> What was it? >> House arrest. >> No. >> Or or am I just more like >> probation? Like you had to be more careful on what you do now. So, [snorts] as I explained, you know, in the state of New Mexico, we work with class 3. So, it's just like the name that we do those. So, so for those criminal citations, okay, saying, "Hey, you're being charged with this battery, right? Due to the fact that you kicked her twice and she wants to press charges on it, right?" >> Yeah. >> Then just go from there based on the video that we had, you know, and everything and the circumstances and even that you admitted like, "Hey, you know what? Yes, I kicked her twice. So based on the whole totality of the circumstances, that's the reason we have to act on that. So now as he explained, you know, it's going to be the class 3. It's going to be issued. I'll just give it to you. Um just sign on it. Mom sign on it and then on Monday or as soon as possible, you guys call where mom called the phone number that it's on the class 3 citation so they can get a hold of the JO and then just go from there. Okay. Because Jessica [music] decided to press charges, the kid now has a permanent entry on his record and is expected to be on probation for the time being.
