But she is 18, so I want to fully press everything we can on her. Understandable. So now I'm going to get reevaluated cuz if this caused more damage, I want even more [ __ ] Can you do me a huge favor? >> Yes. Can you write down all of her information? So full name, I need first, middle, last. And she was scared and clear of all these kids because yeah, like these boys' mom came trying to attack her. Like these boys are just causing problems in our lives. I got you. But I know it should be on footage, so >> Yeah, and that's what I'm going to go work on right now. I'm assuming a black female? Um is she black or is she Mexican? Mexican. Mexican. Mexican. Okay. Dark eyebrows. She's been at our house for like 3 weeks straight until like yeah, we Gray sweatpants. Okay. When you So you guys used to be friends? Oh yeah, very Where did she live when you were friends? She was always at my house. I was never at hers. Okay. It was my house every single day. I've got confirmed battery charges from an 18-year-old female 18-year-old juvenile female. She's got scratches and stuff on her. Hello. Who's the manager? You're the manager? Okay, can I get look at some footage? There's What We had a fight that just occurred out here in the parking lot not so long ago. I'm manager. I'm sorry. Gotcha, Rodriguez. Um Okay, let me look on the camera real Yeah, get my back and I'm with you. Okay. Sorry, they're weird about stuff and I want to make sure I don't get in trouble. I got you. I'm from Ohio, so I just moved recently. Got you. Yeah, I just got to have you just sign a video release form. Is that okay? I can get one. You I'm going to bring you one. We have one, okay? Okay, yeah, let's go. Yeah, I'll give it to you and then you can come back after that, okay? All right. Sorry, it's annoying, I know. Just sign there, there, there, and there. Guys, guys. Hey. Hey, can we find Can we find out a little bit? I'm sorry. Do you know exactly who it was? Uh Somewhere over here? Yeah, somewhere over there. About 20 minutes ago. Should be a two females. You can, yeah. You just Yeah, that's normal. There we go. How can I get this? Export maybe. Is there a way for you to export that to me? I got to get you guys better systems. >> Yeah, I know. It's annoying. Thank you. We got footage. And you asked me because sometimes I do a presser. Does that back her story? Yeah. My daughter's? Yep, whoever it was that she's claiming did it Yeah. walked up to her real aggressive and started swinging. Okay. So, she was within her rights to swing back if she did, which I didn't really see. >> She didn't I've been on her. Okay, long story short, back home. Has this been a problem before with her? She picks wrong friends. So, yeah, she's gotten into it because she picks the wrong friends, learns better, moves on, then they come back. So, you're supposed to be a clean slate. And it has been. And it's just She just went to church last night to talk to her pastor about this spent 2 hours with her pastor because now she has her dance season's done. She tore her ACL. And she wanted to pick better friends, do all this better stuff, and all this. So, yeah. I'm glad to know it. Yeah. Quiet down little one. Let the cops do their business. And her parents kick her out very truthfully. Out. You know, since moving here, that's like the fourth one of her friends that the parents kick out all the time. I don't get it. We got to We got to work on these friends. Yes, we are working on that. And like I said, at church last night she sat for like 2 hours with her pastor, and she does realize that. She has such a good future. She's baton twirler. Uh essentially what happens from here is I collect all the evidence that I have, put it in a case file, it goes to the state's attorney. State's attorney files for a warrant or her we'll get her back. Okay. Perfect. Thank you. Stay safe. Hello. Hi. Yes. >> Hi, I'm Officer Chriser. Good morning. >> Hi, are you the investigating officer here? I am assisting in the case. The investigating officer is not here today, okay? But before we start talking, I'm going to read you something, okay? It's your rights. I have to read this to you. Do you understand each of the rights that I have explained to you? Yes, sir. And having these rights in mind, do you wish to answer questions and make a statement today? Yes, sir. Okay. All right, so tell me what happened. I know it's something happened at the McDonald's, occurred at the McDonald's. >> Okay. Well, first, my question is yesterday, whenever the investigation happened and stuff, as as 18 as an 18-year-old and stuff, I understand right now is if I'm still in school, it's it's weird because my mom is very upset right now cuz she saw us to drag me out, but yet at the same time I'm 18 and I'm about to get taken to a county jail and stuff for something that I haven't even been spoken to about. I didn't even know police were involved. I called off of work yesterday, stayed home in the case that there was an issue out of it, in the case that I needed to be home to make a statement for something. The first thing I did, I went straight home and I I went I said, "Mom, what do I you know, what do I do?" Then we talked we go to you know, whatever whatever. Nobody came to us. I was just going to leave it be or whatever because I mean, I didn't I I wasn't I wasn't going to press charges. I mean, I wasn't whatever. >> [snorts] >> Cool. Nobody I I Nobody came to speak to me about this. This is my first time coming you know, hearing about this. Like I'm in school and and they're asking me my they you know, whatever they ask me my name and he says that they're looking for me and that there's an email that I was suspect in things. I haven't I didn't even know police She has my my full name. She has my phone number. You guys have my address. You I mean, if you guys looked at the cameras my my license plate it was on there. I'm not running. I showed up to school to I'm not running. I'm hiding from you guys. I would have spoken to you guys yesterday and now I'm at school and I'm about to get perp walked perp walked out of school for something whenever if I don't know if you guys look at the cameras but she she pushed on me first or I know not to hit on people first. I know I know to me whenever somebody whenever somebody hits me hits me that's when I act in >> Yeah, yeah, yeah. Self-defense. You can defend yourself. Okay. I my mom if she's taught me anything she's taught me that. She the second that she went and she pushed on me like that I had to me that was you know and I had to >> that happen at? That happened right out like outside of the school. >> Was that Was that So that was before you started swinging on her. So that would have been poured on surveillance. That was that was like right before right like right before. No, that was like in like right where that What we see on camera is her walking away away the victim. I'm not even sure of her name because like I said I'm just assisting in the case and then you following behind her and then words were exchanged. We don't know what the words were cuz we don't have audio on surveillance and then you attacked her. That's what we seen on camera. >> Is there cameras inside of the McDonald's? >> Yes. >> Okay. Did you guys Is there I don't know if there's audio. I doubt there's audio on surveillance >> Yeah, I doubt it. Yeah, I doubt it. Inside of McDonald's did you guys look at the before of inside McDonald's? Like I said it's not my case so I don't know what the investigator wants to say. >> Before inside of McDonald's I she said to call my name about four or five times. She said can can we talk can we talk? I said no. I'm not no. I'm not interested in talking to you. No. After she Can can we talk can we talk can we talk? Finally went up to talk to her. Cool. I looked at her in her face. I said my issue with you is that she had she was doing some weird my boyfriend whatever. She did weird things whatever. My issue with you I don't like you. You did this this and this. You had tried to get How did How did the argument start? Because she because she was trying to get to engage with me. Okay. Originally we were friend group. My boyfriend his twin brother she dated the twin brother. The them two had a messy breakup. She started dating somebody new. These new kids, like couple weeks ago at church, was like instigating stuff with the twin brother and like, you know, pressing him and like telling him, "Oh, you treated her bad." Like rolling something up, which could have gotten my boyfriend involved in it because obviously that's his twin brother. That is my issue with her. That's the reason why I don't like you. And I'm not a fake person and I'm It's It started an argument with him, too. That's really none of it, but because now they're they're trying to forgive her for it and stuff. And I'm like, "Why are you guys forgiving her and stuff?" And so So was she at the McDonald's and you just happened to run into her or you >> did not go and I did not >> So you didn't plan to meet up with her or anything like that? >> I promise I did not plan to meet up with her. I mean, everybody goes to the McDonald's. I literally My friends I I can I can give you their names to get their statements. I asked them whenever we first got there, I said, "Can we leave?" Can I literally asked them, "Can we leave?" Because I did I was just I did not want to. She asked, "Can we talk?" No, I did not want to talk to you. Like I I'm not I was not trying to You know what I mean? In inside of the McDonald's, I again, I don't know if you guys look, but if you guys look, she a good four or five times tried to engage with me first and I shut it down before I finally gave in. Even still then, it was fun and games >> she ever hit you in the McDonald's or was just engaging and trying to >> It was just a It was just a conversation. >> Okay. >> It was just a conversation. And then whenever The only reason I have went back up to her is because she she had told him something very very >> did she push you at? Was that outside the McDonald's or inside? >> right outside the McDonald's. >> Yeah, that didn't get That didn't get captured on camera. So I don't know where that happened at. >> Sir, I If you look at if I pull up the cameras with you guys, I will point to right to it. I I can point to you guys. I don't I mean, I know you guys watch the cameras and stuff. >> Yeah, the camera the camera footage is in evidence, so I don't have access to it right now cuz already been submitted into evidence, but you'll be able to see it once you go to court on the case, okay? Right. So, am I getting am I for sure getting arrested because >> Yes, ma'am. Yeah, you are, okay? This is the arrest affidavit. What I'm going to do for you though is um >> Is she also getting charges on this? Not as of now, no. But until we further the case because there is a possibility that we do catch her pushing you, then you'll have the opportunity to fill out a statement with us and then we can uh um >> Okay. further the investigation, okay? I had if I was the one who had called the police, would she be the one arrested because I I I mean I really I didn't I wasn't told about this and I'm about to get thrown out out of jail. I was not in I was not Nobody came to me about my side and now I'm instantly because she's the one who went. I I mean that's I understand I have the opportunity to as well, but I I wasn't going to sit here and press charges. I got you. Well, unfortunately, she called the police. We did an investigation. Um like I said, on surveillance, it doesn't show you pushing her. Um if it did >> Yeah, her pushing you, I meant, yeah. Um so, unfortunately, what we have is you attacking her. So, it shows her walking away from you and you following behind her and then swinging at her from behind. >> And even though that she's continuously in inside McDonald's, she she left McDonald's. The whole time I was at The whole time I was at McDonald's, me and my friends were just getting lunch. Me and my friends were I was just eating lunch with me and my friends. I went inside, I asked, "Can we leave?" "Oh, no, I really want McDonald's." All right, cool, whatever. I can sit here. Now, she's trying to She's trying to talk to me and stuff. But like and then I me and my friends, we sit outside everywhere. If I mean, I can tell you multiple times multiple every other days where you can look at cameras where we we sit inside the car and we eat right where we Like that wasn't me trying to stay at the scene or anything right after because it was a small confrontation inside McDonald's. I actually inside McDonald's, I ended up me and her, we were still and she just kept on talking over me and getting louder and getting louder and getting louder. You guys should have You guys should have you split up at that point. I Sir, I walked away from her. I completely in the middle I me and her we're sitting right here we're having a conversation. She said I literally got up and I and I walked back to my friends and I said no. Mhm. Like You feel me? I mean it is all there. She left McDonald's. Her friends first of all her friends who she was with I this is irrelevant. Her friends left her so she was waiting for a ride. She left McDonald's after I was there and came back to McDonald's knowing I was still there. She left and came back with a friend. Well like I said um So that's that's not looking like that's not like coming back like you you like you know what I mean? I'll have that officer look at footage inside if he hasn't already. Like I said I'm not sure if he has or he hasn't. Yeah. But what I could tell you is from the outside footage it shows like I said and I'll say it again it shows her walking away from you and then you kind of following behind her and then swinging taking multiple swings at her. Okay? That's what it shows on surveillance from what we have as of now. Right. Like I said when you get when you get just hold on let me talk. When you get out um if you want to contact an officer and say hey this is what went down inside the McDonald's can you review the footage inside the officer will follow up and then you'll be able to make your statement, okay? So sir right as I as I as I go in I I I'm for sure there's no questioning there's no reviewing there's no nothing to prove my point before I go and spend a night in jail tonight sir? You won't spend the night you'll have a bond. So if your parents decide to bond you out you'll be out by tonight. Okay? So before I go and sit in a jail cell there's no further investigation that can be done? >> We already have probable cause to make the arrest. Okay. Okay. But what I'm going to do because you've been very nice, okay? So I'm going to put the cuffs in the front so this way you're comfortable. Because with the cuffs in the back, I have to It's part of our policy. I have to. >> can you please walk me out of school? What What do you mean walk you out? Can we not walk through school in No, I have to for our safety. We have to put you in cuffs now. Sir, I'm not going Because if you leave this office, you'll it'll be easier for you to run. It'll be easier for you to fight. All right? So, stand up for me, ma'am. And like I said, I'll put them in the front, this way you're more comfortable. Put your wrists like that. You don't have anything in your phone? I just my phone. It's both. Okay. I just got to double lock them so they don't tighten up on your wrists. Sir, can we Can you at least wait until between passing periods like >> I can't wait. We're busy We're busy, ma'am. Please wait 2 3 minutes. >> We'll wait till the for the passing Oh, that It's It's coming up. Okay. We'll wait We'll wait till the turn. All right. In her pocket? >> Yeah. Adult female 10-15. Okay. Did my mom taste anything, please? Yes. Okay. Her mom already knows, but you can tell her she's ready to be transported. And mom's going to come pick up her car, so I have her keys on So, her My keys are here and everything else is in my car. They took Just say they They you know, they asked questions and they took a statement, but they're They're still detaining me. And then she'll have a bond. She's ordered a $50 bond through a bailbonds. 50 bonds? Can you retrieve my phone in my wallet? I got my bag. All right, thanks. Transition is over now. And do you have anything in your bag, ma'am, that we need to know about that's illegal or anything? >> Oh, I'll give this to mom. Oh, you can get that to mom? Oh, perfect. Oh, nice. All right, perfect. I know I broke into there, but I'm not I mean I'm not sure. I'm all right. Well, you know what? Yeah. >> sorry to you. I'm just waiting for the paperwork and then we're going to go. Can I give you a piece of advice? Ma'am. Yes, sir. If you would have never said, I mean this probably would have ended up happening eventually, uh, whatever. But it probably went down a different way. If you would have never said that when you was walking through that door this morning, I would have never known that was you. Sir, I'm so sorry. I'm so sorry for breaking into your Sometimes you just got to keep your mouth closed, though. I know. When you get out the door, when you after you walk past us and you get out the door, you can say what whatever you want to. We would have never heard you. I know, but it's frustrating whenever somebody can say whatever they want. >> that's that's but that's how life is. I know. You know, that's like right now we was some mean dirty cops and we say whatever we want to you and you can't do nothing. Is that fair? >> No, thank you. But you know. All right. All right, miss. I'm going to Oh, we'll go straight out here, okay? Make a right. Take care. See you. Have a good one. You, too. All right, Ms. Smith, thank you. Seated on the passenger side, okay? In the passenger seat? Uh, no, passenger rear. >> Okay, I was going to say, since when do y'all put us in passenger seats? Unless you've got an extra party or something. You have a seat in there and then I'm going to buckle you in, okay? >> Oh, I just All right. We'll be up there in like 25 minutes, okay? Okay. Wait. What's that? You're you're you'll be back in 25 minutes? >> We'll be up there in 25 It's about a 25-minute ride out there, okay? She was booked and then released from jail the same day. The original charge was a felony because the victim was underage, but it was later downgraded to a first-degree misdemeanor of battery and moved to a lower county court.
