on June 2nd 2024 officers on patrol observed a vehicle driving recklessly on the road the vehicle exhibited signs of dangerous Behavior including overp speeding and failing to maintain proper control concerned about the risks associated with such driving the officers decided to initiate a traffic stop to investigate further and ensure the safety of the driver and others on the road how are you my name is Officer Ste City Police Department the reason I'm pulling you over is when you made that turn back back there you were on the complete wrong side of the road I know I'm not from here and I realized that I was going okay okay all right well do you have your uh license registration insurance for me this is my brother's car okay so I don't know about the rest but there's my license I'm okay where are you coming from tonight a wedding a wedding where was that wedding at the yach club the yach club okay the vehicle came to a stop after officers signaled it to pull over as the officers approached the vehicle they noted that the driver appeared to be a woman before they could question her a bystander arrived at the scene and provided important information I apologize no it's all right I'm not from here I don't do this not my thing do you have uh Insurance um you should I can give you my insurance on my phone now the insurance for this vehicle this I don't know it's my brother's on a boat in the military how long were you at the wedding for um from 5 what's that from 5 okay from 5 okay I got you do you have anything to drink tonight I did I have a few drinks you had insurance okay and wanted to provide these details to Aid the investigation armed with new information the officers proceeded to engage with the driver when they approached the vehicle they noticed a strong odor of alcohol emanating from her breath this observation prompted them to ask her directly if she had consumed alcohol the driver admitted to having three alcoholic drinks earlier at a wedding dot based on her admission and the observations of erratic driving the officers suspected that the driver might be under the influence of alcohol well no we won't need that here you go you can initially the driver agreed to cooperate and the officers began with the horizontal Gaye nagus hgn test so what I'll have you do so I'm going to have you stand right here all right so I'm going to have you do is I'm going to check your eyes right so want you to do is just put your hands down by your side no no no I'm not doing this you don't isn't it well it depends but I mean you don't have to follow through with all the procedures okay but I mean it's pretty simple all you're going to have to do is just follow the tip of my finger all right so I just want you stand with your feet together your hands down by your side and you're just going to follow the tip my finger with your eyes and your eyes only do you understand I don't want your head to move at all right just your eyes again right my A's a doctor and she's coming okay well that's fine where's your like I said all you're going to do is follow the tip of my finger right here right heard a partial transmission trying which checks for involuntary eye movements indicative of intoxication however as the testing progressed the driver refused to perform any additional sobriety exercises again you're just going to keep claiming she did not deserve to be detained can I wait for my family though I'm not going to have your family come up here no they already said they're coming no it doesn't make a difference but it makes me can I please I'm sorry I'm not this person so what happened is so what happened is uh officer conducted one test of standard field sobriety and if you refusing to do the rest of the tests he doesn't have anything else to go off of to see if you're too intoxicated to drive or not I won't drive anymore I had three drinks at the wedding I won't drink anymore I'm sorry I won't my family's going to what we're doing is we're here to assess if you're able to drive right no I won't drive anymore I won't like he was just saying it's in your best I drove the wrong way I'm the one way cuz I'm not familiar with the town that that's okay that's okay I'm sorry but we but we what we have to do is follow through with what we have to do in our our proced but I won't drive anymore that's okay he needs he needs to basically what you're doing is Pigeon calling him to make and making a decision on one one factor alone okay um it's totally up to you if you if you don't want to do any more but you're you're kind of putting him you're putting everybody in not trying to put you in a bad position I'm in heels that hurt my feet for the last 5 hours like I told you earlier that I've been at the wedding since 4: I'll do whatever test but I'm sorry okay but so you want to do the test it's just two simple tests I'll explain it to you I'll demonstrate it and then I'll have you do it all right I got to wait for my family to give me the okay we don't want them coming out here it's not going to be safe no they're not going to be able to give you any legal advice and they're not going to be able officers explained that her refusal refusal to complete the field sobriety tests combined with her erratic driving and the strong smell of alcohol on her breath provided sufficient grounds for arrest I appreciate it but can I please wait can I wait for my I understand but like we said they're not going to they shouldn't come out here and it's not going to help they're not going to give it to help you in any can I please wait for my family so I feel safe do you want to do these tests can I wait for my family so I feel safe we're either going to do the tests or he has he has a decision to make M informed her of the charges against her and placed her under arrest during the arrest process the driver continued to argue repeatedly asking to be let go and citing her profession as a reason for part of standard procedure they requested that the driver submit to a chemical test such as a breathalyzer to measure her blood alcohol concentration baak [Applause] [Applause] you just one for now
