Like two or three You've been convicted two or three times? For one time, okay. And that was for a theft? Uh-huh. For theft? Petty theft. Petty theft? Like like like from a business? Huh? From a business? Yeah. Okay. Do you remember which one? We're just waiting for my partner to get here and then we'll proceed with the paperwork. Okay. Um Yeah, decision hasn't been made yet on what's going to happen, but when they get here we're going to figure it out. Okay. Hey, come on, guys. Stay on the line. Okay. Um so, we had her in the shop lifting not so long ago. And um she froze uh purses purses with a large two large bags on the top of the bag and key back. Um she selected a $400 $440 or $448 Christian Dior clutch. Um, saw their selection. Um, she walked around a little bit with it and then conceals it in her shopping bag. And we continuously observe her walking towards the mall entrance, walked out past last point of payment, made the stop. She was very cooperative with us. I'm running her conviction history right now. She says she has prior theft history. So we should get a picture. I'm waiting for that right now. All right, there isn't They're calling an NT. Yeah. Well, they did That's not their choice anyway. The suspect is read her constitutional rights right to remain silent because she is not free to leave. Officers ask for her account of events. But so did you have any of the proper anything that you didn't pay for with you? Yes. Okay. Uh anything specific? No, just the purse. Okay, so just the purse. Okay. Um When he came to me, I just just gave it back to him. Okay. All right. Well, um whoever ends up seeing this, they're going to They they They told me you've been very cooperative. Um you The fact that you're very honest with me, I I know goes a long way. Um we're trying to see if you uh apply for a NTA, but um I I think pretty sure that you've had You said you've had convictions before for theft. Um so Did you give this officer your ID? I did. I want to say to you You But you have her um I have her information. Okay. All right, man. Yeah, I know this is hard for you now, but uh just just sit with it and deal with this. We're going to whatever we end up doing, we're going to make sure it's done as soon as possible. So um Appreciate it, man. So, these guys are a little more squared away than some places we go to. They're very nice. They even give us a little folder. So, let's make sure we have everything. Um We We don't really need a whole story her. She basically just admitted to walking out the store with the purse. Yeah. Um Do you have a Is a receipt in here? Yes, sir. It's in the bag. >> Okay. So, let's confirm what what she stole. So, this looks like a Fleming soft chain wallet of $440. >> Yeah, hold on a Good? I know do you have any property with you? Huh? Do you have any property with you? Like your own property? Just your name. That happened. Like is this yours? Yeah. That's all hers. That's it. Is there like stuff in here that you Like you need this box? Okay, so we're not going to take What about those shoes? Those look like they have receipts on them. Okay. All right, so that's trash. Um and this is your stuff? Yeah. And this is your handbag? Yeah. All right, we'll go we'll go through that. And did you have an ID? No. No? Okay. You're Latoya Manning? Okay. Just put that to the side. Um All right, ma'am. You do me a favor and stand up. Chair is behind your back. All right. And you do too is my my wrist. Yeah, yeah. It's okay. You're cool with that? Yeah. So, the last person we put two on took advantage of our kindness and slipped it to the front. No, I can't do that. Okay. Just saying if you do that, I know. then we're going to take it off and we're going to do one and it's not going to be comfortable. But this can't be twisting around. Okay. But that I got to write it in my hand. It's tight. Which one is tight? >> Which one is tight? This one? Yeah. All right. All right, ma'am. Um, last we're going to we're going to search you out by the car. Um, do you have anything on you that if you get introduced to jail would result in a Like right now you're being charged with a mis- like petty theft. Mhm. If you introduce something to the jail that's >> Officers search her belongings, place handcuffs, warn about introducing contraband into jail could elevate charges to a felony and proceed with processing. not allowed to be in there. That's a felony. Okay. Um, so that this is like a opportunity to to squash it right here. You got it like hidden in your No. garments or anything like that? Okay. All right. Uh, you good? No, I'm good. I got it right here. This way. That's why I didn't see you. Okay. The front desk said they found them. So, back my line. Which cross? All right, guys. Did you get it? Did you find anything? Do you have a echo box charger? Tango 34 from LBPD on the line. Any other? Is that you again? Mhm. Okay. Since the handbag's value $400 $48 crosses the threshold in many states like Florida for grand theft felony rather than petty theft, it's likely she was ultimately charged with a felony theft offense. Stealing high value items can quickly turn a petty theft into a felony with serious consequences. Prior convictions only make matters worse, leading to harsher penalties and fewer chances for leniency. If you like this video, please sign up for Law Zone to receive more. She begs to pay for it on the spot. >> No, oh, my bag is over there. I'm trying to find my phone. I lost it in the store. You have anything in your cart that's not paid for? No, sir. No, no, no. You can check. I got the receipt. It's in the guard's office. I lost my phone in here somewhere. I I don't remember you doing saying I promise you I don't. I really >> me stopping you? No, I really don't. Like, I don't remember. I thought I really did with you. >> do want to bar her? Yeah, we're going to get her How long do you want to bar her for? >> Two years. Two years? You know what that means? Yes, sir. I understand the policy. That's fine. Two years. Am I still able to find my phone though? My kids are trying to get in touch with me. Uh, that's that's up to you. If you >> for my phone? I'm trying to get them to call it from here. You can walk with me, please. It's my phone. I just got it. And they're trying to call it. Hey, you want to go to We'll call it. And these bags look There was two bags that were in there that I got from the hotel that I stayed at, so There's a couple of makeup bags that were in there, I promise. Mhm. I promise you. The officers discover more bags with miscellaneous items, including a straw with burn marks, often used for drug use. She denies ownership, saying everything came from outside or belonged to her roommate. Send me to jail. That's my roommate's. That's my empty pill bottle I'm actually worried about. What are we doing, then? Please don't send me to jail. Please don't send me I I I I think you said that more than once. I don't want to lose my kids. We're going to try to decide what we're doing from here. So, we need to see what all we got here, okay? These bags I got from the hotel. Okay. That's fine. Look at the other stuff I got. I don't know how I'm getting in trouble. What did I even do? You're murdering your stuff up. Hm? Take those over here. Pills? Oh, they're my gabapentin. I'm prescribed to them. Okay. That's their speaker. I got that from the hotel. Where did you get that from? A net? Those are cigarettes in there, aren't they? No, yeah. Okay. When are you going to take me, Joey? Can I smoke one before you take me, Joey? Listen, calm down. Please. There's nothing in there. It's mine. There's just my garbage can. Okay. And that was in that bag in the parking lot. I kind of halfway went through the stuff. I don't have gloves on, so I wasn't going to dig through it. >> in there that's going to do anything to you. Please, don't make me write you a ticket, please. Please, don't make me do this to you. I paid for all that stuff. You did or somebody else did? Well, the lady did it. My food stamp card wasn't working. I don't want to lose all my food and stuff. I don't want my kids to lose it. Get out of the fish and chips vehicle. Can I call somebody to come and get my stuff? Just calm down. We're trying to figure out what's going on right now. Give us a few minutes. I don't know how many areas three times. You can put that on your tape area. The neon green What's all that stuff you had in your purse? What stuff right here? Yeah, the I'm going to do it. Okay, just can take one second. Let's let's The yard bag. I'm not using that in it. Well, something tells me if we found anything bad in here, you'd say you found it in the parking lot. No, I didn't have anything in there. But those bags >> Lindsay, okay, so let me just point this out to you. See this right here? What is this? That's a straw. What do you use that for? What do people use straws for? Drinking soda. What do you use a straw for? That Yeah, what It's got It's got makeup I'm not going to touch it. Look, it's got makeup and stuff on it. It's dirty, you can tell it's dirty. Is that ibuprofen or? Why do you have so much stuff in your purse? It's not in like a bottle or something. Cuz honestly like from where I found from where I was at between eggs, I just found stuff out there in the parking lot. I just threw it in there. No seriously like I really do want to So no what I'm saying you got ibuprofen in here. Do you take ibuprofen? Yes sir, I do. So why would you take ibuprofen that's in a bag with all the stuff that you pick up in a parking lot and throw in a bag? Why would you have ibuprofen in here that you take and then throw all the bunch of stuff that you pick up in a parking lot? I don't know cuz I I mean I've done when I was homeless I would dumpster dive and stuff. But that makes no sense. You wouldn't want to take pills that have been in a purse with a bunch of nasty things that were found in a parking lot. You're right. I'm sorry. I'm just saying that that doesn't make sense. >> Officers prepare a trespass order for her to sign, but she refuses to admit wrongdoing arguing she didn't know about the unpaid items. Sign both copies on the bottom and then this here is an admission statement if you could finish out this sentence here and then sign right here. It wasn't a person in my bag. >> The bra in your purse. Yeah, I know. That's Alfred to pay for that. I didn't realize it was in there because I got everything confused. I'm not signing that. Okay. Well, then if we could just have you hold this up and then we're going to take your picture for the database. It's not going to be shared with anybody. All right, cool. Uh it was just that item. The other thing it came up as salvage which means maybe She realizes she's being arrested and pleads to smoke a cigarette and call someone to get her groceries. Officers deny the cigarette request and proceed with handcuffing her. No, I'm not I'm She wants to be just barred. So, you're taking me to jail? Yeah, we're taking you. Why? Can I please smoke a cigarette, please? Please. >> You're going to have to ask that man. Very very nicely. >> a cigarette, please? I I don't mean to be rude, but I don't smoke so I haven't like to smoke a cigarette smoke in my car. I'm going to like I'm like I'm seriously going to have a nervous breakdown. Please, can I please smoke a cigarette, please? I'm begging you. Please, sir. Please. Please. Please. Please, God. Calm down, follow me. Please. Please, sir. Calm down. Please, can I, please? Wait. Okay. Well, you'll talk to >> The woman claimed police were harassing her, asked to speak to a sergeant, and threatened to urinate in the squad car if not allowed to use the bathroom. >> We'll just charge you in the jail. There you go. Okay. Put your feet inside. Okay, then put your feet inside. >> No. Why? I don't know why I'm Cuz you're going to the jail. That's why you're going to jail. What did I do? I don't have it. >> 50-year-old Estella Fernandez was charged with two counts of battery and one count of resisting a peace officer, then transferred to Des Plaines authorities for an unrelated drug paraphernalia matter. Cooperate calmly with police instructions to avoid escalating a situation. Refusing identification and resisting can quickly turn a minor incident into multiple criminal charges. Okay, so it was in my car and I guess it had fallen out and I didn't realize when I got out. >> On March 11th, 2024, detectives in Florida rushed to a local lottery office after getting a tip about a couple trying to cash in a fake $1 million ticket. With that kind of money on the line, there was no way the cops were letting them walk away. I said, "We're We're here about the ticket. There's a problem with the ticket." Okay. So we want to talk to you about it, all right? So she's going to tell you a few things and I'll get back with you. Um hang on a second. Okay. So currently at this moment, because this is an investigation in reference to the ticket, you are not free to leave. Okay. So we're going to talk about it, but in order to I'm going to read you your rights just so that you understand them and then we can talk about it. Okay. So before we ask any questions, you must understand your rights. You have the right to remain silent. Anything you say can be used as evidence against you in court. You have the right to have a lawyer present while being questioned. If you cannot afford to hire a lawyer, a lawyer will be appointed for you without cost before questioning. If you wish to answer questions now without a lawyer present, you will still have the right to stop answering questions anytime. Do you understand that? Okay. Spell your first name for me. K I R A Okay. You would just sign right there next to your name, please. 10-4 10-5. Okay. Thank you. All right. So, you know that's just for now. Oh, yeah. We want to talk to you about the ticket. It must have been tough for these detectives to keep a straight face as the woman fumbled through her act pretending she had no clue what was happening. You don't need to be a casting director to spot a bad actor and her performance was painfully bad. Explain to this detective. I'm going to share it. We're going to split it half and half. Is that the guy on the ticket? Mhm. What is his name? Dakota. Okay. When you came here, was the other day the first I I assume, right? Yes. They had you fill out some papers. Yes, I I filled out a multiple papers. >> Okay. Mhm. So, if I show you a document that has your signature, will you confirm if if it is or is not your signature? Yes. Yes. Okay. Thank you. And there's a second document that they asked you to fill out voluntarily. It's called a security affidavit and on the back is your signature. I'm sorry. I'm sorry. Oh, I was like, where is it at? Yeah, I'm sorry. Yeah, that's fine. That's not even my name. All right. And so, I do have the ticket right here. This is the ticket. I'm not going to let you touch it, but does it look like it? >> Yes. Okay. Is that your name on the back here? >> Yes, it is. Did you put your name on it? I did. Okay. In the office here. Here? Yes. >> Okay. So, let me ask you, how how did the ticket get ripped? Okay, so it was in my car and I guess it had fallen out and I didn't realize when I got out and it was in the rain and I seen it the next day and I was like, "Oh my god." And I tried to scratch it before it was dry and it just was falling apart. The story might have been well rehearsed, but it was obvious the detectives weren't buying a word of it. The ticket itself was a dead giveaway ripped in half and clumsily taped back together. And after hearing her dodge responsibility long enough, the detectives decided it was time to lay their cards on the table. The reason we're here is the ticket The problem with the ticket is there's security controls inside the ticket. Okay. And what the security controls tell me and what also what the ticket number tells me is this is two separate tickets taped together. Is it? Right. And what it actually is is a non-winning ticket >> Oh, I'll go figure. made into a million-dollar ticket. >> What? Now, I'll tell you how you can see that. All right? They don't go together? No. Right here. This is the ticket number. See that number 019? That says 018. Oh, I'm sorry. 018? Yeah. Right? If you look at the bottom, this is the ticket number for >> That's what I was wondering and I was like, why does that not match? >> Right. And I was like, I thought that's what it meant if you win. No. Oh. I didn't know that. >> So, did you tape this together after you saw that? Yeah, after I saw that it was winning, but then I saw the number I was looking at the numbers and I was like, this don't match, huh? Mhm. I thought. Did you tell him you wanted the front? Like, why is it so weird? Why wouldn't you >> No, I didn't even think about that. So, when it was weird, you just went there? >> I just thought it was that's what a winning ticket was like. >> Yeah. Duh. I don't know. >> She might have believed her performance deserved an Oscar, but the detectives weren't handing out awards. Instead, they were about to hand her a reality check, and things were about to get very bad for this D-list actress. Look at the back part. See You see on the back part right here where the white's taped together? See how the words don't even match up? Did you notice that? >> I did not. They do, though. Installments and installments. I just didn't tape it Right. It does if you But no, I did not know But I To me, it matches up. It It actually does. It's from two different The ribs are different. I mean, and to me it looks like it. I guess. I guess. So >> I don't see how they're different. So the ticket's problematic for you. And the reason why it's problematic is because you signed some documents that said this ticket's mine under penalty of perjury and under penalty of fraud. Right. The ticket's not altered. Ticket's not >> I just stuck it back together. I didn't know. Well, you have to understand the position we're You're saying you honestly did that. I did. I mean, I stuck it back together. I thought they went together. So what's the probability of two tickets getting ripped? That That's what I'm saying. I think I'm pretty sure that >> If she had any sense at all, she would have stopped talking and asked for a lawyer. But instead, she kept digging her own grave while the cops, armed with forensic evidence, kept pressing until the truth finally slipped out. >> Filled out a check before? Filled out a check? >> Filled out a check. Like written one? Yeah. Well, not a paycheck. You got a paycheck before, right? >> Yeah. So if you imagine if somebody mistakenly put two pieces of two different checks together. I can see that looking really bad. Yes. Right. And chances I understand that people intentionally do that. >> Right. I would never intentionally do that. I know that's not allowed. You don't do that. You have two pieces of paper like this. Right. >> Okay? Would your in paper >> Would your medication, anything you take or partake in make a difference on But would it That's what I'm asking you. Would it alter your brain in any way to make you think that this right here was a good match? I mean, I would I would think the same way. Like if it matched up and it lined up, I'd be like, "That's not the right size of a piece of paper." Right. Well, you know, like But if it really like the first What happened before? Like Well, let me Let me ask you. That's what like it I thought it really did. right now. >> now what she just talked about. Right. This one is taped together. It's not the right size of a lottery ticket. >> I did not realize that. I did not know that. >> cut the top. >> I did cut the tape. Well, but you you can imagine. Look at this barcode. Right. The distance >> I thought that's how it came off the roll cuz look at the bottom. The distance on the barcode is higher. I did not I did not know that. Okay. Did you cut that top? I I did cut the top of it. At this point, there was nothing left to convince this clueless thief detectives already had all the evidence and they laid it out for her like seasoned lawyers presenting their case to a judge. >> insult you and say you're dumb. I would never do that. >> But usually this indicates intent to do fraud. I would I I mean, I see that, but I would not There was no intent to do anything but put the two together and keep it safe. Did you tape the top? I just taped the whole thing. Why tape the whole thing? I don't know. I just taped the whole thing. I I just wanted to keep the whole ticket intact. >> But when you tape the whole ticket intact, the middle where it's really ripped is not taped well at all. >> I know. It's split. I see that. It's So, you taped the top better than the split. >> I know. Why do that? I don't know. Okay. That's what I don't know. I I see where I don't know. I I'm just asking just to tell the truth, you know. >> I I'm telling you the truth. >> Okay. Okay. Will you raise your right hand? Do you swear and affirm everything you've told us today is true to the best of your knowledge? With her act finally over and not a soul believing her claims of innocence, she and her boyfriend was slapped with a hefty list of charges including forgery, lottery fraud, and grand theft over $100,000. Safe to say their lucky day ended without a jackpot. She was charged with forgery, lottery fraud, and grand theft of more than $100,000 proving this was one jackpot she definitely didn't win.
