on September 2nd 2024 an officer approached a parked car and asked for the engine to be turned off vomiting was noticed leading to a question about the driver's condition the driver admitted to having a bad night and explained being there to check on a cheating boyfriend a beer was consumed at canellis when asked for identification the driver claimed it was left at home hm where you coming from Paran Paran we in par what's in my house can I see your license I don't have what are you doing in Union though my boyfriend was cheating on me oh yeah what do you want to go see like where he was at but you're all right right so where was he at over here canelas canelas [Music] okay you had anything to drink today I had a beer beer okay one second right you got a your ID on you yeah it's a car park put the car par for me it's off do you have your license on you I have a picture I left my license at home I left in a rush okay just give me a second all right go grab my notep Kil Pap uniform on a black and that's your ID M when asked for identification the driver stated that the license was left at home and only had a picture of it the officer took note of this information while confirming vehicle ownership another officer arrived and observed that the driver had been vomiting the officer explained that drinking and driving is not illegal but being impaired is had a bad night said you had your beer right where'd you have the beer at canel canel okay all right one second all right a12 or9 yo are you the registered owner I'm sorry this is your car yeah a12 police officer Freeman yes hey you mind coming over here more St all right so being that all right I pulled up the behind you you were kind of throwing up right there I thought I thought you were broken down for a second okay I I don't drink that's all right so I thought you were broken down for a second but then I noticed throw up okay you did say you drank a beer it's not illegal okay to to drink and and drive it's illegal to be impaired okay so what I'm going to do right I'm going have you step out the car right I'm going just check out your eyes Okay uh I don't have my heels on that's fine okay okay done with this okay to determine impairment the officer requested the driver to step out of the car the driver expressed concern about not wearing heels but the officer assured that it was fine the officer conducted an eye test using a pen and instructed the driver to follow it only with their eyes the driver struggled to comply and move their head despite multiple warnings the officer encouraged cooperation and emphasized the importance of following instructions correctly don't move your head you going to follow it listen I'm I'm be honest with you okay you're not helping yourself several attempts the officer moved on to another test instructing the driver to stand with one foot in front of the other and take nine Heel To Toe steps the driver initially misunderstood the instructions but eventually performed the test a oneel leg stand test followed where the driver had to lift 1T 6 in off the ground point the toe outward and count until told to stop [Applause] all right we finish at 19th three times okay listen you're going to place your head behind your back you're going to be placed under arrest of driving while impaired okay based on these tests okay I determine that you're you're uned okay you have anything in your car license and stuff like that everything's like that ma'am are you the registered owner of the vehicle yeah all right you can come placed them under arrest for driving while impaired the officer asked if there was anything inside the car and whether the driver was the registered owner the driver was then escorted to a patrol car with officers ensuring the placement of personal belongings including a phone and purse oh so she's that yeah cuz I pulled out I thought it was disabled at first yeah I heard and then when I walk up I see this what's up money oh baby there's no I don't know what that is you know what that is g [Music] g and there's no name on no was ripped off was it ripped off yeah it looks like it was ripped off driver stated that it belonged to a son with ADHD but the missing label raised concerns the officer read the Miranda Rights and asked whether the driver acknowledged them the driver confirmed understanding but claimed no knowledge about Who removed the label from the bottle officers examined the pills trying to identify them discussion arose about whether the medication matched what was proceeding the driver was allowed to call someone for pickup before beginning the test you said you what Peruan same thing with him he's Peruan or no yep he's a sh I don't I've met i' it's rare I including when to start the official observation period before the breath test throughout the process the driver continued to express distress repeatedly stating never drinking and struggling with the situation the officer reassured that it was just a process and advised appearing in court to address the charges um so just stand up for me just face the wall oh you're going to PE pull your feet
