In Sebastian, Florida, a Walmart shoplifting case quickly escalated into something far more serious. Police say the suspect not only attempted to steal merchandise by switching barcodes, but also left two children inside a locked car on a hot day with no windows down. What began as a simple theft investigation turned into a case of child endangerment. And now you'll see how officers responded. All captured on bodywn cameras. >> Sorry. We're going to lean up against the car if you're able to. Okay. I'm just going to search you. Can you spread your feet if you're able to? I know you've had surgery, but >> no pockets or anything? >> No, ma'am. >> All right. And you said you have an underwire bra? >> Yes, ma'am. >> Okay. Forgive me if I pinch you with my gloves. Okay. Yeah. >> Have you ever been in trouble before or anything like that? Okay. >> No. Can I see a thumbnail? cuz I keep leaning like that too long. >> Yeah, if you need to do that then that's fine. Mhm. There you go. Is it okay? >> Yes. Too tight. Let's twist a little bit. Ouch. All right. 42. Can you show females have 15 want? So, usually anyone that is charged with theft in this specific Walmart, Sebastian Walmart, they request a trespass. Okay? Have you ever been trespassed anywhere? No. >> Okay? I'm going to explain it. Okay? So, right now, this right now is not a crime. Okay? It's a paper documenting that Walmart does not want you on the property anymore. Okay? So, that includes the entire property, parking lot, everything like that. You can never come back here. This does not expire. This won't go away in a year or two or anything like that. That's not on your criminal history or anything like that. It's just saying that Walmart already warned you that if you come back, you're going to go to jail. Okay? So, obviously, you're not going to be able to sign it because you're in handcuffs. So, I'm just explaining it to you and I'm going to write verbally acknowledged because everything is audio and video recorded. Okay. >> My last name is not Gordon. It's Leon Gordon even on my license. >> Okay. So, it's you have like two last names. Yes, it's >> so I'll explain that when they enter it in there. I will give you your copy. It will be in your property or I can put it in your purse and everything like that just to take with you so you can look it over at a later date. Um, this does just stay on record. So, I do want to let you know, okay, if you do come back here, you're going to go to jail for trespassing. All right. Do you have any questions about this or anything like that? Okay. It's, like I said, it's pretty standard. It's usually to prevent thefts and everything like that from Walmart. They request everyone be trespassed that >> I can go I can go to that gas station though, right? >> The gas station is Walmart's property as well. >> Okay. >> Okay. So, I would honestly just steer clear away from all of Walmart and everything in it. Okay. Do you have any other questions? Okay. Like I said, you're not getting charged with trespassing. This is just saying that you're not able to be here anymore. Okay. So if you do, you'll go to jail. All right, hang tight for me. >> Your nieces went falling. >> Okay. What I say is that I didn't know I was doing that wrong cuz she was 12 years old and her sister's pipe and the doors are open. They had something breaking. I told her, "Open the door." She said, "But parents do that all the time. They leave the two kids in the car." I I I don't understand. I did wrong. She She can open the car. >> So, when you told me that the kids asked to leave the car running and you told them no, why wouldn't you just leave the car running for them? >> No, you're not. As far as I know, you can't leave kids in the car with a car running. >> You can't leave kids in a car, period. This is the state of Florida. Do you know how hot it gets in here? >> But it's very cool out today. I mean, when you got here, it was not that cool. It was over 75°. And it does not take a long time for heat to build up inside of cars. Remember how you sat in my patrol car when you got in and you said, "Wow, can you open up the windows? It's really hot in here." And you were only in the car for less than 10 seconds. Those children were in that car for over an hour. Ma'am, >> I'm going to explain to you something real quick as well. When carbon dioxide builds up in your bloodstream, which is air that you keep on rebreathing over and over again, it becomes toxic. When it becomes toxic, it might cause you to hallucinate or cause you your normal faculties to become impaired to the point where you might not have the ability to open up a door. It can turn that bad that quick. Your vision starts blacking out and then it goes into black and then you pass out and then you just don't wake up. That's how carbon dioxide poisoning works. That's what happens when you shut the car doors. The windows were all up and it's really hot out. Okay? That's what happens. Especially after an hour, you're starting to look at some side effects starting to occur. Okay. >> Okay. And when EMT checked them out, they were okay though, right? >> They were okay. >> So, am I being charged with that, too? >> Yes. So, you're being charged right now with misdemeanor retail theft and child neglect. >> Even though they had access to open the car. Did you not understand what I just explained to you about how that ability might not have they might not have the ability to do that if they have enough carbon dioxide build up in their blood because they've been sitting in a car hot car for over an hour? >> Why didn't you just take them with you? >> I told I the little girl was on the phone with their their grandmother. Okay. And not the little girl, I'm sorry. The other girl, the bigger girl was on the phone with her grandmother and they were making arrangements to do a phone call later like a whatever some kind of video. Okay. and I was going to take the little one with me and she started screaming that she didn't want to go. Now, I understand what you're going to say, you know, but when the other one turned around and said, "My parents leave us all the time." I didn't see anything wrong with that because she's 12 and she's a straight A student. She's not stupid. If she was going to get hot, she could open the door. >> Ma'am, well, that didn't obviously occur because when I walked up to the door, the door hadn't been opened. I opened it. There was a bunch of heat that came out of the car door. Both kids were profusely sweating. There was moisture all over the windows of the car. They are smart. They 100% probably could open the door, but they didn't. And guess what? Again, when carbon dioxide builds up in your bloodstream, you might not have that ability to make that decision because you you got poisoning in the blood. >> Did you look at the video and see if they opened it at all the whole time I was in there? >> Ma'am, when I opened that door, there was a rush of heat coming out of there. They've been sitting there for a while. It comes down to the fact that you came in here to commit a crime inside of the store. You came in here to commit a crime and you left the children out in the car for over an hour. >> I didn't know it was that long. Hour. I didn't know it was that long, sir. >> You got here at 5:53. I walked up to the car at 6:58. >> Well, they said it were in there. Then then I realized But I didn't realize I was that long gone. Right. But it's your job to keep track of time if you have children inside of the vehicle that are unattended. Right? Like you're responsible for them during this time. >> Okay. So I question for my future. What age can you leave in the car? >> Can't leave them in the car. Period. >> No matter what age they are. >> No. >> Again, I'm sorry. I didn't know that. I thought it was like when you have a kid home watching another kid, you know. >> Well, that's different. They're inside in an air conditioning home with access to food, water, and anything else that they need in a secure location. That's a lot different than a busy parking lot in a car that's not running. >> They did have food and they did have a drink. >> Okay. But the heat is what could cause them damage like internally and everything like that. Okay. Do you have any other questions? >> No. >> Okay. Oh, you want to call my husband? >> We spoke to him. >> We spoke to him >> again after he left. >> Is this about the groceries? >> And my purse is in there. And >> yeah, he's picking up all that stuff. Did he already leave? >> Uh, he picked the kids up and left, but he said he has to We can call him again. >> Yeah, I have his phone number. I didn't know he already left. >> Can you give the dispatch and have a call to see if he can come back up there? The stolen items added up to just $8367. But the greatest concern was for the children left inside the vehicle exposed to rising heat. The arrest report says EMS checked the kids' vitals and determined they were normal. She was charged with child neglect without great bodily harm and secondderee pettit theft. Remember, children should never be left alone in a hot car. Even for a moment, the consequences can be life-threatening.
