legal. >> Well, it's completely legal. You're being recorded, and you're going to hand me that, and or it's going to go a completely different way. I don't want to go that way. I'll tell you how what we stopped for afterwards, just so I can identify you. >> I think I got a right to uh to know why I'm getting pulled over or not. >> So, to be completely honest, it's a courtesy. We don't have to tell you, but I do I will tell you. No problem at all. But, I'm going to need that license. >> You invade people's rights and stuff like that. >> in Hillsboro, we take that stuff very seriously. And I will let you know, just for future reference, an officer there's no ORC, no case law, no anything that states an officer has to tell you why we pull you over. Obviously, we do as a courtesy. If I was pulled over, I'd surely want to know what it's about. But, also, I would not immediately say, "Hey, you got to tell me this, that, and the other." >> Would you believe it? The officer boldly declares, "There's no case law, no anything that states an officer has to tell you why we pull you over. We do it as a courtesy." Yet, the moment he faces a citizen who stands firm on his Fourth Amendment rights and flatly denies a fishing vehicle search, the officer's entire tone shifts. Join me as we dissect this sophisticatedly flawed logic wrapped in the guise of protecting your rights. >> Hey, well, afternoon. What can I do for you, please? How are you? >> Good, brother. I got pulled over for being uh >> What's up? >> Um >> License, registration, proof of insurance, and we'll get into all that afterwards. >> What is it? >> License, registration, proof of insurance, please. Then we'll get into everything afterwards. >> Why you running >> Once I get your license, registration, proof of insurance, we'll go over all that. >> I want to make sure it's legal. So, let me get that license for you. No problem, sir. >> Okay, I'm getting pulled over. I think I have a right to know >> Sir, let me let me get your license. I don't want to make this anything that doesn't have to be. I'm going to take your license now, otherwise we're going to have issues. I've asked three times. Thank you. So, the reason for the stop is you didn't use your turn signal 100 ft prior. Twice I gave you whatever I saw it the first time, not a big deal. You got to signal 100 ft prior to a turn. It's not a demand, it's a request when you turn on that turn signal. So, it's just one thing I'm letting you know. Not the end of the world or anything. I just want to stop and make you aware of it. And uh is the vehicle registered to you, sir? >> Yeah. >> Okay, got you. And do you have proof of insurance? >> Uh Maybe. >> All righty. >> Maybe a picture. Probably in the alley over there, you know? You're out with 13. 16 40. Huh. >> Do you by chance have it on your phone, maybe? >> Uh no, I guess not. >> Are you carrying insurance? >> Let me see here. Uh let me see if I can uh I'm going to go waiting now. >> What happened to the window? Remember that that windstorm that came through about a week ago? >> Yeah, okay. >> Yeah, there was a bunch of people that ended up getting >> So sir, let me ask you this while I'm standing here. Do you have anything inside of the vehicle that we need to know about, anything illegal in any way? >> Uh I'm going to plead the fifth. That's uh That's my right, you know. >> Would you mind if we checked to >> I mind. Of course I mind. Because you know, it's my right. >> Sure, I understand. I'm not saying it's not. That's all we're asking. I'm not pulling you out and searching you. I'm just wondering >> 13 years old and >> Turn around. You can put this down here. So here you are, sir. So I'm just a verbal on those turn signal violations, no big deal. Make sure you do signal 100 ft prior to any >> Sorry about that. Sorry about that, bud. >> I understand. >> This is This is uh I like uh check out this guy's channel. He goes over a lot of things. He uh I appreciate your uh >> Sure. I got my muffles out here. >> Yeah, absolutely. >> I appreciate you not in uh you know, going over the top of my rights >> Okay, that's right. I'm here to protect people's rights. >> This is uh I've learned a lot from this guy. A lot of people think that he's a a little bit of a dick, sure. You know, because he don't really like because cops they do they they invade people's rights and stuff like that. >> We take that stuff very seriously. And I will let you to for future reference, an officer there's no ORC, no case law, no anything that states an officer has to tell you why we pull you over. Obviously, we do as a courtesy. If I was pulled over, I'd surely want to know what it's about, but also, I would not immediately say, "Hey, you got to tell me this, that, and the other." If you don't give the ID or don't give the ID, you can be pulled out and arrested for failure to identify. And so, generally, it's a yes, you tell or you may. So, obviously, we didn't take that route. I'm glad we didn't, didn't feel the need. Um yeah, just make sure you hand over the ID. The place to fight anything is going to be in the courts. That's for sure. But again, I'm here to protect people's rights, so uh we'll let you off with the warning. I'm going to block traffic so I can get back on the roadway. Have a good rest of your day, sir. >> Case details. Pretext for stop, failing to activate a turn signal exactly 100 ft prior to a turn. The police [music] logic, declaring constitutional notifications as a mere courtesy while threatening an arrest for failure to identify [music] if documents are questioned. Legal violations, tempted expansions of a traffic stop into a warrantless search, misrepresentation of statutory authority.
