Now, after I'm talking with you and after I'm looking at you and you like listen, you're fine, okay? You are getting a ticket for failure to maintain lanes. You're getting a warning for failure to yield. When blue lights come on, you stop. It doesn't matter how long, even if it's you get to find a safe place and all that, we appreciate it, but don't do that because then it it gets you in a situation like this where we're thinking you're hiding something in the car cuz when we were at the red light, you're moving all around in the car. You must identify. Because I just told you. Because I touched the >> you one last chance to give me your license or or you will go to jail. This is Andrew Cason. The driver pulled over for failing to maintain his lane. However, his delayed stop and suspicious movements inside the cabin led Officer Duncan to suspect criminal activity or drug use. The officer correctly applied two landmark Supreme Court precedents, Pennsylvania v. Mims and Maryland v. Wilson to order the driver out of the vehicle for officer safety. Despite Andrew's refusal to consent to a search or field sobriety test, his extreme nervousness escalated this traffic stop into a high priority investigation. Good evening. Hey there, Officer Officer with the Baldwin Police Department. Reason for the stop is back here when you came through Duncan Bridge BC Grant, you were all the way over that white line, my man. The white line? Yeah. All right. I mean, I may have touched it or something. >> No, you were over all the way past it. When you came by me when I was coming up at the four-way. >> are fogging up. They were fogging and they're defogged now. But yeah, uh That's the only thing I think I have. I got you. What was up with the long long stop? Any reason for the long stop, taking a while to stop? Long stop? >> Yeah, back here. You took a while to stop. Look for somewhere to stop. I got you. Got your license on you, partner? Yeah. Do you do you need it? Yeah. >> Why? Cuz I need your license. For what? Cuz I need your license. That don't But what Because I'm asking you for your license. You must identify. Because I just told you. Because I touched the I'm giving you one last chance to give me your license or or you will go to jail. For for what? For failure to identify and to stop obstruction. What's your name again? Officer Officer, Baldwin Police Department. Badge number 408. And it's everything's on record. Mr. Cates, do you still live off Duncan Bridge? All right, give me just a minute. >> [snorts] >> Vehicle stopped at Woodmont Drive, I'm 10-6. >> [snorts] >> 408 dispatch, Georgia 27. 050 231 578. 10-4. 220 dispatch, myself and 210. So, lit him up before Level Grove. Um he rolled all the way up here. Um he's been weaving within his lane, failed to maintain lane at uh Duncan Bridge BC Grant. I flipped around on him. He's been moving around the cab the whole time while I was behind him at the red light. I waited till we were through the red light. I watched him as he continued down Duncan Bridge and he was weaving. And then he took a while to stop, hence why I was calling all that stuff. If you want to go talk to him, look at his eyes. I'm going to finish up this ticket. Y'all good? >> [snorts] >> You ain't like a felon or anything, are you? Are you crazy with that gun in the back seat, are you? You ever had a felony? No, okay. 408 dispatch. He was aggressive with me at the at the window, too. Can you run the individual last three of that OLN 578, see if he's a convicted felon. The just by OLN? Mhm. Just by OLN? So, he's like super super nervous, but Yeah, he was that way when I walked up and and really aggressive. 65 1987. I asked for his OLN D. Trying to write me I asked him for his ID and he goes, "Do I really have to show you that for just touching the white line?" He was all the way over here. I said, "Yes. I'm only going to ask you one more time before I take you to jail." And he said, "For what?" >> know you got him stopped. You got a dog on? He didn't give consent. You get you got enough? I've got enough on the failure to stop, aggressive behavior. Uh moving around the car, gun in the back seat. 408 dispatch. We got a dog on. Good. Who? Raven County. See if you can get it. If you can't get it, I'll just cut him a ticket and we'll catch him later. What's his name? Uh Andrew. Andrew. Andrew. You said you said there's nothing in that truck that's illegal? All right. Listen. Nervous behavior whenever I walked up to the window, you're immediately aggressive. You're failing to maintain your lane, you're moving around Let me finish what I'm saying. Let me finish what I'm saying. I understand that, okay? I took an oath to defend your Constitution, right? So, I want to make sure you understand where we're coming from, okay? No, it's not. And I'll explain why. I'm going to explain why. Okay? Him pulling you out of your truck, there's case law that protects that. It's Pennsylvania versus Mims. It's a US Supreme Court law when an law when a law enforcement officer orders you out of the vehicle, which anytime we ask you, it is to be polite. It is an order. You must follow. Whenever you are told to get out of the vehicle, you must exit the vehicle. Pennsylvania versus Mims covers that. And then that was extended by Maryland v. Wilson, okay? We're not here trampling on your rights. We're here I'm doing my job making sure that you're not up to anything and you're leading me to believe that there's some criminal activity afoot. Can you see as a reasonable or prudent peace officer, being with all my training, knowledge, expertise, running down methamphetamine off these streets, looking for drunks on the streets, whenever I walk up after somebody's failing to maintain their lane, they're immediately aggressive. Why didn't you pull me over earlier? I was trying to give you somewhere to pull over, I was figuring you were going to pull over into the gas station and then you yanked it over here. All these people are here because I called out we're turning left onto Level Grove. We're turning right onto Woodford Drive and then you flipped it in here. That's that leads us to believe that you could be running, too. Do you see what I'm saying? I'm trying to make sure you're understanding where we're coming from. We're asking you He asked you to search your truck because all those things that I just listed to you leads us to believe that there could be something in that truck or something that you're up to that you shouldn't be up to. I'm going home. Okay. Have you had anything to drink that would make you that would make you fail to maintain your lane, anything like that? >> Nothing. Would you be willing to let me check your eyes just to make sure that you are safe to drive? >> No, I'm not going to consent to any field sobriety test, man. Every Every attorney tells you don't do that. If you're If you're sober, why would >> I am sober. I'm 100% sober. Okay. Your eyes aren't reacting a lot. When's the last time you smoked methamphetamine? I ain't smoked no methamphetamine. >> When's the last time you used any sort of opioids, anything like that? I haven't used anything. I'm clean. I don't do anything. Adam, come here. You've been trained in this stuff. Look at his eyes and you tell me what you think. Let me see your eyes, boss. What do you see? Give us just a minute. They don't look normal. No. They look kind of pinpoint. But they're reacting a lot. They were like delayed. The blue lights are screwing with my eyes. Or his eyes, too, I think. I ain't got enough to lay on him, County. What? What you got? Uh immediate aggressive behavior. >> pull him over? I pulled him before Level Grove. Or before Mud Creek. He continued up, turned on his left turn signal. We kept rolling. Turned left up here, kept rolling. So, he hit where that blue lights were at? Hang on, I can tell you. So, at the church. Same wagon? You writing him a ticket? Yeah, failure to maintain. On BC Grant Duncan Bridge. That's where I saw the first and that's when I flipped around. For what? Failure to yield. Failure to yield. I mean, you saw it. We're still rolling. Yeah. Like watch. Blue lights, 30 seconds and then watch. Still rolling. He's been recording the whole interaction, so. Not till I got my truck running. We're still rolling a minute in. I wrote that. That's 30 seconds. And then I had to turn on sirens to get it finally. 100%. 408 dispatch. 408. Did you get a return on that criminal history? Unable to run it at this time. GCIC is down. We're still trying. Wonderful. 92101. Happy holidays. Post the season. There's a GCIC says it's not working. At the moment, we're unable to log in. I'm trying to run a criminal history. >> [snorts] >> Now, what's your address? Now, do you get your mail at your last address, too? Where do you get your mail? You live there? Yeah, I do. So, just to make sure. Okay, he gets his mail at his mom's house. It's this one here, right? The 7 761 Duncan Bridge Road, Alto, Georgia. That's the address you get your mail at, okay? Listen. I'm not trying to harp on you and cause you any fuss. You got to understand from where we're coming from. We're out here looking for people who ain't up to no good. And you're you're giving me a lot of signs that you could possibly be up to no good. Does that make sense? Now, after I'm talking with you now After I'm looking at you and you Like listen. You're fine, okay? You are getting a ticket for failure to maintain lanes. You're getting a warning for failure to yield. When blue lights come on, you stop. Doesn't matter how long, even if it's you finding a safe place and all that, we appreciate it, but don't do that. Because then it it gets you in a situation like this where we're thinking you're hiding something in the car cuz when we were at the red light, you were moving all around in the car. Right? And I'm assuming that was you putting your your gun up. No. No? What were you doing? I was playing on my phone. No. When you do that? I'm not going to write you a ticket. But listen, you're getting a ticket for failure to maintain lane when you passed me at Duncan Bridge BC Grant and I have it where you were coming through the four-way. While you're passing me, I saw you all the way over that white line, my man. So, listen, what I need from you is a signature. Signature is not an admission of guilt, it's just you saying you will either come to court or pay the fine and that you have received a copy of the citation, okay? And we're going to go over your copy, okay? You got enough light? Yeah. Thank you. Your copy of the citation, sir. Your court date is going to be the 10th day of February at 4:00 at Baldwin Municipal Courthouse. I'm underlining the address there, okay? Don't forget this court date. I'm putting a little box here so that it gives you a quick little reference. If you choose to pay the citation, you can do that at this website or if you want to call and make any have any questions about the citation, you can call this phone number here, okay? That is your copy of the ticket. This next one here, all this is is a warning, no fines, no fees, nothing like that. Just saying that we talked about when blue lights come on, you stop your truck, okay? There's that for you. And then your license, sir, it's about time you get a new one. I know, right? All right. Have a good night. Hey, don't forget your knife in the back of the truck. Case details. Initial violation. Failure to maintain lane, weaving, and crossing the white line.
