You saying you're saying I'm just
passing. You're saying I'm just passing.
>> You're under arrest. Stop.
>> She pushed one of the nurses and then
walked out in the lobby, refused to
leave. So when I got here, asked her,
you know, repeatedly, "Go outside. They
don't want you here. Let's go outside
and talk."
>> You all right?
>> Yes.
On May 5th, 2020, officers responded to
a call about a verbal disturbance at a
doctor's office in Palm Coast, Florida,
where a 51-year-old woman and her
18-year-old son had entered despite a
COVID 19 patient-only policy. The woman
argued loudly with staff, shoved a
nurse, and refused to leave the waiting
room despite repeated warnings from
Flaggler County Sheriff's Sergeant
Jonathan Dopp about trespassing charges.
During the arrest attempt, she resisted
by pulling away, kicking, scratching the
officer's arm with her fingernails, and
trying to bite him as captured on body
cam footage released the next day.
>> What's going on today?
>> Well, I my son is in the with the doctor
inside. I told him that after seeing the
dog, I need to talk to her. My my
[Music]
>> son is only 18 years old,
>> okay?
and he has a lot of issues at least
three different issues. So I called it
because and he's he's a kid over he had
no idea how to talk to a doctor. So I
said after he see him I'd like to talk
to a doctor about whatever he whatever
information he had missed.
>> Okay.
>> And so they say I couldn't stay here and
I have to leave.
>> Okay.
>> And and I said I don't care. I I know I
can that I can I perfectly know I don't
want to I don't need to see be with him
with the dog. I know I can't I just want
to see after he can I can talk to her
six feet away 10 feet away feet away but
I need to talk because my husband is my
my son is very young and I need to go to
his
>> I don't know if you're aware but the
doctor is not legally allowed to discuss
any of his medical issues with you
because he's an adult.
>> Uh the He He's uh D has done permission
for him to start with me.
>> But the doctor doesn't have to is what
I'm trying to tell.
>> I I'm She knows me for years. So she
knows.
>> You understand that the rules are
different right now because of the virus
and that they don't want people in the
building unnecessarily. That's the
reason for the
>> They told me to wait here and I'm
waiting here and they starting giving
help for this because this thing keeps
sliding but I keep putting putting it
down. So there are two things.
I'm not insisting to see the doctor
there with my do my husband and and I'm
just keeping the guideline that they say
to stay outside and wait until doctor is
out.
>> Right. But you're not a patient
and they have asked you to leave the
property. Is that correct?
>> I'm a member of this base.
>> Well, that that really is beside the
point. If you're not being treated, no,
it is beside the point of those
organizing
any law. You know,
>> it's called trespassing. If you've been
asked to leave, it's trespassing.
>> You're you're a a customer here.
Essentially, you're not a member. You
don't pay dues. You don't have any right
>> to pay
$700 for this.
>> That is a customer.
>> Don't talk over me.
>> You're going to have a big problem if
you keep talking over me.
>> Oh, really?
You're going to go to jail for
trespassing.
>> No, I'm the law enforcement. And when
you trespassing,
>> you need to walk outside, ma'am. Yes,
you can.
>> Sue them. That's fine. But today, you
have to leave. Leave.
>> You need to leave. You're being asked
now lawfully to leave the property. You
need to do it outside.
>> Come on. Call your lawyer outside or you
going to go to jail for trespassing?
>> I'm not trespassing.
>> You are trespassing. You've been asked
to leave. You're refusing to leave. Ask
the doctor.
>> The security here has asked you to
leave.
>> Is the doctor the one who decided?
>> No.
>> Is you need to leave?
>> It is the doctor who decided to see me.
>> Come on, get up.
>> Is the doctor who
>> get up and go outside. You're going to
go to jail for trespassing.
>> I'm going to go now.
>> If you keep it up, you're going to
>> Okay, I'm going.
>> Okay. Uh, hold on.
>> Outside.
>> Just a second.
>> Ma'am,
>> just a second. I'm not going to continue
doing this. But you've been asked to
leave. You need to go.
>> What are you saying? Say again.
>> Your son is a is not a minor. Ma'am,
>> he asked you not to come in. You told
him he
>> But I wanted I asked you as I asked you'
to see with the doctor after. And you're
saying you're saying you're saying I'm
trespassing. You're saying I'm
trespassing.
>> You're under arrest. Stop.
[Music]
Stop resisting.
Get on the ground. Get on the ground.
Get on the ground and stop. Stop.
Get on the ground now.
>> Stop you. You
>> get on the ground.
>> You daughter. You You Now you're very
painful death. Get on the ground.
>> Get on the ground.
Get on the ground.
On the ground.
Stop resisting me.
You
Don't bite me.
>> You need backup, sir.
>> I got one on the way.
>> Okay.
>> Get on the ground. Get on the ground.
Get on the ground and stop fighting me.
idiot. You don't even know anything
about law. You go. What is your name?
>> Get on the ground and stop fighting.
>> Stop scratching me.
>> I'm not scratching you.
Close on me.
[Applause]
It doesn't bring me
trying not to hurt you.
>> Get on the ground and stop fighting.
I hope you
>> come on.
>> Can you grab this arm here?
>> Ma'am, don't release this. Okay,
>> stop.
She's been trying to bite me.
>> I'm not trying to bite you.
Did I bite you?
Man,
just put your hand behind your back.
>> You want me to help you?
>> All right.
Wait.
>> Put your hands behind your back.
>> Suddenly,
>> put your hands behind your back.
Put your hands behind your back. Yes.
>> You might want to do it from that side.
>> Yeah.
[Music]
>> Put your hands behind your back.
>> Do the hob front.
>> Yeah. That'll be easier for now.
>> Yeah.
>> Yeah.
That's just a one,
>> man. We just want you to listen. Okay.
>> No. No. I want you to off. I'll talk to
my lawyer. Don't waste your Don't waste
your saliva.
>> Okay.
>> Idiot.
Trespass after warning.
Okay. either resisting with violence or
battering on Ellia. One of the two.
Okay. So,
>> damn.
>> Now, she was cuffed.
>> She was cuffed in the back. Now she's
cuffed in the front. She got hinge cups
on.
>> Okay.
>> We may go the belly band route if she
keeps, but for now, that's what we got.
Okay. So,
>> um
>> he's getting statements from the
witness. was uh
>> yeah, there was uh I got in there. There
was a security guard in the lobby
>> who waved me in and there was two
nurses.
So, he's got three statements now. So, I
was going to get her ID and see.
>> Okay. Ma'am, will you say anything to
me?
>> No.
>> No. Okay. Is your son inside?
>> Okay.
Um, was the uh she or anyone else or was
it just uh
>> I don't know how it got to where it got.
He when I got into the lobby,
>> they were kind of tussling.
>> Yeah.
>> So, I don't know.
>> Okay.
>> If he tried trespass at the warning, I
don't know what if he tried to get her
to leave or what?
>> Okay.
>> I'm keeping the cameras rolling.
>> I'm I'm on now too.
>> Um,
>> she got out of touch. She picked him.
She tried to bite him. She He said,
>> "Um, okay. I'll talk with
>> right now she's secured. So
>> 10:15 at least for the battery on LEO or
resist trespass after warning because it
sounds like
>> been trespass.
>> No, I mean it sounds like they told her
to leave and maybe he told her to leave
and she wouldn't.
>> Okay.
>> But I don't know how it got to that.
You're going to have to ask.
>> Okay.
>> When I got here, like I said, she was
fighting with him.
>> Yeah.
>> And I was just
we was just It took us a couple minutes
to get it secured and out here. Okay.
[Applause]
She's not really cooperating. I was
going to get a menu to come check her
out.
They're on their way. Or do you want me
to call?
>> We didn't call them yet cuz we just
won't talk to him. It looks like she has
Okay.
She got some history with us four years
like DUI and some drug.
Did she say at all why she was being
inquire?
>> She wanted to talk to the doctor after
her 18-year-old son talked to the
doctor. They explained to her that she
needed to wait outside and that the
doctor basically wasn't going to talk to
her because her son's an adult. Uh
>> Oh, I see.
>> And she just refused to leave.
>> Okay. Simple.
>> Still recorded.
>> They're working. Two others are working
on this. Okay. I'll do the use of force
and I'll do a supplement for the 707.
You just take that?
You want a admin page or anything out
for your thumb or you going to go to the
doctor?
>> I'm going to call Jerry. I'll probably
go to the doctor and get it looked at
real quick, but I'll just call Jerry
first.
Gotcha.
Can they do like x-rays at care here? Do
you know?
>> Yes.
>> Yeah.
Oh, care here. No, they can't. Um,
Pinnacle.
>> Okay. Uh,
>> walk in.
>> Or not Pinnacle. Uh, MedQuick. Either
the one here or
>> or here.
How you doing? I'm still recording my my
camera, just so you know. Um, we got
here. A mom's here with her 18-year-old
son. He's an adult. He's fine. He's a
normal adult. Um, doctor's office wanted
her to leave the lobby. She refused. We
came here. She wouldn't wear the mash.
We came here. My sergeant asked her to
leave. She wouldn't. He tried to escort
her out. She She was fighting him. Um,
she resisted. So, I got here. We both
cuffed her. She tried to bite and spit
on him, just so you know. And I mean,
she just has some like surface
lacerations and scratches from just
tussling. So, she has
>> she doesn't want you guys, but you know,
>> liability inside.
>> Everybody's fine inside. So, you can
probably talk to her through this
window.
>> She hasn't been too cooperative, but
we're just throwing out the medical app
and all that.
>> Yes.
>> Hi.
>> Hi. Do you hear me?
>> Claudia.
>> Claudia, can you hear me?
>> Find out if you're okay.
>> Okay. You heard anywhere?
>> Okay.
All right. Well, you want to go to the
hospital?
Another hard question.
>> I'm thinking about
>> Okay. Go ahead. Just answer the
question.
>> Yeah. Why am I taking you to the
hospital?
>> Why am I taking you to the hospital?
>> Okay, let's let's take this different
approach. What day of the week is it?
>> You keep doing that. All you're going to
do is hurt your wrist.
>> Well, it's going to hurt worse. You keep
twisting on them like that.
[Music]
or what do I need to tell the doctor at
the hospital? What's wrong with you? Why
am I bringing you there?
They're they're all fine.
>> I'm paramedic. I'm better.
>> Well, no. The way the way you're sitting
there doing this with the handcuffs is
telling me you probably don't have a
broken arm.
>> Tired of talking to her now. Your turn.
>> I got tired of talking to her this past.
>> She uh So, what what happened? She went
in there and started yelling at the
staff or
>> Well, she wouldn't leave when the staff
asked her to leave. She pushed one of
the nurses and then walked out in the
lobby, refused to leave. So when I got
here, asked her, you know, repeatedly,
"Go outside. They don't want you here.
Let's go outside and talk." So finally
came down to she's just screaming at me
and the security guard with her cell
phone recording. And I told her, "You
need to leave. You're going to be
arrested."
>> She wouldn't leave. So I put hands on
her. We went to
>> um her left arm, I was pranking pretty
good on it. I mean, I was just
>> She's sitting here doing this with her
cuffs. I mean, man,
>> she got out of them once.
>> Yeah. And she's going to be all bruised
up and sore because I was just sitting
on her face.
>> Well, we'll go in and uh and talk to the
nurse. Make sure she's okay. They got
pushed.
>> Yeah. She didn't want We'll see why.
>> Yeah.
>> Um which where where were they at? But
>> you go in here and see the door uh to
the left.
>> Actually, I need to walk in anyway and
see if they have cameras in there.
>> If you'll stay here and watch Julie,
I'll put the
any
question?
>> She's not really.
>> If you are being aggressive,
>> you can ride right in the back here.
>> I know, but you're
going to
want to talk.
>> That is over.
you would like help, I'd be more than
happy to help.
>> 100.
>> Does she want to go to the hospital?
>> Yeah.
>> What is she like saying like
>> shoulder pain and pain on her face?
>> What?
>> Pain on her face.
>> Well, I'll I'll talk to the sergeant
real quick. I mean, we may try
>> if she's um going to be as nasty as she
is, they won't they should
>> No, I wouldn't. Yeah, I I I completely
agree.
>> I'm just wondering like, you know, if
she's saying it was something more
serious like some shoulder pain and all
that, we could take her
>> Yes.
>> physical stuff. It's not something where
she's going to, God forbid, happen to
her back car. Your guys safety or their
safety is more, you know,
let me uh run it by him. But I think it
we'll do it.
Boss
still recording. She wants to go to the
hospital. Shoulder pain and face pain,
>> but well, the ambulance isn't here, but
and the fire isn't they're not
comfortable with her riding if she
anything close to this. So,
>> we can transport. Okay,
>> we'll transport.
>> You guys want to cancel the rescue?
>> Do that. Or if they got to do Yeah. So,
I'll just have one of you guys sign on
her behalf.
>> Sure.
>> I'm going to start that supplement so
that he has it for the 707. I didn't see
any cameras in there, but when security
brings out um statements, can we just
double check with him?
>> Yeah.
>> She's fine. More abused than anything
else.
>> Do you want to uh cancel the rescue?
>> That's what I was about to ask.
>> Yeah, they're going to transport. We're
going to take her since it's just
physical shoulder and face pain and
stuff because on behalf of her right
here
I'll have you
rescue.
>> Thank you.
>> Yeah, the nurse is fine. She seemed more
abuse than anything else.
Were
>> you able to get anything out of her?
Okay, Claudia, will you come out,
please? I'm going to have to hold your
arm when we walk. Okay.
>> Okay.
>> Is that me?
Who was it?
>> The husband.
>> Take a message.
>> We're going over 14.
>> Right here, Claudia.
>> All right. I'm going to sit on this bed.
Okay.
Do
>> you guys have any information for me for
her?
>> I got a DL. It's just in the car.
>> Okay. No problem.
>> Claudia, were you going to give him your
name?
>> Can you swing your feet?
[Applause]
Claudia, I'm going to take one handcuff
off. Okay. But I have to handcuff you to
this bed.
Claudia, what's your birthday?
>> Just check my fans on my
>> Well, they they need to
[Applause]
I'm going to fix this handcuff. Okay. In
order them to treat you, they have to
know who you are. Okay. So, please
cooperate with them.
>> Can you see something with my hands on
my face?
No, I just need
>> Okay, then you come
you you have a driver's license outside.
>> Yes, I can get you. Yeah,
>> that way.
>> No problem.
>> I was just making sure they were uh
>> Okay.
>> tight enough since she got out once.
[Music]
>> A little tighter. Claudia.
[Applause]
>> Okay. Not bad.
>> No.
[Applause]
I'll get the confirmation. All right.
Thank you.
>> Possible cuz the floor is kind of hot.
Step on the the white there. That's not
as hot.
>> You all right?
>> Yes.
