If you want to If you want to ask them why they're creeped out and film that. >> Well, now I've told you what it is. You don't have to figure it out anymore. I'll even when we're all done Okay, can you tell me a little bit of what happened? Well, we're out here I still was just curious what what this is about. I I don't I don't understand. A single camera [music] sent the whole street into chaos. And then one officer made a deadly mistake. Okay, so you were 50 ft down the sidewalk. They didn't come out yelling at you. They stuck their heads out the doors. You know what? It doesn't even matter. You're talking about And I'm going to do the best job that I can. Right. Okay. And if I can influence somebody else by my actions, cuz in my opinion action Police rushed in. The crowd panicked. [music] And an unlawful threat rang out. In just seconds, the truth was exposed. In a quiet town, a single camera sent an entire street into panic. Shutters slammed shut and 911 lit up. Well, nobody put the camera inside. When you start filming inside >> you You're now filming juveniles, okay? Let me out from the outside. Well, that is the case. I'm telling you that's the case, sir. They were just having a normal conversation when the clinic owner burst out yelling, "Shut it down." Trying to ban filming on a public street. But in the end, who was really crossing the line? I mean you're out in the public and I mean you're you're well within your rights. We just film public. I I I I'm sure it's my right to take video. We just We just got a call. That's all. We didn't All right. So, what I'm saying is is it's unfortunate that people are getting creeped out and alarmed by it. So, I'm hoping that you gentlemen will explain to that there's nothing unlawful here. All right. I'm not going to be distracted by this. Did you guys put them in the office? Yes. No, it's somebody down there. I'm not going to say who. Okay. All right. Very good. So, we're just here making sure everything's Well, the thing is is your your If you want to If you want to ask them why they're creeped out and film that. Oh, I did. So, why Why are we I asked you. Why What are you creeped out of? I wasn't even here by ourselves. I wasn't even here by myself. No, there's two women that came out on the sidewalk and started yelling at us asking us what we're doing. So, we walked down here away. And then you were like you yelled though. Never have. I just asked you. You just filmed the citizen in the store. I never walked up and slammed my camera You didn't do that. Yeah, he I just more or less was trying to be respectful. I was like, "Hey guys, what's going on?" I was trying to be asking a question. Just be like a business. Just cuz it's you know I just was like, "Hey guys, what's going on?" I wasn't trying to do it in an aggressive way. I was not being Oh, I never said you were being aggressive. You did say you were essentially yelling. Well, you had to yell from 50 ft down the sidewalk. Okay, so you were 50 ft down the sidewalk. They didn't come out yelling at you. They stuck their heads out the doors. You know what? It doesn't even matter. You're talking about Samantha. Whatever the situation I can have a conversation with anybody I like to have a conversation with inside. Standing in front of the lens, the officer coldly warned, "Keep filming and it's harassment." In an instant, a perfectly legal camera was twisted into a crime. The problem that we're having is that, you know, you're allowed obviously to be out here on the street. There's no expectation of privacy when you're out here on the street. The problem that we run into is that whenever Sorry. It's okay. Whenever you start putting the the camera inside then it starts to become an issue. >> Well, nobody put the camera inside. When you start filming inside >> you >> You're now filming juveniles, okay? >> Yeah, that's from the out from the outside. Well, that is the case. I'm telling you that's the case, sir. >> No reason to get up. When I was down off of Katella Avenue, the receptionist came out. We were having a very cordial, lovely conversation. Laughing back and forth. All of a sudden the owner in the green shirt comes out and starts screaming, "Shut it down." Yeah, I understand that. And you And they don't understand that that you are well within your First Amendment rights to film in the public place. You're on a public sidewalk, all right? What it What it arises to is that you are now creeping out residents and well, owners of or What expectation of They have They have a display in front of this window and have glasses right here. So, if I walk up to this window and I'm looking at the display they have in the window, you're going to tell me that too? If you continue I I understand. If you continue to film inside there Yeah, you can't You will be cited for harassment. Yeah, you can't film inside the window. For filming inside, filming people who do not want to be filmed. Listen to me. Listen to me. >> to be charged with harassment. I'm trying to have a civil You keep trying to escalate. I'm trying to I'm not I'm not escalating anything. Is there a supervisor available? That's you. Okay, so I'm going to deal with him if that's okay with you. Okay? So, what we're trying to do is we're trying to eliminate the people who They They have an expectation of privacy when they're in the you know, once they're inside. >> Not when they're behind clear glass windows and they have static displays and I'm not allowed to come by and look at the mirror uh the In the middle of the street, the cameraman declared, "Want to stop me? Then cuff me." A spark in gasoline. Would the police dare pull the cuffs or be the ones forced to back down? And I appreciate you being reasonable. So, that officer is being You You witnessed the whole thing. Just trying to figure this whole thing out. Well, you want me to tell you what it is? This is a First Amendment order. And you know exactly what that is, okay? So, I'm out here with the sole purpose to exercise my right to take video and photographs in public. Right. And I'm not going to allow you or that other officer or anybody else to interfere with that right. If you want to do that, it's going to be putting me in handcuffs, charging me unlawfully with a crime, and then like I said, I'm going to clean out the coffers in Oak Lawn. So, let's not go there. You've been very civil. You've been very courteous. Well, now I've told you what it is. You don't have to figure it out anymore. I'll even when we're all done here, I'll give you my channel name. Oh, of course. Are we being detained? Are we being detained right now? No, no, no. You guys are good. Very good. All right. Thank you. Well, no. You know what? I I want I want to see how this ends here, officer. He's got a hair up. He's about to try to take some legal action here. But I'm hoping you're going to rein him in and save the citizens a lot of legal Well, I've been very forthright with you. I told you what I'm doing. So, now you can go in there and explain it to them. We just want to make peace. Yeah, but keep your officer in check. Don't let him screw up. Fair warning. That's a video inside the windows. Ridiculous. Veteran officer stepped in. No barking orders, no tension, just quiet listening. And instantly, the entire story shifted direction. And clearly that, you know, they you you gentlemen have a right to be out here. You're filming in the open air. You're on a public street. There's no expectation of privacy. Okay. It's no different than if somebody has a traffic cam or um [music] cameras on a building, you know. Right. The problem they had was that I don't know if you guys are aware of the HIPAA laws. There's There's It's Health Information Pri- [music] Okay. Privacy Act. They were just worried about that as far as maybe getting information that maybe they're working on the back Well, you know what's funny about HIPAA to address that? You probably already know, but HIPAA laws only apply to people that are trained and certified in HIPAA. Oh, okay. I'm not bound by any HIPAA laws. The onus is on them to protect the private information because they can trade Right. So, if they leave private information out there, I can video it and do whatever I want with it. Yeah. Not that I would. Right. I don't think Yeah, you know, I don't see that you being that kind of person. You're not a vindictive person. >> No, not at all. I just so you know, this is this is my son. Oh, okay. Nice So, I'm clearly not out filming kids with my son. I'm Joe, by the way. And that my wife is standing down the street here somewhere. Oh, okay. So, nice to meet you, Joe. My name is Jason. Jason, nice to meet you. Pleasure. And I'll tell you what. You know, I'm a little I am a little concerned though. I just wanted to express my concern as a citizen here about from this. Your officer threatened me basically to charge me with harassment if I pointed my camera in the window. Yeah. So, I don't know if that was with him and and we've already talked about that, addressed that. >> Okay. I appreciate that. We talked about it in there. I talked to my supervisor on the phone as well, just to double-check. >> Of course. I'm going to make sure that that everybody's on the same page here. Citizens can sue police officers under SS 1983 when their rights are violated. Officers who break the law may be required to pay damages and face disciplinary action or termination. Police may face internal complaints, administrative discipline, mandatory retraining, and the risk of a federal lawsuit. Up next, a car screeched to a stop, a man charged straight at the camera, and within seconds, everything exploded in a way no one saw coming. And this is a great lesson for anybody watching here. I mean, just think about what you just saw. Okay? Tammy, I think was her name that works here, came out and said as long as you guys stay on the sidewalk, which we know and we don't need her permission. But she came out, [music] acknowledged the fact that we're allowed to be doing what we're doing, and asked us not to come on the property. We're respecting that. [music] And this guy decides to come out. Now, option number one was he could have just pulled out of the driveway and left. And he'd be having a great day right now going to get his beer or whatever else he does. Um I don't know. Maybe his car failed and he's upset. But instead of that, what his mind told him to do was pull over, demand an answer of what we were doing, get out of his car, and walk up and physically grab Watchman here. Well, you know, he's got no way of knowing the Watchman's 17 years old, but you don't put your hands on anybody. So, good lesson to be learned by all here today. And we'll see how the police handle it. They're going to want to see your video. Yeah. If he calls anybody. Yeah. Yeah, maybe he'll smarten up and not call the cops on himself. If I was him, I would just get in the car and leave. But you know. I'm not going to press it. I think he uh He learned a lesson. He learned his lesson good enough. We don't call the cops. In just seconds, tension erupted into physical contact. The man grabbed the 17-year-old and instantly got a response that left the entire area stunned. You guys okay? I He was actually the one involved. You can speak directly to him. Yeah, what happened? So, I was standing right there on the public sidewalk, just taking some video, and the guy who was driving that silver SUV over there got out and got in my face and tried to grab me and assault me. You have it on camera? Yeah. Are we able to see it? Uh yeah, sure. And what was the what was the issue about? So, I was just standing there taking video, and he came up demanding answers, getting way closer than How do I know you're not involved? Do you mind if I talk to you over here, please? Am I involved? Yeah, no, I was not involved. Did you witness what happened? I did witness what happened. Yeah, he's inside. Yeah. >> The other guy's inside. I think unless he went out the back door. He went in the office there. >> Okay. Okay, can you tell me a little bit of what happened? Well, we're out here >> What happened? >> Yeah, we're out here taking some video on the sidewalk. Do you Do you mind just moving it? No, I can still record me, but Well, it's a very tight lens, and you're standing 2 ft away, so let me back up from you a couple of feet, and then it won't be in your face. So, she went back inside, no issues. Then this guy goes to pull out. I guess he was done with his inspection. Um So, he doesn't work here? I don't know. >> That you know >> Not that I know of. No, I'm assuming he was getting his car inspected. So, he comes driving out, rolls his We were standing on the other side of the street on the sidewalk. He comes driving out, puts his window down, and says, "What are you guys doing?" So, I just ignored him. I just kept doing what I was doing, and then he said, "Hey, what are you guys What's with the cameras? What are you doing?" Just ignored him. So, then he gets out of his car. This is my son, who's 17 years old, by the way, so he assaulted a minor. Police arrived, and everything flipped. No more arguing. Only one question remained. Who would have to face the body cam with evidence captured frame by frame? I did Let's I don't >> Yeah, yeah, no problem. I just don't You can understand what my parents are saying. I don't want to >> I work in the sun all day, so I hear you. We can walk over here in the shade if you want. >> Okay, sounds good. >> I'm okay with that. Very good. And I'm sorry, can you I didn't ask you. Can I just ask your name and badge number? >> Maria, 49996. >> 49996. >> That's three nines in there, okay? >> Appreciate that. So, yeah, we actually saw that camera there, and it's actually pretty Self-explanatory. Clear as day, and he showed us his video cuz he was recording you guys at the same time. Okay. So So, he basically called the police on himself? He didn't call the police. >> Oh, he didn't? >> No, he did not. >> Oh, I thought he did. He said he was going inside to call you. The the staff called. Oh, okay. Got you. That's where we're at. He's already been explained exactly what's going to happen. Um it's an arrest. Okay. And and he'll have his day in court. Okay. Okay, do you have any questions? We're going to get you the case number and >> Sure, yeah, I was just going to say, I just need a case number and the No, and I got to tell you guys, I really appreciate you being thorough, and professional, and courteous. >> No, you got And I was cuz I was explaining to them um because they were I guess they were aware You guys have a YouTube channel, I guess? We do, yeah. Cat's out of the bag, so yeah, we do. >> Yeah, so uh Oh, they knew about that? >> Yeah, they knew about that. I guess they had like a company email that says, "Hey, be aware these guys might show up." >> Got you. And uh Good on them. And so, they were aware of it, and then I guess that's why the representative came out to talk to you guys cuz, you know, she's like, "Hey, maybe." And then she talked to you, and she's like, "Yeah, that's them." >> So, she told you the same story I told you. Cuz she Well, I was speaking to the other officer. >> Yeah, I Well, I heard something weird, but anyway, >> So, she came out and said, "Just stay on the sidewalk. You guys are good." See you later. >> Yeah, she just asked if you guys need anything, and you were like, "No." She's like, "Okay, so I guess it's fine." Like what what After reviewing the footage, police made it clear this was assault. A moment of sidewalk bravado instantly turned into an arrest and a looming day in court. brotherhood group, gang, whatever you want to call it. And sometimes that's not doing it because bad cops are out there not doing us any favors, and they're not doing you any favors. Somebody could have a bad experience with a police officer today that has nothing to do with you, and then you pull them over 2 weeks from now, they're still pissed off at the other guy, and they take it out on you, and now your family's got to deal with that. >> I understand. >> So, it's up to you guys to police your own and represent your departments properly and create that trust. So, what we're trying to do is give you an opportunity What we don't try to influence things, we don't antagonize, we don't try to create an outcome. We let things happen very organically, and we want to give you an opportunity to act like a fool >> Yeah, so we give you an opportunity to either act like a fool or uphold your oath, uphold the law, and do the right thing, and you've done that here today. I'm doing my job. No, but don't just shrug it off, either. It's very important. And that's becoming increasingly more difficult to do. >> to me. Yeah, but you know, I'm going to hold myself accountable, and I'm going to do the best job that I can. Okay, and if I can influence somebody else by my actions, cuz in my opinion, actions speak louder than words. >> For sure. So, if I can hold myself accountable, if I can carry myself like I would want others to carry themselves, and if I treat others >> like to be honest, how I want my family to be treated in a law enforcement context. >> You know what I mean? What can I tell you? People do that. I'm going to step out of the way and let you Thank you. Okay, I'm sorry I touched you. I still was just curious what what this is about. I I don't I don't understand. But if you're not going to tell me, that's fine. >> I'd be happy to explain it to you now. >> No, we're not talking. You and I are not talking. >> Oh, okay. I just didn't understand I thought maybe >> attitude, I don't want to hear it. >> No, no, listen. I thought maybe you were doing a school project or something. I just was curious. I didn't want to I didn't >> what? And since it's my And since it's my decision, then, go ahead. Let's go ahead with the arrest, then. Let's just do that. That's not an apology. That's not sincere, and I'm not interested >> Look at here. No, I'm not interested in it. I I'm not I don't want to hear any of it. I I am sorry that No, I don't I don't want to hear any of it. Given a chance to walk away from trouble, he stepped out, but his own attitude slammed that door shut. And just like that, the final decision was made. See you in court. What would you do if the police wanted to arrest you just because you didn't tell them your name? This man chose the most unexpected way. You can't tow a truck while somebody's sitting there. You It's against the law. I know the law when it as it pertains to that. But this is my nephew's truck, and he Excuse me. I was talking to you. Well, but they're the ones that came out here initially. So, if you want to talk to somebody that has a little more know-how with what's going on, talk to her. >> Who's the officer in charge? She is. >> Okay. Okay, first of all I That's That's That's what I'm saying. >> and look at me. Talk to me. No, no, I'm picking my phones up. I'll hold your phone. You don't want to just give me your name? Being pulled over illegally, the uncle fiercely defended his nephew's rights, and the result was two cold handcuffs. What's going on, man? Okay. Officer All right, my name is Kevin. Hold on, hold on. We'll talk to Officer Hamilton right now. Officer, this is my My nephew's on the truck. All right. This is his truck. He lives in this compound. I called my I said, "Hey, did you have someone to pick up the truck?" He said, "No." I ran over here and jumped in the truck and told him, "You can't tow a truck while somebody's sitting there. You It's against the law. I know the law when it as it pertains to that." But this is my nephew's truck, and he's That's against the law, I'm telling you. He tells He'll tell you it's against the law. But you're hooked up right now. Yes. That's against the law. >> So, you know, like you're obstructing it. If they're already towing it, you can't just hop in. >> No, I got the video. He was He was up there, he was backing up, and I jumped in the truck and said, "This is my nephew's truck. You can't do this." have any signs up there saying it's no parking overnight, it doesn't have a sign to say what time it is. Yeah, it's When you got your orders that you can't park there. All right, come on out. Come on. Hamilton, this is a civil matter. It's not criminal. This is civil. You know this. You're obstructing him, man. Listen to me carefully. This is You're on recording. Yeah. This is civil. This is not criminal law. This is not criminal. Am I yelling at you, bro? You I apologize. I apologize, Hamilton. This is civil. This is not criminal. All right, bro, let's go over here. Don't think I'm going to teach you. No evidence, no charges, but the police took action anyway. So, who is responsible for 48 hours in jail? from the spot that it was sitting in. It doesn't make a difference. When you disconnected and I got the truck as you stated In Chicago, that's how it works. It don't work But the truck was never hooked up. He should have No, it is. Why he Yes, I am. Well, I'm almost done. Okay, that's that's that's what I'm saying. Turn around and look at me. Talk to me. No, no, I'm picking my phones up. What is your name? Excuse me. Can I have your badge and and name and badge number? Badge number, please. 706 Can I have your name and badge number, please? You're going to do what she says. I know. Under Texas law, if you get there before your car is completely towed, you have the right to get it back. So, why was he arrested? It's a city ordinance. If you look it up, Euless city ordinance, you'll be able to find it. If you read the sticker Hold on, hold on. She's explaining to you. Now, he's playing the game. Here's Here's the whole problem. You made me ownership of the vehicle. I've had the vehicle for 20 minutes before you even showed up. It doesn't matter if I'm hooked to it or not, buddy. Mhm. Well, he got me as I was backing up to hook to it. So, I I had to pull over here cuz I didn't have enough room to pull it out of there. She knows that. And I drove it out here. I parked here. I got in my truck to realign to it. And I was backing up and he was like, "This is my my nephew's truck and everything, but this is a pissy truck." So, either way, dude, there's Oh, so you couldn't even done the drop fee. I couldn't even done it for him. Well, he I don't know why he was able to see everything today. It's like, "All you have to do is move the thing." After his arrest, he was held for 48 hours before being released. All charges were dropped.
