As a cop and a man with a German Shepherd, I love police dogs, but these criminals definitely do not. >> Why are you going to let the dog around my car? >> Cuz we can. >> We have a case of a man leaving a known drug house, and when the police use a canine on his vehicle, unsurprisingly, there's a hit. >> I've given you an order to exit the vehicle. >> Is your body camera on? >> Yes, it's on. >> And what seems like a normal couple, but there's a hidden stash in their car. >> Why are you nervous? >> But first, cops pull over this man who is anything but cooperative. >> How's it going? How's the window not rolled down all the way or What's up? No? Okay. Well, I'm Sergeant Daniels, that's Officer Lang. The reason he stopped is that your plate light, it's not illuminating your plate. Like it's on, but it's not really >> It is on. >> It is No, I didn't say it was off. >> illuminating my plate. >> So, you in the way the law is written, it's got to be able to be readable or read from 50 ft. >> Plate light out, classic what they would call pretextual stop. A larger crime is at hand, you don't have probable cause to stop the car and search it yet, but you can find something to stop it like a plate light or a headlight or swerving down the road. Pretty controversial depending on the state that you're working in, but it is regarded as legal. >> It is not >> So, not from 50 ft. That's why the officer shut his headlights off to look at your plate to see if it was if he was able to read it. Okay, which is not a big deal, man. He's not going to write you a ticket for it or anything. I'm sorry? >> No, because I know it's lit up good. >> I just said that it's lit, but it's not illuminating your plate. It might be dirty or something. It could be a simple thing as like that, but it's not >> You want me to wipe it off for you, please? >> That's not what I'm asking right now. I'm explaining to you why we stopped you. >> Well, that's not That's bull >> Okay, well, that's the way the law is written, man, and that's the way that's what we do. >> Downright bull >> Okay. Do you have your license and proof of insurance in the vehicle? >> What's that? >> Do you have your license and proof of insurance on the vehicle? >> Yeah, I do. This here is not a legal stop. >> It is a legal stop. Now is not the time to argue about it. You can take it to court. >> Now, why don't you tell me the real reason why you >> That is why we stopped you. Yes, it is. >> No, it's not. >> Yes, it is. >> Cuz I've seen you guys go by. >> This guy has a good idea what a pretextual stop is, and he knows he's now the target of that said stop. >> All right, man. Um, driver's license and proof of insurance. >> And you guys sit right up there at the top of the hill wait waiting for me to leave. >> Yep. >> I know exactly why. >> Yep. >> Now >> That torch right there in your center console probably hints at it, too. >> No, it's not. >> License and proof of insurance, please. I'm not going to continue to ask you. >> God damn. I'm going to get this damn thing to work. >> That's fine. Could I have your license first, and then I can get back to start on your paperwork? >> Little bit about Peter Brady voice cracking going on there. >> Thanks. >> Paperwork to get you out of here quicker. >> Okay, there's my license. >> All right. >> I'm allowed I'm supposed to show you my license. >> Okay, man. All right, well, I guess I can't run you then. I don't know. >> I guess you win. Really, you have to physically give your license. You can't just show them the information. >> I can't read that. Your window is dirty. >> I know it. I was going to go through my truck. >> If you going to hand it to me, can I run you real quick and then give it back to you? Thank you. 2018. I have a 2017 for the driver when you're ready. Can I see the date? I don't see a date. Go up. Expired 23. That's expired February of this year. Or last year. I'll be back. Just when you get it, stick your hand out window. That's fine. Keep your hands on the dash. He's going to run the dog around the car. I'll be back with the paperwork. >> And there we have it. The plan the whole time. Get the car stopped for a motor vehicle infraction, run the drug dog around. You can do that. The Supreme Court has decided, you know, sniffing the air is not a violation of your Fourth Amendment right. So, technically, they could run a dog around your car on any motor vehicle stop. Cuz we can. Actually, I can. Here. Check it. Check it. Easy on the paint. Check it. He wants to get in there. Typically, it's pretty difficult to get the police department to pay for your stuff. With the canine, you're going to have to show that the police department was grossly negligent in their actions when they damaged your property. It is pretty hard, and you know, we're not trying to damage property. We're trying to prevent the damage to people's property, but it is a dog, so we can't 100% control what it's doing all the time. >> We can do this the easy way or the hard way, man. >> This is what we're going to explain. I'm only going to explain this once to you. The officer said the end of the or the canine in the canine on the vehicle. I don't want to hear your I don't want to hear you right now. You can either step out of the vehicle or we are going to pull you out of the vehicle. If you >> No, it's true. >> So, you can either step out of the vehicle or we will pull you out of the vehicle. >> He knows he's caught. >> Out of the vehicle. Okay, Jeffrey, I'm only going to say it one more time. Get out of the vehicle. >> It's a bull >> Yeah, okay. You You can have your opinion on that all you want. You can take it up with the court if you have an issue with it. But, the canine in the canine on the vehicle, you are to step out of the vehicle. I've given you an order to exit the vehicle. >> Your body cam >> Yes, it's on. All of ours are on. All the cameras are on. >> Give it up, brother. >> Okay, that's perfectly fine. But, I'm I'm telling you to get out of the vehicle. >> Get out of the vehicle. >> Hold on. >> There's no hold on. Get out of the vehicle. >> God damn, dude. Right here by the >> Let's go. >> All right. >> All right. >> You ain't got to swing my [ __ ] door open. >> I have nothing >> All right, stop reaching. Walk back here. >> God damn, man. >> Quit acting like a fool. >> Good advice. >> Stay right here. All right, stop reaching in your pockets. >> I'm not reaching in my pockets. >> Did you like it? >> Yeah, I did. >> You must be too. >> Yeah, I am. >> I'm assuming he was doing the crotchal area. >> GET YOUR HAND OFF MY PENIS. >> SO, THAT'S WHAT THE conversation was about. >> Wait in your seat for me. >> Or maybe not. >> going to get real gay. >> Jeez. >> All right, man. Just go ahead and sit there and relax. I'm just going to leave this up here, okay? >> I swear to God they must have left anything in my >> Who was it? >> You know exactly >> No, I I really don't. >> Nate. >> Nate. >> Nasty Nate. >> Well, this one here you probably know him real well. >> Nate uh I think >> If it wasn't for my buddy asking me to come over and give him a ride, I wouldn't have done it. Cuz I know I stopped at Casey's and got my soda and I left him sitting in the truck. So, >> He's already trying to paint the picture that whatever's in the car, there was somebody else not mine. It's uh these aren't my pants type of situation. >> [snorts] >> Well, most people aren't going to leave their drugs if they do have it, so >> Yeah, but he's seen you guys cruising around, I guess. >> Oh, I'm cold. I see your breath. >> He was not a fan of ours. >> Searching cars like this is always a little nerve-racking because people who use drugs a lot, they're not really always careful. They don't always put the caps on their needles. So, when you're reaching around, it's always nice to have a pair of those gloves that have Kevlar in them. So, it might stop a needle poke. Oh, that's why. Got something. I'm going to transition over to the latex gloves here. You know, I'm going to test that. See what else I find, if anything. Well, that's about as blue as it'll ever get. So, with a field testing kit for drugs, it's great for charges, but it doesn't count in court. You still have to send the drugs out to an actual lab and get them certified for what they actually [music] are. >> You can go ahead and 95 into it. You got something? >> Pipes and needles so far. >> Yeah, we got a lot of traffic leaving that house recently. So, it's >> Still that's no reason >> not necessarily you, but >> That's not a reason to pull me over. >> No, but it's a >> It's not a reason at all. >> That's not why we stopped you, though. >> No. You are in >> That's why we we showed interest in you, yes. >> That's exactly why you said you stopped me. >> Oh, yeah. No, that's why we were sitting there because that isn't >> Cuz you was waiting for me to leave. >> Not necessarily you, just that vehicle that was there. >> And said that, and you said yes. >> I get what you're saying, man. I think we're saying the same thing. The reason that I conduct I can't do the traffic on you for that reason. The reason I did the traffic stop is I said it's on the camera. That's why we turn our lights off. It's got to be 50 ft. You have to be able to read. >> So, you might say, "Well, the cop turned his lights off when he was driving. He broke the law." But, really, in most states, cops we can be exempted from certain motor vehicle laws, like driving really fast, without sirens, things like that, if it's in the performance of our duties or if we're doing an investigation. >> We drove by and saw a vehicle parked there. >> All right, man. They found some stuff in your car. Turn around and place your hands behind your back and interlock >> For what? >> For the stuff that they found in your car. Turn around and place >> What did you find? >> Put your hands behind your back. >> Don't put your hands behind your back. >> Put your hands up. >> Put your hands >> Relax. >> Put your hands behind your back, man. >> Can I stop for a second? >> Just one >> One second. >> Just put your hands behind your back. >> Put your hands behind your back. >> Put your hand behind your back. >> Okay, relax and then put your hands behind your back. >> Put your hand behind your back or you're going to get tased. >> You're resisting. >> Contrary to popular belief, you do not have the right to resist arrest. >> That's impossible. >> So, you have to comply. In a civil society, you would comply with the police and then later fight it out in court if you think you were right. >> Put your hand behind your back or you're going to get tased. >> I am. I am. >> PUT YOUR HAND BEHIND YOUR BACK. >> RIGHT? >> IT'S A CLOCKING OF THE TASER. >> RESISTING. >> BACK. >> You got it? >> All right, fine. Oh my god, dude. >> He's holding the taser against him like that. Depending on the taser, you take the cartridge out and then you put the bolts directly on them. Or some tasers, you can just use the bolts without taking the cartridge out. Pain compliance, it's like a level of force below active assaultive. So, most places you can do a drive stun they call it to get somebody to comply. >> I did not. I said all I asked for was for a quick second. >> Don't look at me. It's all It's over now. Let's be friends. >> Man, I swear to god I'm going to kill that mother Thanks, man. >> It's all his fault. >> It wasn't me. >> I'll grab your hat. Yeah, I'll grab it. Throw it in that way. >> I Like I said, I just wanted a moment with you. At least you without What? without hand. When you guys did pull me over and I got out of my truck, I figured out why he took off. >> Okay. >> I grabbed my wallet. When I grabbed my wallet, there was a bag laying there with it. >> Mhm. >> Underneath it. Cuz I had my wallet laying right there on the center console. That's where it was laying at. >> So, where's the bag at? >> It's right here with my wallet. >> In the front? Okay. We'll get it in there, man. >> And nothing. That's why I said it's mine. >> No, no, no. Not here. No, no, no. Except That's not a different charge when you come in here. That's if you go to jail. This is not jail. >> That's why >> This is just a holding. >> So, this guy's obviously been through the system before. He knows that bringing drugs into an actual jail is an additional charge. So, he's been through the ringer. He knows what's going on here. We'll get back to his charges in just a minute. But first, the cops stop a car that appears to have illegal tint. >> Hello. Hi, my name's Deputy Magnuson with Flagler County Sheriff's Office. The reason why I stopped you today is because the tint in your front windows is is definitely >> We just bought the car. We just bought the car. We just bought the car. >> Okay. How long ago did you buy the car? >> About 3 months ago. We didn't change anything at all. >> Okay. >> Our tint is >> Okay. >> They just had the one tint for some reason. >> All right. So, what I'm going to do, I do have a tint meter and I'm going to go I'm going to put it on it just so I could see. All right? Do you have your driver's license, registration, and proof of insurance? >> Where I work, you can have window tint, not much, like 30%. Down in Florida, you can have it pretty dark, but not that dark. >> Where are you heading to today? >> We bought property. We're just going to go check it out in Palatka. >> Oh, up in Palatka? >> Yeah. >> Where are you from? >> Uh Daytona. >> From Daytona? >> Yeah. >> Do you have any weapons in the car? >> No. >> Do you have a driver's license, ma'am? >> I I left it at the house. >> I do. >> He does. >> I was tired and I couldn't I didn't feel like driving. >> He was tired. He was sleeping. >> No, she's >> All right, do you have a valid license? >> I don't think so. >> You don't think it's valid? >> You left it at the house or you don't have one? >> She was sleeping. >> I have the registration. >> Are you the registered owner of the vehicle? >> Yeah, I am. >> You are? >> He is. >> Okay, are you? >> I would have tried to you, but >> They wouldn't let you? >> I am. >> Okay. All right, I'm going to have you start I'm going to start with this window right here while you're getting the documents together. Okay, I'm just going to have you >> I'm going to do the driving. >> All right, uh so my partner's going to come over if you want to roll up driver side and >> So it sounds like just one window is tinted probably for the driver. Just a side note, you can apply to the DMV for medical exemptions. Say you've had a lot of skin cancer or something like that, you might be able to get darker tint on your side of the car. Just so you know. >> Registration card. >> It's 5% or I think they said. >> Can I look out for us? I'm not driving, man. She said. >> Looking for a deal. >> Listen, I'm just trying to get my documents right now. I I haven't I haven't made any kind of determination. You know, the reason why I stopped you is because of the tint. Once I get all the documentation, we can we can cross those as we as they come, okay? This is the insurance. All right. >> Why are you nervous? >> The back windows are >> Just because she got a license. >> You shaky? >> She got a license. >> How come you didn't you didn't drive? I mean, you know she didn't have a license. >> I was falling asleep and I we stopped at the store. I was like, man, I don't want to drive. >> Yeah, it's crazy. >> It's been a while. >> I don't know about that, man. >> This is kind of crazy. You have a licensed driver who could be driving, but you let the person without a license drive? >> How's it going? Hi, sorry to scare you. My name is Deputy Boswell of the Kern County Sheriff's Office. I'm with the K9 unit, okay? Got a few questions for you. Anything in the car shouldn't be in the car? Firearms, large knives, machetes, anything at all? any drugs of any kind, like cocaine, crack cocaine, heroin, hemp, methamphetamine, marijuana, or MDMA? Nothing at all in the car? >> Woo, I think he said that a few times. >> Okay, would you mind if I look? >> We're not I don't want anybody to look in the car. >> Okay, that's all right. I'm going to walk my dog around that side of the car, okay? Um is that window Can you roll that window up halfway up for me? I know the keys are over here. Here. All right, can you do it? >> Halfway up? >> Yeah, if you can. >> Don't give her the keys. >> I don't want him jumping in the car. >> Car, nothing, that's all. All right, thank you for your cooperation. >> And they will jump in the car. I had a K9 run around a car once and it jumped right in through the window and it actually happened to be the son of a local chief of police. >> Oh, I saw the hair about this. >> Awkward. No drugs in the car, but someone in the car earlier that had some. I don't know if people realize how strong a dog's nose is. They say it's, depending on the breed, up to 100,000 times more powerful than our sense of smell. Totally nuts. Oh, puppy saying hi to you. Um for all the wrong reasons. Hey, sexy pie. >> All right. May I have you step out of the car for me? You can come back here. Basically, my canine alerted to the odor of the car inside the vehicle, >> This is ridiculous. >> Is there anything in that car that shouldn't be in the car or anything that was in the car that shouldn't be in the car? >> No, and he didn't alert to anything cuz there's nothing in the car. >> So, canines alert in all different ways. It kind of depends on the dog and the handler. I've seen them like paw things, stick their nose in things, kind of bite at things, or even just sit down. It all depends on the situation and the dog. But, nothing at all? >> Okay, do you have anything on you? >> No. >> Okay, do you use drugs of any kind? >> No. >> No. Okay, your nose is growing. Okay, will you just sit right here for me? Yes, ma'am. Ooh, that looks promising. It looked like a infant sock. Something in there. >> So, in the glove compartment on the passenger side, there was this, and it was tied up in a ball, and inside of it, there's a stem and there's some cocaine. >> Cool. There you go. >> can see down in there. >> Yep. >> This is a broken stem. That with a stem. >> Hey, just so you know, just so you know, she's she's habitual, too. It's felonious DWLS. >> Oh, I didn't know that. >> It's she's habitual. It's it's from years ago, but it's still >> But, she never got it reinstated? >> No. >> Do you ever get it reinstated in the past? >> I think he's saying she's a habitual traffic offender, DWLS. I wasn't super familiar with that acronym, but it means driving while license suspended. So, this is not her first rodeo. >> All right, Miss Audrey. >> Yes. >> Um, for the being time, I'm going to have you turn around, um, put your hands up on the vehicle for me. >> Why is she getting arrested? >> Nobody's under arrest at this time, okay? >> Yeah, we are. >> You're just being detained, that's all. >> That's being arrested. >> It's not. >> Right now you're being detained. >> It's chronic. >> Okay. >> It's mine. It's all mine. >> Can I get a 12? >> It's not deep. >> We have a whiskey foxtrot and a whiskey mike secured at this time. >> Hey, reader reader reader Miranda real quick first. >> Good idea. They're in custody, read the Miranda just in case. You don't want to risk something getting thrown out in court because you didn't Mirandize. >> You got a So, there was a broken stem. 80s 40 slider in the coffee and 260. And there was a foil and narcotics inside. >> So, they know they have drugs. They know they're letting somebody drive who doesn't have a license. I'm guessing they know their tint is too dark. Why chance it? Why take any of those risks if you have illegal narcotics in your car? I don't get it. The woman from the couple was charged with driving without a license, possession of drug paraphernalia, possession of fentanyl, and driving without license plate habitual. She was sentenced to 4 months in jail, had her license suspended for 6 months, and received over $700 in fines and fees. And the man was charged with possession of manufacturing paraphernalia, permitting an authorized person to drive, introduction of contraband into restricted place, possession of drug paraphernalia, and possession of fentanyl. He was sentenced to 3 months in jail, had his license suspended for 6 months, and received over $700 in fines and fees. The man from the other case was charged with possession of drugs, aggravated battery on an officer, and resisting. Unfortunately, I was unable to find anything else about this case.
