She come pulled it out like that, and then she tried to like [ __ ] it right there, and then it jammed. I would never do it, but I mean he knows I have it with me on, you know, my person in my bag. >> She's a very sensitive person. A lot of things get to her very easily, very emotional. AKA unstable. Yeah, sure. Yeah, okay. Could be. So, I wanted the bullet out, and I wanted the magazine off of it. Okay. I really don't want to go to jail. Officers are called to a park after a woman gets mad at her husband and pulls a loaded gun on him in the car. Hey guys, what's going on tonight? A mess. A mess? I see that. We They had been down at McDonald's, come by, he was going to have dinner, and so we all went to dinner, and I don't know what pissed her off, but it it was so bad at dinner, she was so rude, I just told her that we were getting the food to go. I wasn't sitting there eating, and so she That made her mad, and we went back to my house, and literally they got in the car, but I just told her, I said, "I know you're mad at me, but don't drive like an idiot going home, you know, you're still cared about." And she said that she was very driving very erratically. That's why they apparently called me, said, "Can you come get me up here?" So. Okay. I just came to pick him up, but when we got up here, honestly, it wouldn't have escalated to this. We just kept telling her to give the gun up that was inside the vehicle, and she wouldn't hand it out, or they would have sat there and already talked about it, but I wouldn't allow them in the vehicle as long as there was a firearm in there. Okay. Who all was in the vehicle? Just me and her. Okay, so I live 5 minutes from here. >> Okay, so what what happened in the vehicle? Uh well, she wouldn't talk to me tonight, so what's wrong? Why are you so mad? And then she said it was because some waitress was too close to me at a restaurant, but it she was mad way before that, so I know that's not the case, right? So, she ended up getting mad because I asked, and pulled into someone's yard, and we probably sat there for 10 minutes just ignoring me saying, "Oh, I'm not going to leave till you get out." And I'm like, "Well, I'm not going to get out on the road. Bring me over to the park, and I'll get out." So, we drove over here, and I said, "So, are you going to talk to me now?" And then she said, "No, get out." And I said, "Well, this car is in my name. You can get out, and you can walk." And then that's when she pulled a gun out, and she was like, "No, you're going to get out." He like chambered it, but it jammed, right? And she said, "No, you're going to get out." I grabbed the gun, threw it in the floorboard, and then she ended up like driving erratically probably like she did a U-turn and kind of drove down here and going probably 40, I would say, which I think kind of too fast right here, right? So, I got her I like I grabbed her arm for her to slow down. She slowed down. I jumped out of the car, and I'm like, "No, I'm not going to get back in your car." That's when I called her, and she came over here, winded up driving over here. She was kind of sitting there. She kept calling me like, "Oh, I want to talk." I said, "I'm not going to talk till you throw the gun out of the car, and then we can talk." And that's kind of how that evolved. >> So, where did Do you know where you were at exactly whenever you pulled in someone's driveway? Well, it was in someone's yard. It was on this road right here. It was just like a couple houses down. Okay. Yeah. And whenever she pulled a gun out, what was your What was your reaction to that? >> No, I knew Other than taking it from her. In reality, I knew she wasn't going to do anything. I mean, I've been with her for long enough to know you're not going to do anything. You don't even know how to use a gun, but that's kind of my reaction. I was just like, "Okay." Grabbed it, threw it inside. Okay. Cuz like she didn't point it at me or anything. I guess just to kind of intimidate me to get out is kind of the the situation there. So. Got you. Um So, all because a waitress got close to you. Yes. So, she claims, but she told me that she was mad way before that, so. Mhm. Cuz she's dealing with some stuff with family, I guess, with her right now. And she's a very sensitive person. A lot of things get to her very easily, very emotional. Yeah. So. AKA unstable. Yeah, sure. Okay. Could be. Where what restaurant did y'all come from? Maynard's at the corner. Maynard's Up on Spout Springs, right across from Kroger and all. Spout Springs and Friendship. Okay. Is that where like the argument kind of sparked? There was no argument there. I mean, look But I didn't say anything to her at all. See, he didn't say anything >> at all. I never said anything to her at all even after leaving. I just asked her, "Why are you mad?" That's all I ever asked her. And she didn't tell you until No, I mean, I asked her at the table, too. >> on the drive back home. Yeah. I said, "You're not talking to me. Are you mad at me?" So, "I'm not mad at you." I said, "Well, then it's kind of rude to sit there and not talk to anybody while we're sitting here at dinner." All right, you guys just hang tight for me. Let me go talk to her real quick, okay? Okay. You may have heard there's three versions of every story, his side, her side, and the truth. Well, the officer Jamie will be recording her side, and it happens to be extremely different. >> doing, ma'am? I really don't know what to do. Why don't you just talk to me and see what what's going on tonight? Please, no. Sorry, Jamie. Yeah. So, what happened? I know y'all he was saying that y'all went to went to dinner and then things kind of escalated after that. So, what happened after that? So, I had pulled over on the side of the road. >> Uh-huh. I wanted to calm down, and he kept screaming. I just I don't We live up in Cleveland. Mhm. I don't want to drive 45 minutes angry. Okay. Uh that I mean, that could just be bad. And so, you know, he said, "Just go to the park." I said, "Go to the park." I said, just you know, "Get out so we could, you know, he could get out, he could take a breather, I could sit here or walk and take a breather." Mhm. And then I asked him if he would fix my gun cuz it was open. And he he freaked out. Like I was going to shoot him. Okay. So, why did Why You were driving? Yes. Why would you ask him to fix your gun while you're sitting here driving? We were parked over there. Okay. I It's not smart. I Yeah, that's That doesn't really make a whole lot of sense why y'all are in the midst of an argument and then you just pull out a gun and say, "Hey, can you fix my gun?" That doesn't make sense. Okay. So, He has a gun on him, too. Okay. That's >> But, I'm asking you what happened, okay? Cuz I'm already kind of got a gist of what happened, so I'm trying to get to the truth. I pulled my gun out. I was never never intended on shooting him. Okay. So, how did you pull it out? Like why did you pull it out? >> got it out of my bag. Okay. So, why did you pull it out? Because the whole can you fix my gun thing does not make sense. I went to go try to chamber it so I could get that bullet out. Mhm. And I couldn't and it jammed because I I mean, it's sitting there with There's a I mean, it's It's almost loaded. It has bullets in it and us fighting, I don't want that to happen. I would never do it, but I mean, he knows I have it with me on, you know, my person in my bag. Mhm. So, I wanted the bullet out and I wanted the magazine off of it. Okay. And it led to this and he called his mom. Do you think that was probably the best time to be doing all that? >> No. And I do stuff before I think. Okay. And he can even tell you that. How long have you How long y'all been together? 6 years. 6 years? Are y'all married? Yes. Okay. Do y'all have any kids? No? All right. So, whenever y'all got to the park and were y'all arguing a little bit more Did anything get physical at any point? Yes. He grabbed you? He actually left the park. I mean, it was a little bit ago, so it's probably faded, but he I actually I showed the other officer. Okay. I don't What? Anything happened to him? Yeah. >> But, you know, it would have just taken a 5-minute conversation. But, calling his mom just didn't help. And she's over here telling him what to do. Yeah. And what to say. And it just it's not helping. She's never liked me. She's always had it out. So, I I mean, she's going to say anything. Yeah. And I just want a simple conversation, just me and my husband. We're the ones that are married. Not us and her. Does that make sense? >> Yep, absolutely. I just want a conversation with him. Okay. 5 minutes and it would be resolved. Yeah. Then she brings up what happened at dinner. Because I probably took it a little too far at dinner. But, I was already going through stuff before. So, what happened at dinner? The waitress kept getting closer and closer to him. Mhm. And it's just like I'm already upset. And that just added it added to it. And I just kind of like burst. Got you. Are you going through any family issues or anything like that? My grandfather. Got you. So, he's not doing too good? He just got put in a nursing home. And I actually just got a bunch of family stuff that was his. So, that I mean, I'm going through that. Yeah, it just all piled up. I got you. And I'm not the type of person to just say every little thing. This is not the first argument we've had. I build it up and build up. And it just takes one thing. And it's always something small, and then I just burst. Yeah. And that's just how I am. Okay. And I've been trying to work on myself, but it takes time. Have you all ever tried marriage counseling? We were talking about that a few weeks ago. About doing it. I think that'd be a good idea. All right, just give me a couple minutes, okay? I'll be back with you, all right? I don't know what's going on right now, okay? I'm just trying to figure out what all transpired with that, okay? So, as of right now, you know Okay, but not saying that might change, but I'm just letting you know right now you're okay, okay? So, just relax. I'll be back with you in a few minutes, okay? I'd rather you not, since how you all were just in an argument, okay? When can I talk to him? Um whenever we're done with everything, okay? Do you know how long that'll be? >> I don't know. Okay. In Florida, for domestic disputes, typically someone has to go to jail. So, the officer dives a little deeper and analyzes the story once again, but this time with just plain old common sense. >> Um can I talk to you for a second? What's wrong? No, you're fine. So, she kind of gave me her side of the story. Yeah. Basically, she Y'all were getting in an argument cuz of the nurse was Or not the nurse, sorry. Just the waitress was getting too close to you, and that kind of made her upset even more. Y'all began to argue on your way home. Um she said y'all were leaving Cleveland, and she didn't want to argue the entire 45-minute drive all the way up, which is I understand. >> Okay. So, y'all pulled in here in the parking to kind of talk, I guess, and to kind of calm down. And she said first she told me that she pulled the gun out because she wanted you to fix it. That didn't make any sense. >> No. So, I told her to tell me the truth, and she actually said, "Well, I pulled the gun out because it was jammed, and I wanted to get the bullet out." So, I'm asking you, did that happen, or did she actually pull it out with intent to actually use it? I think I don't think she would have used it, but I think she pulled out for intimidation. Cuz it wasn't jammed. She tried to chamber and she jammed it afterwards. So. Yeah, it just didn't make a whole lot of sense with her. And and she she not pull into the park to talk about it cuz I tried to talk about it once we parked. I asked her, "Do you want to talk about it?" She said, "No, get the [ __ ] out." So. Did you ever at any point put your hands on her or anything? When she was driving down the road and I was scared she was going to crash, I kind of grabbed her arm. >> Okay. I was scared trying to get her to stop. Okay. Got you. Other than that, you know, I didn't do anything else other than that. Okay. How whenever she pulled the gun out, how did she pull it out? Did she like point it at the floor or did she point it like She kind of pulled it out in my direction. Yeah, she kind of pulled it out like that and then she tried to like [ __ ] it right there and then it jammed. Okay. What was she saying then when she did that? She wasn't saying anything. She didn't say anything. She wasn't talking about that. She didn't say get out or anything like that? Mhm. Okay. Kind of did and then after she's like, "You need to get out." And then that's when I just grabbed it. Straight over in the kind of like So she said get out as she was pulling it out? >> Well, after she uh jammed it, I guess, or or whatever. Okay. I mean so I don't think she would have done anything, honestly, knowing her, but maybe my perception's wrong on her, but I mean you never know. I mean she did say that y'all argue a lot. This isn't your first time that y'all argue and y'all been married for a while, so um I don't know if y'all might want to look into some marriage counseling or something. Mhm. I've mentioned it before. I don't know. I mean it's probably a possibility there. All righty. Well, go have a seat and I'll be with you in just a few minutes. Scratch. Simple assault at least. She told me that the waitress was getting closer to him at the restaurant. She got upset cuz she has a lot of other things on her mind right now. And it just was boiling over. So she flipped out on the way home here. They pulled into this park. What happened now? Uh they began to argue a little bit more and then she pulled the gun out. First she told me that she said she pulled the gun out and asked him to fix it. Which that didn't make absolutely no sense. So I was like, "Okay." I already kind of know the gist of the story, so tell me the truth. And then she recanted the story and said that um I pulled the gun out to try to unjam it. I was like, "Okay, that still doesn't make any sense." She said that What else did she say? Um she's like, um She's like, "I never I never I never was going to use it or anything like that." But he's all He stated that when they were sitting here arguing, she literally pulled the gun out and leaned it over and cocked it around into it or tried to at least, but jammed. And then she said that you need to get out. So that's 95, but Well, I asked her something real quick. Simple question. But she said that Yeah, I'm like, "How do you know it was jammed? Did you pull the trigger?" How do you know it was jammed? Why at that point? Just a simple I'm thinking a simple question. Well, she's like, "Well, he's over there saying that I don't think he ever She never intended to do it." I'm like, "Well, you don't You don't have to argue with You don't clear the gun on me. No, simple question. Look at her. I don't know. For some reason when both officers confront the woman, her story changes yet again. Hey Kaylin. Can you step out? >> so we can talk to you for a minute. Am I going to jail? No, I just want to talk to you for a second. Hold on. Yeah. So whenever you said you pulled the gun out, how do you know that it jammed? Well, I was going to pull it back so I could try to get it out. >> Uh-huh. And it got stuck. Okay. >> And so I I I wanted him to fix it. I asked him if he would fix it. Okay. So, the the thing that doesn't I don't quite understand is y'all are sitting here in an argument, okay? Yes. >> And then you pull a firearm out to unjam it. Why would you do that? I didn't want any bullets in it. Okay. >> In case anything were like were to happen if What were you thinking that was going to happen? He has a bad temper, too. Okay. I mean, he has guns. He's more familiar with guns. I'm not. I didn't grow up around guns. I don't even normally have my gun on me. Whose gun Whose gun is it? Is that yours? >> Mine. We went to Atlanta to see my grandfather in nursing home. Okay. So, I had it because I mean, you it you're going by Atlanta. Yeah. Otherwise, I never carry it on me. I never have my gun. So, can I just jump in here? I really don't even want it. I'm just going to be honest with you. Okay. All right. I don't believe it because if I go rob a place, you know what I'm going to tell the cops? It jammed. I just had the gun out. You pull the gun out. You don't just pull one out during an argument. All right. All right. We've seen this a thousand times. That's why I was asking you. It that doesn't That story doesn't make any sense because when you first told me you took it out to have him fix it, which you kind of recanted on that, and then you told me again that you pulled it out because you were trying to unjam it. That still doesn't make any sense. >> never going to hurt him. I mean, that may be the case, but you still took a firearm out and loaded it or cocked it back with the intent of doing something. I wanted the bullet out of the chamber. >> Okay, but that it was not a That was not the proper thing to do at that point in time, especially during an argument. Okay? >> Thinking back, I can see that, and I completely understand. Okay. All right. Just hang tight right here for me. Just going to ask What do you think, man? No, it doesn't. Simple assault. Reckless conduct. Let me read the code section on reckless conduct. The officer then reads into reckless conduct to see if it'll apply and moreover, if it can be combined with simple assault. >> Does this do reckless conduct? Reckless conduct? Yeah, because simple assault, he never stated that he was in fear of his life or anything like that. Well, he also told me stated to me he she pulled out to offend me. Yeah, she did intimidate so you do simple assault, too. Especially since she pulled it out, cocked it back for intimidation purposes and told him to get out of the car. I think with what you have logically telling him to get out of the car, he's like, "I'm not getting out of the car. I'm not here." And she pulls out the gun. That's intimidation to me. No, absolutely. I say we go to a bank. Give me money. We're not giving you money. Then I pull out a Give me money. You're not arresting me, are you? Yes, she's going to jail. Is there a way I could No, this is domestic violence. We don't have a choice. >> nothing I can do about that, then? Okay. She'll have her day in court. You can go to court with her and you can explain to the judge what all transpired, but based on what you're telling me and what she's telling me, what she's telling me doesn't make a whole lot of sense anyway. And you don't just pull a gun out in an argument with the intent of just unjamming it or cleaning it or whatever. That doesn't make any sense. I understand. She had the intent to use it if necessary and she's just trying to cover her tracks. And so, I've been doing this way too long to understand that. Okay? So she's going to be going to jail. We have to do this tonight, man, because I'm going to be honest, I'm I'm going to be honest with you. You You could have died tonight. Like what would have happened if the gun didn't jam? Do you think she would actually pull it out and would have used it if she got pissed off enough? Well, I mean, I guess you really don't ever really to but personally, knowing her, I don't think she would have, but I don't know. Exactly. People are sporadic, so yeah, I understand. But, um Hopefully you find love. You don't know. Any time you guys want. If you're doing this, man, I'm worried about your well-being in the future. Yeah, man, I'm good. Yeah, I just know she got a new job. I just got a new job, so I was hoping they'd come to this side. There is no amount of stress in the world that can excuse this. Okay. All right. I don't I've been We worked a lot of hours, we're barely home. Any of those times have we ever once wanted to pull over? Yeah, but I'm on her side. So, I don't want to hurt anybody. There's no excuse for it. Okay. I'm being honest. Okay. All right. Just hang tight over there. We'll be with you in just a minute, okay? Hey, Kaylee. Hello. Kaylee. Yeah. Come on out here for me. All right. Go ahead and turn around for me. Am I going to jail? >> Yep. All right, Jamie, bye. I love you. All right, bye. Bye. Can I get some blankets? Uh, no. Not right this moment. So, right now you're being placed under arrest for reckless conduct and simple assault, okay? All right. Is the vehicle in both y'all's names? Yeah. Okay. So, I guess he's going to take possession of your fire of the firearm and the vehicle, and you'll be going down to the Hall County Jail, okay? Um from there, that you'll have to see a judge cuz it's FVA charges. All right. Cuz this is a domestic situation. All right. I know he was trying to say that you know, there's anything that I can do. Unfortunately, not. It's mandated by the state. Okay. During an FVA situation, we have to take action for it. Can I at least say something to him? Uh, whether you not, because this has already escalated enough. Is he going to take my car to the house? Um I think that's where he's going. I'll double call confirm with that before we leave, okay? All right. All right, keep >> tell him that I'm sorry that I Yep. Well, I'll let him know, okay? Do you have anything on you? I don't think so. Okay. Officers then inform the woman on specific conditions she'll have to abide by. When would I see a judge? Uh you'll probably see a judge I don't think they do Sunday, so you'll probably see him Monday morning. Okay. Can he come get me out Monday? He's not going to be able to place your bond cuz it's F V charges, so you'll have to get a family member to come do it. Can you see if he can find someone? I can talk to him and see. What's cuz I don't have anybody. Okay. All right. Just have a seat for me. Need to lean up just a little bit. I just want to make sure your cuffs are not tightening up. Oh, yeah. That one is. Yeah, just tell him my left hand can be safe. Okay. It's okay. I mean, can he come with someone Monday to get me out? He cannot bond you out now. No. But he couldn't even be with somebody? So, you're going to have a you're going to have bond conditions, okay? Because of this, you're going to have a no probably a no violent contact order or a no contact or no contact order. And if no contact order is in place, then he's going to have to go stay somewhere or you're going to have to stay somewhere for the time being until y'all go to court of this. So, but if it's a no violent contact order, then y'all will be able to be with each other one another. You just can't have any violent acts with each other.
