So, Catherine, I forgot to advise you. You are being audio video recorded now. We got these fancy cameras here that uh have that. So, Catherine, I need you to speak. Listen to look at me for a second. Look at me. Please look at me. There's alcoholic beverages in your car. Okay. There's empty containers in your car. My partner sell them like uh are are are they like like uh like soldiers? I don't know what they are. Okay. I just had my 20 my golden birthday was on February 27th. They're they're literally from that. You you can see it's on my birthday. Catherine, I've literally been out of town since then. Okay, Catherine, you got pictures on that. You want to cut me a cup? Catherine, would you be willing to do a voluntary field sobriety test? Huh? Honestly, I just want to die right now. That's not going to happen. Okay, Catherine, look at me. Catherine, no. No matter how good you are, it doesn't matter, does it? Would you be Listen to me. Would you be willing to do voluntary field sobriety tests? I'm anemic. Do you know what that's like? No, I don't. You get dizzy just from [ __ ] being on your periods. So, we can do that. But they're voluntary. You don't have to if you don't want to. Would you like to do voluntary filter body test? I would die. Okay. Give me a PBT. Catherine. Catherine, would you be willing to blow in a portable breath test? So, I know that I'm not blowing in anything. Okay. And you're not going to do voluntary pills or body test either? And I would, but it's it's just going to [ __ ] me over more. Okay. They're voluntary. If you don't want to do them, I'm not going to for you. You're not obligated to do them, but I would like to do it to take the the PBT so I know I'm not sending an impaired driver back away from here. Yeah. You be willing to do that? Yeah. Okay. Thank you. These guys anymore? No, they clearly she she's good. Okay. Thank you. See you. So, it sounds like you're volunteering to provide a PBT, correct, ma'am? Yes. Okay, perfect. I didn't say I'm blowing anything. Oh, that's what I asked you. No, I said I'll do a test. I'm not blowing anything. The voluntary field sobriety test was walk and turn, all that good stuff. I told you I just drank alcohol just before doing this. I'm not doing I'm not doing that. Okay. My understanding was you didn't want to do the voluntary fuel or body test, but you would blow in that. Are you declining? That was the opposite of what I said. So, you will do the test. Yeah, but I will not blow in that. That is what I said. Okay, that's fine. I can do it. You can I can do it. You sure? I can do it, but you're taking the arrest. All right. What do you mean taking the arrest? Why are you laughing? If there if we need to go down that route, okay, that's all that. So So if I don't take it, there's no arrest. I just go through the process. We have to make we have to make a decision. Okay. Cuz right now there's there is the odor of alcohol emitting from your breast. You told me that you drank before this. There's empty bottles, empty cans in your car and not and you crashed. Don't let the word arrest scare you. So that that's on me. Can you talk to someone that is that has been through all this? Yes. Thank you. Okay. Let me talk to him if you want to keep working this real quick. So, okay. What's your name, sir? I'm John. How do you know her? She's good friends. Okay. Where are you coming from? We were just having lunch. It's 8:20. I'm lunch. Yeah. Okay. She told us, well, I watched her crash. I watched her make a U-turn and crash into that tree. I watched it, too, so with that being said, She told us that she drank before. She has drank tonight. There's there's empty containers in the car. Okay. And she she caused a collision, single vehicle collision. So we right now we're doing an investigation for DUI. Okay. So that that's where we're at right now. Okay. Yeah. So is there anything you can add to this investigation? Turn around. Uh she just asked me to follow her to work because she was afraid somebody was going to be there and she wasn't. Okay. Okay. Okay. In the time being, you give us a minute. Let let us let us follow me when I did a U-turn and it gave me like we're going to be conducting an investigation right now. So, please give us a little bit of space, a little bit of time. Okay. So, if you can just kind of stand kind of a little, you can watch. I don't care if you watch. I don't mind you watching, but we do need you guys to kind of not impede on this investigation, distraction, anything of that nature. Kind of just I was asked to follow her to work because she was worried about somebody following her and she just said she felt like somebody was following her. Okay. So, and we we'll investigate all of that, but right now we're conducting an investigation for DUI. So, I need you to kind of just step to the side, not distract her, not get in her way, please. And thank you. You see my pen? I just Okay. And are you wearing any contacts right now? No issues with your eyes. So, uh I I have a um a little flash. I'm sorry. Stigmatism. A stigmatism. Okay. But nothing that would prevent you from doing an eye test. Perfect. So, perfect. Arms and legs together. Taking my pen. Once again, eyes only. Don't move your head or neck. All right. my I don't want the dog. Is there a dog in there? Do you have any fixation? Oh, robbery in Redmond. Huh? A robbery in Redmond. Do they need more? No. Yeah, that dog jump I don't know. I think it jumped out the window. She left the car open, but it just started running. I know. I tried to get somebody this so I could take over. I appreciate it. But I was I literally pulled out my stuff. I was like, "Let's do it then." And then I was like, "I got it." I was like, "Okay." So, here's what we're going to do. I have the uh the dog if you want to come by for me. Your arms and legs on your side standing straight just like you were. Okay. So, you've got a line in front of you. I want you to put your left foot on that line. All right. Using heel to toe contact, you're going to put your right foot directly in front of your left foot, just like this, like me. I'm demonstrating for you. So, right foot in front of your left foot. That's right here. Okay, that's cool. Okay, perfect. That's the starting position. Don't move until I tell you to start. Do you understand? Yeah. Okay, so look at me now. I'm going to demonstrate and explain the test to you. Okay, so here's what you're going to do. From this position, you're going to take nine steps, heel to toe contact, looking down your feet. You're going to count out loud. Okay, I'm going to show you. It's going to look like this. One, two, three. I'm going to do three. You're going to do nine. Okay, once you get to your ninth step, you're going to do a series of small turns just like this. Keep your foot on that line. You're going to take three more steps. Sorry, nine more steps. One, two. I did not. Three. You're going to do nine. Okay. So, once again, while you're doing the test, keep your arms up. Go back to starting position, please. Hey, buddy. Hey, Zena. Hey, puppy. Hey girl. Where's that pole? Come here. Where is she? Behind you. Hey, girl. Get out of the way. Zena, come here. Baby, come here. Zena. Zena. Hey girl, stay off the road. I don't give a [ __ ] I give a [ __ ] Don't touch me. I'm You're not going back on the roadway. I'm not. I'm giving I'm I'm I'm trying to put my dog in the car. She's running away right now. Hang tight for a second. She will let me let her in the car. You're not going to go out into the roadway. Okay. I give a [ __ ] about my dog more than you. I do too. But you're not going back into the roadway. No, you don't. Just let me get my dog. Please. We are going to work through getting dog. JUST GET OUT OF THE WAY. SHE WILL come to me. GET OUT OF THE WAY. NO, you can stay here or you're not going in the road. Come here. Zena, can you just get out of the way then? Get out of the way. As long as you DO NOT GO. ALMOST IN THE WAY. SHE'S IN. LET ME OPEN. SHE'S IN. OH, YEAH. YEAH, she's in the car. She was in the [ __ ] car when I pulled over. She's in. Then let me [ __ ] put Let me shut the windows then. Your friend said the dog is then shut the windows. I'll I'll let him know. Okay. Are you good there? Yeah. Okay. Do the windows roll up at all? Uh, it probably needs the key and the ignition to roll up cuz it's an automatic. Okay. Can you hang tight with the dog? I'm okay. Thank you. I just want to make sure he's good. Hey, what was your name, dude? I'm John. I'm just going to restart all the instructions again. Okay, that's fine. From the top one more time. Okay, so left foot on that line. Your right foot, your right foot, Gina, sorry, Catherine, directly in front of your left foot. Heel to toe contact. Okay. Arms down at your side. Get them like me right in front of the other heel toe. Okay. This is the starting position. Yeah. I'm I'm telling you I did my leg. This is not normal. This is not normal. So like can you kind of [ __ ] run it? Sure. [ __ ] Okay. I'm stand on your side. Don't start until I tell you to start. You understand? Yeah. Okay. So stay in this position. Okay. So when you're doing this test, you're going to take nine heel to toe steps looking down on your feet and counting out loud. Okay. Look at me. I'm going to show you. I want to give you the best. We're good here. If you guys want to clear out, we have a lot too many here. All right. On that imaginary line, sorry, this line right here. Continue to take nine more steps. You're going to do a series of small turns. Take nine more steps. Okay, Catherine. 1 2 3 so on and so forth until you get to nine. All right, so one more time. Keep your arms down at your spine. Look down at your feet. Count out loud. And once you start, do not stop. Do you understand? Yeah. Okay. Go ahead. Begin the test. What's going on over there? Catherine, do the test. 1 2 4 5 6 7 8 9 Is that it? Oh, did I instruct you to test? 9 10 step. Are you done with the testing? Yes. Okay. You got one more test. Okay. It's called the one leg stand. All right. So, one thing you need to show your test. We're almost done. All right. Catherine. I'm sorry. I can't I want her away from my [ __ ] car. I cannot focus until she's away from me. John is with your dog. I don't care. I want her away. She said you my dog was fine and she lied. I want my dog secured and I want her. I cannot [ __ ] focus. She's right here. Would you like to continue with this last portion of the test, Catherine? Yes. Okay. This leg, this portion is called the one leg stand. So, once again, legs together, arms out at your side. Okay. Explain it and demonstrate the test. Do we have a like an evidence bag or something we can take to the window? I think eventually if we do go 105 with her, we'll let him handle the dog and let him take it. Um, I'm thinking I haven't been watching fields. I'm going to mute the point. For some unknown reason, officers muted their body cameras for 30 seconds and then turned them back on. Uh, I'm going to deal with him after we can deal with her. Please, put your hands behind your back. You're under arrest for DUI. Yeah, I asked you guys not to be right there. Why can't they have a a simple test where you guys were not there? Okay. So, if I would have done this, I would have come to you live. No, that's not how that works. Basically, I was just trying to make sure that you were safe to drive when you got in the car accident. Okay. Trust me, Jerry. You told me multiple times you wanted to do it. I just asked for them not to be in the line of sight because I kept crying. Okay. We just I need my partners here around. Okay. No, that's fine. I just I kept looking at them. Sure. And I kept worrying about my dog. So, we're we're done arguing. We need to do our the rest of our process over here. Okay. I understand. Where's I can use transport. Okay. I'm going to We're going to set let's just put away talk about us real quick. Left side. Okay. Please, actually, why don't you do the transport and the search? I'll take the TA portion of it. Does that work? Since she's a girl, you do the search and the transport and you want me to run the BAC? Yeah. Okay. Wait. Want me to run the BC? No. No. I'll do it. Oh, okay. Yeah, he does. Wait a minute. Yeah, cuz you got to get back here. Laughing right now. No, we're just discussing. It's not funny. No, this is Let's just uh I can transport her. Actually, I'll take her. I'll take her cuz I did fields. I'll do BC with her. Does that make sense? Jo's going to search her real quick. Okay. So, I need you stand for me like this. Wider. So, I'm searching you. Okay. You need Actually, you know what? I'll I'll take I'll take the whole I'll do the TA portion and wait for the tow and do all that stuff and I write you the sub for what I said. I'll do this whole thing. Yeah. Okay. Motion portion to be mine. And I'll send you that sub. All right. Stay there. Okay. Check your accessory with back of my hand. Same thing. I'm going to check your chest area with the back of my hand. Really? You guys didn't let me know before you made jokes. I promise you we were not making a joke. You guys kept laughing. It was [ __ ] up about our own instance, our own mis. You guys should not be laughing. I've done crying scene cleanup. There's no reason for you to be laughing while you're doing a [ __ ] arrest. I've never been more embarrassed in my life and you have no idea what's going on. I had someone following me home. I should not have been driving. I just wanted my car home and I [ __ ] up. Okay. Are you with the back of my hand? Yeah. I'm going to kill myself after this. Let's not do that. What's the point? I've been a good girl my entire life for this. You know what? We want to put you in the seat belt for your security. Okay. So, either I'm going to go over there and put you in the seat belt. Are you going to be cooperative? You're under arrest. I'm I'm [ __ ] tomorrow if I don't. Right. I I can't answer questions like that. I can only read this to you again. That's not going to [ __ ] do anything different. I didn't get my license for a year because I was [ __ ] held back by my m like I was So, Catherine, let me read this part to you then. Okay. You are now advised that you have the right to refuse and that if you refuse, your driver's license, permit, or privilege to drive will be revoked or denied by the Department of Licensing for at least one year. Okay. Okay. So, how long if it says that I'm drunk, how long is it as my license denied? So, you have you're going to get a copy of a do hearing paperwork. Okay. So, what how it works is you'll contact the department of licensing. There'll be a hearing and you can apply to get your license back. Okay. So, m no matter when I lose my license, not necessarily. I I I can only read this to you again. I you're the questions that you're asking. I wish I could answer for you, but I can only read this to you again. Does that make sense? That being said, you can talk to a lawyer and he can adise me. You have a lawyer? Yeah. I'd like a lawyer. Okay. I will make a phone call for you and then I'll step out. You'll have a chance to talk to the lawyer. Okay. Yeah. Okay. Am I going to get a lawyer tonight or [snorts] Do you know? Hang on a second. I can call. You're going to be on the phone with the lawyer. Do you guys have the updated information for the lawyer? Cuz didn't that change recently? Okay. So, the test is really simple. And you need to take a deep breath like you're about to blow up a balloon and continue blowing hard until I tell you to stop. Okay? You'll hear a beep as it's going on. Just keep going until I tell you to stop. Do you understand? Okay. Okay. Go ahead and grab the tube. Big big breath and blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. It has to like interpret the results. So, it takes a little bit. M but all things consider I appreciate you uh you know being cooperative. [snorts] [snorts] Mhm. [snorts] Heat. Heat. All right, one more time. So, do the same thing you dig. Big, big, deep breath like you're blowing balloon. Blow hard until I tell you to stop. So, the the machine has to think. You're going to get a copy of your results. So, I'm going to get one and you're going to get one. Okay. I'll let you know where you're at. [music] How old is your kiddo? Well, my mother is about 12. How old is she or her? Her son is seven. Seven. [snorts] Are you close with your mom? I'm not supposed to answer any of your questions. So, like I said, we we what we do we do the criminal piece. Okay. But there's also the DO piece, the Department of Licensing piece. Okay. So, I'm just going to read this to you. Now, I need to get a signature from you. This is your notice that your Department of Licensing intends to suspend, revoke, or deny your license, permit, or privilege to drive. You have the right to request a formal hearing to contest the suspension or revocation of your driving privilege. The hearing will be conducted according to chapter 308-101 of the WAC. Your request must be postmarked within seven days of the arrest or within 7 days of the date the notice is given. If your request is not made within this time frame, you have waved your right to a hearing. Okay? So, I'll let you read everything else. All right? So, essentially, that's how to get a hearing so you can get your license to drive back. All right. Was I going to get that no matter what I blew? You were always going to get that. Okay. So now that I've given that to you, I need your signature here. This just means I gave you this. Okay. Driver's hearing request information was given to the arrest arrested person. All right.
