today we will look at some interesting cases of corrupt cop on December 3rd 2021 officers Teddy Dyer Candace Miller and Sergeant David Myrick of the East Ridge Police Department responded to a wellchild check at Haley sherrard's residence finding Haley's mother Ang sherard and her son Devon in a vehicle officer dire approaching from the right passenger side hello hey what's up hey do you put your hands on officer Dyer claimed the right to run the vehicle's tags and conduct a search citing the smell of marijuana despite Tennessee's lack of marijuana legalization legal precedents supported the idea that the odor alone provided probable cause for a warrantless vehicle search courts consistently ruled that checking license plates in a police database did not violate the Fourth Amendment as there is no reasonable expectation of privacy in license plate numbers therefore officer Dyer's action of running Miss sherrard's plates would likely be deemed constitutionally sound after she was handcuffed officer Simmons upon Miss sherrard's struggle to comply Drive stunned her with a taser applying the fourth amendment's reasonableness standard Miss sherard May argue excessive force particularly during the tasering when compliance was challenging the ambiguous nature of the initial arrest raises questions about the proportionality of force used and actions such as pulling no illegal substances a well child check confirmed the child's well-being Miss sherard was transported to the hospital medically cleared and charged with disorderly conduct and resisting arrest charges against Angel and Devon were dismissed on July 12th 2022 in the lawsuit filed the shards reached a settlement with East Ridge on September 21st 2023 the settlement amount for the adults remains undisclosed due to Tennessee laws Miss chard's minor daughter received a $110,000 settlement officer Simmons who was terminated for use of force and uncivil behavior later joined the Bradley County Sheriff's Office but resigned in May 2023 for undisclosed reasons no public disciplinary action has been reported for the other officers involved in the chard's encounter on March 8th 2023 an officer from the Jackson Police Department on patrol observed a vehicle with a broken tail light pull into a store parking lot the officer apprehended the vehicle and activated his police lights as it pulled up behind the driver Mr Harrison who was parked and walking toward the store entrance the driver Mr Harrison was not aware of the police when he entered the parking lot so he did not notice and went inside to shop when he came out he was met with an unexpected sight keep backing your car man hey back your car get back your car right now no traffic stop my car was stopped and parked car off an unusual traffic stop to Mr Harrison being forcefully restrained and handcuffed notably when the officer called for backup another officer released a Suspect with a suspended license during a separate stop in retrospect the officer's actions seemed disproportionate rather than informing Mr Harrison about his broken tail light and letting him go or issuing a citation the officer pursued and restrained him in a store despite Mr Harrison's possible overreaction it doesn't justify the excessive use of force by the three officers involved especially considering he showed no resistance when restrained on the ground put you on your side buddy okay it'll help you out why am I in cuff and I'm not arrested I I I wasn't why am I being arrested I'm supposed to go to work to take care of my according to the Jackson Police Department's use of force policy officers have the privilege to use Force reasonably necessary for a lawful arrest and to avoid actions that could result in death or great bodily harm unless there is no alternative to assess the reasonableness of Force officers must consider three questions one the seriousness of the alleged offense two whether the suspect poses an imminent threat to others and three whether the suspect is actively resisting or attempting to evade arrest given these criteria it seems unnecessary necessary in the circumstances described to attempts to obtain permission to search his vehicle being unsuccessful they subsequently requested a K9 unit for assistance it's crucial to note that in order to search a car officers typically require probable cause for a crime Beyond a traffic violation or the driver's consent extending a legal traffic stop for a dog sniff is considered constitutional unless the police have Reasonable Suspicion of a crime in this case the officers now claim Reasonable Suspicion based on the alleged odor of marijuana justifying the use of a K9 unit for a search there's weed in it Swit your sweet was released from the hospital and subsequently booked in jail on misdemeanor charges including resisting and obstructing an officer disorderly conduct and cited for non-registration of a vehicle possession of THC and parking in a handicap space his cash bo bond has been set at $250 of course there were moments when Mr Harrison overreacted we can't rule that out and yet the behavior of the police was as it should be but at the very beginning of the incident a verbal warning or a ticket could have been given and the matter closed instead he was pursued like a murder suspect and arrested
