on August 25th 2022 Eartha starh Hills sat in her white van outside a school waiting to exchange empty goat milk bottles with a substitute teacher despite having permission to be there officer Amanda winters of the Florence City Police Department found the parked van suspicious after checking the license plates she approached Miss Hills camer record started okay no rush Break Free can you copy a plate please it's the Arizona plate Victor Nora Tom Adam Sam Tom Charles hello it's officer Winters how are you guys doing good I'm good hey so why what brings you out here just making them exchange with go ahead the lady here what lady goat milk goat milk okay um so I was I'm officer Amanda Winters I'm the school resource officer um the principal out told me that you guys were down there waiting to go through the cones and then you guys came back up here um right we're just trying to get here to this car okay so who is meeting you guys here do you know she worked here at the school and she left us milk officer Winters appeared cooperative and non-confrontational yet her questioning of Miss Hills and the other occupant was notably excessive although the van occupants answered without reluctance it's important to recognize their right to remain silent as stated by the American civil liberties Union individuals are not obligated to speak to law enforcement officers and they can walk away if they are not detained arrested or in jail despite Miss Hills not being detained by Officer Winters the situation escalated as the officer continued questioning potentially compromising the individual's rights okay do you guys have your ID cards on you no we don't have such things you don't have ID cards what's your name that's no one's business but my own okay so in the state of Colorado if an officer is contacting you for a law enforcement reason and I'm here for that then you are required to give the ID if not it's obstructing color of all you don't operate that okay are you an American we don't have any obligation to show anyone okay but you understand that it's a it's a charge right like obstructing a charge a bill for money that people give to other people okay I'm not going to play semantics with you either you have your ID you're going to give me that information or you're going to go in handcuffs that's it so that's a threat it's not a threat it's called auth to tell anybody that when St no harm step outex do you need to step it up please Frank to can you com as well come out no I'm a three being I don't answer questions cause and purpose uh excuse me but that's trespassing it isn't trespassing step out is trespassing step out no this is you have no Authority you're operating under color of law which is Title 18 fraud I don't know what you're talking about but in Colorado this is the law that we have impersonating an officer under color of law step out no okay so what do you no who am I injuring what is your cause of action in the state of Colorado you have to tell me what your name is show me the law that show that uh that says I have to over here Fel member of the state of Colorado or that Colorado even exists okay come out under threatened arrest I can offer this but are you threatening us no but if you don't want to give me your information then you're going to go in cuffs and then I'll no no one has any you can't be hanging out in front of a school and not tell me who you are officer Winters persistently attempted to compel Miss Hills to provide identification and subsequently ordered her to exit her vehicle she asserted her legal authority to demand ID insisting Miss Hills comply under the threat of arrest for obstruction officer Winters cited Colorado stop and identify laws stating they require showing ID during traffic stops or when reasonably suspected of criminal activities however it's crucial to note that officer Winters lacked Reasonable Suspicion for detainment as Miss Hills showed no signs of criminal Behavior in this encounter Miss Hills was essentially unlawfully detained rendering the demand for ID not legally Justified consequently Miss Hills was not obligated to provide identification hanging out in front of a school that's his ID we're not hanging either you come out or I'm going to pull you out I don't follow milary orders and if threat I am not in the military all right out do not touch me do not not assault me either you come out or you're going to be tased immediately IM I'm not going to fight with you come out or you will be tased Frank to you need to step it up one more time ma'am then come out of this car I am not going to play this game either you get out or you come out I have one a teaser Point she doesn't want to come out of this car if you're a pce officer then force and under threat and under duress you are operating under color of title 18 fraud section 2172 go you have no authority to to cause you will be sued officer Winters first attempted to physically remove Miss Hills from her vehicle and when unsuccessful Drew her taser aiming it at Miss Hills while ordering her to exit this use of force may be questionable under Colorado statutes despite Miss Hills being detained not under arrest officer Winters continued the arrival of a Second Officer didn't change the situation officer Winters briefed supervisors who despite initial uncertainty allowed allowed her to proceed with her actions okay let go let's go over there okay this is your wife's yep freak I'm we have that female detained right now what's going on so Mindy said the van was parked down there and he said we're waiting to come by and she goes this is going to be close for like an hour hour or so and then she in front of those cones down there um by where the kids are there's kids out here playing he's parked here in an out ofate van with the door open facing the kids okay um and then I'm like well who are you here to meet they were supposed to meet somebody here for goat milk and I was like okay well I'm here to find out like who you are and what you're doing and why you're here I'm introduced myself and she didn't want to uh come she want to give me her name she started saying her Title 18 stuff which doesn't even apply um I said under identify herself no she refused to give me her name okay and I said well you understand that if you don't give me your name it's obstruction like Colorado state law is you have to give me your information when you're being contacted for a law enforcement reason she still wouldn't give me her name and I said step out and she said no um and then I said either you step out or she the or she's a driver no she was in the passenger seat and she didn't want to step out so I told her I called for cover um I told Felix to Stu it up and he didn't want to she still didn't want to come out and then she wanted to pull away and try to fight me so I pulled my teaser and turned it on and said either you come out or I will tease you okay and then Felix got here and we were able to I reached in I grabbed her and I pulled her out okay so the I'm just trying to she under the one that was no they were both sitting on the side he was cooperative and she wasn't he was like if you're going to threaten me here's my ID um there was no threat I just told them what the law said okay and so here we are this point uh I'll probably try to find out her information and run them until yeah um but I might charge her with obstruction like can't and then to refuse to get out of your car and then to passively resist me so I mean I haven't run him yet hand you will not predict that your handcuffs your handcuffs are under now my officer Winters then absurdly accused Miss Hills of attempting to abduct children claiming suspicion due to the van being parked in front of the school with children in the playground this accusation appeared to be another UNF found an excuse to rationalize the unjust arrest now my partner's going to talk an assault either you're going to give me your here's the deal you're either going to give me your name or you're not either way you are under arrest because you're going to be charged with resisting and obstruction in the state of Colorado you are required to give me that information not only that you refuse to get out of your car even after I asked politely on top of that order I'm not stop talking it is my turn now other than that you're parked in front of a school children are on the playground and then you don't want to tell me who you are which makes me think that you're here to abduct children regardless of whether you're here for goat milk or not so regardless of whether or not you give me your name you are going to jail you're just going to assault a peaceful person no I'm not here walk back to walk back to my car no we're not going to walk we're past that I'll show you we're past that I'm show you my identification I am past that no it's not too late I am past that no righteous very resistive at that point so H he said if you're going to threaten me which there's no threat okay I just explained this Colorado state law then he he gave me me his ID um and then I started fighting with her and obviously I called for Felix to speed up because I have him right there and her right there and and then a dog in there too so um do you want me to take you in or you want to talk to the school what do you want U if you don't mind transporting her I'll I'll talk to the school if that's okay um and then what do you want to charge her with uh obstruction and resisting is is he clear to go he is clear to go so I'm going to talk to him um he cannot stay here this is this is a security issue is the vehicle come back with the same band and all that vehicle fre come uh what did you say about the vehicle ma'am I'm sorry OBU obstruction and resisting I'll do the custody you wanted to for you up there that c me thank you very much ma'am let him know I'm in rout with the okay um said to let him know that the jail she's very um verbally non compliance okay B okay will you hey Felix um I'll let them know and then that's the case number and stuff um and instruction and what El resisting resis got never mind I got got okay okay Mr Haley I not Towing your vehicle let me grab that then do you want to keep it for her okay I'm going stve off with her things on the top are too tight you want to loose them loosen them up no no no if she's going to resist and she's going to do that no following this officer Winter's animosity towards Miss Hills became evident when another officer informed her of Miss Hill's complaint about tight handcuffs officer Winters callously responded stating she would not loosen them justifying it by claiming that Miss Hills had resisted prior to the detainment police officers have a duty to use Force including handcuffs reasonably while Colorado lacks a specific statute on loosening handcuffs excessive force leading to unnecessary pain can violate constitutional rights officer Winters refused to adjust tight handcuffs despite complaints citing prior resistance she allowed the second occupant to leave but insisted on Miss hills's mandatory compliance with questionable commands that's that's not an issue the Jail's not that far 541 okay these are her her necklace and her Vape give those to you okay this of that visits card and your case number she's going to be taken to the Fremont County Sheriff's Department in the Detention Center in Kenyon City no it's 136 Justice Center Road in Canyon City it's not that far it's just the next town over okay um in this again in the state of Colorado if you're being contacted for a law enforcement reason you cannot refuse to give us your identification that is your name your first and last name and your date of birth that was it um and if a police officer tells you to get out of your vehicle you cannot refuse okay uh if you have any other questions that okay ultimately Miss Hills was taking into the county jail booked and charged with obstruction and resisting arrest the situation worsened when she was held in prison for 15 days without apparent reason the court later dismissed the case against her as of the date of this recording Miss Hills plans to file a civil lawsuit against the police department and the involved officers
