police officers exist to ensure the peace and security of the public but some of them become corrupt over time as a result of the high Powers they are given and turn against the very people they are tasked with protecting today we will look at some of these cops on September 3rd 2023 fuchia County Sheriff's Office deputies claim to have observed a speeding vehicle running through two stop signs during Patrol Duty they initiated a Pursuit With Sirens alleging the driver an active military personnel was fleeing at over 70 mph however a review of body cam footage contradicts this showing the deputies were driving at 35 to 40 mph Additionally the computer AED dispatch report revealed no record of the vehicle fleeing this raises questions about the depuy's credibility and suggests misconduct before they even made contact with the driver put off the brake roll down your windows roll down your windows all the way roll down your windows all the way what's wrong with you my door in a matter of minutes the driver was placed in the back of a patrol vehicle deputies swiftly escalated the situation ordering him to roll down Windows and forcefully opening the passenger side door they collectively demanded him to exit the vehicle without explaining the reason for the stop until after handcuffing while officers aren't obligated to disclose the reason for a stop their aggressive approach seemed geared towards unnecessary escalation violating the driver's constitutional rights particularly by opening the door without permission occurred without meeting the necessary exceptions under the Fourth Amendment notably the Hot Pursuit exception was incorrectly applied L people act like this shit's award did you hear what he said he's like hey what on the window the rest I don't have to like who are you didn't run through two stop signs in an Alleyway why the hell do we have to go 75 M hours down the alleyway we were like right behind him yeah I don't know how he was doing the math didn't do that right and it's not deeply suspicious that he took the alleyway and he gunned it right Works no there it is Sig all right uh you got your gloves on so go ahead and make it safe pop the mag on it going pop the mag on it there you go all right now pull it out try not to index me and then make it safe right like the side to the rear going teletype tell me you have a SE number for a firearm did you me he didn't provide me anything I think that's what he was doing CU I saw him put his hands in here he was he was putting the gun in probably [ __ ] my glove ripped yeah here's his IDE so you can tell one out of Florida by number and then the uh that you need to your number deputies conducted an extensive search of the vehicle uncovering a legally owned firearm in the process despite lacking the driver's consent and having no probable cause related to the traffic violation that prompted the stop the deputies assumed the firearm was illegally possessed this unlawful search constitutes a violation of the Fourth Amendment of the United States Constitution I don't you have to your what's your service did and I did no no no that's not how it work so you turned on the light in mid right before the curve I don't want to be on the he ran two stop signs in front of us drove a good distance at a high rate of speed stopped had furtive movement towards the center console found the gun in the center console but he's probably able to have it but he was hostile with him only cracked the window ha told him to roll it down open the door I need you to step out of the vehicle because him you're not allow we as to step out again he refused I had to reach in to undo his seat belt and then we had to get him out of the car fine but you have no right to open my door like that and you have to get out okay and I would get out but he opened my door before I even before even say anything I was trying to ask what you guys you said you're reserved I'm reserved okay you did you did six years I'm no I'm still in watching so what's this cuz he wouldn't he wouldn't comply with any of our commands we told him to undo seat belt and step out of the car you guys to take him out we had so I had to I had to reach in undo his seat belt from the passenger side and then I don't know if he gave youall any grief no not really once once the seat belt was off he he came out he he tined out but he wasn't he wasn't like fcking or doing anything 24 seconds that's the time that it took this man to stop his car but we lit him up way back there yeah and he he kept going I thought I thought I thought he was going to take off like you know they do that like that hesitate and then oh that's right I do have a key in the car and then they punch it cuz I turned on back there I was like oh he's not stopping yeah there was no break it was nice that you were with us well I saw it too that's what I wanted to do was to see if it would do that burn those stop signs right there come outch and then shoot out I was like let me see and then I saw he did yeah he burned both of them his theory is like I didn't see any lights behind me I made two complete stops like there's no way no way that's why we turned down the alley cuz was like if you didn't go into the gas station I mean he went the alley to shed us so we turned and we and he was he was well he went down the alley to skip the light cuz he lives right here so he probably does that oh that's that's fine but then he but then he burn but he's driving fast as [ __ ] and burns the stop signs which which looks which looks suspicious that what is it 131 at this point the police officers who explained the situation to their supervisors who arrived at the scene emphasized that the driver was giving them a hard time and was not consilio however according to the body camera footage the police officers were the ones who caused difficulties and escalated the incident the fact that the driver opened his window a little does not justify the attitude of the police officers moreover there was no chase and the driver did not run away from the police as the police claim you're you seem like a legit dude leg well let me let me explain this to you when the officers are asking you to roll down your window roll your window I I did roll down my window he cracked it I can see how far down it is the uh dude's on the pastor side he's like hey man I need you to roll IR your window I didn't hear him cuz my window wasn't wasn't on that side right yeah why you open the door so you can see you I guess you were moving around inside or something I wasn't moving around but I moved to point at him to tell him that he wasn't allowed to open my door like that all right you got remember we don't always deal with the nicest people all right some things we do that may not look normal to you we end up doing because it's officer safety stuff the um I don't want them to arrest you you're in nursing school right yes you're about to get out right uh maybe we don't I'm um I can't I can't help it sir um the the weapon is back where it was the mag is in the bag where the other magazine were um my C yes although the driver was released with a verbal warning and did not receive any punishment the fact that police officers de-escalated at the end of the incident does not negate the fact that they violated his constitutional rights and detained him for the wrong reasons it is unclear whether the driver has initiated legal proceedings it is clear from this video that there is nothing more dangerous than a coward with authority ego and guns if you think this incident is bad you haven't seen anything yet let's move on to the next one on July 28th 2022 Kevin and his pregnant wife Sabrina and ciso were heading to Jackson memorial hospitals in Florida Miss eniso involved in a recent car accident was in pain prompting a hospital visit to assess a possible miscarriage approaching the emergency service Kevin encountered a police cruiser at a stop sign blocking traffic as officers conversed after sounding his horn Kevin explained the situation to the officers while one left officer Daniels demanded Kevin's license sure so what are you pulling me off for for what are you pulling me what are you pulling me off for can I have your sergeant sir give me your license can I have your sergeant give me your license I've asked for your supervisor [Music] already let me have your license can I I'm asking for your supervisor call your supervisor call your supervisor let me have your Li call your super what am I being pulled over for let me have your license to ask my license I have to have to commit a crime traffic infraction I honed at you because you're blocking the way of your car the other let me have your no put it back in my pocket your Eagle's really this big I honked you very nicely one time for you to move out the way he wants continue I have an emergency that's why I at the emergency room for my wife Mr eniso explained that he honked his horn at officer Daniels to ask him to get out of the officer's way Florida law permits honking on highways for safe use however in Miami unreasonably loud honking is prohibited except to warn of danger some courts have held that noise restrictions on the use of horns May violate the First Amendment but of course there is an exception in some courts even though though Mr eniso honked his horn to communicate and not as a political statement given the relevant Florida case Law Courts May interpret this as a violation of the noise ordinance we're going to we're going to if you you need if you need emergency help that's one thing I already told you that first thing I told you when I open this window you let me go my emergency rescue I'm at the hospital SE fine I'm not being aggressive I'm fine keep can you start a fire rescue this way uh young lady say she's been involved in an accident let me have your license sir what what infraction let me have your license let me have your license I ref okay we'll deal with you on the morning officer Daniels repeatedly asked Mr eniso to show his driver's license told him to get out of the car and made them wait for paramedics according to Florida law drivers must have their license with them and show it when asked by a police officer however in a 1979 case the Supreme Court said that stopping a driver just to check their license without a good reason is against the Fourth Amendment which protects against unreasonable searches and seizures even though officer Daniels didn't do a typical traffic stop a court might still say that Mr eniso was stopped by the police the Supreme Court has said that a person is stopped when given all the circumstances a regular person would feel like they they can't leave this could include things like several officers being around an officer showing a weapon physical contact or an officer using a tone that makes you feel like you have to do what they say in a 1993 case the Florida Supreme Court said that an officer telling someone to get out of their car is also a kind of stop even if it started as a friendly talk so a court might say that officer Daniel stopped Mr eniso when he told him to get out of the car while officer Daniels could argue he had a good reason to ask for the license because of the noise issue we talked about earlier Mr eniso could say that officer Daniels kept them stopped for too long while waiting for paramedics which was not reasonable have your driving license sir no I asked you several times Department and according to news articles published shortly after the interaction they are represented by an attorney however it is unclear if they intend to pursue legal action against officer Daniels or the department if you think this is bad I'm here with something worse in 2019 46-year-old veteran Advocate slay Douglas was checked by police officers at his Los Angeles home after being notified that he was wanted for a health check upon letting the officers in Douglas allegedly reacted to an unjustified and retaliatory checkup based on malicious false allegations of suicide made against him by the Veterans Affairs hi Doug dougas Douglas Mr slay yes how you doing all right we got a call from uh was it the veterans I don't know what they call for can we come in and talk to you to the high powers given to them they think they can give orders to anyone they come across and as a result this is what happened obviously I wouldn't want them to call you all well they did okay okay over the phone then I hung up the phone so it generated a call with the VA called us get out here we get up to the apartment um he's in there um he opens the door for us he actually lets us in i h um after a few minutes um start just check and make sure nobody else is in there uh we handcuff uh handcuff him because he immediately gets iate starts calling 911 on his phone because now he's asking us to leave but it's like at that point I'm already there so put him in handcuffs um I'm not able to get a hold of the lady from the VA whoever puts whoever called it in I I have to try to find her extension somehow um but he he's just been completely irated the whole time um he's in handcuff he wants his handcuffs in the front I told him cannot do that I made sure his handcuffs were loose enough they weren't restricting any any type of of uh issue with his hands or anything like that but like I said he's completely foror 15 he wants a supervisor called him an RA he's got said he's got pre-existing uh injuries from the military won't answer any of our questions won't work with us at in the slightest but that's where well to us at this point he won't answer any of our questions to do anything but I and then after we got him in handcuffs anything I started making the phone calls uh meu says oh yeah okay we'll have a team at the station for you to meet us there uh but as far as uh me verifying what he said with the VA I can't you know can't do that yeah right yeah 's gonna meet meet us there at the stage okay all right so what display you didn't let us finish our investigation mean you no you that's no reason you put someone it why because you was violating my rights we're not violating any rights how can you say that we did not conduct our investigation what was your investigation to see to see if you needed to that that I was good okay you didn't let us finish our investigation okay okay okay all right all right if that's how you like to see it all right Douglas this is our supervisor slate explains that he was put in custody for calling 911 and the extent of his disabilities to the supervisor during which an ambulance arrives how you doing sir um he's this guy's been very difficult with us he's he's in custody for uh 5150 evaluation the thing is he has prior uh uh injuries to his back I guess a sepine issue or something from previous injury in the military or something like that okay and he requested an ambulance so here we are uh but it's I mean I know there's nothing you can really so he's ablator on scene walking talking awaking yeah and we're going to the hospital because you know what if he say if if he says he doesn't want to go does he still have to go I'm asking yes okay he's gonna so he's so we're here because he says he doesn't want to go by squat car wants to go by no while you're here is I was going to take him to the station to get elled by our mental evaluation people but he has been so difficult with us and now he's claiming he's got previous back injuries and wants us to reposition his handcuffs and we can't do that so that that's that's where we're at we're here for a mental evaluation okay and so when we have him in handcuffs he doesn't obviously like being in handcuffs so now he's complaining we need to move his handcuffs to the front we can't do that so he's saying it's irritating his his previous injuries from from the military do you have any medical complaint before you guys got down here so if they don't transport then uh yeah we'll just take them to the station I mean there there's nothing medically there's nothing medically how much time you have on 20 I have 34 so far as thing's going to be put them on our gurnie and cff them to the rails take them to hospital tell tell the doctor but he's complaining that he's got previous back injuries and he fell in cover position he get clear that way takes all the liability out of you guys Pi it off the city I think be I I think be most that'll be the best thing to do sounds good to me okay we got so we're on the what information does he have so all I need is his you know his name birthday address he's got for his homeless we'll basically do that following the false arrest Douglas sat handcuffed in the patrol car for approximately half an hour and complained of pain officers can be heard laughing and joking at Douglas's statements about his disability and denying his requests for reasonable accommodation the video also shows a paramedic advising the officers take him to the hospital you need to clear him that way all the responsibility is off you and the city dougas was then handcuffed twice placed on a stretcher and illegally taken by ambulance to Good Samaritan Hospital Hospital in Los Angeles California according to Douglas's affidavit he stated that the officers told the nurse Ricky that they needed to find something in Douglas's system that would justify his arrest Ricky agreed to do so and then injected Douglas without his consent records from the hospital show that Douglas was forcibly injected multiple times while he was double handcuffed to the gurnie Mr Douglas said that his genitals were touched and treated without his consent this reported abuse lasted for more than 8 hours he plans to sue seeking $10 million in Damages the officers seeking qualified immunity asked for a dismissal but the judge rejected it the judge ruled that officers wheeler and yabana are not entitled to qualified immunity for various violations including unconstitutional detention excessive force retaliation due process violation Americans with Disabilities Act violation Bane act violation B battery false arrest false imprisonment and negligence the judge also held the city vicariously liable for the officer actions the officers are now set to face trial early next year over charges related to false arrest sexual abuse and forced hospitalization it's unclear whether they will face criminal while officers can establish probable cause based on the smell of marijuana problems arise when they falsely claim to have smelled it more importantly the officer ordered a passenger to leave his cell phone inside the car before getting out essentially seizing his personal property this action violates the passenger's Fourth Amendment right against unreasonable searches and seizures step in front
