police officers are in charge of de-escalating incidents and ensuring Public Safety but some of them with the high Powers they are given become corrupt over time and abuse their power today we take a look at some of these corrupt police officers on July 15th 2022 911 received a call in which a woman was attacking a man officers from the carlbad police department responded to the scene man good hey were you just walking with the with a girl huh were you walking with a girl down pain Street or nothing like that okay we got to call a guy possibly getting smacked around by a girl in a pink shirt so we're just checking there you're good someone down there you saw somebody down there pink shirt what's all the scratches on your neck thing right here yeah yeah yeah what's your do you have an ID on you bro don't you don't what's your name man I don't need to talk yeah look bro I mean it doesn't need to be complicated man I didn't breaking the law I didn't I know but I have a lawful reason to stop you okay because we got dispatched you match the description of the guy that was getting beat up by a girl okay you have injuries on your neck all right it don't matter it does matter you don't have an ID on you man no I don't you don't what's your name I don't feel like I don't need to tell you that okay you feel like that but I haven't broken no laws understand listen listen to I haven't committed a crime I don't need to provide you okay but listen to me I have a lawful reason to stop out and talk to you okay so you have a lawful reason to identify yourself to me if you if you don't want to identify yourself to me I'll take you to jail for concealing your identity it's that simple you have scratches on your neck which are signs of some kind of battery all right which are probably from which are probably from your girlfriend right I'm obligated by state law to do something about this okay so are you going to give me your name or not if you don't want to identify yourself we can just take you straight to jail for concealing your identity why if I committed you guys are honestly like no we're actually investigating I see what you guys are doing like I you guys doing your job obviously why you talking to me because I don't know who I'm going to talk to find out what the I can't cuz you're not giving me any information man You' be the victim I don't want to be a victim I don't want to press charges I don't want I ain't pressing no charges so what are you guys going to do just take my name and me more or not take your name and take you straight to jail for concealing your identity you guys are able to stop someone that's walking on the public Street corre and ask them for their ID whenever you want no what I'm telling you is I was dispatched to this area for a domestic disturbance between a chick with a pink shirt and blonde hair and a male and all black okay you fit the description you got injuries on your neck which means you got beat up by a chick okay so I have a lawful reason I have a lawful reason to stop and identify you I I would prefer not to take you to jail cuz you're right you haven't done anything wrong okay but at the moment that we know at the moment you are committing a crime by not giving me your name and your date of birth wring New Mexico law the officer argues that the potential victim may have been committing a crime by refusing to provide his name and date of birth however Reasonable Suspicion is required to charge a person with concealing his or her identity in the absence of such suspicion the Supreme Court's decisions in similar cases make it less likely that the potential victim will be convicted under the concealment of identity law especially given the Court's Reasonable Suspicion requirement for such charg es the context suggests that a potential victim may not be legally charged with concealment of identity where there is no reasonable suspicion that he or she has committed a crime I just don't want to get in trouble but I didn't do nothing okay but you not wanting to get in trouble is getting in trouble I want you to give me your name once we in the car I'll tell you my name we go down there and we can talk to the person the all right let's go do that then you back I love you so what's going on I just had an argument it's nothing serious I'm sorry it was more on my part so I can give you my ID in everything okay where's your ID right here that was my old address I lived with my parents then I just graduated high school about 3 years ago so that's where I'm at now I'm leaving back to Albuquerque tomorrow and I do have court cases so what's your relationship with this guy uh this my boyfriend for about a year now okay and so what's going on between you two a verbal argument it's more than a verbal argument cuz we had people calling in saying that a female was hanging on the shirt of a male you didn't do anything that to me if anything was myself and my nose look at my nose okay what happened I scratch myself I do get pretty crazy myself I play nothing on him I'm sitting here telling you right now like I'm fine he's fine you have an address you have my ID I can give you my Social Security right now I have no problem with that sir okay it's just I don't want no problems this is my man we had an argument that's it when someone batters another person in a domestic violence see that or did they just hear us arguing say I yell I going to lie it's not even him H to it's me I will complete say I'll go to jail right now for that okay that's me let leave him the out officers questioned 21-year-old Brooklyn Shay Rodriguez about a reported altercation and despite her denial of physical violence she was arrested under the crimes against household members act in New Mexico the law deems assault or battery against a household member illegal extending to those in dating or Intimate Relationships evidence including scratches on the potential victim's neck and Rodriguez's fingernails provided probable cause for her arrest on battery charges notably New Mexico law permits but does not mandate warrantless arrests in domestic violence cases when officers have probable cause I'm telling you respectfully touch like that tries to kick me [Music] like she just broke my glasses chill the out for real I get rested bro she kicked me in the [Music] face hey about you so much a stop B stop I hope she's going to buy me some new glasses hey will you get your do you have a spit Hood Jake a spit Hood no one's going to know huh she's got a good horse kit have a seat you either got to sit in there or you're going to get Dragged In you coming no so sit up you okay you have cheat on you three times dir I'm not married what do you want me to say how much you want me to pay you how much what's worth it for you what what do you want don't talk like that you just get yourself in more trouble after her treatment at the hospital while sitting in the police vehicle Miss Rodriguez offered money to an officer to secure her release this action could be seen as an attempt to bribe a public official as set out in the relevant section of New Mexico law this law prohibits the offer of anything of value to influence an officer to neglect his or her Duty given that a municipal police officer has a duty to apprehend law Breakers Miss Rodriguez's offer could be considered an illegal attempt to bribe the officer for her freedom obviously it doesn't matter what trouble I'm in because I didn't nothing and I'm in the of a black cop car what did I do wrong I know you kicked one of the officers and where's the video body y'all going to take his side I'm man side hey a hey knock it off you let me out or what I I get out like a normal person you're kicking the door I didn't do nothing wrong we're going to figure that out okay well then call my we'll pH get you dress oh my Lord we'll put you on the phone Miss Rodriguez was held until July 19th 2022 and faced various charges including assault on a peace officer criminal damage resisting arrest and Battery on June 29th 2023 she pled no contest to assault and resisting charges with the other three charges dismissed in a plea deal the attitude of the police towards the potential victim was very frustrating they not only humiliated him but also threatened to arrest him on May 9th 2023 a Florida man Ryan gold was swimming in his apartment complex pool when a resident Anna Ivanova asked him to swim in a different direction when Mr Gold refused A collision occurred and led to a verbal argument Ivanova called her husband benedetto Salvia who arrived on the scene and showed Mr Gold the gun in his pants during the argument alarmed Mr Gold called 911 and waited for the police officer Bethany gerero of the Palm Beach Gardens Police Department along with another officer responded to the incident come man how you doing keep hands out your pockets for me I'm not the one the done sir I don't keep your hands out of your pockets I haven't done a crime don't talk to me like that listen to me I don't know you you put I don't know you you're the one with the gun why get down on the ground now get down on the ground get down on the ground what the I told you not to reach for anything I haven't committed a crime you don't have any out to your side I committed a crime now you put your hands behind your back you can't defeat me for what yes I can for what I don't know you I don't know you you're the ones with guns funny yeah you're arresting me for nothing I'm detaining you right now that's fine you're detaining me for what crime because you don't want to listen that's not a crime your are your body camps on yes they sure are good I called you guys for help cuz this guy's brandishing a gun at me officer gerero approached Mr Gold instructing him to keep his hands out of his pockets despite Mr Gold reaching for his cell phone officer gerero ordered him to keep his hands out pointing her firearm she then instructed him to the ground and handcuffed him even though surveillance footage showed Mr Gold backing away with his hands down courts recognize consensual encounters Terry stops and formal arrests while this encounter should have been consensual officer gerero May argue for a Terry stop based on a mistaken belief that Mr Gold had a gun even if a Terry stop was justified officer guero's actions might be seen as exceeding the permissible scope courts have ruled that actions Beyond an investigatory stop leading to a deao arrest are unconstitutional without probable cause Mr Gold's non-aggressive Behavior could support the argument that officer gerero lacked an objectively reasonable belief he was dangerous constituting an unconstituted U arrest without probable cause sit down I didn't say get up I said sit out who the is this where's your supervisor I'm getting you see how she's T me I haven't done anything you don't want why am I in hand I don't care you're not my mom because I'm com for a gun that's fine I don't have a gun I haven't committed a crime when I told you to keep your hands out of your pockets you're not I didn't commit a crime you you don't get to tell me what to do yes I do no you don't why are you yelling at me because I have every right now are you what's your badge number 321 Guerrero g u e r r i make you spell it right if you're this scared of a guy in a swi here for 20 years you're terrified of a guy in a swimsuit I didn't do anything you can shut your mouth she just they just detained me I explained there's no gun that Iain to listen to you yes you do no I don't she doesn't get to detain me pull her gun pull her gun on me put me on the in your pocket and I didn't commit a crime I don't care you're that terrified you shouldn't be a cop if you're that terrified I've been here for 20 years Punk yeah here here go somewhere real you're Terri P be are you a supervisor can you ask this lady why I'm in handcuffs tell her what crime I've committed tell crime fing over me what crime I get called because someone is what's suspicion you don't need to be in crime you need suspicion of a crime do she yes you do you don't know the law please explain it to him you cannot just go around detaining random people Cal down can you calm down second I'm in hand stand up I'll calm down if I can stand up what I I'm in charge not you no you're not and you blue nail polish cute okay I'm not going to do out all right right now all I need you for to do is keep your mouth shut yeah that's I don't care I'm not going to do it arrest me you are I want okay arrest me goad take me to jail resisting I am go ahead take me to jail take me to jail right now take me to jail oh I will do it I'm ready okay I'm ready let's go what's your name dude excuse me what's your name what's allow me to stand up negative doesn't work that way okay tell me what crime I'm here for fine it's fine don't worry you are you're for what crime you have to give your name you're already on arrest that's fine what crime though she already told you she's already got resisting arrest is a secondary charge that's a secondary charge it's not a secondary take me to jail you are going to jail don't worry about it I got you let's go the officers inform Mr Gold that he will be arrested for resisting arrest and Mr Gold argues that resisting arrest is a secondary offense to understand the legal principles it is important to distinguish between states that criminalize resisting arrest and states that prohibit resisting an officer in Florida resisting is an independent charge under the relevant chapter of the Florida Statutes which criminalizes resisting an officer in the lawful performance of any lawful Duty courts have held that individuals can be convicted of the crime of resisting for refusing to obey lawful orders in an exemplary case the court noted that the statute authorizes arrest for obstructing an officer including refusing to obey lawful orders ERS however again in an exemplary case the Court held that failure to comply with an initial order to stand down did not constitute probable cause for arrest in Mr Gold's case although he initially disobeyed officer guero's order to remove his hands from his pockets he reached into his pockets to retrieve his phone after he provided information about the gun when it became clear that officer gerero still wanted him to remove his hands Mr Gold complied it is clear that Mr Gold did not disobey police orders that's fine I'm ready to go to jail take me you're going to go is your body camera on Sir all our body camer on he came out here me and he got his hands in his pocket and I go bro take your hands out of your pocket right and then he goes he goes and pulls the phone out and he goes to put it I down on him I drew down on him okay that has anybody talked to not yet cuz Mike came running out Joe went running out I'm over here literally by myself with this guy all right are you okay to go talk to her yesing me wondering me so I had to go my you wish to tell me what happened here today so I can have a better understanding yeah I mean my wife called me she called me and said that there was a guy harassing her at pool okay was it that guy there um and so I just ran over here obvious a lot bigger than me I didn't you know want to get involved I was trying to pull my wife away and she just got closer at what point did the gun become in all how did how did he know that you were armed um I'm not sure you told that other officer that you put your hands up like this so that my wife um I know it didn't come out of the whole or anything like that no I didn't say it came out but how was he able to know that you were armed cuz he called us and said that you were armed I mean if I lift my shirt up you can see it okay so did you want him to see that you were armed did you tell him you were armed um I don't no I don't think so contrary to Mr salia's conflicting stories the pool's surveillance video clearly shows him approaching Mr Gold standing directly in front of him and lifting his shirt to display a concealed firearm according to the relevant article of the Florida Statutes the improper display of dangerous weapons or Firearms is a misdemeanor if done in a rude careless angry or threatening Manner and not in self-defense the footage shows Mr Salvia displaying the firearm in a threatening manner but he would not be guilty if it was deemed necessary for self-defense under Florida Statutes the use of force is Justified only when a person reasonably believes it is necessary to defend against impending unlawful Force the footage shows Mr Gold engaging in a heated verbal argument but making no physically threatening move and maintaining a safe distance Mr Salvia however approached Mr Gold and displayed his gun self-defense cannot be mentioned in this case okay so we spoke with that gentleman okay I spoke to him I'm trying to understand exactly what happened again can you explain to me from your perspective what happened he started screaming he started getting closer he started P up his fist so he's walking towards you yes okay my wife got closer to him and I tried to insert myself in between them okay um so at that point we were maybe like four or five feet apart okay and what point in time did you pull up your shirt somewhere in there I really am not comfortable saying anymore I'm not I'm so hazy In My Memory but I don't want to say the wrong thing um I can I can I wait till I have a glare sure absolutely we just want just want to give you the opportunity because we're going to look at those cameras and we just want to make sure that what we're going to watch matches what you're saying mhm well I mean I'm telling you I I lifted my shirt up at any point during your encounter with him did you inform him that you were armed I mean I think that was informing him that I was armed by lifting up your shirt yes okay we'll leave it there I mean we'll leave it there you already ask for yeah I was going to say either you hold them or you file but we have a weapon and it was used in the crime well we'll take the weapon what are you going to take the weapon for right now P out of this investigation so then I I would go with that then take him for the what do you think and then you can let him know hey we're taking your firearm um pending the outcome of this investigation but I I I feel like at this point they both deserve to go and I'll tell you why officer gerero turned off the body camera and Mr Gold was first sent to jail after being taken to the hospital but was later released without charges the surveillance footage prompted Sergeant Dennis B to order Mr Gold's immediate release officers confiscated Mr salia's gun but after reviewing the footage arrested him for improper display of a dangerous weapon Mr Salvia participated in a pre-trial diversion program and the charge was dropped after he completed the classes officer gerero with over 19 years of service was fired for policy violations and intends to appeal through arbitration after the incident Mr Gold moved back to Chicago and considered filing a lawsuit he filed complaints that triggered an internal affairs investigation there is no further information about the incident on July 26th 2017 detective Jeff Payne sought a blood sample from an unconscious crash victim at the University of Utah Hospital the patient injured in a collision caused by a fleeing driver was critically hurt the Logan Police Department not suspecting intoxication prompted detective Payne's request nurse Alex wubbles informed him of the need to consult administrators for authorization the interaction was recorded on pay's body camera mhm yes please so I'm going to arrest her we have exent circumstances for a blood draw on a patient that's upstairs she is refusing and my lieutenant says that if she Department are you with Salt Lake City police Salt Lake City which I'm sure you'll get to meet my lieutenant soon and if I don't get to go get the blood I'm taking her to jail I'd rather not do that I'd rather not do hi can you protect me I've been threatened to be placed under arrest by this officer here I'm trying to prohibit him from drawing he does not have a warrant for if things still keep going the way they're going I'm arresting her they can't protect for interfering with the criminal investigation that if he's conducting an investigation it's obstructing J okay I'm just being told what to do by my entire hospital and I'm being told what to do by by my boss okay so and I'm going to do what my boss says there's no reason that this has gotten as elevated as it has if he want to arrest stop he said if this guy's going to arrest me he's not going to stop him yeah let's to go that's fine get right here yeah let's not we're not doing one thing or another until house to gets here yeah yeah and I've got more of my guys coming up so this officer TR to arrest me he's agreeing with this officer he needs to have a warrant signed by a judge that says he can draw he doesn't and there's also the laws that talk about exigent circumstances and implied consent law which does apply okay I can have you talk to our privacy officer okay well but until he said yes we can okay she's going to jail why interfering with the criminal investigation for my Watch Commander and I'm not going to argue with him detective Payne threatened to arrest nurse wubbles for interfering with a criminal investigation if she refused to allow blood to be drawn from the unconscious patient however this threat lacked Clarity regarding the applicable law the relevant sections of the Utah code which Define interference with the peace officer and obstruction of justice are inconsistent with wubbles his actions even assuming legal authorization for the blood draw it is doubtful that wobbles his refusal constituted an illegal act his adherence to hospital policies does not indicate a deliberate interference with the investigation therefore even if there were constitutional Authority it seems unlikely to convict wubbles under this statute okay this is coming from our leadership okay and it's coming from mine but I either go away with blood and vials or body and toe that's my only choices what up P this young lady right here right now is not free to go about her business her watch command if she does not allow me to go get a blood draw from a guy up in the Burn Unit she's going to jail and I'm just trying to do what I've been told to do by the hospital where's the disconnect problem they don't want to abide by the implied consent law or exent circumstances they want it to be a search warrant so where's the lieutenant he's coming at I talked him on the phone she's talked to him on the phone he was the first one to tell her that if I don't get the blood she's getting arrested I wonder why you have to be so awful and threatening I'm not here to imp I'm just stating what is will happen we can both say that sir I'm just I'm just a nurse trying to protect the patients and do what my hospital has obligated me to do believe it or not I'm trying to protect him too I have two officers now another officer they don't have is this patient under arrest nope he still says he's not under arrest do you have an electronic warrant no no no every single one hold on so I printed this off that's is what I was told to print off I have this it says obtaining blood samples for police enforcement from patients suspected to be under the influence this is something that you guys agree to with this Hospital the three things that allow us to do that are if you have an electronic warrant patient consent or patient under arrest and neither of those things the patient can't consent he told me repeatedly that he doesn't have a warrant and the patient is not under arrest okay so I take it without those in place I'm not going to get blood am I fair to suisee [Music] that blame I don't know I have no idea why he's blaming me me I'm just represent BL why are you blaming the messenger sir she's the one that has told me no nurse wubbles explains to detective pay that hospital policy requires a search warrant to draw blood from an unconscious patient without consent or arrest previously detective Payne had argued that anyone driving a vehicle must consent to chemical tests citing implied consent laws specifically Utah's relevant section however the statute mandates enforcement at the direction of a peace officer who has reason to believe that a violation has occurred since pay had no such grounds Utah's implied consent law became unenforcable despite Payne's claims the law does not authorize blood tests based solely on driving in the state and even if it did it would be unconstitutional yeah but sir you're making a huge mistake right nowat no we're done we're done you're under arrest I have hospital administ she can sit in my car while we're they coming this is unnecessary man right this is my department and this is completely unnecessary I'm leaving now with her okay anybody who wants to prevent that that's your option he will be taking them leavee sir you're hurting me then walk no I have no reason to walk what is going on hi sir hi would you like to speak to this young lady well I need to talk to you first and then I'll talk to her okay so they're arresting her for she's called people they say no she will not take me up there she absolutely will not thank you I have our privacy officer on the they're busy give him a second okay let me shck with her for we're breaking the law we're doing wrong call Tom Miller listen to me if we're doing wrong there are civil remedies what I'm telling you is we are not making a mistakes okay I've done this for 22 plus years I know what the law is when it comes to search and seizure what you have done because your bosses are telling you to has been to prevent this officer who was called out to do a job to do his job that's obstructing judgment detective Payne supervisor Lieutenant James Tracy The Watch Commander arrives and accuses nurse wubbles of obstru R in Justice by preventing a blood sample from being taken the fourth amendment protects against unreasonable searches and seizures and only allows warrants to be issued under recognized exceptions such as emergencies in a landmark case the Supreme Court ruled that a non-consensual blood test is a search and that exigent circumstances do not automatically apply to all drunk driving cases in another case blood testing without a warrant was authorized for impaired drivers if there was was probable cause for the offense of drunk driving in this case despite the lack of any evidence or probable cause wubbles was arrested for protecting the patient's Fourth Amendment rights is this person do you know is this person arrested we're trying to get BL I have no idea I don't even know who okay so you're why are you involved in this you don't have anything to do with it because I'm the charge nurse and the unit that he was admitted my job is to help understand where what we're supposed to do and how you're not trying to understand you're trying to sell us that's all you're doing cuz he's going to tell me what your policy is I understand what your policy is I'm trying to tell you what I need legally okay and your policy right now is uh contravening what I need legally officers detained nurse wubbles for about 20 minutes before releasing her without filing any charges in late 2017 she reached a $500,000 settlement with Salt Lake City and the University of Utah without pressing charges an internal investigation into the incident revealed that detective Payne claimed he was following Lieutenant Tracy's orders while Lieutenant Tracy said Payne was withholding important information in October 2017 Payne was fired and Tracy was demoted pay appealed but the results have not been made public Tracy appealed the demotion and in 2019 the commission upheld it in 2019 detective Payne filed a lawsuit against the department and the city alleging various violations the lawsuit was dismissed in January 2022 possibly signaling a settlement
