police officers often prefer to escalate and complicate simple issues rather than resolve them quickly today we will look at an interesting example of this on May 30th 2022 two Yavapai County sheriff's deputies on patrol noticed a vehicle with broken headlights and initiated a traffic stop the encounter was recorded on both officers body cameras just go over there and let know oh yeah can I get out and leave go home yeah you can you're a passenger yeah yeah I can yeah you're the passenger are doing I live there yeah what is what is this okay my is open calm down stop talking just stop talking stop talking I'm good okay go whatever you need to do what's your name I own the property right do you have a middle name and what's your date of birth oh my God he's going to stand here and give you a goddamn lecture do whatever you need to do you've gotten the information he's a passenger this is nuts you are too young to be doing this hey can you step out of the car please no go on with what you need you have my name you have my birthday what other information do you need you can look up by that address and you can find my name that's me I need to step out okay no I don't need to step out just I'm good I if you're going any further with anything I'd like to talk to a supervisor I'm good I don't want to talk to you anymore so here's the deal I understand you don't want to talk but I am going to talk currently we are doing a traffic stop I'm not going to let you just go off across the street you are not free to go at this current moment in time for all I know oh my God he's going to stand here and give you a goddamn lecture do whatever you need to do you've gotten the information hey have first step out you just started because you said my headlight is out you don't do all of this for a headlight my father's a police officer you are completely out of line both of you this is nuts here's the deal we need to call your supervisor your supervisor out here now and you need to explain to them what the [ __ ] you're doing to pull my wife out of the car this is super super stop talking get the super your supervisor out step out of the car now all right we're pulling the police department right now during the traffic stop officer Galay approached the driver Becky Bailey from the driver's side instead of informing Miss Bailey of the reason for the Stop officer gay immediately demanded her personal information as can be seen in the footage the Second Officer on the passenger side displayed a similar Behavior both officers asked Miss Bailey to step out of the vehicle but it can be argued that there was no Val valid reason for this request given that the reason for the Stop was a broken headlight don't you [ __ ] touch don't touch call hey okay you need to step out of the car now given the behavior ma'am step out of the car now step out of the vehicle now okay that's fine but I want you to step out of this vehicle right now that is a lawful order step out of the vehicle or you will be my father is a police officer completely out of line This is a traic stop right highlight this out there's no reason for me to get out of the car you need toite me a ticket and go on your behavior why because I'm annoyed about you coming up here and giving us lectures what is your goddamn problem now I'm trying to call your supervisor or get another police officer out here but instead you're standing outside my door and yelling at me you're not even allowing me to call the police myself and you're telling me that my behavior is suspicious your behavior is suspicious I am angry because you are stopping me from going over there to my house this is nuts Bor and want something to do step out of the vehic you [ __ ] know I calling your supervisor sir can you please calm down ma'am will you step out of this vehicle please what do you need me to step out of the vehicle because given your behavior right now I want to for you to step out of the vehicle for everybody's safety for all I know for everybody's safety yeah and plus I am asking you to step out of this vehicle will you please step out of this vehicle and you're being like a child because I won't do what you ask you to do because you're police and you have the authority you're going to you have no reason for any of this you said you needed to know my information you are asking me questions about who me step out of the car stand back here every single question that you asked me now you can go and run that information right there and you'll find out that my record is completely clean I've never been arrested for anything I've got no traffic tickets there's nothing wrong just because I have no teeth it doesn't mean that I'm doing speed or me or anything like that because why are they telling me to step out of the car this is [ __ ] insane they're not going to stop it so go and run my name run my information and then you can find out who you're dealing with can I ask a question can I just ask you a question I I know for myself that we were just running the store and back and this is spiral so now I'm because that's happening and she is just irate I'm asking for a supervisor before you end up touching in my wife we are in the influence of nothing this is about a traffic light I'm worried you're about to ticket and go it's apparent that both officers had malicious intentions during the traffic stop as admitted by the Second Officer he explicitly stated that Miss Bailey's attitude and behavior were the reasons for asking her to step out although they later claimed it was for safety in Arizona officers can order occupants to exit a vehicle for safety or investigation reason however even though technically allowed we can argue that the officer's basis for doing so in this case was unjustified as conceded by the Second Officer supervisor I never said you guys were under the influence of anything you telling us to step out of the why why step out the vehicle why any of people around go you have my information Becky run my information please quit yelling behind me Becky Becky Becky yes go run my information you're worried about me what you're worried that I'm going to drive away take the keys to the car why the hell would I drive away my house is right there where am I going to get what am I going to do can I just oh please you've been dying to that's why you got mad because I rolled up the window and and let you give him the speech so give me the speech that you need to give this is nuts okay first and foremost now I'm going to start believing you are under the influence of something cuz you guys are talking about that I never said anything about any drugs or anything like that great that's one two if you want a supervisor down here it's going to be an hour plus for them to get down here we've got kids in that house I know they don't give a [ __ ] they're on their little game their little Power Trip okay this is nut can I call my no I submit whatever the [ __ ] you want I will do for you so I can get the hell out stay in the car now oh my God don't touch her stay in the car now don't touch her oh my God I'm not going to do nothing I'm not getting out of the car is overacting over here you're like trying to JP on me as I'm walking out stand the back of the car I submit whatever the [ __ ] you want I will do for you so I can get the hell you need to calm down sir stay in the car now oh my God stay in the car now oh my God I'm not going to do nothing stay in the car I'm not getting out of the car is overreacting over here you're like trying to jump on me as I'm watching out to stand at the back of the car go do what you need to do I'm Miss Bailey complied with their unfounded orders and stepped out of her vehicle subsequently the officers charged at her husband ordering him to stay seated officer gay then directed Miss Bailey to face the vehicle for a pat down and handcuffing further prolonging the detainment without a clear justification it's noteworthy that at this point the officers had not provided any legitimate reason for their actions it seems as if Miss Bailey's resistance to the violation of her rights displeased them I'm standing at the back of the car now Mr turn and face the car hands on the hands on the TR pleas no I'm not no I've done nothing but drive here you're not doing this to me no you're not doing this to me I there's no reason for you to arrest me you have you are being detained at this current moment in time the reason being stop Becky stop you do not get in that car please don't touch her I will give you the police number for dispatch get to the back of the car tellr I don't know what to do he's telling me he's going to arrest me what are you doing sir you are being detained this is this is nuts I don't know I don't even get to the back of the car now or I will place you in cuff and I will put you in the back of the patrol car what what are you going to right me up for for um having a a burnout taite for not getting out the car standing here when you wanted to for being upset when you're stopping me and all my kids are right there and I can't go take care of them I don't get this okay you've got to make up something real quick here for what it is and why this way this is I am treating you this way because of the way you've been acting in that vehicle to that Deputy to myself you flung that door open he tried jumping out of that vehicle as well I have half the mind to put both of you in cuffs right now okay if we had intention on running I mean that would have been okay this is not this guy is dumb okay I got you you're the boss I will dip my lips and just let's go on so we can go back to our house do you have her crazy it is clear that officer giles's conduct toward Miss Bailey was motivated by his attitude and contradicted the Yavapai County Sheriff's Office mission statement which emphasizes honesty and respectful Behavior officer gal's condescending behavior is contrary to the rules of conduct set forth in the Arizona Administrative Code this code requires employees to to exhibit respect fairness care impartiality courtesy efficiency and integrity in all interactions with the public officer gal's conduct clearly constitutes misconduct out my call I'm stuck here for so long I'm I'm yes shut up know well yeah see and if you're telling me that you don't even know if my information comes back clean or not you still don't know then that means that you're thinking about whether to punish me because I'm not happy with you when you pull me over and start asking me all the questions just kind crazy right so what and I said I so I don't like what you're asking me I'm allowed that that doesn't me you're supposed to have a driver's license too when you're sure but I mean you arrest people for not having the driver's license on them I never said I was going to arrest you well you're telling me that you don't know if you're going to let me go so I'm curious as to what is the thing that has happened here that you don't know if he'd let me go or not it can be argued that the traffic stop was unnecessarily prolonged because officer Galay waited seemingly without cause Arizona's law regarding the extension of traffic stops is based on the Fourth Amendment to the United States Constitution which protects individuals against unreasonable searches and seizures by the government while Arizona does not have a specific law directly addressing the unreasonable extension of a traffic stop or the use of an extend ention as a pretext the Constitutional requirement of reasonableness applies to all police conduct including traffic stops does that make sense during a traffic stop I have to identify you okay you didn't have a driver's license okay so I could site you for without your headlights out too right okay so if you're going to arrest me for that is that what you're telling me for yeah you are you're waiting for your backup to come oh my God ma' hey stop no I'm I'm not I'm just letting you know go back there telling me now go back there now because they're waiting for backup to come go back there now to arrest me just so you know they're going to arrest me because I didn't I wasn't nice enough to him when he pulls me over about the front tail light cuz initially for a broken headlight escalated absurdly to accusing Miss Bailey of being under the influence of alcohol such a significant shift often indicates officers searching for reasons to justify an arrest after subjecting her to a sobriety test for over an hour the officers concluded she was under the influence leading to her arrest for driving Under the Influence at the station she underwent a drug recognition evaluation to assess impairment and identify potential substance use or medical conditions I have nothing in my yeah whatever you want yeah no right here would be perfectly fine everything that I have have nothing so her heart R the only thing that I got on at that was the only test so let me uh it's your case right so so basically you've got THC in your system and based on what they saw out in the field with their fsts they saw impairment out in the field so we're going to S and release you for DUI okay beautiful an hour of testing proved that Miss Bailey was not intoxicated however as a result of Officer Gay's efforts Miss Bailey was charged with driving under the influence and released even though the tests proved otherwise at the time of the video's release
