welcome back to the body cam Zone on February 24th 2022 the Jackson County Sheriff's Office received a complaint from a local financial institution concerning three suspicious persons some police deputies responded to the report and found the three suspects whose names are Deborah Ann Donald Lamar and Spencer Dean they were all from Chipley Florida during the investigation the deputies searched the vehicle the suspects arrived in and found a substance that tested positive for MDMA they also found other drug paraphernalia upon further interrogations none of the suspects admitted to ain't gonna let yeah that's not ours if that was mine I will I'm ready to go right now I'll bail out and hear me I've been on probation with my life but until that ain't mine I'll get it I know I gave her permission description [Music] you're a liar here's the thing on probation is not supposed to be around any problems hey can I speak with him for one moment because he is talking about going around there and doing my debit card and my mom hold on a second let me have you been petted Donuts turn around for me okay all right thank goodness there should be nothing on you right I'm sure they will completely do the investigation you're on probation right now about three weeks left out of where where are you at where where's your probation Washington County okay you have anything in your shoes I'm gonna be straight up with you for I'm not I don't do this stuff to get in trouble my mom what are you on probation for what oops there's some control of someone so I stole my daddy's lower attention going to jail but my sister that was a little harsh but can I please talk if he's willing to come over here and talk to you that's fine but each of these three suspects tried to convince the officers that the other suspects owned the drug in Florida giving the police misleading information is regarded as false reports to law enforcement authorities under section 837.05 of the Florida Statutes a person who knowingly gives false information to a law enforcement officer concerning the alleged Commission of any crime commits a misdemeanor of the first degree when the deputies couldn't pin the illegal drug and drug paraphernalia on any of the suspects they were arrested and taken to jail so where's the rest of their property you're saying that it's it outside but um flip out about that which you already told him not to give him a ride I just heard about it so you know them more than just around here I know when they do robe and their mother lets me work at her house she was a good one you know what I mean and they went to California and just found that when you say they are they related they're together oh okay what drugs what do you want me to do he wants to talk to you yeah everything's mine in that truck everything in that truck stop um I mean you guys can't possibly like pull some of your sign you're scared and think that he's gonna be there you okay with them having a drink to ask if they want the restaurant yeah they said there's a 12 pack of body armor you better drink your body armor on the side I take this one's hers with her eyelashes on it yeah that's how I knew it was yours what are we charging them with just so I can tell the jail possession of ecstasy or ndmi whichever one they want to say okay uh possession of paraphernalia that's it all three of them yeah I didn't know if they were like disrupting the business well they were but we wasn't here to see it I got you this one over there so I'll go drop these off and I'll be right back this isn't my investigation that's [ __ ] crazy because you're gonna see right now y'all are going to everybody's going to jail so it don't matter what anybody else says from here I said everybody's going to jail so it don't matter what what else do you say yeah every every single one of y'all uh for possession of whatever he tested if you want to flip and come back that way there will be a five yeah I do appreciate you doing it well both the hour talking so I was like okay let me let me just do it out of jail which ain't gonna happen right under section 893.13 of the Florida Statutes subsection 6A States a person may not be in actual or constructive possession of a controlled substance unless such controlled substance was lawfully obtained or be an actual constructive possession of a controlled substance except as otherwise authorized by this chapter a person who violates this provision commits a felony of the third degree also as seen in section 893.147 it is unlawful for any person to use or to possess with intent to use drug paraphernalia violation of this statute is a misdemeanor of the first degree in the end all three suspects were charged with possession of drug paraphernalia and constructive possession of a controlled substance they were not charged with lying and trying to mislead the officers about who owned the illegal substances the decision to not charge them for that offense seemed to be supported by the Supreme Court case Dayton versus Rogers in that case a police officer conducting an investigation within the scope of His official duties asked a citizen a question material to his investigation and was told a lie the Supreme Court later held that making of a false unsworn statement to a police officer cannot be the basis of a charge
