let's check out what court TV has to say after the Brian coburger Alibi was revealed I'm Vinnie politan we've got breaking news tonight put on your seatbelts get ready you're not going to believe it now if you didn't know they said a few weeks ago that Brian coburger had an alibi and this was kind of all over the news for a bit it's like oh he's got an albeit oh he's got an alibi because they haven't been talking at all really just kind of filing motions and whatnot for a little bit and so now it has finally been revealed and spoiler alert it's not much of an alibi if you ask me well I'm not going to believe it folks in the biggest case that we're tracking across the country out in Moscow Idaho the mass murder of those four one thousand percent innocent college students from the University today they file an actual Alibi to me anyone who's innocent right I'm not not anyone but I would say 98 of people who are wrongfully cues are factually innocent should be able to provide an alibi it could have been me I agree if you were not involved you should be able to have an alibot you should be able to you know even if it you know how sometimes in crime cases when the person says oh I was just staying at home and nobody was home at all like if anything that's kind of an alibi right like what were you what were you doing just nothing did you not exist in time and space for a certain period of time so you know we've been asking for months what were you doing when this was happening because we know the exact time that the crimes were committed there were Witnesses like the numbers are all there and it's like where were you love this Rachel the Pooh bear says being active on your phone or a computer could be an alibi now they legit track everything absolutely I'm sitting in my bed on my phone for eight hours a day I got an alibi and trust me the phone is active we're in one window then we're on Tick Tock then we're scrolling we you every motion is tracked in the phone bro does he have an alibi every time they came across the suspect did he have an alibi did he have an alibi does The Alibi check out right time for me to reveal what this Alibi is tell us Vinnie again you're not gonna believe it take a look Mr accused murderer has long had a habit he's a Mr accused murderer of going for drives alone often he would go for drives at night he did so late on November 12th and into November 13 2022 the accused mass murderer is not claiming to be at a specific location at a specific time at this time there's not a specific witness to say precisely where the accused mass murderer was at each moment of the hours between late night November 12 2022 and early morning November 13 22 2022 he was out driving during the late night and early morning hours of November 12th to the 13th let me just say this right now I'm because I know there's some co-burger Defenders that have been popping up in the last couple weeks I just want to say I do not like y'all and it has less to do probably with the whole Coburg situation and more to do with whatever level of naive it is going on there because if that alibar right there changes everything for you shut the up that was not it that is not it we got some high-breast affiliation the building Jesus all night just driving this is stronger this is huge we know the evidence that prosecutors have not only following his cell phone the night of the murders Vinnie but his white Hyundai Elantra along the path around the times of the murders and now he's admitting to being out there driving around Vinnie we've been on the ground there I've been through all of those locations on the scene we showed you where he was and the path that he allegedly took so for him to admit this is um it's huge for prosecutors so you got him in the car that night right is there a world where the prosecutor can argue like oh so you were out driving that night so what are the chances you made some stops no I didn't make any stops and it's like but you were out driving so you could have made some stops I feel like that if somebody went in on it that way that could I'm sure an attorney could do it much much better obviously but that's an angle that I would listen to if I'm in the courtroom see I don't know a whole bunch of details on this I apologize I feel like I blocked a lot of this case out because there was so much misinformation online however I trust Court TV I trust their anchors I mean it's a huge liability when they get stuff wrong right I was under the impression that he had like left his phone at home or something because he thought he was Mr Smarty Pants so I guess it was actually with him if it was actually on him is there a history in the past six months or a year I mean we have months and months and months of data where he's just gone out for like a little 3 A.M Drive I I I don't know I don't know appreciate everyone at home you must know previous time what's that the affidavit said 12 previous times remember at the um around the crime scene he didn't turn off his cell phone this time he turned off his cell phone oh it was turned so he so he does have a habit of doing these drives but he doesn't have the habit of turning off the cell phone for the drives I really do believe that the prosecution has something up their sleeve because we social media affects cases for a while we've seen how median General affects things I think the Gabby potato case was like a huge turning point in not letting too much really important like details spread too far into social media like even the way that they released the affidavit so I just think that when it comes to the trial the prosecution has a few things that we're not expecting I really hope so because if Brian coburger really really did do this and he did it for the reasons that they suspect he did which a lot of people said that he was a crime student that was interviewing Killers asking them did they feel remorse did they get away with it how did they plan their crimes things like that then if that is true then being in this courtroom and having the possibility of doing it getting caught but still getting away with it would be such a rush for somebody that would do that at 2 42 a.m the affidavit alleges that Brian coburger's Sarah places him likely at his apartment at 2 44 a.m co-berger's vehicle and cell phone are on the Move police say his white Hyundai Elantra is spotted on WSU surveillance cameras traveling north on Nevada Street at Stadium Way according to the affidavit it was here in this area of the WSU campus where surveillance video and covered her cell phone placed him here around 2 47 a.m according to the affidavit he spent several minutes in this area where he allegedly turned off his cell phone before heading out of town toward Moscow Idaho by 2 53 a.m coburger's white Hyundai Elantra is observed heading in the direction of Moscow Idaho at 3 28 a.m video shows the vehicle on Steiner Avenue at Highway 95 as it made its way towards the King Road neighborhood where the victims lived 3 29 a.m to 4 20 a.m the suspect vehicle the white Hyundai Elantra is observed multiple times on video passing by 1122 King Road during the alleged time of the murders before being seen on video of speeding away on willing to thrive the probable cause at the David states that the car likely exited the neighborhood at pole loose River Drive and Conestoga Drive a road that eventually leads to Pullman Washington about two hours after he allegedly turned off his cell phone police say coburger turned it back on here near Blaine Idaho it's about 10 to 15 minutes south of Moscow a rural community off Highway 95 and it has its own cell tower according to the affidavit from 4 50 a.m to 5 26 a.m coburger's phone movements show him allegedly moving south towards Genesee Idaho and West towards Uniontown turn his cell phone off for 90 minutes and then turned it back on Lord Jesus help me join us tonight in Atlanta Georgia criminal defense attorney Eckland Mercy Arizona attorney the attorney guys she was just in the last thing tank she's a criminal defense attorney I'm curious in Phoenix Arizona the attorney who represented Jodi Arias Kirk nurmi and in Washington D.C the attorney representative Johnny Depp in his defamation case won the case and fellow of the American College of trial lawyers Ben Chu is with us and before I ask a question Ben that was a surprise huh that was oh let me move me she is a criminal defense attorney and then bottom left he was a defense attorney for Jodi Arias um and boy did they try and then bottom right we have uh Ben Chu who's in the uh Johnny Depp neighborhood case is this an alibi or an admission if your Alibi is putting yourself in the white Hyundai Elantra and and that's how they track down this killer through the videos and and the cell phone in in the car moving with the car then the cell phones turned off and then the car is seen at the scene then speeding away what's going on here what's going on this is one of those cases in which it's hurry up and prove it prosecution you want the prosecution to prove their case they're having to um you know carry their burden uh the officers did a great job with being very detailed and the prosecutor was being very detailed in the timing and literally setting it up for an alibi so if he doesn't give one the only thing that he can do is literally poke holes in the prosecution's argument they did a really good job do you guys think it's better or worse that he gave that alibi because what she just said was well if he decides not to provide an alibi which is pretty suspicious in its own but that's kind of a detail that sometimes people forget they're like well we don't have anything so it's like why go in on that right otherwise he would just be able to poke holes in their defense personally I feel like that alibi makes it look worse if your Alibi puts you in the white Hyundai Elantra and it's the white Hyundai Elantra that's like circling around the crime scene and speeding away from the crime scene um is this really an alibi that I was I was going for a drive by myself to no specific location at no specific time with no specific independent Witnesses no you know as as I was reading along there I I said this is more of an emission than an alibi and it made me you know look the crazy defense defense attorney for Jody area to him this is more of an admission than an alibi the responsibility of a criminal defense attorney in a capital case they're immense and intense but the number one goal of that criminal defense attorney in that representation of death penalty case is to preserve their clients life and I don't see this does that this doesn't really constitute an alibi to me it's more of an admission that some of the state's evidence is accurate it doesn't really make any sense to me so you know if their focus should be on things that save his life and things like this these partial admissions they just go further because you extrapolate this out say he's got this habit of doing this well the state can come back and say look look he was stalking he was praying he was looking for victims he found the victim this makes it look all the worse in terms of the preservation of his life when you get to that sentencing phase so to me it doesn't make a lot of sense what's going on here for Mr Kohlberg's attorneys Peppa talking about uh has a long habit of going for drives yeah all the drives that were done driving around and near the scene of the mass murder before the mass murder seems to prove premeditation and planning more than hey I just go for drives yeah yeah Vinnie it reminds me of that expression I I was born at night but it wasn't last night I mean this seems to be a non-alibi alibi there you go all right bench you Kirk Derby Eckler Mercy they're with us the whole hour oh my God oh more I know you guys watch me to
