So, I need to read this to you verbatim. It's a little lengthy, all right? But, I just want you to listen to everything that I'm saying, okay? And then at the very end, there's going to be a couple questions. Just simple yes or no questions. Just two of them, all right? Just listen to me, and it'll maybe take me 5 minutes, but just I want you to focus, okay? >> Can you just Officer, can you just tell me what you're reading me? Or something? >> Yeah, this is the Attorney General's standard statement for driving while intoxicated. Um it's just I have to read this to you by law, okay? >> Okay. Mhm. >> You have been arrested for driving while intoxicated, N J S A 39:4-50. The law requires you to submit samples of your breath for the purpose of testing to determine alcohol content. A record of the taking of the breath samples, including the test results, will be made. Upon your request, a copy of that record will be made available to you. After you have provided samples of your breath for testing, you have the right, at your own expense, to have a person or physician of your own selection take independent samples of your breath, blood, or urine for independent testing. If you refuse to provide samples of your breath, you will be issued a separate summons for the refusal. A court may find you guilty of both refusal and driving while intoxicated. If a court finds you guilty of the refusal, you will be subject to various penalties, including license revocation of up to 20 years, a fine of up to $2,000, installation of an ignition interlock, and referral to an intoxicated driver resource center. These penalties may be in addition to penalties imposed by the court for any other offense of which you are found guilty. You have no legal right to have an attorney, physician, or anyone else present for the purpose of taking the breath samples. You have no legal right to refuse to give or delay giving samples of your breath. Any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit to breath testing. Even if you agree to take the test, but then do not follow my instructions, do not properly perform the test, or do not provide sufficient breath samples, I will charge you with refusal to submit to breath testing. I repeat, the law requires you to submit samples of your breath test breath for testing. Will you submit the samples of your breath? >> Yes. >> That's we got to wait about 15 minutes before we can take your breath sample, okay? >> I'm sorry. >> We have to wait about 15 more minutes before we can take this sample of your breath. >> You cannot give you water until I until I Afterwards I will give you as much water as you want. >> Okay. >> All right. >> Um what's the purpose of waiting, sir? >> Uh so it has to make sure all the alcohol in your body is you're not burping anything up or nothing's coming up to skew the test results. >> and officer, I admitted I had, you know, a drink or two tonight. >> Yeah, I understand. >> Okay. Um >> You chewing any gum right now? >> No. >> No? >> No. >> Do you mind if I just be checking? Can you open your mouth? >> I'm sorry. >> open your open your mouth. I just make sure there's nothing in your mouth. >> Of course. >> Tongue up. Okay. >> Yeah. >> All right. Now all your property has to come off. So watch, rings, and I'm going to document every single thing that we take. It's also all on camera. I'm going to take it all from you. >> Mhm. >> And you're going to sign that we received it, and when you get released, you're going to sign that you received it back. >> Okay. One second. >> I We we need that. You got You need to take that off, all right? I know you can text from those now. You can't use that. >> No, I don't have >> No, no. All right. >> Okay, there you go. Um what else? >> All jewelry. Just about earrings, rings. >> Sure. >> No belts. >> Mhm. >> So did the other car get in trouble at all? >> So we had law went looking for it. I don't believe they located it. So. >> So it's all my fault? >> I had There was one of me and there was three cars stopped. I stopped the car that had the most damage, which was your car. >> Yeah, cuz the >> I but I be I said I can't be in three places at once. >> And that's not what I'm saying. >> No, I know. >> But when you get run off the road >> No, I I I know. I just I can't be >> Do they have cameras there also? >> Right there I >> So how do we prove that you know, you're calling me over for drunk driving, what about the other guy in the big truck who totally geared me off the road and I swerved and then I hit the guardrail. >> So in my accident report I will note that that's what you said happened. >> Yes. >> Okay. But it still doesn't do anything for the driving while intoxicated. Okay. >> Can Can you tell me what I got in trouble for as far as the tests? >> What do you mean? What do you mean what what you what part you failed? >> Yes, sir. >> Failed all all of it. Every test. >> This thing, what was that? >> called the horizontal gaze nystagmus. >> I do wrong? >> So nystagmus is involuntary movement of your eyes, okay? So when you follow a certain direction, your eye will twitch if you're under the influence, right? We look for and you get five of the six, okay? >> Oh my god. >> It's something that no matter how good your balance is, there's nothing you can do about that, all right? >> And what was the other test that I failed? >> Those are just walk and turn. Just >> I failed every test? >> Reason. >> Oh my god. Can I fully home on Monday evening? >> I promise you once this test is done we're going to make every phone call we can to get somebody to get you so we can get you out of here as soon as possible, okay? We don't want you here just as much as you don't want to be here. We'd rather have you get out of here and get home. >> My sister's not going to be able to come and get me. She's unable to drive so my parents are so how am I going to get home? Can I get an Uber? >> So you need somebody to come and sign off that you're their responsibility until you're sober until you're sober, okay? So either somebody needs to pick you up so that you're so that they can watch you until you're sober or you have to stay here until you're sober. >> And how long would that be, sir? >> Depending on what you blow, there's a calculation we do that determines how long. >> I I had a drink like 2 hours before I left so it could be hours, sir. >> What's that? >> I had a drink probably 2 or 3 hours before I left. >> No, no, you're okay. >> Um I'm here. Well, okay, let me ask you this. Will I have access to my phone to call somebody? >> He's coming back with your phone right now. All right, so once we get all the tests done >> I'm just >> I know. Sorry. Once you go into gets back here >> Okay. >> we're going to test and then you're going to we're going to give you the phone so you can call us maybe whoever you want. Okay, cuz we want you to to get somebody that can pick you up. >> I'm in a lot of trouble, aren't I? >> It's It's a just a driving while intoxicated. I mean, it's not Everybody's okay. >> here, sir. Do I have to come back to New Jersey to fight this? >> to have a court date. >> Can I do that via Zoom, sir? >> I believe so. I'm not positive, though. >> I I just wish your officers were at the columns. [snorts] >> Yeah, unfortunately, I was the only one that was >> I'm I'm not I'm just My mother's car is damaged. And it Where's it going to get towed to? >> Here. >> What What do you mean by here? >> Stop. Believe Belmar Police Department. >> Okay. And then can I pick [snorts] it up uh tomorrow? >> Uh >> Tomorrow's Sunday. I need to get it tomorrow. >> It's not It's not drivable. >> Where are you going to get it towed, sir? >> You can pick it up here tomorrow after we have we have a whole temporary hold on it to depending on how long until you sober up. Okay? >> Once I'm fine to drive the car, but the car is not drivable. >> And it's here. It has to get towed. >> It's going to have to get towed. Correct. And you >> Can it get towed on a Sunday, sir? >> 70's Belmar. Do you have to pay the the towing fee? >> I I will pay whatever I have to pay. >> The vehicle's going to be impounded at their yard. I'm going to come at 10:30. >> All right, so they're taking it back to their yard. Bennett's Bennett's is right across the bridge on 35. Do you know where Avon is? Where the columns is? >> Sure. >> It's about maybe eight blocks from from there. >> Okay. Are they open on Sundays? >> They are. You just have to call them. >> When can I call them? >> Tomorrow. Tomorrow between 8:00 and 9:00 typically. So that they can make sure somebody's there for you to pick the car up. >> You're telling me they're there on Sundays between 8:00 and 9:00? >> Just when you're available, let me know. I have a uh noise complaint. >> reason I know this is cuz I just talked to them about an hour ago about it. All right.
