Menomonee Falls Wisconsin on October 14 2022 and around 906 a.m a Menomonee Falls police officer observed a silver 2012 Nissan four-door traveling Southbound on I-45 South with an expired registration sticker from 2021. the vehicle turned left and began traveling eastbound on Bradley Road the officer followed and conducted a traffic stop the vehicle eventually yielded to his lights and the officer approached the driver's side as he was instructing the driver to roll down the window the vehicle made a sudden jerk forward which the officer identified as a sign of suspects beginning to flee an officer good evening hey man can you can you grab pull down the rear window don't run pull down the real window don't you run cut the car off check out the car off is there one else in there with you why are you trying to run man hey hands on the steering wheel s the both of us here I don't know I don't know I don't know I just got off work to buy the vehicle sir step out of the vehicle you're not getting off the parkour what the [ __ ] am I acting like open doors no the doors should even be open why are my doors [Music] get out of the car now put them onto this one for failing to get out of off okay they said that the car was jerking I wasn't here I didn't see it but that's what they were saying so I don't that don't even matter so whatever my car jerk I I don't know I don't know what to looked like I was about to pull off okay then they opened my doors okay like do that make sense well did they ask you to get out of the car yeah but why would I get out the car if I didn't do nothing going to get put in your car in the drive or were going to take off and that's how they told you to get out of the car no this is what happened my food was literally on the break I realized my car wasn't in the park so I put it in park once they walked up okay but again you got if they tell you to get out of the car you got to listen to them that's a lawful order so we'll be watching you so I can get you so I could get a ticket for having a trash bag yeah yeah you need a clear window you need to be able to see through it what if I got the money to get a clear window and shouldn't be it like a year and a half ago or so I just bought the car from somebody so talking to him briefly that sounds like why they stabbed you and I overheard you tell them that you just got off work yeah police officer conducted a search of the vehicle and found the following items a black digits brand digital scale in the driver's door compartment two plastic bags containing a green leafy vegetable-like substance which was recognized by the officer to be marijuana and plastic bags were located in a black backpack in the rear passenger seat area on the driver's side and open 150 count box of plastic sandwich bags located in the glove compartment small amounts of a green leafy vegetable-like substance which was recognized by the officer to be marijuana were found throughout the vehicle in the driver's compartment ashtray in the center console in rear passenger seat a plastic cup containing a green leafy residue which was recognized by the officer to be marijuana a small plastic sandwich bag containing a small amount of a green leafy vegetable-like substance an iPhone inside a black case foreign jerking yeah like the car jerked like when you left like when you release your foot off the brake the car move a little bit okay if you've never seen that before I think I know what you're talking about yeah that's what happened so you put it in and then when you release the pressure off the brakes yes the car jerked okay all right I obviously you know when I showed up so I'm kind of oblivious to what happened this common sense I'm gonna be in the driveway somebody got to release me or y'all just gonna Release Me hurry up so I can skip I got to look I don't know if you've ever been arrested before or not yeah and if you have it you have priors of doing resisting or anything like that they could possibly go State instead of just issuing you a ticket uh like doing a misdemeanor on you instead of a ticket but I have no idea what you're history looks like oh that's what they're about to put down that I was resisting that's what it is yeah what they say obstructing that's the word Trucking resisting is the same statue obstructing be like you say you're but still you set the car jerk that's because I put the car in park so it could have been easily explainable and you could have said yeah yeah my key fob's on my key ring I'll give it to you right now no big deal why would I reach for my [ __ ] key Oregon trust y'all left her the way y'all approached me yeah absolutely agree no no officer ever asked me to get on my key nobody ever said that to me before I got pulled over too many times again when the vehicle starts jostle around like that when we come up on it after being brought to the Menomonee Falls Police Department by another officer the suspect was read his constitutional rights from the mfpd advisement supplement form the suspect indicated that he understood the statements and was willing to speak regarding the investigation he then provided a detailed account of the events stating that he had left work at approximately 9 A.M from FedEx in Menomonee Falls and was driving when he got pulled over by the police he stated that he forgot to put his car in park until the police arrived the officers asked for his car keys but he felt he did not need to provide them at the time suspect admitted that the two baggies of marijuana were his one for personal use and the other to sell he admitted to selling marijuana to people at work and others he knows including people in Menomonee Falls selling 7 grams for between forty dollars and forty five dollars he then completed a written statement detailing the incident the suspect was transported to the Waukesha County Jail without incident and charged with misdemeanor resisting an officer and felony manufacturer delivery of THC
