I said, >> "Do you have this on camera?" >> Do you have this on camera? >> He said he's got a gun, sir. >> He can't have a gun. >> He's threatening to kill myself. That's fine. Step over here. >> He's like strangling Eric. I see blood coming out of Eric's mouth. >> I'm going to kill you right now. I got a gun and I'm just like, whoa. So, I backed up. He grabbed me like that. So, I swung him around on the ground and hit him. August 31st, 2025. It's a little after 3:00 in the afternoon when Rockwell police get a call about an assault at a McDonald's drive-thru off I30 in Texas. To get there, and the fight's already over, what they're left with is two men, two trucks, and two very different stories about who started it. And what the officers decide in this parking lot is going to cost one of these guys a lot more than the other. >> I've been out here the WHOLE TIME. >> WE HAVE IT all on camera. >> Let's step back here. Let's not yell at each other. >> He said he's got a gun, sir. >> That's fine. Get out. >> That's fine. Step over here. All right. >> You stay over there. >> Hey guys, let's get back in the trucks. All right. >> Let's all get back in the cars and we'll talk about this like adults. >> Okay. >> Probably need paramedics. I'll help you out. Help me up yet today. >> Which car right there? >> You got your ID? >> Guard that phone is threatened to kill my 15year-old's son. He's going to run into his vehicle. Let me grab my ball. >> I have TO STAY IN THE CAR. YOU HAVE TO STAY IN THE CAR, TOO. I HAVE IT all on video. >> What am I, MAN? >> OKAY, GOOD. RIGHT HERE. >> You were the one that walked right here AND FLIPPED THEM OFF AND TOLD YOU. >> NO, YOU'RE >> LET'S stop yelling at each other. >> I'm getting people through the drive. >> I'll be on this. >> Get back in your truck for me. We'll come talk to you in a minute. >> Officers arrive after the fight is already over. Pull the two men apart and have to piece the story together from people who each tell it differently. Set the scene and the stakes without recapping the footage. This guy was in full mount on this guy >> right there. >> What was the deal? >> No idea. >> But between the two cars and they're all very animated. So just turn left door. I got my kids in exactly like that. We're on our way to Six Flags. I was >> And then um what you call it? That's when like that boom kiss and that's when he punches right here. >> You were out that time. >> Yeah. Because I asked I was going to ask something wrong with what's going on. I'm sorry if I cut you off or something. And he jumped off too. And I was like, what the what's going on? Like I said, I don't know if because they were his people. I guess mom were walking as well like I'm sorry if I did something wrong. Like I'm trying to let him cut like is everything okay? And he's like his son started saying something and I don't know what he said. And his dad jumped off at me with a gun or whatever he had in his pocket and said >> and that's when he punched me in the mouth. >> That's all started cuz you flipped him off. No, he flipped me off. >> You cut him off in the light. >> I I No, because I guess they were walking through the store this way and the mom and the son this way. I want to walk. So, I tried to stop him properly cuz I didn't see him because here you go. My mirror was right here. And I like did I do something wrong or is everything okay or what? And then his dad got off and attacked me on that. I like dang. I was just trying to see what was going on. If I did something wrong, I was going to apologize like my bad. And then his dad was like choking me. And that's why I'm like hard to talk right now cuz I can't talk. Almost lost consciousness. >> Get off of me. >> It doesn't matter if he's HAD ENOUGH. GET OFF. >> THAT'S ENOUGH. >> Don't ever. >> Get off of my husband. You >> I don't care if he's had enough. >> I don't care. No, he doesn't. >> He just told me. >> I'm telling you now. >> DON'T THREATEN ME. >> GET UP. >> DON'T THREATEN. >> Get off me. >> I said don't. >> Do you have this on camera? Get off. You don't press. >> Do you have this on camera? >> Get off. >> Get off now. >> Get off. Get off. >> I will not tell you again. Can we call 911? >> I was going to remember that he set my head on the ground. >> He hit me first, so I don't know what happened. >> That means I didn't know what happened. >> Yeah. >> I like, man, I'm sorry if I cut you off or got in front of your bomb or >> is there a walking right here? I was like, man, I'm sorry. I was like, I just teach her some respect. I don't want my kids seeing stuff like that. >> I don't know him at all. >> Is that your wife? >> Yes, sir. >> Has she gone? >> No. >> That's why I like I was like, man, what did I do wrong? If I did something wrong, you know, let me know. >> If I get his info yet, >> huh? >> Did you get his info yet? >> Uh, she's supposed to come around with his license. But >> Oh, I tell you right now, I'm on probation. I can't get caught in trouble. >> What are you on probation for? for uh assault with deadly weapons. >> That probation he keeps bringing up isn't a small thing. What he's on probation for is a secondderee felony. And the only reason he's out at all is that a judge gave him a shot on the outside instead of a cell. >> I got a fight with my son's my ex and son. You got a fight all at the house. >> What's your name, boss? >> Two Rs or one R? >> Two Rs. >> Two Rs. my kids. I was about to ride back truck. I said, "Man, teach your kids some respect." And when he did, he was I got something in my pocket for you like that. So, it'll take care of you real fast. >> What's at what point did you get out of your car? >> When I was coming this way, I got out. She like, "Hey, man. I'm tired. Did I do something wrong?" >> I tried to roll my window down and he just kept saying something and I was like, "Man, what did I do wrong?" What's up? Like I was I'm sorry if I if I got in front of y'all or y'all trying to walk and I cut you off and I couldn't see through that angle of that window. >> Were you in the drivethru already? >> Yeah. I was like they were walking. I was like I'm sorry. You know >> you were in drivethru and they were walking. How'd they get behind you? >> I don't know. >> Okay. >> He tried to threat me. He says he knows y'all that y'all going to take care of me that it'll all be on his side. Like playing favoritism. I just want to tell Tar because like especially with kid and his mom. I I try to respect the woman at all times. >> So his son is the one that allegedly blew the kids split to you. >> He flipped me off. >> He flipped you off. I mean you blew a kiss at him right >> at the dad. I mean me and the dad were already right there. I was like teach some respect man. >> And you were in your car during this first interaction or were you >> Yeah. First I was in my car. >> Where at? Exactly here. Right. Right here >> in the parking lot. >> Yes sir. >> And they were walking from where? >> This direction. >> Dad and son. >> Mom and son. Okay. >> That's why I was like, "Man, I don't like to respect a mom or a kid." >> That's why I was like, "Man, I'm sorry." And then he was like, and then I was, "Is everything okay, man? Did I do something wrong?" And that's when the dad got out, got my face, grabbed me with a gun or whatever he had in his pocket. Not a gun. Exactly. >> Yeah. >> Yeah. Right when I turned my side, that's when he punched me. >> Yeah, I have a video of it. There was no video on this. >> Uh I talked to the manager. She said she can release the video surveillance to any of them. >> So what happened is we were right here and the mom and the boy, it looked like you couldn't tell if they were trying to go or not. So at first he went to come up and then he slammed on his brakes and Eric got out to tell him I was trying to let you and your mom hurt. So that's when the husband comes out and got all up in his face and that's how all this started. >> That's why I won't hit nobody cuz I'm on probation. I can't afford to get in trouble because I'm looking at 12 years, man. >> It's not worth the fight for me. >> Pick up a fresh charge while you're on that kind of paper and a prosecutor can ask the court to tear the deal up and sentence him on the original felony instead. That's where his number comes from. To him, this isn't a fist fight in a parking lot. It's years of his life riding on it. >> Tell me why I can't even breathe on you right now. I didn't real >> I'm having trouble trying to talk. >> They were like right here. It looks like >> Hey, mine's right there. Willie >> is And then you have my head on the ground. >> I'm sorry. Can I get one of those sheets? >> No, sir. >> Thank you. Oh. Uh, well, let me get this for you. One of your pants is I got my other pants dead and this one's >> what do I call it? That I don't know if you can see. Sorry. >> Yes, ma'am. >> And did did anybody get her? Is she attached to the phone? >> I don't know. I don't know. >> Has anybody gotten your license for you, ma'am? >> No. >> No. Do you have it with you? He has it in a haircut. >> Yeah. No, I'll have it in the middle of the console of the truck. >> Yeah. >> And the video, what did you observe with the video? >> Just kind of give me your own >> the video or like what happened? >> Just what what you observed. >> Okay. So his his son and I'm assuming his wife, they had to have like went to the bathroom or something cuz they were coming through like this way and Eric was confused like like at first they were speed walking and then they were slowing down. So he was confused like are you going or are you not going and I was like wait I think they're going so slammed on his brakes >> and then the sun flipped Eric off and then Eric got out to ask him about it and then the minute that Eric came that's whenever he came out and then all I that's whenever I told the the video was actually taken by a 10-year-old in the back seat. I was like, "Start recording because some stuff I couldn't see." And then that so the video was taken from the back seat and that's when they were just kind of I don't know what was being said or whatever and they were just kind of face to face and then that's when he hit Eric. I saw Eric come down and then that's whenever I got out and by then he was like completely like completely on Eric. It was like and cuz he might have scratch marks on his neck cuz I was like trying to pull him off like bent over trying to pull him off and he was like he says he has a gun but I had heard him say something about a gun. Not Eric like I'm not proud of it but he's a he's a felon. If he goes back he's gone for 12 years. Like he does not pardon my friend. Um he dots his eyes, crosses his tees on everything business related everything. >> Okay. >> Um like that's not something that he would say and he doesn't have guns. He was the one that said something about a gun. And so I was like I kept telling him I was like he does not have a gun. Get off of him. And by then I'm trying to pull him off. Pull him off. Pull him off. He's like strangling Eric. I see blood coming out of Eric's mouth. So I don't know what happened in between. I don't know if all that was from the punt. I don't know what all happened at that point. >> Okay. >> But that's all that. And then after that the wife came out, >> right? >> I was like, you know, get your freaking husband off of my husband. And he just went south. Uh my husband's going to Lake Point Bailey. You want to tell her that in Raleigh Temple Huntsville. So uh we're going to have an officer go meet him over there. We got to take pictures of his of his. >> Uh so just to let you know that's where once we're all done with everything, dog, you're free to go >> wherever you want. >> And then what do we have to do as far as is that like a police report with y'all? >> Uh so we're going to take care of everything. We're about to take care of everything on that side. Uh, have you written out a statement at all? >> No. >> Oh, is this [laughter] my time? >> Uh, yeah. Just everything that you saw. I know we have video evidence, but just everything that you saw up from the point of them walking out up until the point where they had Is it your husband? >> Yeah, >> they had your husband on the ground with choking or whatever. >> Okay. >> Um, >> just your name, all your information here, and then basically everything that you told >> if you want to, you're free to go right in the car. I know your kids aren't in there, right? No, the red Cadillac that came because Oh, >> they picked him up. >> Eric, like I said, I'm not proud of it or whatever, but his little one knows like if he goes back, he's never coming back. So, when this happened and y'all showed up, like she's still balling. I was like, "Come pick her up." >> So, uh the my sister-in-law came and picked up. >> Okay. Well, you're free to write that wherever you if you want. >> I'm sorry. I don't have a clipboard. >> Let me see if I have one actually. >> I got to get my clipboard to >> Is that because Lake Point isn't private? Cuz I was we live right across from Fresie. So, I was like, whenever you said Lake Point, I was like, >> Lake Point's a little bit better, which is kind of >> I'm not a fan of over there anyways. But I was like, I wonder why. >> Yeah, Lake Point's just kind of >> I'm about to pull this truck all the way through. >> All right, please do that. >> Hey, this Whose car is this? >> What's that? >> Do what? >> Where's You're going to park, right? >> I'm going all THE WAY. I'LL COME BACK AROUND. JUST come back around and park over here in the handicap if you have to. >> Michael. >> Yes, sir. >> So, tell me what happened, man. Why don't you step step out a little real quick? >> So, my 15-year-old son and my wife >> went in to use the bathroom. >> We grabbed some food. >> We're driving here. My wife was walking. She came around the building to get back in the vehicle with us when we were in the drive-thru. >> Okay. >> And this guy got out strike in fronting my 15-year-old kid cuz he said he was looking at him. And I said, "Sir, he's not looking at you. He's 15." >> Okay. >> He said, "I don't care." And I'm like, "Whoa, whoa, whoa, whoa, dude. Take it easy. >> We're just going through a drive-thru. I got all my kids in the vehicle. Please don't." He goes, "I'm going to kill you right now. I got a gun." And I'm just like, "Whoa." So, I backed up. He grabbed me like that. So, I swung him around on the ground and hit him. >> Okay. >> Did he hit you also? >> Yeah. Okay. >> In the mouth. >> All right. >> You can see my >> Yeah. I can sit. >> Yeah. He hit me in the face. Give me a second. Okay. >> Okay. And my wife and my kid just in the back. >> Are you armed or anything? >> No, sir. I have a knife on me at my >> That's why that's fine. >> Yeah. >> Hang out with him for a second. >> Hey, boss man. Did you see what happened? >> Dude called off the other guy. I have no idea what happened before that. >> Was the guy in the flannel? >> The big guy. Yeah. >> Okay. >> Did you see the other guy do anything? >> No, they were I mean they were arguing. I knew it was going to happen, but I he stood with his hands on his hips. >> Okay. >> Some words said to somebody else and this guy just called off and hit him. >> Okay. I'm sure there must have been some reason, but >> he's got video of it. >> Older guy used to person. >> Okay. Did the other Did the Hispanic guy grab him? >> Uh, he uh all I saw was >> Let me see your video. >> Yeah, I sent it to him, too. >> So, right when I pulled it out, he swung. So, it's like right at the beginning, he swung. >> Yeah. I can't see anything on there. So, my kid and my wife got in the car and >> he was going crazy. >> All right, give me a second. Can we watch him real quick? Talk to him. >> Did he grab you? >> He hit me in the face. >> Mhm. >> In the lip. And so, I just grabbed a hold of him. Tried to restrain him. And he's gone crazy. >> Yeah. >> He's like, "You don't you don't tell your kid not to look at my car and stuff." I was like, "My wife went into the bathroom. I got my 12-year-old and we're getting chicken nuggets." when he gets out and comes over and tells me he he'll kill us. He said, "I got a gun. You don't think I have something?" So, I don't know what you have, but I we're just trying to get some food, please. And he just escalated. He came at me. He hit me. I mean, >> I don't know what to do. >> Yeah, that's crazy. >> Yeah. He's nuts. He's like, he goes, "You don't think I've taken out cops before?" And I'm like, "You're messing with the wrong guy." You know what I'm saying? You You do that. >> Yeah. >> I just was worried. And then he was tustling still when your officers were here like trying to whatever he was doing. I don't know if he was doing crazy. Then his wife got out. My wife was out and uh they said, you know, settle down. Settle down. The whole time he's trying to punch me and just going crazy. >> What the bigger man did might be completely legal. In Texas, you're allowed to put your hands on someone if you really believe it's the only way to keep yourself or your family from getting hurt. If that's what happened here, he didn't break any law at all. He used force he was allowed to use. But there's a limit on that. You lose it the second you're the one who started the fight. The whole case lands on a single question. And it's the one thing nobody here tells the same way. Who threw the [music] first punch. So >> all right. >> Yes, sir. Thank you, though. I appreciate that. When were you in the 82nd? >> Yeah, I was 11 Bravo Charlie. Were you military? Yeah, I was I have a lot of buddies that were in 82, >> but I wasn't good enough to do PT tests for a Ranger Ranger induction program or any of that. So, >> I was 11 Bravo, too. >> I did I was deployed and stuff. >> I didn't know what to Nowadays you people tell you they're going to kill you and he's >> throwing blows at me. I mean, I took that pretty serious, you know. I just tried to restrain him. I was I had holding him down like that and he's grabbing my neck and >> Yeah. >> Whatever. So anyway, all these people were like, "Stop," you know, telling him to stop and stuff and he just didn't care. >> Yeah. >> He said, "I don't care cuz I don't know what he's going to do, you know." But anyway, it's crazy. >> Looks like he's wanted, >> huh? >> Looks like he's wanted. He's crazy. Look like he's got a couple warrants. >> That's my 15-year-old son that he was. So you got magazines looking at the car. >> My son and my wife are waiting for us in the drive-thru. >> Yeah. >> So he comes this way. My wife and my son right here. He's right here in front of us. And my son just looked at his vehicle and then he jumps out telling him he's holling at my kid. I said, "Sir, please." And then as soon as I got out, he he comes to me and then he's like, "I've been in prison. I just want to get out of here. We're trying to get some chicken nuggets and get out of here." He said, "I'll kill you. I'm in I've been in prison." >> Yeah. And I said, "I don't care where you've been. We don't want any troubles." He's like, "You don't think I'm packing?" I said, "Sir, we're you you know what I'm saying? This we're getting chicken nuggets. I will talk to my son. If he looked at you, I apologize." He wasn't having any piece of it. >> That's so That's just bizarre. >> He's a lunatic. And of course, I didn't hear anybody. Seems like it's forever, you know, to get somebody here, but I'm sure it was seconds, you know, minutes. >> Yeah. Yeah. You're okay. Yeah. You don't need to see EMS or anything like that. >> I don't think so. My face before he hit me. >> He's been hit in the face. You know, it's a little >> Yeah, >> over what? Over my son looking at his vehicle. My son didn't do anything. I was watching my wife and something over here. >> Yeah. Ridiculous. >> If you want, you can get I don't know if that's shade, but >> you get a stand out here. I might as well see it. >> I mean, I want to press charges, you know? I mean, I don't know what that looks like, but >> seems like he has some warrant, so he'll be going regardless. So, >> I have a warrant, too, from about 25 years ago. It's not nonextraded from another state. It's from an unpaid traffic ticket. >> Uh, Montana. >> Yeah. Okay. >> Mine still shows up, but >> I've been making payments until they said, "Yeah, don't worry about it." So, never They said I'd have to go back there. And of course, when I talked to an attorney here about helping me, cuz it's been 25 years. >> Yeah. >> They said, "Well, you know, you were 18 when you did it. You're 55 now. You should probably figure that out. I said, "Yeah, I thought that uh thought I knew everything." Whatever. You know, it's a smart alley kid, I guess. But times change. My mom is in law enforcement. Has been for 30 years. >> Oh, wow. Yeah. >> Where at? >> Uh North Dakota. >> Okay. >> So, she gave me lots of talking, too. But what it was is I paid uh it was a $7,500 fine and I thought I'd be a smart alec about it, you know, cuz I wasn't getting along with the probation officer. So I took it to him in singles and change. >> Yeah, it wasn't a real smart. >> How you doing, sir? >> Doing all right. What about yourself? >> No, but the guy sent me the video. >> Oh, you already sent you. Oh, he's on that side. I'm just going to have you sign this real quick. Just saying that came out off of hospital saying this time. I'm not a physician. I can't give you the clean bill of health. There could be something going on internally or whatnot that I can't see. That could lead to other complications leading up to that. Just have to give you that whole field. If you're okay with that, then if anything changes, we're calling back in. Okay. >> Uh yeah, I've got everything. Uh >> California. >> Oh yeah. >> Refugee. >> All right. Is that what they call it now? Refugee. >> So where did you do your basic ed? >> Oh benning. >> Benning or what? The old school res. >> Hey. Sorry. So I few questions. During the the whole scuffle. >> Well, what happened was I pulled around here to get in the drivethru. My wife had to use bathroom and so did my 15-year-old. So, they went in this side of the building. >> I got in. We ordered chicken nuggets. I got in the drive-thru and we're coming around this way and my wife and my son were walking right over here and I I saw my wife and son. They kind of looked at the vehicle right here cuz I was right behind them. And this guy jumps out of his vehicle and he's tolerant. I said, "Hey, hey, sir. I got out of my car and I said, "Sir, take it easy." He goes, "I'll kill you. I've been to prison. You don't think I'm packing?" And he grabs like he's got something. I said, "Hey, hey, you know, I don't I don't I don't want any troubles. Please, just get in your vehicle. Let me get in my vehicle. Let's go about our date." He's like, "All my kids." He goes, "I don't give a what you got." And then he took a poke at me. And I backed up like this and I grabbed him. I grabbed his arms. I punched him, threw him to the ground, and uh that was it. Tried holding him there. Help me up. I'm going to you. And I'm like, "Call cops. I got something for you." And I said, "Sir, relax. Relax. The police are almost here. I can hear the sirens coming." He's like, "I don't care. Get let me up right now, mother. I ain't worried about cops. I don't think I dealt with cops." So, I don't know what you dealt with, but I'm not letting you up until the cops get here. You just told me you're going to my family. So, I had no reason after he took a poke at me that he was going to do whatever he said, you know? And then just the way he looked, I was like, I have no doubts. He's probably been to prisoner. He's probably done whatever he said he was done. But I wanted you guys here. That's why I told my wife I'm going to call 911. But he just kept on and would not stop. And his wife was standing over. This guy's wife is going, "Get off him." I said, "Ma'am, I have the police are on their way. I'm He told me he's going to kill us. He doesn't have a gun." She said, and I said, "He just told me he has something, you know, for us. out and so I just held him there until his guys showed up and then nothing. I think he probably was still even with you kind of back. I was just like right before he threw a punch. What was he say? He said I'm took a punch at me. So then I grabbed him, threw him back towards the back. I said, I said, "I'm calling the cops." And I had tried having everybody call the cops. And he said, "I ain't worried about cops. I got something for you. I got something for you. Let me up." And I said, "Sir, we there's no problem here. I'm going to wait till the police get here and then they can take care of it. Whatever we got to do. I'm just not I had no reason to to believe anything other than he would do." >> So So what what do you want done right now? Do you >> I want to press charges for him. I'm trying to tell us he's going to my family. I mean, >> all right. >> I don't know what that looks like, but >> All right. We're gonna we're gonna need to get a written statement from you. >> Give me a couple statements. Uh one for him and one for his son. >> Yeah. I got a couple statements here. I think my pen might be >> I probably don't. >> Okay. >> As well. Let me know if you guys need a panel. I can get one for you. >> But uh >> All right. Um I have one clip. I'm sorry. Um Okay. Whatever you think. >> Um so at the very top just your name and then all your contact information and then all those lines. just basically everything from start to finish. >> If you could just notate in your statement what what she saw too. Um since you guys pretty much saw the same thing like we just really just see yours and then his. All righty. Well, I'm sorry. What was that? >> Yeah. Everything what he said be be be as detailed as possible. We want everything. Okay. Sorry. >> All righty. >> Sorry. >> No, you're good. You're good. >> Thank you for yours. >> Yeah. >> I'll just be right over here. >> We didn't see that one time. >> Okay. Okay. I mean, >> I saw the man get out of his car and approach my husband and I didn't I had no idea what's going on. I didn't think it was anything. I So, I got in the car and the next thing I know is I seen him come at my husband like aggressively and anyways then they're on then they're on the run. We tried approaching you >> here. He knows better than I do. So, my son and I, sorry, we were in the breast together and the drive-through line and when we came out, what happened? >> We were walking through right over here right here. >> Okay. And and we have video of all this somehow. >> So, no one in here has video of this encounter. Okay. But, and do you know them? Cuz I heard you call her by name. Called her Mia or something like that. >> Oh, >> okay. Okay. I was like, >> that's why I was like, this is so weird. We like know each other, but we're fighting in a drive-thru. This is I'm so confused right now. >> So, did y'all see what happened also? >> Yeah. This one here, you're going to want to talk to >> He says basically he's walking out here and that guy >> that guy flips him off. So, he stares him down and says something to him. >> Tell me what happened, man. >> All right. So, uh, we were walking from the restroom and we came up beside here and, uh, I looked I looked at him in the car. >> Okay. >> And that's where I don't know if he thought I gave him a dirty look or something, but that's where he flipped me off. >> Okay. >> And, uh, at that point, I looked into my dad's truck and he saw the whole thing. And uh, I kind of I was probably right here. His truck was right there and that's where he opened the door and got out and uh he tried approaching me and that's where my dad came out and approached him. But uh yeah, that's that's what happened there. And um at that point he was with my dad and he was like he was saying you're not going to do nothing. Punch me, hit me and stuff. And uh I was about to get in the truck and I don't know what happened after that, but they were on the ground and uh he said something about a gun and how my dad was punching them and he was like, "I'm not done. As soon as I get up, >> he's like, "I'm not done. I'm not finished with you." That's what the the Latino said. But uh >> that's about all I know about all. >> Eric, can you talk to me for a second? >> Yeah. Can you help me up, please? Yeah, >> that's right. >> Step right over here and talk to me real quick. So, >> tell tell me in your words what happened. >> Yeah, >> it's right here. Tell tell me in your words what happened. >> So, coming this way, I can't see because the pillar in my vehicle is big. >> Mhm. >> And I'm shorter. So, I said lower in the truck. >> Okay. >> So, when I said lower in the truck, I couldn't see him and his mom walking this way. Okay. >> Hey, I'm sorry. I didn't see y'all because it look like they want to walk this way in front of me. And I don't like disrespect the kid and their mom in front of each other. That's that's not right. And then he flipped me out and said, "F you." I'm like, "What?" So I got off like, "What's wrong, man? Did I do something wrong?" You know, I was going to apologize to him. And then when he did, his dad jumped off and said, "What's wrong with my kid? You got a problem with my kid?" I said, "Yeah, you need to teach respect. I got two little girls here. You can't be doing that." >> Okay. >> And then he just started saying, "Well, I got something in my pocket. I changed your mind. This that I've done jail time and this and that." And he says, "Well, I've taken care of commissary and everything like that." I said, "Look, man, I don't care." I was like, "You got a gun? What you got?" I don't care. I'm not scared. I said, "Man, because that's stupid what he's doing just walking around flipping people off and saying, "F you." Okay. >> That's not right, man. I got two little girls that see that and I don't want them. >> You got out of your car in the drive-thru to talk to him about that. >> Yeah. I was going to tell him sorry because I was like, man, if I did something, I apologize. You know, I want to respect him and his mom and I don't want him to see his mom be disrespectful. And then, you know, him doing that. To me, it's like, man, you disrespect your mom. You're making your mom look like an idiot. Like, she didn't raise you right. >> So, I was like, man, if I did something wrong, I'll apologize. But I was like, what's the problem? What did I do wrong? you know, and that's when um his dad was threating me and I said, "You know what? I'm not going to lie." I blew him a kiss. I said, "F you." >> Okay. >> And when I got ready to turn around to walk back to my truck to get back in, that's when he hit me and punched me. >> Okay. >> And then I lost my footing. That's why I'm like sounding kind of horses. I can't really talk. And I lost conscious. He slam my head on the ground. I feel it right here on the back. >> Okay. >> Or he busted my head on the ground. >> Okay. >> All right. You can go you can go back to EMS where your police >> everything these men say on camera is evidence and it cuts both ways. The law leans hard on one idea here. The aggressor. The person who picks the fight, who pushes it, who won't let it go, usually can't turn around later and call it self-defense. So, one of these men, still working to sell himself as the victim, keeps handing the officers proof that he's the one who kicked it off. >> I thought you were going to go to the hospital. >> Oh, I I I didn't know if I got to get on there. I was going to walk over there. No, they can they can give you a ride. >> They can come over here. >> Yeah. Okay. >> I really >> Hey guys. >> Eric. >> Yes. >> What do you want done about this situation? You want to press charges? What do you want to do? >> I want to press full charge. Everything I can do. >> Okay. All right. >> All right. I'm going to get an ID on you real quick. >> Yes, sir. >> Is the address on your ID good still? Yes, sir. >> Real quick, uh, when was the last time you checked your sugar? >> Uh, not today at all. Since yesterday, I believe. >> Yes. Okay. >> And then somebody still has an ID or that Eric has it. >> I do not know the answer to that. I think my partner has a steel. >> Okay. I wasn't even sure what hospital they were taking us to. >> Y'all see any of this chaos? >> Did you see any of this? I got you. You're good. Thank you. >> Yeah, cuz I don't think >> I don't know if we actually can see it on the area. >> Okay. >> But but I have one of the guy that saw it exactly what happened. >> Okay. >> Okay. Because Yeah. Let me see. Uh, back drive through camera, front drive through. That's that one. And back drive through that. The only one that we might can see is on that one. >> Okay. >> This one down here in the bottom right. >> Yeah, this one right here. So, let's see what camera is that. Uh, let's put single one. I just want to see the number of the camera. So, it's camera 19. >> Okay. >> So, that's Let's put a lot. >> It'll be close. Yeah. >> Play back and that will be like today. And now we came like around. >> Right now it's 3:16. >> 3:16. >> Yeah. I think it was pretty close to three. But I had two of the youngest adults who taking orders and one of them was doing face in the back. Okay. >> And they saw everything that happened. >> They saw it all. >> Where are they at? >> Right now is the Gary right here. >> Oh, okay. >> He's one of them. And the other one already went home, but he said you need his statement. He'd be able to do it tomorrow. >> Okay, perfect. >> Yeah, he saw everything. >> You saw what happened? Okay. So, what exactly happened from your point of view? I was back there um cleaning off the trays and we had both noticed that there wasn't a driver in the green truck. >> Okay. >> And we had both looked out the window and I saw both the guy in the white truck and the green truck. Um they were standing there. They looked like they were arguing. He got up on his face. The the littleer guy >> and then the taller guy I just see him start punching him and then they went to the ground and when I got outside I saw he had him on the ground choking him. >> Okay. The bigger guy was Okay. right there. So, >> so right there. So, let's back. Okay, let's first of all, let's put it out regular. So, there's a truck coming in >> right there. And and you see the guy who's just coming going out of the truck. There's two people walking up. Yeah, that's the other truck driving up. >> There's a guy on the truck coming up right there >> right there. >> Out. >> And that's all you can see. So it all happens on the other side of the wall. >> Yeah. >> Like I said, it's like a dead point >> cuz the other truck will point where we take the orders. So >> Mhm. Okay. >> And there's no cameras near the the menu area. >> See right there? >> Yeah, there's another camera. Let's see. >> Oh, wait. Hold on. Thought I saw something. >> Okay. And then that person gets out. >> Everybody's looking. >> Everybody's looking. Yeah. >> Wow. I didn't realize she got out. >> What? >> I don't know if she's recording it or what. >> Yeah. >> And the back door's open. >> The cashier told me on the back. Then I went ahead and called you guys. >> Okay. >> I even told Jerry right there that you already was calling. >> Yeah. doesn't really captures any bit of a fight, huh? >> Mhm. >> Okay. All right. Do you know would that have been in view of the cameras on your menu? >> Let's see. We can see. Yeah, we can see. >> Okay. So, that will be drive through with the speakers. I remember the camera. >> I think it's this one right here. >> Okay. be full screen. Maybe >> the one above it. All right. So, yeah, it doesn't really catch one. I'm sorry. >> No, it's all right. Um, your manager. Is that right? >> That's correct. >> Oh, okay. Um, and then if I could talk to Gerald real quick just to grab his info. >> Hey, man. Sorry. I don't want to take up too much of your time. Um, so you said you were standing over here at the window. >> I was in the back at that like back window. >> Okay. >> Which kind of had a view exactly what they were doing until they went down below the trucks. >> All right. All right. So, yeah, from the video looks like the guy in the green truck, the the shorter guy, the ball guy, he got out. >> Um, and so then they started talking or arguing, he got in the the taller guy's face and then taller guy started punching him. All right. >> From what I could see and when I got out there outside, that's all I had seen. >> Okay. Um, do you know your license ID number by chance? >> Uh, no. >> Okay, that's all right. Is it Texas? >> Uh, yes. I res appreciate you, man. Where your knives at? >> Stand with me. The video shows you the first time. Okay. I I understand back and forth. I understand that. Okay. Moving the mouth to keep the fist out of a man and such open. Okay. So, right now you are going to go to jail for assault. Okay. Right now you're trying to evidence I have. No, there's people there. uh all that that that's for down. >> So what happens with >> I mean they said there there are different >> this is where it stops making sense at least on the surface. An arrest isn't a ruling on who was right or even on who started it. It's a narrower question whether the officer has probable cause. The people here with nothing to gain all land on the same man. That not who started the argument is what probable cause runs on. And it puts him in cuffs. Even if he never wanted the fight, even if the other man walked up looking for it. >> Like there's other the girls were in the back taken. Like that was sent to me from another girl. >> Okay. Yeah. We're going to have you send it to this phone right here. Okay. >> That way we can have it. >> Uh Sergeant, can you help me? I need to double cuff him. >> He's got a herniated disc. I don't want to aggravate him. >> She said someone else sent you this video. You didn't take it. >> That was uh once I saw in the rearview mirror Eric go down. I got out of the truck back. I was like, "Start recording." >> Okay. >> Cuz both of our daughters were in the back seat. >> Oh, y'all's daughters were back there. Oh, okay. So, it was your daughters that recorded it? >> Yeah. >> Gotcha. >> Yeah. Eric hadn't eaten all day. He has diabetes and we were headed out to uh we just lived on the other side of the bridge. We were headed out to uh they wanted to go to Six Flags. M. Oh yeah. See, I didn't even see this one yet. I just haven't went through some of this. Like straight up just strangling them. >> Yeah. So, this is another one too. >> Yeah. If you'll just send me all the ones that you have, I'll make sure and and submit them to the case. >> My dad's retired from Fallen County and he was like, I don't know how the f we did it before this technology. >> It definitely helps. >> Yeah. when it car started getting too techsavvy, he retired. He was like, "I don't have time for this." >> He like literally types like one at a time. I'm like, "Oh my god." >> A couple guys like that. >> He's like, "It's time to retire after 25 years." >> You sent the other one, too. >> Yeah. Let me see. Ever since I had that workout on my phone today, it's being silly. It says it went through. I don't know. >> Oh, there it is. Yep, I got it. >> Yeah. >> Yep. I got uh both videos, too. I'll upload them to to Digital. Do you want them? >> Let me Let me look at them one more time. >> Okay. So, I haven't seen both of them. >> You can just take the phone if you want. >> I was like, "Hey, there's another video on my phone." >> Like, I saw the first one. >> Like, Eric is on the ground being strangled and I told him a million times he get off. Like, he does not have a gun. There is no denying that. I asked them and I was like cuz she's like what's happening because she's like that guy didn't show my husband first and I'm like she's like people were telling us they shut down I was like we have video like very clearly completely me at all y'all I get on so but I I don't live the criminal like to him and how it is in prison. Yeah. That's why I try telling him like we're done with that. We're like you have to get out of that. So right here, like I said, we couldn't tell if they were coming and going. It was like they were speed up and then they was close. I was like, "What are y'all doing?" So Eric literally got out and was like, "Hey man, what's going on?" This >> as I expect a husband to like I I expect that. >> Yep. >> They get chest to chest up to that point. Like I got no problems. >> Yes. >> Yeah. We're a little hot. We're a little hot. Like we're doing stupid stuff. >> Yeah. Yeah. She's leaving right now. But as soon as we start hitting each other, you can't. >> Where are you from? >> I was born and raised. That's why I laugh and said I was like, we moved here to get out of the ghetto. [laughter] >> And then did somebody give him his ID back? >> Yes. >> The charge is assault. That's a class A misdemeanor under Texas Penal Code 22.01. And it carries up to a year in county jail and a $4,000 fine. And the man who gets cuffed for it is the bigger one. The guy who put the other man on the ground and choked him. He threw the punches. So on that video, he's the one who committed the assault. The guy who got out of his truck and got in his face. The one with everything to lose. He's the one who walks. For all the talk about a gun, officers never found one. If you were making that call in the parking lot, did they get it right?
