16th 2023 patrolman Edward Jennings with
the Middletown Township Police
Department observed the black 2012
Toyota Camry swerving into the shoulder
on Highway 36 between Wilson Avenue and
Main Street he activated his overhead
lights and attempted to stop the vehicle
but the driver continued driving since
the driver was not stopping he activated
his audible siren and the vehicle
eventually stopped inside the uturn on
Main Street and Highway 36 he used his
PA system to instruct the driver to pull
into the deli parking lot and the driver
complied insurance insurance um
um 31 392 status
check

coming from my boyfriend's house uh in
Keyport I'm just going back to my
patrolman Jennings made contact with the
driver and she told him that she was
heading home after leaving her
boyfriend's place in keyboard he noticed
that she was slurring his speech and
seemed confused about her proof of
insurance after giving the officer her
license and registration he asked her if
she had consumed alcohol before
operating a motor vehicle but she denied
it based on his suspicion of impairment
patrolman Jennings called for another
officer to command administer field
sobriety exercises around 11:40 p.m
patrolman Dominic libery arrived on
scene to assist in doing so and what
were you doing tonight um hanging out
just seeing them uh you know okay did
you have anything to drink tonight no I
didn't nothing at all no okay din repo a
so the reason I'm I stopped you is you
went over the white line three times
when I was behind you I'm sorry then
when I attempted to stop you you didn't
even know I was behind you I had my
lights on so then I had to activate my
siren to get your attention which got
your attention then you just continued
to drive you went into a U-turn and then
you just stopped in the U-turn I'm sorry
I guess I got a little nervous okay then
when I told you where to go to go
straight across then you started going
that way then you stopped again so
that's why I'm asking if you've been
drinking tonight it seems like uh seems
like something's going on am I wrong
from saying that no I just I got a
little nervous I don't know what uh what
got over
me okay can you put your car in park

now as he started speaking with her
patrolman Liber he detected the odor of
alcohol and noticed that her eyes were
bloodshot the first exercise was the
horizontal gaze nystagmus hgn test and
patrolman libery observed a lack of
smooth Pursuit distinct and sustained
nice stagis at maximum deviation and the
onset of nagus prior to
45° he did not observe any vertical
nagus the second exerise was the walk-
and turn test and she failed to touch
heel tooe on each step while lifting her
arms to assist with her balance the
final exercise was the one leg stand
test and she did not raise her foot in
the proper fashion and noticeably sway
for the duration of the test okay it's

vibe that you're intoxicated you you

going to take a series of nine Heel To
Toe steps so they're going to look like
this one 2 3 and you're going to go all
the way up to nine when you get to nine
you're going to leave your front foot
planted and you're going to take a
series of small steps like this okay and
you're going to turn around then you're
going to take nine more Heel To Toe
steps back okay okay so just nine
forward and nine back two three so
they're going to look like that yeah
it's going to be nine forward and then
you're going to do the turn and then
nine back okay all right while you're
doing it you're going to count out loud
you're going to keep your hands at your
sides you're going to look at your feet
while you're doing it and once you start
don't stop until you're done okay okay

libery placed her under arrest for
driving Under the Influence her vehicle
was searched and impounded for a
mandatory 12 hour hold under John's law
he transported her to Middletown
Township Police headquarters for initial
processing okay all right we're going to

to be impounded I'll explain all that
they're going to tow it but I I didn't

anything based on the tests you were you

sobriety test we just

at police HQ she was read the standard
statement for motor vehicle operators
and she agreed to submit breath samples
for 10 ing patrolman libery operated the
ALCO test machine and her results
indicated a back of 0.1 foot% which is
over the legal limit of
0.08% since there was no one to sign the
potential liability warning form on her
behalf she was placed in a Cell until
she was sober enough to be released she
was issued the following summonses
operating Under the Influence reckless
driving traffic on marked lanes and
failure to possess driver insurance card
with her real quick you stay with you
don't need to open it just give me one

the DUI part if you want to do the
whatever you saw so yeah take that okay

Reckless and the uh the DUI if you want

he's he's going to bring me a piece of
paper from the tow truck guy that he has
to fill out he's going to bring me that
do I got to pay for it for the toe yes I
don't know how much it is awesome
