On May 19th, 2025, police responded after a woman reportedly exposed herself to patrons at a bar. But the incident took an unexpected turn when officers investigated and she ended up facing a DUI arrest. >> Good afternoon. I'm Officer Smith with Wanke Police Department. Reason for the traffic stop is you were weaving all over the road when you pulled out. >> Oh, I'm sorry. >> Okay. Any reason for that? >> No, I just put gas in my vehicle. >> Okay. How much have you had to drink tonight? >> None. >> Okay. Why do you absolutely weak of alcohol then? >> No alcohol. >> Okay. You haven't had any alcohol at all? >> No, I just >> Okay. >> Sorry. >> So, where were you coming from? >> I dropped off a bunch of dogs at home and then I'm I'm heading back to Rabbits. >> Okay. But where were you coming from before that? >> I drove to Madison to drop off dogs. >> Okay. Were you coming from Buck and Honeys? >> No. >> No. No, I went >> So, you haven't been to Buck and Honeys at all? >> I went to um Quick Trip. >> Okay. Was that before or after you went to Buck and Honeys? >> Quick Chup. >> Yeah. But did you go to Quick Trip after you went to Buck and Honeys or before? >> No. No. After? No. Quick up. >> Okay. >> Okay. And how much have you had to drink tonight? >> None. >> Okay. Would you be willing to do some field sobriety test for me? >> No. >> Okay. I'm going to have you step out of the vehicle for me. >> Okay. I'm going have you place your hands behind your back for me. >> Okay. Right now, you're being placed under arrest for robing a motor vehicle while intoxicated. >> 5741. We're 955. >> Okay. Do you have anything in your pockets on that's going to poke, stick, or harm my partner here when she searches you? >> No. >> No. >> No. >> Okay. >> All right. We're going to come around to the back of your car here, and I'm going to pad search you out. Okay. >> All right. Face the back of your vehicle for me and separate your feet a little bit. Just going to pad search you to make sure you don't have anything on you. All right. You want in the back of yours or mine? >> Uh, she can go in the back of mine. We're going to search the vehicle here. >> Sounds good. I'm going to step on back here. >> Yep. Good day. Go ahead and have a seat. >> I got you. You might have to go butt first and then slide your feet down. >> Then just turn your head that way for me. I'm just going to buckle you up. K5736. We're going to be searching the vehicle. There's a pot pipe right in plain view here. So, >> does she not want to get out? >> No, she she tried to get out right away. She refused fields and she's she was swerving all over the road, almost hit the curb, and she had stopped at Quick Trip. So, that's why we all missed her coming down south entry there. But we got the pipe in plane view here. So, we'll search it. Um, I'll actually You wanna I'm gonna get the ball rolling with the uh informing the accused cuz if she's going to be a no person, we're going to have to do a warrant. Um, so do one of you guys want to stay here and search it. >> Yeah. >> Okay. >> Pop pipe in the center counselor. >> There's a weed pipe in the center council there. Hey, what is your first name, ma'am? >> Elizabeth. >> Elizabeth, do you need anything out of your vehicle? A phone, wallet, keys, or anything? >> My phone is in my vehicle. Yeah. >> Do you want it with you? >> Ideally, yeah. >> Okay. Okay. Um, wallet. Anything else? Keys? >> Yes. >> Okay. You want both of those with you? >> Yeah. >> Okay. Gotcha. Is your Is your driver's license in your wallet? >> Yeah. I just didn't show Can I show it to you? Can I like show you? >> No, we're not going to get out at this point. >> Okay. >> Okay. All right. So, Elizabeth, um, so right now you're under arrest for OWI. Okay. You can't leave your vehicle parked right here where it is. So, would you give one of my partners consent to move your vehicle to a legal parking spot in the parking stalls over here? The other alternative is we tow it at your expense. >> Yeah. >> Okay. That's okay if they move it over there and park it. >> Okay. Then they're going to roll up the windows, lock, and bring the keys to us. Okay. >> Okay. >> Okay. >> All right. I'm going to get your seat out here for you and I'm going to have you step out with me. Watch your curb. All right, you stay right here for me. Right this way. There's your front door here. This door right here. Right here. You have a seat right there for me. Right. Here's this if you'd like to follow along while I read it to you. Under Wisconsin consent law, I'm required to read this notice to you. You have either been arrested for an offense that involves driving or operating a motor vehicle while under the influence of alcohol or drugs or both. Will you submit to an evidentiary chem chemical test of your breath today? That's a question for you, Elizabeth. Elizabeth, will you submit to an evidentary chemical test of your breath today? If you don't answer, I just have to mark it as a refusal. I'm just going to put two sets on there. >> Okay. >> You want to stand up so I can get the another set on you to relieve the pressure a little bit? Okay. >> Yep. >> Just going to take your left hand out. Okay. And then we're just going to put on two sets so it your arms aren't so far behind your back. Okay. >> Thank you. I really appreciate >> you. Give me just a second here. That one's going to stay on. Give me a second. >> Good. [snorts] That help a little bit. >> That feels a lot better. >> All right. Careful. Careful. Careful. >> Okay. >> Yep. >> I really appreciate it. >> Yep. Yeah. [snorts] No, dude. Don't Don't lay on the floor. Stand up. We're not laying on the floor. >> Okay, I'll help you stand up if you need, but we're not laying on the floor. Can you stand up? >> No. >> Why? >> There's no law that says I cannot sit here. >> Legally, I can. >> Okay. I'm not having you lay on the floor because when you fall asleep, I'm not getting you back up. That's fine. But >> no, it's not fine because you're not laying here all night. >> Read me my rights, please. >> I'm not asking you any questions to have to do so. Can you please stand up? >> No, I'm not resisting arrest. >> I'm asking you nicely to stand up. >> And I'm telling you nicely. There's no law that does. >> I am telling you to stand up >> and sit in this chair, >> okay? >> Please. And thank you. There's laws and I have my rights. You have your rights. There's nothing illegal about me being right here. >> I do not want you lying on the floor because if you want it's about >> it is right now. I do not want you lying on the floor. >> My rights. My rights legally. I can >> Your rights are you have the right to remain silent. You have the right to counsel. And if you can't afford it, council can be provided for you. Nowhere in there does it say you have the right to lay on the floor. And nowhere does it say that I do not have the right to not lay on the floor. >> Okay. Well, either way, can you please stand up? >> No. [snorts] >> 36, if you can come in here, please. >> I have the right to I This is my right. I have the right to >> I'm not doing this with you. Please. And thank you. Can you please stand? Yes. >> Please stand up and sit in the chair. >> Legally, I have my rights and my right is to remain. I want to sit here. >> Okay. I I already told you why I don't want you laying there or sitting there. Because if you lay down on the ground, we're not getting you up off of the ground. >> What's going on? >> She doesn't want to stand up and sit in the chair. She wants to lay on the floor. >> Elizabeth, what's going on? >> She wants to lay on the floor. It's her right to lay on the floor. >> No, it's not. You're going to sit in the chair. >> I want to sit right here. >> Why? >> Cuz she wants to sleep. >> Okay. Well, we're not going to sleep. We have about 5 minutes before we leave. We already have a warrant sign for a blood draw. So, we're going to leave for the hospital. Okay. >> Okay. >> So, can we just sit in the chair until then? >> Can I sit right here until then? >> No, we're going to sit in the chair because I don't want you falling asleep on my floor. >> What are my What's the next option? >> The next option then? There are no other options. That's your option. Sit in the chair and wait and then we're going to go to the hospital as soon as I get this emailed over to me. >> Was this arrest? >> Well, we don't want to go that route. What if you don't sit in the chair? Then can you just please sit in the chair for me? We're trying to >> sit right here, please. >> No, Elizabeth, we've we've given you as much leeway as we can. I already didn't tow your vehicle for you when we couldn't find your key. I'm trying to work with you here, but if you keep pushing my buttons, we're going to go with resist resisting arrest and you can just go to the jail after all this. >> No resisting. [snorts] >> So, here's the thing. You're not doing what we're telling you to do when it's a lawful order is resisting and obstructing, right? So, as of right now, you can call for a ride. Once we're done with this blood warrant, I'll let you call for a ride and I'll let you go home tonight. But if if we tack on resisting, you're going to jail for the night. So, the choice is yours. I don't care either way. [sighs] So, would you rather sit in the chair or would you rather go to the jail after? >> Do you need help? >> Yes. Okay. >> I appreciate it. It's just going to be a couple more minutes and we'll be on our way. Okay. I'm going to fall. I'm going to fall. I'm going to fall. >> Can you push yourself up with your legs or not? >> I'm going to try. >> All right, Elizabeth. So, >> yes, sir. Yes, sir. Here's what we got here. This is a warrant for a blood draw based on everything that's happened today. A um >> I'm listening. I'm listening. >> Okay. A James County judge granted us permission to do a forcable blood draw. Okay. So, we're going to go down to Meridor Hospital. Um all things go well. Hopefully, you'll be compliant and we're going to go through with this blood draw. Okay. Um if you're not compliant, then we're going to get more officers and we're going to have to forcefully fulfill the blood drawn. Okay. So again, um we want this to go as easy as possible and we want you to be cooperative. Um so we're going to head down there right now and then we're going to get the blood draw and if you still remain cooperative and everything, then we're going to call a responsible party and get you going home tonight. But if you become uncooperative at any point or you resist at any point, we're going to tack on resisting and you're going to jail. Okay? So you don't understand all that. >> I'm not resisting, but >> I know I know you're not resisting right now. I also do not compile the blood draw. >> Okay. Well, you don't have to. That's what the warrant is for. >> Okay. >> Okay. So, um, give me one more second. I'm going to grab use the bathroom quick. >> Grab something. I'm going to take off. >> All right. Do you prefer Elizabeth or do you go by another name? >> Dispatch has been updated. >> It does not have. >> Okay. So, we're going to have you get up now. Okay. So, we're going to walk out to the squad and make our way to Meridor. >> Can you put my glasses on? >> Yes, I can. One second, ma'am. >> You don't mind me asking what prescription do you wear? >> No idea. >> Had eye surgery a few years ago, so >> No, I'm blind. Like, I'm blind without them. >> No, where where do you want me to set them? behind the ear like >> Okay. How about I go like this and you put your head on where you want them? >> Yep. And then a little bit tuck behind the ears. That's perfect. >> You want this one? >> Yes. Okay. There you go. >> That's perfect. Thank you. >> All right. I'm going to have you stand up and we're going to walk right off that door that we came in right over here. >> Yes, ma'am. >> Yeah. the front door here. >> Oh, wow. Okay. >> All right. Going to reach over here to put the seat belt on you. >> Yes. I >> think you're sitting on the >> I'm sorry. >> No, you're okay. I got it. I found it. >> I'm just trying to do this onehanded here. >> All right. There we go. >> Oh, sorry. Didn't mean to scare you. >> Okay. Sorry. All right. So, um, can you unbuckle yourself over there? So, we're back at the PD here. All right. I'll have you hop out. We're going to go wait inside. Hopefully, mom or dad should be here in about an hour. Sounds like hopefully dad. >> Do you have my phone, son? >> I do have your phone. Yes, I have your phone and wallet. >> Okay. >> My car keys are >> in your car somewhere. In your car. >> We're going to head right inside. Okay. Um, >> I'm going to have you give dad a call and just check in to see where they're at. Then we'll go [snorts] over your paperwork and then it's just a waiting game. Guess [panting] what? >> How far are you from Wani? >> What? >> How far are you from Wak? Where are you? >> I'm at the PlayStation. >> What? WS? >> Yeah, that's right. I had this address. >> Yes. >> I got to find my car first and I got to get the keys. >> Where? I got to go. >> Just come get me first. Come get me first. >> Dad sounds like he's handling a bit better than mom. >> Yeah, mom's psychotic. >> All right. So, I got to read the um You're all good. Before we ask you any questions, you must understand your rights. Do you have your right to remain silent? Do you understand those rights as I've read them? >> Would you answer any questions today? No. >> Okay. >> Okay. So, I'm going to go over this paperwork and then um I'll get those handcuffs off you and it's just a waiting game until mom and dad can hear them. So, this is what we got for paperwork today. So, this is your copy of that warrant. Um this is a warrant for your blood because you refused the breath. So, this is a copy of it. This is the judge signature. Um this is me who applied for the warrant. um I received at this date this time. This is the blood draw executioner. Um this is the um hospital staff that actually drew the blood at 9:28. So this is the informing the accused form. This is what I read you to begin with. I requested your breath. You said no. Um identified you via driver's license. So this is what this is why we went the warrant with the blood. Um so tonight you're going to re receive four citations. Again, you have a mandatory court date though. So none of these are set in stone. So, right now, um, we're being charged with operating while under the influence, third offense, $850 citation, six points operations. Second one is operating left of center, $213,10, four points. Uh, third one is possession of THC for that um, uh, THC pen you had in your car, $100. Um, you may pay. And then possession of drug paraphernalia, another $100 for the week. >> That's all legal. Well, it's all legal. >> All the THC stuff. >> Okay. Um, >> it it tested positive for THC, so I'm going to charge you with it. Um, >> it's from the legal smoke shop. >> Okay. Um, I would get all your ducks in a row with that and just explain that during the court date. So, with these four citations, you have a mandatory court date, August 25th, 25 at 8:30 a.m. The reason it's so far away is we have to wait for that blood result to get back from the blood test. So, I have like the receipt. Well, I mean, I don't know if I have the receipt on or not, but I have like receipts for them. >> If you have the receipt, I would save it then. Um, so the mandatory court date is going to be in Madison at 215 South Hamilton Street, room 1A in Madison. Um, the court number is right there. If you have any question, this is a mandatory court date. All the court dates are same time, same place. So, they'll go over all four of these at the same time, same place. So, you don't got to go there multiple times. Um, and this is a notice of intent to revoke your operating privileges. So, when you get your driver's license, you sign what's in what's called implied consent. So, that when you when they make you sign, what you're signing is that if you're asked to perform field sobrieties, you will do it. Um, since you refuse to do field sobriety tests, now we're going to revoke your driver's license. So, um, you should be getting something in the mail. Where what haven't So where did you guys search the car? >> Yes. >> So where is everything then? Like the pen and all that. >> So it it's seized as evidence. >> Okay. Did you seize everything like the backpack and everything? >> What backpack? >> Is there not a backpack in there? Cuz that's where the where the pen would have been was in the backpack. >> So I didn't search the vehicle. I'm not I'm not sure if >> So that makes So where did you find this pen then? >> I didn't search the vehicle. >> So then where's this pen at? So it's it's an evidence. So another officer her report will say where the pen was located in >> Okay. Because to my knowledge the pen is in my backpack. >> Okay. I'm not sure where she found the vehicle. I wasn't there for that. >> Okay. >> Um but the reason we searched the vehicle is because there was that marijuana pipe in plate view. So >> which is all legal marijuana. It's all legal. But I wasn't smoking it like >> Okay. It's all legal. >> And again, I'm I'm not here to say whether it is delta 9. >> Okay. I'm not here to say whether it is or isn't legal. All we know is it tested positive for THC um from our present positive. I I understand that we we don't have a test that differentiates between >> Okay. >> Um any of those. All we have is a test that says whether or not it has the presence of THC. >> So that will be for a judge to decide whether they want to send that stuff to a a lab to get that. they can gladly send it to her. >> I I don't know that that's that's all going to go through the court system and they're going to handle it from there. But um >> not even trying to get on my own, but I'm just saying I don't want to drive because like that's all legal. >> No, I I understand. Um but you also understand that you probably shouldn't be smoking that and driving, right? >> I was not smoking it and driving. It just happened to be in the car cuz I'm not allowed to smoke with my parents. >> I I understand. I I'm I'm just I'm making the leap that if it's in the vehicle that it's also being used to smoke in the vehicle. So whether you are or aren't, I don't know. That's that's not my place to decide right now. Um but I'm just saying probably >> that in and of itself is completely fine that I >> So just so you know, your your license is going to be revoked. So, look for something in the mail so that um if you do have a revoked driver's license, you're not driving with your revoked driver's license cuz it's that's an expensive citation. It's only going to make it worse. So, this is all your paperwork for today. Um I'm going to take you out of cuffs now. As long as you agree that you're going to um stay cooperative. Okay, perfect. So, now we're we're literally just going to sit here. I'm going to do some paperwork and and wait for mom and dad to get here and then um hopefully >> go back now. Nope. I'm going to keep the phone just cuz just just for officer safety. I don't want you texting anybody, having them showing up here or anything. So, if you want to put your head down and and sleep, that's perfectly fine. Um just understand that at this point you're not free to go. Um I'm just taking out of handcuffs just cuz I want you to be as comfortable as possible since you've been cooperative with me. >> Hey, Elizabeth, can you see can you see if this is where my parents call? probably. >> Yes. >> Hey, where are you, Elizabeth? >> I'm in the police station. >> Where? Which police station? >> Wi by Starbucks. >> Nope, not by Starbucks. >> Starbucks. We're We're not by Starbucks. >> Just kidding. We're not by Starbucks. >> What's your address? >> It's 205 North Klein Drive. the address. >> It's 205 North Klein Drive. >> North Klein Drive. >> North Klein. K L E I N. >> K L E I N. Drive. >> Yes. >> Okay. We'll be there shortly. Okay. >> Okay. >> We just got to Monica. We just got to my car. >> Okay. I'll have an officer stand outside and wait for you. >> I'm so sorry about this. I'm very very sorry. >> No worries. No worries. We'll see you when you get here. >> Thank you. >> Bye. >> Was [clears throat] that called? >> Yeah. >> Okay. It started with 715, so I figured out >> they're um they're they're not from the area, so can you just stand out there? They're coming from South Century. >> Yeah, I'll just stay out there. >> Okay, we appreciate it. [snorts] >> All right, Elizabeth, it sounds like uh parents are pulling in. Uh so Mhm. Um, this is your paperwork. Classes right there. Wallet, phone. Um, so all we got to do is get one of them to sign this release form and then you can be released. Okay. Here's the thing though. If for some reason, cuz I know mom was pretty upset. If for some reason they refuse to sign this, I have to take you to jail. So, let's >> be in our best behavior to try and get her to sign this. She'll sign it >> cuz I don't want to I don't want to end up taking a trip to the jail tonight. >> She'll sign >> here. This is all your paperwork. >> That's part of it. >> You're just doing your job. >> Evening, sir. I'm officer Schmidt. >> Um I'll have you come right over here. We got to do this uh quick. >> Um so this is just a release to responsible party form. If you want to read over it, that's fine. >> I'll be I'll be driving. Yep. Yep. The nuts and bolts. So, you're not going to let her do anything. Um, that's she can't do us. She's intoxicated, you know, medicate herself, drive, operate heavy machinery, you know, stuff like that. >> So, um, all I need from you is signature and then print your name and she will be released to you. Thank you. >> Oh, god. [laughter] >> Yes. >> Yeah. We're doing that. >> That's real funny. Okay. >> Well, you think there's a joking matter, huh? >> Yeah. There's nothing funny. I really want to hear, >> right? Um, Elizabeth, the short lecture I'm going to give you is just keep in mind you can't be doing no driving. Um, someone could have got hurt today the way you were driving. Um, this is your third offense as well. So, take that into consideration. Just food boot. Okay. Um, do you have the vehicle then? >> I have a vehicle. She's going to be in my vehicle. >> Okay. But you guys were able to find hers. >> Yes. >> Okay. Perfect. >> Yes. >> How did you get there? >> So, that's where she pul she pulled into the north lot that like um drop off lot. So in the middle of towing it out of there, we just had an officer driving around. >> So number >> trying to do our best. All right. You got everything you need. You got all your paperwork. Do you have any questions? >> The t-shirt. Why? >> I just threw a t-shirt on me because I remember this. >> I do see the comedic value. >> I'm sorry. I'm sorry. I'm sorry.
