During my 29 years as a police officer in Florida, I've watched people get sold out, not usually by their own husband who's sitting 20 ft away. >> And there was a a moving construction they were doing potholes. >> Mhm. >> So, as we approached them, I started to merge over. I was in the inside lane and she saw me merging and tried to speed up to not let me in. >> Mhm. >> So, I just kept coming over. So, she actually pulled up alongside of us on the shoulder and was giving us the business. I'm like, "Yeah, whatever." So, then after the as soon as we got by the trucks, I went back into the inside lane. And she pulled up alongside of us, rolled her window down and we thought, "All right, she's going to start yelling at us." But it was So, I just said to my wife, "Just ignore it." And then the next thing we hear is bam! And she So, she threw something at the car. >> Mhm. >> It's not a big thing, but this is this is brand new and this this is definitely new right here. >> Yeah. >> What kind of car did you say it was? >> a white Chevy Traverse. >> All right, so let's talk about the obvious here. It's not necessarily about the damage to the car. You're throwing a moving object from a moving car at a moving car. So, there's a bunch of things that could go wrong with any one of those variables. Not to mention, what if this were like an elderly driver and they didn't know how to respond to to what that was or they didn't see the object being thrown and they just hear the thud and, you know, you jerk your wheel over, next thing you know, you cause a a 10-car pileup. This is dangerous business. >> Oh, okay. >> She's got a picture of the license plate. >> And as soon as it happened, we we she sped away, but I sped we caught up with her. >> Who is that? What did she look like? >> It was she was a white female, um seeing glasses, maybe ponytail, blonde blonde-ish hair. >> I thought it was more brown dark dirty, you know, like >> Dark brown, maybe? And we think she had a passenger, but we didn't see them. >> So, it's up to you guys. If you want to take it criminally, I could try and find her and forget who she is and try and file charges on them. Let's >> I say press it. >> I'm going to press it. >> And the main the main thing is one finding her and two uh none of the business cameras go to the road and because like she was next to you guys, it's going to be like right between >> Yeah. >> like blocking any cameras. >> Yeah, there was no view. >> It's going to be unless she I can get her to admit it, it's going to be hard to prove and take her to court. >> Kourtney Klopek. >> We're ready to move. Sorry. >> Nope, you're fine. >> Oh. >> I'm Officer Rodriguez with the K Corp Police Department. >> Hi. >> You guys have ID on you? >> Um no. >> They thought they were in violation of being in the curbside pickup lane. >> No. >> Okay. >> Sorry. >> What is your first name, ma'am? >> Uh what's going on? >> Well, we have this vehicle >> Okay. >> uh reported a disturbance earlier where an item was thrown from this vehicle to another vehicle. >> Okay. >> Do you recall that incident? >> Um no. >> No. >> We've been home. This is the first time leaving today. >> What's that? >> This is our first time leaving today. >> Today? >> Yeah, we just got food. >> Okay, awesome. Do you have ID with you? >> No, I don't. >> You don't? Okay. Can I have ask you to step out of the vehicle for me, okay? What is your first name? >> Maggie. >> Maggie, okay Maggie. Face the vehicle for me. Do you have any weapons on you or anything like that? You don't? Okay. All right, then place your hands behind your back. You're just being detained for right now, okay? >> He kind of knows he's got the right person because she is not resisting whatsoever. If that were you, just be your own yardstick. If you had nothing to do with nothing and you were just in a random white Chevy Traverse and it was your first time leaving, as she put it, and an officer pulls you out of the car, asks your name, tells you to face the car, says you were involved in a disturbance, and starts throwing handcuffs on you, you'd have an issue with that. She thus far has not protested too much here. >> Sir, do you have ID on you? >> I don't. My son actually lost my ID a while ago. >> Okay, what is your first name? >> What is the reason? >> What am I I haven't done anything though. >> Well, because this vehicle was involved in a disturbance earlier and I'm investigating. I don't know who was inside the vehicle. >> to call my parents right now. >> at home with my son all day. >> I'm going to ask you to stay off the phone for me cuz this isn't a current investigation. That's fine. >> My child is in the car. >> Okay. All right, go ahead and put the phone down for me. >> Call my parents. >> Put the phone down, okay? It's my scene. I'm giving you a lawful order, okay? >> 14 12 K. I don't know what you're talking about. I've just been at home with my son. >> Okay. We'll figure that out in a second. Can you grab him? >> Can I step out for him? >> Yeah, he's going to step out for you, B. >> Any weapons on you? >> No, I have my vape in my pocket. This is my vape. >> Yeah. Okay. What's your name? Xander or Xavier? Yeah. Good. >> All right, so they did their due diligence and Xavier must be the one with the warrant and he might be the registered owner. He must be the one with the warrant. That's why he won't give his name, but finally he acquiesces like, you finally caught me. >> Can someone please call my mother and father-in-law so they can >> He's in the back? >> Yeah. >> All right, yeah, we'll be there. You got warrants? >> I'm not 8. >> I got to take your hat off, can you all right? >> Thanks. >> Just double checking real quick. >> Yeah, no problem. >> No necklaces or anything like that? >> It really helps you out if you tell us the whole truth. >> All right, that's going to stop on our part right now. >> Just got a new house, a job and >> All right. >> Well, she just has a couple warrants for um >> South Collier and >> Yeah, yeah, so >> So she has warrants too and he knows where they're out of. >> She might get a bond so she might be able to get out right away, you know, so I don't even think they have to transport her to I could be wrong. How do they get her to transport her to Collier? I think they could just if you could post a bond there, I think they can just let her out. All right. So have a seat for me. Do you know your parents phone number or her parents phone number off the top of your head? >> She'll be astounded to hear this. >> Is that the husband? >> Yeah, he has a warrant. >> Yeah, he has a warrant too, right? >> There's a kid in the car, right? >> Three year old. I'm going to grab the phone. We're going to call her parents. You say you don't have any ID on you? >> I'm not sure. >> No? Nothing illegal in the car? >> No, sir. >> Okay. Go ahead and take a seat for me. >> Okay. >> Spell your first name for me. >> M A G G I E >> And where are you living at currently? Okay, what brings you into Cape Coral today? >> I'm DoorDashing. >> You're DoorDashing? Okay. Do your parents live here in the Cape? >> Um no, we all live in Bonita. >> All right. So I'm going to read you your rights, all right? >> Am I being arrested? >> detained right now regarding the investigation from earlier, all right? Okay? >> Mhm. >> I also believe you to have a warrant. >> Okay. >> Okay. Are you aware of that? >> I am. >> Okay. Awesome. I think that's why you were acting all nervous and hesitant and trying to kind of >> be cooperative. I'm just trying to >> I mean, at least you didn't lie about your name, I know that much. >> You know, sometimes it's not about being uncooperative with the cops, it's just about trying to protect yourself. Though it makes the cop very nervous because why are you hiding your identity? Like what is this warrant actually for? And they got a bonus on this one. It was a registered owner that had the warrant and then it turns out the other person had a warrant as well. You know, she wasn't being forthcoming. I'm not going to put her in for a good citizen award for doing that, but I understand where she's coming from. It's just basically like you're going to have to earn your money on this one. And they did. Once the handcuffs go on, she's just like, "Yep, not going to fudge you." We'll see what she does in this interview though. >> Okay, give me 1 second, okay? >> Um are so just be honest, are you taking me to Collier or >> I don't know. If they confirm the warrant and they want you, okay? You will be arrested under that warrant and be transported to the county jail. Then they will arrange for transport depending on where the warrant is out of. Is it out of Collier County? >> Yes, sir. >> Okay. What is it for? >> Um assault. >> Assault, okay. >> Ironically, [laughter] it's for assault. Just for geographical reference, Lee and Collier County are yeah, in the same kind of area-ish. You know, it might just be an overnight stay for her in Lee County jail. >> Figure it out together, okay? How old is your child? Cuz I don't want to leave the child alone in the car. >> He's three. I just want to call my >> Okay. I will allow you to do that. Give me 1 second. I will allow you to do that. Give me 1 second, okay? Hi, big guy. >> [laughter] >> My name is Officer Rodriguez. I work for the Cape Coral Police Department. What is your name? Yeah? How old are you? >> Uh I three. >> You're three years old. You're a big boy. >> Yeah. >> Yeah? What are you watching? >> Bluey. >> Bluey? You stay in here, okay? Grandma and Grandpa are going to come pick you up, okay? All right, I'll be right back, okay? >> Okay. >> Thank you. Maggie, is this your phone? >> Mom, right there. >> Your mom? >> Yeah. >> The sweet kid in the backseat. Two parents, both with warrants. I I don't know if if he is the actual father, but like, man, get your stuff together. You have an assault warrant. You're accused of throwing stuff at a car in a road rage incident while you're out door dashing trying to make money to feed your kid. >> They are coming from Bonita. >> Okay. >> So >> All right. >> It's >> don't I'm not going to leave the kid alone. I can tell you that much. >> Your call has been forwarded to voicemail. Can you text her and say call me ASAP? The cops are here. >> [laughter] >> Every Every mother's dream to get the text, call me ASAP, the cops are here. >> Briana Jackson >> Um so, there was a I guess an incident. Um >> My name is Officer Rodriguez with the Cape Coral Police Department and I'm speaking to >> I'm Maggie's mom. >> Um there was an incident involving uh the vehicle that's registered to your daughter uh in a disturbance where an item was thrown from that vehicle and then it was uh hit another vehicle. Um so, we've been looking for her vehicle and her cuz the description given by the people involved match the description of your daughter. Also, uh I don't know if you're aware, but your daughter does have a warrant for her arrest that we're going to confirm here now and see if the jail wants her. Her boyfriend or husband, I'm not sure what the relationship is, but he also might have a warrant. So, can you come pick up your grandchild? >> Okay. Um [clears throat] yes. >> If we could just have someone here that way we don't have to turn him over to DCF. >> Yeah. Yeah, definitely. >> To do that, I'm going to read you your rights regarding the issue earlier cuz I believe you know what I'm talking about. Obviously, I explained to you the initial reason for my contact with you and the vehicle. So, earlier my partner over here, Officer Bartok, responded to a disturbance, what we call a rolling disturbance. That means it's usually involving a vehicle or some type of road rage incident. Um the reporting party stated that this vehicle, which they photographed, and that's how we were able to find the tag for the vehicle, and a white female driving the vehicle that matches your description threw an item from that vehicle that struck the other vehicle. Is that true or false? >> Um, I didn't throw anything. >> You didn't throw Who threw >> situation. No one threw anything. >> No one threw anything at all? >> anything outside of the >> So, there was a road rage incident, but there was no items thrown? >> no items thrown. >> Okay. Was there any threats made? No, nothing? >> didn't even roll down the window. >> Okay. >> Um, what had happened was we were turning onto going home. >> Mhm. >> Um, well, going trying to door dash on our way home and we were turning and there it was there was a sign it said move over like to merge that like one of those big trucks with the orange arrows. And we're like, what is this truck doing? They're not like merging. And so, all of a sudden he starts turning on his signal and he literally turns and like starts running us off the road. And I have my toddler in the car. We ended up driving on the sidewalk. >> First of all, she said, "We haven't left the house today." Xavier said, "I've been with my son all day. I don't know what is going on here. I don't know what you're talking about disturbance, blah, blah, blah." She keeps saying, "We were driving. We were turning on the road to go home. We were out door dashing. I had my son in the car." Xavier, are you lying? Let me know in the comments if Xavier's lying. >> So, I like get heated and I started following them and then they started to following me, but we didn't throw anything out. >> No items were thrown or anything like that. You didn't cause any >> They started following them and the people that they were following started following them. The big concern for her was we almost got run off the road and we had a toddler in the car. And then you're going to chase this guy down with your toddler in the car? Not a good idea. >> Uh, criminal mischief to the other vehicle. You didn't hit it, strike it, went after it or anything like that? >> I don't know. I don't think they hit me. They about did. >> Okay. Yeah, they didn't report that the vehicles collided or anything like that. >> close, though. They ran ran us right off the road. >> All right, perfect. I appreciate you giving me your part of the story, okay? Just wait for me to let you know if they want you for this warrant or not. Fair enough? >> God mighty, I told you I didn't want to go out. >> [snorts] >> Told her, bro. She did this. She us, bro. >> So, I'm going to be honest with you. What what led up to all this is uh I guess there was a road rage incident between >> They're They're claiming there's some damage, all right? So, um I'm just going to read you this, all right? You have the right to remain silent. These rights remind you if you wish to talk to me. >> Yeah. >> What What happened with the whole road rage >> thing earlier? So, we get over and we're in the right lane and that them they're in the left lane. They're trying to merge over and we're like they're like next to us like like how they these two cars are. And she's trying to like creep up and they just keep creeping forward and it got to the point where they tried pushing us and we literally went off the road in the grass. So, she got mad, drove up, and then got like up next to them, and then uh she went to throw the little cup and I I tried to grab it from her. I'm telling her to stop and I knew this was going to happen, so. >> What kind of cup? >> Just a little like a little glass cup. How's that we >> What What was it a clear cup? Was it >> No, it was a white. >> White cup? >> White cup, yeah. >> Almost like an espresso cup? Like that kind of small? >> Yeah. Yeah. Just like that. >> All right. >> Um I know I didn't do anything with the cup. I don't want her to get in trouble. I'm not trying to throw her out in the bus, but man, I'm already going for a VOP. I'm I'm already screwed as is. >> Those of you who may think, well, God, he just sold out his wife, blah blah blah. Xavier knows that the cops just talked to his wife. He has no clue what they said, though. And he doesn't know if she >> [laughter] >> timed him out, he doesn't know if she just told the truth or whatever, so what's he got to lose? He just tells the truth because he's already in enough trouble as it is. His mind is already racing because of this violation of probation warrant that he just got [clears throat] picked up on. It would just so happen that you keep them separated and then you interview them independently. That way neither one knows what the other said. >> I'm being ratted out by your own husband. >> What if I think if I play it like Kayla, so they sent me a video. They're recording it. I see a white cup. And it just randomly thrown out of your window. >> I have evidence that shows something was thrown out of the car. >> Okay. >> Seems to be something white. >> I didn't throw anything out of that car. I did not. I did not. I did not. I did not. I did not. >> Well, something came out of that car. >> How do you know that it was from me? >> All right, so did Xavier throw something out of the car? >> No. No. No one threw anything that came out of my car. Nothing. >> Well, I told you Xavier confirmed something came out of that car. >> I don't think he would say that because nothing did come out of that car. >> [laughter] >> She She just wanted to >> I don't think he would say that because nothing did come out of that car. >> Well, she threw the cup. >> Let me Let me talk to her. >> Did you or did you not throw something out of the vehicle? So, if it wasn't you, was it your husband? >> No. >> So, nothing was thrown? >> No, sir. >> So, these people are just alleging this damage to their vehicle out of nowhere? >> Well, maybe it was previous damage. I don't know. I didn't throw anything out of the vehicle. >> Okay. >> I gave them the finger. >> So, I I just want to make this as clear as possible for you. So, what we're looking at right now is throwing a deadly missile from a moving vehicle. That in the state of Florida is a second-degree felony. I am looking for your honesty in regards to this incident because obviously it's something very serious. Serious enough that the state declares it to be a second-degree felony. >> So, I'm going to become a felon? >> Huh? >> I'm going to become a felon? >> What's that? >> I'm going to become a felon. >> An item was thrown by you from that vehicle today during the road rage incident. What was that item? >> Is there proof? >> What's that? >> Is there proof? >> Yes. >> What's the proof? >> Okay. Well, we can start off with the damage to the other vehicle. >> Okay. >> Okay. The victims are >> that I did it? >> What's the proof? That when these victims get here and identify you, that would be the proof. >> I can identify them. We were already in an altercation. That doesn't mean that I threw something. >> Ashley wants to meet this out on the side of the road. She She wants a parking lot trial. The video has already foreshadowed that she's going to invoke her rights in a minute here, which is a whole separate discussion. You can have them identify her one. You have three people that have now said that she threw it, and everything is consistent within the story. And her concern is more that she's going to be labeled a felon. And it's understandable. It really is. But she's not coming clean here. >> I want a lawyer. >> Okay. >> Thank you. >> Yep, no problem. Hey, buddy. >> Yeah. >> What you got there? Oh, you got the helmet from the firefighters? >> Yeah. >> I'm here. >> Dad? Okay. So, you can take him. >> Yes, sir. >> Okay. The vehicle is being towed, though. >> Can we Can we pick it up? >> No. Not tonight. You can pick it up at the tow yard. >> Can't just ask somebody to come pick it up? >> No. No. They It's part of a criminal investigation. >> Okay. >> Okay. >> Okay. So, I can take him. What about the keys to her house? Cuz we got loud dogs and stuff like that. >> Yeah, keys here. >> Keys to the house. Appreciate it. >> Okay. >> Thanks, sir. >> Um do you have any questions for me other than >> Other than uh I I uh Yeah, I'm not really. >> Okay. >> I guess uh Pretty sad. >> Yeah. I mean, she knew she had a warrant. It wasn't like it was, you know, >> We don't hear much of the personal business. >> I got you. >> So, uh >> This all could have been avoided if she just took care of it. >> It's It's all just just stuff that should have been taken care of. >> Yeah, 100%. Little things left alone can turn into bigger things. >> Hopefully, it's not too bad, and we can we can deal with it. >> All right, you behave good for Grandpa, okay? All right, you're good. You promise? All right. Can I get a fist bump? >> Fist bump. All right. >> All right, thanks, Grandpa. >> I want to talk about how if there's proof that I'm the one that threw something, or if there was something that was thrown out of my vehicle where where the proof is at and that the mark wasn't already on their vehicle. >> Okay. So, right. My job is to establish probable cause, right? So, I have established that burden. >> Okay. >> Right? Based on the evidence that I have gathered throughout this investigation. I know that it was you. I know that it was you that threw the item, right? And I even know what the item was. The only thing I want is to hear it out of you to allow you and give you the opportunity to be honest with yourself. We've already tied up enough of everybody's time. >> Okay. No, I know. I get it. >> Okay. >> I apologize for that. >> No, you don't have to. I'm getting paid. I'm I'm out here getting paid. >> Fair enough. >> Right? I'm I'm out here to do a job and I'm doing my job. >> I'm embarrassed. My son like I'm just >> Right. Right. This This is This is what I'm trying to get to. That it's time to be honest because you've been dodging this warrant for how long now? Almost a year? Yeah, almost a year. You've been lying about where you've been physically living. I know that for sure. I know it's not Bonita Springs. You want me to give you the address? >> No. >> Yeah? Is it Does that sound familiar? Like the keys you just gave to your dad where he's going to let out your dogs? You made a bad mistake today. We both know it. I would like to hear it from you. >> I threw a cup. >> It was like a coffee mug cup? Yeah, I know. >> [snorts] >> Well, I want to let you know that that coffee mug cup struck that person's vehicle and caused felony damage. Okay? I appreciate you coming out front and being honest with Like it's like when kids are on the side of road and they throw rocks at cars, same same law, right? Because if the window comes through, it hits somebody and they crash and kill themselves, that's a pretty serious charge, right? That's what it is. It's called throwing deadly missiles. All right. I'm going to have you step out for me real quick. We're just going to go ahead and stand right here and we're going to face that sign right there. >> What are they doing? >> It's called a show-up. >> Call a what? >> Show-up. For the victim to identify the suspect. >> Oh, yeah, but they ran us off the road with a toddler in the car. Uh-huh. Funny. I should How do I press charges against them? For that? >> For? >> You said you can look up street cameras. You can see how he ran me off the road. So, can you look into that? >> I can look into it. So, what is your complaint? >> My complaint is that he ran me off the road and literally about killed us with my toddler in the car. >> Okay, so you admitted to a traffic infraction. >> Right. Yeah. >> Okay. >> Right. >> At most, I can give him a ticket. >> For running me off the road and >> infraction, failure to maintain a single lane. Yeah. >> Running you off the road is what she keeps referring to is not intentional. This was like two people just trying to edge each other out for the merge lane. Throwing a cup is intentional. It's a different story. We are talking about a traffic infraction versus a criminal act. >> Oh. >> Hey, no crash was You know, no vehicles didn't come into contact. Nobody crashed into anything. I'll give you an affidavit post Miranda admission, and I think they uh 100% ID too. Uh so, she post Miranda admitted to um throwing uh the item from the vehicle. That item being a coffee mug. But, like I said, Officer Bartok is the primary investigating officer in regards to the throwing deadly missiles. I did advise him that you were forthtelling and that you know you threw >> Hey, do me a favor and subscribe. I also run the Comms Center. It's another channel where I take true crime cases from the 911 call to the verdict. Check it out. It's linked in the description below. >> something out of the vehicle, and that something was >> Yeah, I'll meet you over there. >> a coffee mug in in the sense of it. So, we do appreciate you being honest, okay? It goes a long way with us. Watch your head. >> Babe. I'm sorry. Can you see me? >> I see you. >> [laughter] >> I love you. I'm sorry. I'm sorry. Will they give me my bond tonight? >> I'm not 100% sure, but I think they should. >> Okay. Cuz my dad said he's going to bail me and my mom out and not Xavier. >> Well, you can't Xavier can't get bailed out. >> Yeah, that's what Yeah. >> Yeah, so that's that's the main problem there. >> I'm I'm so I and he told me not to throw it and I just I got so mad cuz he ran me like straight off the road and like I literally thought I was going to get into an accident with my kid and I was just so mad. >> I understand too. I'd be I'd especially if my kids were in the car. I would not be a happy camper. >> Maggie was charged with shooting or throwing a deadly missile. It's a second-degree felony here in Florida and criminal mischief for the damage that it caused to the car. She was held on a $5,000 bond, which she posted, I'm assuming her dad did. She initially pleaded not guilty and then changed it to a guilty plea on both counts. The judge withheld adjudication and sentenced her to 36 months of supervised probation with no contact with the victims, who she didn't know anyway, and a DNA sample to the state database, which most felons have to comply with anyway. She was ordered to pay just under $2,500 in restitution, court costs, and fees. Look, if you like this video, watch the next one, be safe, and don't get body slammed.
