The male was instructed to exit the vehicle and asked to perform field sobriety exercises. The male would eventually pass the field sobriety exercises and be permitted to drive away, but he was still issued a summon for reckless driving. She doesn't want to be tested. >> Huh? >> She She's not cooperating. >> I want to wait till you were done before >> she got out of it. She was driving. We didn't believe she was drinking. He went to speak with the other female driver as Sergeant Graham was performing field sobriety exercises on the male driver of the pickup truck. Jacqueline denied consuming any alcohol before operating a motor vehicle, but she exhibited indicators of impairment such as slurred speech and bloodshot and watery eyes. After some hesitation, Jacqueline agreed to perform field sobriety exercises as well. >> As our sergeant said, he saw you get out of the car. So, if you're refusing, then I'm going to have to place you under arrest for driving. >> Sir, we thought you was >> then let let me go through some tests with you. The second exercise was the one leg stand test and Jacqueline failed to raise her foot in the proper fashion and did not count aloud as instructed. The third exercise was the walk and turn test. During the walk and turn test, Jacqueline did not touch heel to toe on each step, took an incorrect number of steps, and raised her arms for balance. The final exercise was the horizontal gaze nestagmas HGN test, and Detective Albany observed the lack of smooth pursuit, distinct and sustained nestagmas at maximum deviation, and the onset of nestagmas prior to 45°. the English alphabet for me without singing it. From the letter A to Z. >> A B C D E F G H I J K L M N O P Q R S U V W X Y and Z. >> All right. Very good. All right. Next one I'm going to have you do is the onelegged balance test. Okay. Now, I'm going to demonstrate it. Yes, sir. >> And then I'll have you do it. >> All right. Just keep your hands at your sides the entire time. Okay. Yes, sir. >> Very good. All right. All right. So, from that position, I want you to pick whichever leg you feel most comfortable with, left or right. All right. You're going to lift it approximately 6 in off the ground. Yes, sir. >> All right. You're going to keep eye contact with your pointed toe and uh and count uh from 1 to 30. Okay. >> Okay. >> All right. >> So, should I just >> And you're just going to All right. Now, from that position, >> keep your hands out of your pockets at your sides. Okay. I want you to take your right foot and place it in front of your left. Just like that. Again, as my sergeant had said, >> am I legally obligated to do this? >> As my sergeant said, if you don't want to do it, you don't. >> Am I sorry, >> you don't have to, but then I'm gonna have to place you under arrest for driving while intoxicated because you refused to do the test. Okay. Now, from that position, you're going to take nine walking steps forward, touching heel to toe. One, two, three. When you get to the ninth step, you're going to take a series of small steps to turn around and take nine walking steps back. One, two. Again touching heel to toe. Do you understand? >> Yes, sir. >> Okay. All right. >> Y >> one, two, three, four, five, 6 7 8 9 >> 10. >> Nope. Okay. 17 ready to copy on. >> I'm so sorry, sir. >> Okay. All right. Okay. Do you understand? >> Yes, sir. >> Okay. Don't move your head. Just your eyes. >> Yes, sir. All right. Right now, I believe that you're under the influence of alcohol to a degree that makes it unsafe for you to drive. All right. So, at this time, >> I live here. >> I understand you live here, but at this point, I'm going to place you under arrest for driving while intoxicating. All right. Now, >> will you have a chance to blow on a box? All right. On the Alcatest system and see what that brings up. Okay. Okay. >> Based on Sergeant Graham's account of her erratic driving, the odor of alcohol, her slurred speech, and her inability to perform the field sobriety exercises in a satisfactory manner. Detective Albany placed Jacqueline under arrest for driving while intoxicated. She was transported to the Honan County Sheriff's Department for further processing. At the Honan County Sheriff's Department, Detective Albany read her the standard statement for motor vehicle operators, but she refused to submit breath samples for testing. >> All right, do me a favor.
