Can you step outside? >> No, I'm not coming outside. >> You are coming outside. I have a warrant for your arrest. >> There you go, dude. Put your shoes on. You I'm not coming for you. I'm not going to fight you. I got to put my dog in the cage. >> I understand, but give her >> No, don't grab me like that. >> You better elusive for Okay. And what does that copy of my car? >> A secret 911 call sent officers rushing to a home where a mother and daughter reportedly feared for their safety. What unfolded next was captured on body cam. I've got some uh court paper. Okay. >> So, I want to say >> No. >> Yeah. >> No way. >> Yep. I got I have charges for you said yesterday. >> Yes, sir. >> I told you I charges for you. I have >> You don't have charges for me? No, >> I do. >> No, you don't. >> Yep. >> Where was the crime? >> Charges for what? What crime? >> From the domestic that happened on the 27th. >> There's no domestic. Why wasn't I charged? >> Hello. >> My name is Dan. >> Hello. >> So, what happened tonight? >> So, it's his weekend. He has my little ones every other weekend. >> Okay. >> Um he was mad that I wouldn't let them stay again. So, I was going to get them and he um had stopped responding. He wasn't answering my calls or texts or me knocking on the door. So, I thought maybe he had fallen asleep. So I opened the door and stepped inside and he was sitting right there and he came over like came he was hitting in the chair came running over. He grabbed hold of my arms and he raised his fist like he was going to punch me in the face and then let go and then regrabbed me and turned me the way that it is. The front door is here and he had originally slammed me into this wall and then slammed me into the open the door into the open the door to the open door and my arm hit the hinge. My oldest daughter was sitting in my car and watched the whole thing. My two toddlers are inside every time that >> inside the [clears throat] house or the car >> inside the house cuz I was trying to get them. He wouldn't answer for me to get them. So, like I said, I thought he'd fallen asleep, so I just opened the door. >> Okay. >> And so then I I grab the kids. She my oldest jumps out of the car and she comes up to help me and says she asked me if I wanted to call the cops and the kids were upset. I didn't want to do in front of the kids so she helped me grab the babies and then I just put them in the car and drove them home. and then I came down here. But this is an ongoing thing. This isn't the first time. This is the reason why I left. Um, and our restraining order and it had just expired a few months ago and I want that reinstated. I don't want to have contact with him. >> Okay. >> He and also I'm pregnant and he knows that. >> Okay. >> So, >> do you need to go to the hospital or anything? >> I mean, I'm very anxious. I'm not feeling right, but it's I anxiety. The only thing that hurts is it just my arm stings. And he grabbed where he grabbed it was my shoulders. He was going to punch me in the face. He didn't actually. He stopped himself, but I don't need to go to the hospital, but I don't I want I want a restraining order back in effect. And I I don't know how I don't I need to refile court papers for custody because I cannot do this anymore. >> Okay. Well, I'm just making sure. I'm not saying you have to go to the >> Yeah. No. If I felt I like I I feel very I'm crampy, but I know it's anxious. I cuz he touched the front of me like in my stomach. >> Okay. Obviously, you know better than I do about any of that. So, I just wanted to make sure you didn't need an ambulance or anything. >> Mm- >> um are you guys divorced or >> We were never married. We were together for 17 years. Um there is a history of domestic. Um after I had originally moved out, um it's been a little over a year now. He kicked in the door at my first house that I moved out to. Went through court through all that. There was a restraining order for the sake of trying to co-parent. I reduced it to a refrain from which I think it just expired in September and I think his one-year conditional just expired. Um, but he's clearly not learning and I'm trying to co-arent and I'm trying to be amicable and I'm trying to deliver the person and I can't I can't be able to think. >> How old is your older daughter when you >> 17? She's 17. and my two younger [clears throat] ones that were with him the 385. >> We have 50/50 custody. Um but he his visitations are every other weekend. Only the younger two are required to go because my other three oldest children do not have contact with him. Okay. >> So they choose not to have contact with them. My 12-year-old, she's iffy. She doesn't go there, but she'll talk to them if he reaches out. But my 17 and my daughter will be other daughter will be 15 tomorrow. They don't even have any contact with them. >> Okay. And just so I'm understanding, the 17-year-old was the one that was in the car. And then how old are the two that were in the house? >> Three and five. >> Three and five. Okay. >> Those are the two that I was picking up. >> Okay. Were they Where were they when this occurred? >> Penelope was in the other room and she had come running out. My three-year-old and Elliot was right there. He was sitting in the chair that he was sitting in with him when he jumped up and came at me. So Elliot saw everything. >> Okay. All right. So Elliot fell asleep on the way to town. Um, so I took them home with my my oldest just because I wasn't sure how long I'd be here and I didn't want them to have to sit around if they're little kids. So >> And there's Is there anyone else at the house with him? >> No. My other at at his house. I don't not that I saw. I literally was right in the entryway. I just opened the door and stepped into the little footing area. If anyone else is there, I didn't see them. >> Okay. >> He's not pleasant though. I hope so. >> And he just tried to call me too and I don't know what he tried to call me for if I didn't answer. >> Okay. You do you think he would go to >> to my where you live? >> Well, I told him that I was going to have him arrested before I left. >> So, I don't think that he is that I don't know. My daughter would have called me if he was there. >> And that's here in the village. >> My apartment. I'm in the I just bought a house in Kenneda. So, we're kind of transitioning. But right now, uh Okay. >> But if he was there, my daughter would have called me already. Okay. >> All right. Well, he's going to have some more questions for you. >> Okay. >> It's been two weeks, bud. >> We're here now. So, >> I'm not going for a child. >> Told you last night. >> You called me last night to tell me that you supposedly have these. >> I did. >> I'll take the papers. You can leave. >> I do have these. >> What? Um, I wasn't there, so I don't know what happened, but it's 4:00 now. >> I'm not going down there. >> Listen, just listen to me. >> Hey, we can either >> bring you so you can get ar by 6. >> Okay. But that's what we're trying to help you out with. Okay. If >> you're saying go there, sit in jail. What's that? Like a slap on the What's that? Like a What's that for? >> And get a rain. Why do I got to do that? Well, I tried to called you last night about that. >> No, you wanted me to go there last night at 8:00 at night and sleep there. >> That's what we're trying to avoid. >> That's we're trying to avoid that. >> If we can get you there now, we can get Is there Is there anyone who can come and hang out with your kids? >> It's not happening though. I'm not getting in cuffs or going nowhere for you guys. No way. >> It's not something that's it's not something that's going to go away cuz we we will get warranted. >> You don't have nothing. >> You got nothing. All you guys hearay and them pieces of paper. adult. >> Huh? >> We're not going. >> I evidence. >> We're We're trying to come out here and tell you what the options are. Okay. >> You can come with us and have someone watch your kids for a couple hours until we can get you back home or we will come get you with a warrant and then you won't have a choice. >> Tomorrow next how about two more weeks come with a warrant. >> That's not how that works. >> Why don't you come back later? >> You can just show up at my house and take me with you guys crazy. You should have brought Daget or somebody that I care about cuz you guys >> I've never dealt with you, Paul. I AND LIKE I SAID, I wasn't there. I don't know what happened. Okay. >> But we are we are trying to help you out and get you home as soon as possible. That's why we're here now. >> So, we want to get you there so we can get rain at 6:00 instead of 8:00 in the morning. All right. So, you can only be there for basically as long as we can take a cross and then you're going to get rain and you get really >> at 6. It's 4. Correct. >> Instead of having to sit overnight. Why would I have to go down there and sit for 2 hours? >> Obviously, you got all the information you need, right? >> I don't think you do have all the information. That's why it takes 2 hours for you guys out of me for me to answer your question. Sit there in the little room like I haven't ever been arrested before. I'm not going. You can't make me go get a warrant. You're not coming in here. That's it. That's all. >> Did you give him his civil is there someone who's going to be able to stay with the kids tonight? >> No. Okay. So, that's going to be an issue, Paul, because if we come back with a warrant tonight, your kids are going with CPS. >> Okay. >> Okay. I'm trying. >> I'm not trying to scare you. >> I'm trying to give you all the options because we have >> I got all the options. I We'll go wait. >> No, you don't. Go ahead. >> Look me up. I'm in the system. I've been there before. Look me up. It's the same papers so I can go. >> I gave you the papers. This is just Okay. All right, >> that's why I'm doing it now. I can't. >> There's still verbal arguing going on. >> I'm sure where one of the female parties has gone. >> So, I don't know if my neighbor old ne my old neighbors would be helpful. So, there's no way that he didn't see, but he is also friends with Paul. So, I don't know how helpful he will actually be. >> Okay. Yeah, cuz I was texting and calling when I I was there between 6:00 and 6:15 and I sat there in the driveway. Every time that I go to pick him up, he makes me sit in the driveway for 15 minutes. Freezy brings him out. This time he just wasn't answering. So, like I said, I went up and knocked on the door. A few times he didn't answer. So, I just opened the door cuz I thought maybe he fell asleep, but he was not sleeping. He was just ignoring me. Bellnap Hill Road and that's in Branch Point. And I don't know if I can get in trouble for opening the door and going in. I mean, >> has he ever told you that you were not allowed to do that? >> No. And he knows that I was coming there and my name is also on the house. I own half of the house. But he also didn't tell me that. Like he when he brings the kids to my house, he just he just brings them in like cuz when he's not being like this, it's he just as long we don't communicate, he just opens the door and brings the kids inside and then leaves. >> Yeah. No, if it's if it's common place for you guys to do and he's never told you that you couldn't do it and like you said, if you're still on the deed, then >> yeah, the my name is on the title. >> Okay. >> Don't go in there because I try to avoid being enclosed spaces with him. I usually wait outside, but he wasn't answering. >> Okay. >> Oh, so you're not there yet? >> Yeah, I'm not there yet. I will be there. >> Okay. Are you injured anyway or >> I just have just a scrape on my arm. It was runner, but other than that, it just hit the hinge of the door. Okay. >> I took a picture of that. >> Yeah, you can. I My daughter took these two when I left. I don't [snorts] know if you want these. You can't I don't know what you can really see. It was a little bit more red, >> but you can't see it. I mean, >> okay, I'll take a picture of that one if you want. >> Which one? >> You can scroll. Feel free to scroll. >> That one. And then I'll do a >> Okay. [snorts] Do you guys have a child in common? >> We have five. >> That's why I was there. I was picking up my younger. >> And you guys are formerly married? >> No, we were never married. >> You were never married? Just former dating partners? >> Yeah. See, >> and then did he make you feel fearful? >> Yeah. And can you describe that? I wasn't here. >> So he just So he when I when I opened the door and walked inside, he was in a chair in the living room and came up and came at me and grabbed a hold of my shoulders and slammed me into the wall, raised his fist like he was going to punch me in the face, stopped himself from punching me and then turned me and slammed me into the the door. The front door was open, so he slammed me into the front door and that's when my arm hit the hinge and then pushed me out onto the porch. >> Okay. Was there any weapons he used? >> No. >> No. Okay. Does he have access to guns? >> I'm not sure. I haven't lived there in 2 years and I haven't I don't go inside. So, if there's guns there, I'm not sure. >> Okay. Did he make any threat to you or your children or anything like that? >> No. >> I mean, previously, has he ever made threats? Yeah. But in this exact second, No. No. And you told him you were calling, so he's probably not going to answer the door if we go out there, right? >> Probably not. >> Was there any children that witnessed any? >> Yeah. My three-year-old and my 5-year-old were inside. >> They were inside. They witnessed it. >> My 5-year-old witnessed all of it. My three-year-old came running out um as he was like as he was shoving me out onto the porch, she came running out through the kitchen. >> Okay, we'll just do both of them. What's the first one's name? >> Elliot Carrick. He's five. and then Penelope. And then my oldest daughter was outside, but she saw she didn't see the initial push into the wall, but she saw the push into the door and then out onto the porch. >> Okay. And what um this help is her last name Carrick as well? >> Yeah, all they all have. >> And is their current address technically yours? >> Yeah, I have custody. Yeah. And then my 17-year-old also was she wasn't inside, but she was outside and witnessed it. >> Okay. That's trying to get Carrick um like you imagine and these things. So I lessened I asked them to like lessen it for the sake of the kids >> and so they did they offered them a one-year conditional but I don't know what if you >> like the conditional order protection or conditional. >> They ordered a one-year conditional for like getting in trouble and then we had a restraining order but I think it that I got reduced to a refrain from but I like I said I think it expired in September. >> Okay. All right, I will be back. >> Was on a one-year conditional from court, but I think it just expired. Like what they have said is if he gets in any trouble for like the same thing within the one year, then they would reopen what he was originally charged with from the last domestic thing. But I think >> Okay, I understand what you're saying. [snorts] I'm going to go look into that order and just make sure it's not in effect. Okay. >> Okay. His first name was Paul. >> Yeah. >> Okay. All right. So, with these, all right. Um, [clears throat] I do offer everybody the opportunity to write a statement about what happened. >> Um, so if you would like to write a statement, just kind of summarize what happened. Um, you're more than welcome to do that. If you don't wish to, you don't have to. Um, it does help with, you know, charges and stuff like that. It does usually help with that. So that's normally when I try to, you know, have people write them, but you don't have to. It's 100% voluntary. So if you want to write >> restraining order. >> Okay. So if you want to write what happened in there, um, you just go through, if you want to stand up and use that, too, you're more than welcome to >> for me. >> Yep. I Yeah. So just write down here and start here and just go in kind of order of events of what happened. Okay. >> Okay. >> Definitely if he does come to your house, we're going to need to know about that. But we're gonna end up going trying to make contact with them. That'll be our next steps. And um see if we can get them to come out. Um it sounds like we do we would have a charge to bring them in on to hold them to get a rain for a protection. >> Okay. >> And that would happen if we were able to to make that happen. It' be in the morning. >> Um and that's kind of how we'd be going with that. >> And someone would contact me. >> The Cuz I'm not going to stay home tonight. So I'm going to take the kids out. I'm going to go to my boyfriend's house for the night. >> That's why I leave your phone number on there, too. >> Yeah, we can give you a call if we can't, but if he won't answer the door, >> okay, >> obviously, we're going to have to apply for a warrant, right? >> Okay. And then my question is this. So, I don't know if you guys will be able to answer this or if I need to call my lawyer. Um I He's not scheduled to have the kids again for two weekends [music] like not this weekend, the weekend after. This would be sorted out by then so that I would know cuz I don't want to get in trouble for withholding them obviously. >> Right. I would suggest no matter what we do tonight that you go to family court explain your >> that's all I need to because we do have a custody so I would just need that to refile right >> ask for an order of protection and and safe harbors could help you with that in that application you could ask for a change of >> custody it doesn't mean the judge has to grant it >> but you can ask for >> but at the very least the jud even if he doesn't grant not them not going there the likelihood of him granting going through a third party. What do they do that? This is all new. >> Um the third party visitation is an option, but being that one of the charges is going to be against the two children that do have the visitation, I would think they would be included in the state of if that's what you're asking for. >> Yeah. >> Again, it's completely up to the judge, but that does >> I just want to make sure I'm doing what I need to on my part to follow the order I already have. So, I'm not doing >> Yeah, you can you can list the two little ones in a stay away order if that's what you ask. Is that what you're asking basically? I don't think that he's in the heart of mine right now. So, >> yes, because if a judge branched a stay away order that includes you and both of those kids, that would precede any possibly >> anything. >> Okay. >> Okay. >> All right. Thank you so much for your help. >> All right. That's right. >> Like I said, I'm not going to stay home tonight, so >> I will make sure one of us calls you. >> Yep. We'll give it to you. >> Yeah. Should not get super emotional. I'm sorry. So on the 27th I filed a statement against my children's father because during pickup he got physical with me. Um so I filed a statement CPS met with us. Um my 17-year-old daughter, my 5-year-old and my four-year-old were there. Um and when I followed up with officer Wayne, it was like a week later. He said he know he said that he was not originally. They told me that they had to press charges. >> Okay. When I spoke to him a few days ago, he said that he no longer had enough to press charges because it was just his statement against mine. Um, my 17-year-old daughter witnessed it and I asked him, he took a photo of my arm, which at the time was like a scratch. It turned into a bruise a few days later, which I told him I had photos of. Um, and my 17-year-old, she doesn't have a relationship with her dad. She wanted to make a statement. And he said that even if she made a statement and even though that they have the photos that there wasn't enough that they presented it to the judge, but the judge said it wasn't enough. >> So sorry to have you answer question. So you have a 17-year-old daughter. She witnessed this incident happen. >> Yeah. >> Okay. >> And I told him that she just I didn't she didn't make a statement. I just made a statement. >> Right. You were very aware of that at the time cuz you came down here to report this, right? >> Yeah. I put right in there so that my 3-year-old and my 5-year-old were inside of the house. Um, and my 17-year-old was 17-year-old was in the car. So, it happened to be sitting into the wall. The front door was open, grabbed me, and sang me into the front door and then out onto the porch. So, she saw the door and out onto the porch. >> Okay. So, just to clarif she she was out in the car while this happened. She saw the driveway. She saw it from outside, not the original wall, but the door and then out to the porch. She got out of the car and came up, helped me get the kids because my four-year-old came running. And then my son was sitting there and he saw it. They met with CPS. They told CPS. And then when I spoke with CPS after the officer told me that they can no longer press charges, she told me that um he admitted. So, Officer Lane said W. Lane said that when the other officer wanted to speak with Paul that he denied anything physical and said it was all verbal. When I spoke with Kristen Cler, she's our CBS. She said that he admitted to her that um it did get physical but that I initiated it by opening the door and walking inside. >> Okay. So, just to clarify for you, anything he says to a third party, we can't use that in court. So that if you had it to one of us, you would be able to a third party. So um I'm I'm somewhat familiar with this. Um so just to give you some clarification on how this all went down. Um they initially filed for a warrant based on your statement alone, >> which isn't enough. >> Okay. >> Okay. Just so you understand that. So I saw that in the paperwork and I asked them to hold off on that and go investigate further and go talk with him. >> Okay. However, new information that you're giving me now is that your daughter is a potential witness to this and we haven't spoken to her yet. >> No, but I told you that on the phone on Wednesday um that might be correct that I gave you the correct date >> probably Tuesday maybe. >> Um whatever date he called me shortly after 5:00 p.m. >> Um I know because I was very very upset and strong over it. >> Okay. Yeah. So, so I think I think this warrants us looking a little further at this particular case. Um, and we'll do that. Okay. >> I'm not So, this has been it's this is a long time coming. Um, I've protected him for a long time. We haven't been here with him in 2 years and I am pregnant and he knows that. So, clearly he's not going to he still thinks that he has the right to do it. thought my frustration came from when I talked to Deputy Lee and he didn't seem he made me feel like like it wasn't a big deal cuz I said to him I said I have pictures like cuz the original was just like a scratch but a few days later you can see the scratch but there's bruising around it >> are there still marks there >> um I don't think that there are but I have the photos on the time >> you scratch >> you took some additional photos yourself the additional day later yeah I took photos was it? I can show it to you. It just started to bruise around it. And I didn't realize at first cuz I couldn't really see, but it got tender. So, I took those on the 30 the 30th. So, this is the 30th. It just started to bruise around the initial scratch, which the photo he took, you can see is the initial scratch. And I told this who took these pictures. >> My friend Elizabeth took it at work. >> Okay. um because I couldn't get a good angle. But my frustration comes from I told deputy lady this Tuesday. I told him that my 17-year-old witnessed it and asked like she's willing to make a statement. She doesn't have anything to do with her dad and said that it wouldn't be enough and there's nothing that he could do that I needed to do for family court. >> Okay. >> Which I did follow through court emergency notification to have all the pop and drop off in the police department. >> Okay. You guys have a custom >> every other weekend, but I have like a clock set in there that weekend every um an emergency modification. It's very messy. Um my CVS worker um when she originally met with us with all of the things that my kids told her, she originally told me when she was leaving that I didn't need to do an immediate modification because that CPS would be filing neglect charges on their own. So, I held off because I was waiting cuz if that was the case, then I was just going to go for sole custody. >> Okay. >> Then she informed me when I reached out to her Tuesday that their attorneys didn't think that they had enough to go for neglect charges. So, then I went and filed the modification on Wednesday. So, >> was that? >> It was yesterday. So, it's just temporary until we have they just assigned court the 15th. >> So, you're supposed to do pick up and drop off the municipal police department one. >> Okay. No, that's fine. >> So, 5:00 on Fridays and Sundays. Um, that's where our pickup dates are every other week. >> Does the police department aware that that'll be happening? >> I notified them that I submitted the order and Kristen was supposed to let you just contact them just to make sure let them know that that did get granted and that's going to be happening. >> So, that was temporarily granted until we and then he's scheduled to court date for the 15th. But um my worry is is that he's that to him he's just it's like just another day like >> well I mean so I I actually just started here. Um I was a I was a sergeant with the police department for for 6 years. Um I'm just transferred up here. That's why I have another sergeant here with me today. Um so Trenton's a fairly new deputy. Okay. So sometimes getting started in this job, it's difficult to understand how to navigate some of these more difficult conversations. I don't think he intended, you know, to to come off that way cuz like I said, I have talked to him uh personally about this case. I was the one that kind of instructed them to do some more followup uh to, you know, do a thorough investigation essentially. So I didn't get the sense he didn't care about it. I think maybe it's just a sense of like, okay, things keep changing and maybe he's not quite >> keeping up with everything keeps changing like what you're telling me changes a lot about how we're going to look at this case. >> I know too cuz it's in my statement that she witnessed it and that she came to the car. >> So that's something I will look into because that wasn't something that was initially very clear that there was a witness to this. >> So we'll definitely look into that further. Um, and I can talk to to Bey Lane a little bit just about probably his delivery it sounds like was was where it kind of >> Yeah. upset you a little bit. >> Well, yeah. Because when I said, "Well, I have updated photos." And here you can see the initial scratch, but there's breathing around my daughter. I didn't initially bring her. I didn't call the cops when I was there because I'm trying to shield my kids from as much as I can. So, I brought them home and then I just came to the station. >> Okay. >> Um, so I didn't bring my daughter with me initially. So, it probably would have been helpful to at least bring her as a witness. If she she had watched the kids, I understand. But that's fine. But yeah, like I said, from the initial report I read, it wasn't clear that there was a witness to it. So, that was that was one of the limitations when looking at like, >> yeah, it looked like it was just one word, one person. >> I understand. And I also did tell him the my ex neighbor Al, he lives across the road. He was on the side, but he is also friends with Paul. So, the likeliness of him being is not I mean, that's something we can look into, too. But, um, so if if you're satisfied with that, I'll have a conversation with Deputy Lane just kind of about his delivery with that and just making sure he's trying to be cognizant of, you know, obviously this is an emotionally charged situation for you and your family. And sometimes deputies can come off cold and uncaring. It's not necessarily how it was meant to be, but you know, >> communication is important. >> Clarification. I need to make sure that >> Sure. if it is possible because if it is, I want charges to be pressed. >> Yeah, we're certainly going to look into this this new information with the case and uh we'll we'll investigate it as as thoroughly as we can and uh certainly we're going to want to talk to your daughter at some point, it sounds like. So, um you spell >> t R I N I T Y. >> Okay. Um does she have a cell phone? >> Until she's out of school hours. So, >> okay. No, we won't try and call right away, but like I said, I will try and reach out to something. So, she lives with you full time. >> Yeah, they all do. >> Okay. Okay. So, what what I'll do cuz I I I'm not going to be 100% but I don't remember her name on that initial report. So, I'll verify that she's added to that and then you'll certainly want to speak with her probably at some point. Um, is he working tonight? Is he on this wheel? >> He is. >> Okay. So, I'll probably reach out to the sergeant of the evening shift. Uh, we didn't have one the night you came in to report that. So, I'll reach out to him to make sure he's aware of what's going on and then he can kind of be on top of things to follow up. And then at some point I'll I'll meet up with Deputy Lane and you know just explain to any conversation we're having here about kind of how how that conversation came off on your end of making sure that you know people understandably you know feel something. you're here to help them, you know, like that's not that's not that's not how we want to come off, but if that is how it seemed, we would like to try and rectify >> something that I felt like he wasn't taking seriously was just my pleas that like that someone witnessed it and that >> it wasn't just cuz when I said that he's like, I'm sorry, there's nothing that I can do. >> Yeah. And he may just contribute something I said to him about how this is very strong case as we had it. So maybe maybe that's it's something as simple as that. But we'll we'll kind of talk through that and we'll get it sorted out. Um, if you're okay with that, that's that's where we're going to go. >> Well, I'm not looking to get I was just um I wanted clarification because I've been struggling with the understanding. It's like I finally am like doing what I have been >> scared to do for a very long time. >> Well, it is it's a difficult tight rope to walk for for someone in your position and and it's it's good for us to explain and and I'll I'll do that. You know, obviously we have to have a case we can present, you know, in court that's strong, you know, because we get a lot of reports and things like, oh, this happened, that happens. It's like we have no evidence to support any of that. It's very difficult for us to take that in front of a judge or a jury, you know. >> And so, we try to make sure that we're we're being thorough and we have the evidence we need before we go into that. >> So, that's really what this is all about. It's just making sure we're doing our things correctly. and and get you easier and we're still learning a lot of things. So, you know, this is just we'll track this up as a as an opportunity to improve and uh hopefully we can help you out, but we'll definitely look into it. Okay. >> All right. Thank you. >> Penelope and >> so the younger ones, >> the younger ones, three and five, >> five, >> I think those are the ones that are on there already. >> Yeah. So, um Penelope didn't witness it. She came out at the very end. and she was in the other room. My son, so the way it set up is the doors right here. There's a chair right here. My son was sitting in the chair. So, um, I was there for pickup. He wasn't answering my calls or texts. So, I assumed he had fallen asleep. So, I just opened the door and slept inside. He wasn't sleeping. He was sitting there just ignoring me. And then he was very I was inside and that's when he got up and came at me. Okay. >> But, um, so Elliot technically saw that he's five. >> Yeah. Well, we don't we don't want to involve kids that young to that level either about Trinity. Like I said, she didn't see the way that it's set up is um that like the door is right here. So when he hit me in the door this that's when he slammed me against the wall here and then when he turned me it was into the door into the door hinge and then pushed me onto the porch. She saw into the door and onto the porch. She didn't see the wall. She only saw what she could see from the driveway. said that door was open. >> Yeah. So, like I said, I'll I'll talk with him probably tonight. I would imagine they'll probably try and reach out tonight to to talk to her a little bit more about >> talk to her in person or >> that would be best. I think if if she has that kind of information, they're going to want to have a statement form filled out and everything. So, yeah, if uh you know, you guys are right here in town, so it shouldn't be too hard for >> I think she had plans today, but I'll see if she can push them off. >> If it's necessary, one of them can stop out of the house even. So, yeah. But that's kind of how we'll go forward with this at this point. Okay. >> Thank you so much for your time. >> No problem. >> Thank you. >> You're welcome. >> Y that door. Y >> Trinity. Okay. How do you spell your name? Trinity. Oh, just before we get that far, the only thing I got to get over is you're okay with me talking to Trinity? >> Yeah, I consent. >> You consent to that? And do you also consent to her giving me a statement about this? able doing so. >> Okay. >> I T Y. >> Yeah. >> Okay. [snorts] And do you remember what happened? When do you remember when it happened? >> Oh gosh, I don't remember the day. >> Okay. Um, do you remember what day of the week it was? >> It was a Sunday. >> It was a Sunday. Okay. Does the Was it last month or this month? >> Well, this is May, right? >> We're in May. So, it was last month. Does the 27th ring a bell? >> Sound about right? >> Cuz it was >> right at the end. >> It's the day before Montana's birthday. >> Perfect. Yep. So, it's 27th. Make sure we're on the same page. Okay. So, can you kind of explain to me what happened, what you saw? >> So, my mom and my dad were arguing on the phone. >> Okay. >> Because my dad waited until we were like almost to his house to pick up the kids like we do every Sunday. >> Okay. >> To be like, "No, I want them to stay." So, my mom said no. >> Mhm. >> And when we got there, we sat in the driveway for like 20 minutes waiting for him to break out and he never did. >> Okay. So my mom called him like three times and he never answered. >> So my mom went to her front door and knocked on it a couple times and he didn't answer. [laughter] So she just like opened the door to go in >> and I saw him grab her by her arm and pull her in >> and pull her in. >> I didn't see what happened while they were inside, but then I saw her get pushed into the front door. >> Okay. >> And it like obviously [clears throat] opens inward. So the door got pushed back and then she came pushed out onto the porch. >> Okay. >> And then I got out of the car and I went up. >> You went up >> and the kids were in the doorway with my dad and the dog and they were crying. >> Okay. >> And I picked up Penelope. >> Okay. >> No, my brother that we picked up. >> I picked up Penelopey and she then picked up Elliot. >> Okay. >> And we took that to the car. >> Okay. And I remember my dad was yelling at her like, "Get out." All I remember is get out, but they he was like yelling at her and I just took >> Mhm. went back to the car. Okay. All right. So, I can do this one of two ways. I can ask you questions and then I can just write down your answers or if you're if you want to, you can write it down, too. Either way is okay with me. >> Write down my answers. Um, so either, um, I can ask you questions and just write down your response, or I can have you write down in like an order of events of what happened, what you remember, >> and then I can read it, and I can ask you more questions from there if I need to. Um, either way is is fine with me if you want me to write it or you to write it. >> Okay? So, I'll give you this. Um, and then what I was have you do is um try try to write down like um the date and then where you were. All right. Like where it happened. >> If you don't know the whole thing, that's fine. >> I can just answer your question. >> That That's fine. Um, so we'll do that then. Then I'll once I'm done with all this, I'm going to have you read it >> just to make sure that everything is in your words and I'll let you read it, too. and then we'll go from there. Okay. >> Okay. >> All right. >> Yep. >> So, the first question, um, it's a simple one. So, was there a time on Sunday, April 27th, 2025 that you were at your father Paul's residence on Belnap Hill Road >> when we were going to pick up the kids? Other than that, now I do not. >> Right. So, you were there. Yes. >> Yeah. >> And then the next question, do you recall the reason why you were there? Yes. >> And what was that? >> To pick up the kids. Not being >> you went with your So your answer is Is it going to be Were you by like >> by yourself? >> My mom went to pick up my brother and my little sister. >> Yep. And then the next question, what do you recall happening, if anything, that day? >> Um like at my dad's. >> Yeah. >> Okay. We went to pick up the kids and the parents were arguing. Um, when we got them to pick them up, my dad was not answering the phone. He's not bringing the kids outside. >> Okay. >> And then my mom went to the front door, tried going inside after knocking and he didn't answer. Before that, how long was it? >> You mentioned a time earlier. How long you waited? >> We just sat there waiting. >> Okay. >> After about 20 minutes, my mom went to the front door and knocked. >> When my dad did not answer, she tried going inside. I saw him grab her, go inside, and then saw her get pushed into the front door. And then she came back and fell on. So, um, he didn't answer the door. She went inside. I saw my dad grab her and then what? I He She got pushed against the front door. >> Okay. >> And then like specifically she was against the like door frame between where the hinges are. >> Okay. and then she got pushed out onto the porch. >> So, my next question is going to be, what happened after you saw this happen? >> I got out of my mom's car and went to the front door. Um, my mom was standing outside the door on the porch and my little brother and sister were standing in the doorway with my dad and the dog, his dog. And um I picked up Hilly and my mom had picked up Elliot and I took to the car and left. >> Wait one second here. >> Bring here [music] more private. >> Yeah. All right. Yeah. If you guys want to, we can go in here. It's a little more private just in case people come in. Um I didn't know if they had court today. So see that door open. Thank you. >> Perfect. >> And you sit wherever you want. Okay. So after that, you said you got out of my mom's car, went to the front door by my mom, and then you picked up Penelope or No, that's not what happened. You said you saw Penel. >> Oh, my dad and my siblings were right. Yes. It's in the doorway. >> And after that, you said >> I picked up. >> Okay. >> My mom had picked up Elliot and we went to the car. >> Okay. Okay. Trying to think of how I want to word my question. Um, you're fine. I've been the same way lately. It's like my first day napping that way. >> Last weekend. >> Oh, man. >> That'll do it. >> Everyone at school is right now. >> No, it's Sunday. Yep. >> I was I wanted but I want to go on. >> So we've had too much of it. [laughter] >> Um so the next question. Do you recall anything happening after you guys went to the car? >> Not that I remember. I was pretty upset. So >> Okay. I just remember the time when she wanted to tell the police and >> I kind of just didn't really talk the rest of the ride. >> And then do you recall how your brother Elliot and sister Penelopey felt when you were in the car? >> Um when we were in the car after like 10 minutes they had stopped like crying. >> But when you got in the car >> they were crying. >> Okay. So after leaving your father's house, do you recall where you where you went >> to my house? >> To Okay, this is your mom's house. >> Yeah. >> Okay, perfect. And the last question is going to be a very simple one. >> [snorts] >> What is your mom's name? [snorts] Okay. All right. So, what have you do? I'm just going to read over this just to make sure that everything is accurate to what you said. Just to make sure I didn't write anything wrong or miss anything. Okay. If there's anything you feel like I missed or you want to add, just let me know. [snorts] Mind the chicken scratch. [snorts] This weather change has got the allergies going, huh? Oh my lordy. >> Mhm. >> Barely anything I can take right now. >> I can imagine that makes it tough too. >> Goodness. >> I think it takes almost anything in the last 24 hours. >> Yeah. Well, even if it's not sleepy or like even if it's not nighttime medication like that for some reason cuz I don't take it often and it makes me very drowsy. >> Yep. >> I did try and take it at work at my desk. Are you supposed to read it? >> No. So, you just have to read it. >> Yep. That's your statement. Um I'd like to tell everybody, too. Um so, let me just make a line here. So, this line I'm making just means that nothing else can be written in your name. Okay. um one today's the 9th May. Okay. And like I tell everybody, um this is a written statement and if anything's found to be untrue, it can be punishable by a class A misdemeanor. I don't think you're lying to me. I just like to tell that to everybody so they know what they're signing to. Okay? So, what I'm going to have you do in this line that I made, just write your initials on there. And then once you're done with that, where it says signed, just sign your name right there. [snorts] >> Who's going to taken care of? >> You step outside. >> I'm not coming outside. >> You are coming outside. I have a warrant for your arrest. >> There you go, dude. Put your shoes on. >> I'm not going to run from you. I'm not going to fight you. I got to put my dog in the cage. >> I understand that, but give it >> No, don't grab me like that. >> You've been elusive with us for a while. >> Okay. And where does I want it? >> I got a copy of my car. See it? No, we don't need to go get it. All right, >> put the dog away. >> I got a company. >> He's not mean, dude. Don't worry. He's not He's not mean at all. >> I'll come get you. Okay. >> All right. [snorts] >> I don't know. I uh All right. Yeah. Maybe I'll get in there. Is that actually his name? >> Yes. I love that. >> You don't have a warrant for my arrest. >> You do, man. What's it for? The domestic dispute that happened a while ago. You'll get copies of everything, so you'll know what it's about. >> Be super quick. Get you done. You don't have to freaking let this hang over your head. You know what I mean? >> You definitely wouldn't be here unless we had one. You know, not our first stop. Yeah. >> Yeah. You guys been here for 10. So, >> yeah, it happens. >> How long I'm going to be there? All night. >> Um, probably >> I'm going to spend the night there. >> I don't know. Depends on if we can get a judge out or not. >> Time is spending the night there. That's [ __ ] >> We'll see. >> Proof of anything. So, I don't know how you got a warrant. >> I don't even know what it's about. All I know is it's a warrant. >> That's the course for me. >> Some sucks. You guys can follow me. I need some socks. All right. Actually, I got socks right in that suitcase. [snorts] >> Yeah, my job. >> You guys can't put me in that car without showing me the warrant. So, Cam, one of you stay here and the other one goes >> show you the warrant, isn't it? >> Then I'm not going out. I mean, come on. You guys can't just do that. >> You We wouldn't be here if we didn't have >> [ __ ] people out of their home at 7:00. >> Well, obviously you do. Well, because Where is it? Why would you bring vehicles to you? >> Why would you not bring it? >> We don't need to. We got to It's a >> Once we get out in the car, I'll show it to you. >> There. You can read it. How about that? >> I guess that's it. I don't even my wallet. >> I don't even think you need that. >> Whatever you The less you got in your pockets, the better. >> Cell phone. >> Nothing in your pockets at all. >> Go ahead. >> We'll check you out. >> I'll cuff you out by the car. >> Come on. We'll cover up front as long as you get up front. >> Hang on. I need the key. I do need that cuz my door doesn't work. Shut up. >> Yeah. Poor dog. >> I know sucks, but you'd rather take care of it's just a bunch of [ __ ] It's going to be inconvenient no matter what day it gets taken. I got the uh Don't worry. >> Uh this fell here on the other side will go over here. I'll put him in the front with me. All right. Maybe not. There's more room. >> I believe you. I've got them both multiple. >> Be careful. I got bad wrists. >> I'm not going to fight you. >> No, I'm sure they're nice and comfortable. Were they too tight or they all right 22? >> I was going to check the pockets all I know you said you didn't have any All right. >> I probably could hang it on the nail under the for that right here. I got you. >> [snorts] >> Careful. That's where I keep my You got to slide all the way over my head. >> I'm not going to take it off you. I'll let the jail take it off you. But I'm working on it. It's my buddy. >> I got you. Will it come off easily if I slide that over you? I guess I'll do that for the jail then. >> My buddy's in here. Yeah. All right. >> Okay.
