Okay. >> Around 9:11 p.m. on December 5th, 2022, patrolman Christopher Burke with the Barnagat Township Police Department responded to call involving a male and female who were arguing outside a white 2020 Toyota Corolla on Nautilus Drive. He arrived on scene and made contact with a 19-year-old female who was identified as Nadia. Patrolman Calakio made contact with the male and the two parties were separated as the officers conducted their investigations. Don't regret Stretch those eyes. All right, keep looking. Keep looking. Keep looking. Stretch those eyes. Stretch those. Nadia told patrolman Burke that the two of them had driven to Burger King after which they got into a verbal altercation to his state of inebriation. As he was speaking with Nadia, he detected the odor of alcohol and observed other indicators of impairment. Based on his suspicion of impairment, he asked Nadia to perform field sobriety exercises. >> Keep going. 5 hours. >> It's okay. Keep going. >> The Troman Burke started with was the horizontal gaze nestagmus HGN test. During the HGN test, he observed five six indicators of impairment. The second exercise was the walk and turn test. During the walk and turn test, Nadia failed to touch heel to toe on each step. The final exercise was the one leg stand test and Nadia failed to raise her foot in the proper fashion and put her foot down before the test was complete. I'm going to go up. Okay. What you're going to do is you're going to put your right foot in front of your left, heel to toe, like this with your hands to your side. Do you take your hands to your pockets? Yep. Based on the indicators of impairment, the odor of alcohol, and her inability to satisfactorily complete the field sobriety exercises, patrolman Burke placed Naja under arrest for driving under the influence. A search of the vehicle incident to arrest revealed the presence of to open bottles of vodka. After she was placed under arrest, her vehicle was impounded for a 12-hour hold according to John's law. Patrolman and Burke transported Nadia to the Barnagad Township Police Department for further processing. >> All right, you're too intoxicated to drive. I put it under arrest. >> What was that, ma'am? At police headquarters, Nadia was read the standard statement for motor vehicle operators and she agreed to submit breath samples. Her alco test results indicated a back level of 0.2% which was more than double the legal limit of 0.08% 08% and 20 times the legal limit of 0.01% for drivers under 21. After the officers were finished with processing her, she was released to a sober adult pending her court appearance after he signed the potential warning form on Nadia's behalf. >> [ __ ] cameras damn mother wasn't me who drove in there. >> Just be careful. If the court finds you guilty of the refusal, you'll be subject to various penalties, including license revocation of up to 20 years, a fine of up to $2,000, installation of ignition interlock, and referral to an intoxicated driver resource center. These penalties may be in addition to penalties imposed by the court for any other offense for which you are found guilty. You have no legal right to have an attorney, physician, or anyone else present for the purpose of taking breath samples. You have no legal right to refuse to give, delay giving, or delay giving samples of your breath. Any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit to breath testing. Even if you agree to take the test but then do not follow my instructions, do not properly perform the test or do not provide sufficient breath samples, I will charge you with refusal to submit to breath testing. I repeat, the law requires you to submit samples of your breath for testing. Will you submit samples of your breath? Court records indicate that Nadia was later arrested again for DWA in Middletown Township, New Jersey by the state police on January 13th, 2023. Uh, who's the owner of the car? Do you have ID on you? Following these arrests, Nadia was charged with shoplifting to see 211B1 on January 31st, 2024 I Stafford Township, New Jersey. She was later charged with the allegations of criminal mischief to see 17 to 3A1 and simple assault to see 12 to1 A1 in Stafford Township, New Jersey on May 28th, 2024. >> Okay, just uh give me a second.
