enjoy the video [Music] on March 13 2023 officers with the Webster Police Department were dispatched to a local hotel over a reported disturbance allegedly two lovebirds were yelling at each other one thing the caller didn't know is that the female lovebird has a restraining order against the male lovebird I guess true love does conquer all well it conquers everything but armed police officers with a protective order hey baby girl can I talk to you in here yeah just just real quick yeah put your shoes on and go out there and talk to him I just need to talk to her in here for just a second sit down here for me what's your first name again I didn't I don't remember it okay how long have I been here tonight we went to the hop for those wondering The Hop is a local nightclub it used to be real popular with the older demographic but I'm not sure who goes there now going to the hop and then we left from there how do you like the house pretty good it's fine it's different have you ever been there before yes and I went in there and everybody was like trying to no I had a good time and then some people were just being the girl in the officer are talking about are probably swingers but I can't be 100 sure it's not exactly my scene we got a call of a disturbance so we've got to identify y'all we got we got you all identified but unfortunately in the state of Texas we've got to actually investigate what exactly happened so we got to separate y'all first we gotta separate y'all was it loud yeah I talk loud carries huh that's all it is right now when I try to make a point about things mullet what is this your wallet wallet phone please are you leaving I don't know I never know what Toby's going to do with me outside what's up why do you think that I don't understand child support right wrong I don't know anything about child support man to be honest with you I know you'd just be entertained okay the cups come off just as easy to go on Patrol all right because it's cold out we're just gonna set you in the back of a car okay we gotta sort this out though okay so you can just inform them of the order that's in place there's a protective order against you so from her so issued by Harris County because it's still showing active Okay it hasn't showed expired over like two months three months ago okay in Harris County system is still showing active Okay but listen so so just so you're an understanding okay when it comes to protective orders we don't have a choice okay that's why at the initially when we made contact with y'all we didn't have any information about it but Harris County sent us that information okay that's unfortunately that's one of those things that we don't have an option for okay now here's the thing okay Harris County has to look at it they're going to be the ones to determine just okay they're gonna be the ones to determine whether or not but at the at the end of the day it's up to them it's not up to us okay we're doing what what we're required to do in regards to that order okay you can set them in the back of the car and then you think I got the heat on he's aware of it um I told him that you know the protective order he's aware of it but he thinks that it expired two or three months ago okay well I mean they can pull it up too yeah I mean they're going to be able to look at it just the same as we but it says not within 200 feet residence work all that good stuff not threatened but it also says no contact At All by any means so um I'll double check still active so the expiration date all right well all you do is call the DA's office yes sir I appreciate it the officers called the District Attorney's Office due to the confusion with the protective order and the guy who they spoke to couldn't even find it in the system it was just an all-around bureaucratic [ __ ] show this is why you don't get involved with the law kids still doing everything um yes so we're waiting on hold right now okay they're having a hard time locating it by FBI they're trying to locate it by FBI she said she she says that he told her that he had to go pay some stuff and it supposedly it was a little everything was supposed to be over with about a month ago or a couple weeks ago or something like that but I told her the protective order to go from day to day doesn't matter how much you pay they've got an end date they got a beginning date they got an end date and this is within that end date if there's still an open case of some kind like if it hasn't been disposed of at the courts level then it may still be active it's been disposed of so the court if we're receiving the hit for it that means that the court didn't do they didn't take it out of the system yet or they may be slow due to covet or something like that or whatever but as long as it's still showing good in the system then we we have to call the D.A and we'll we'll tell the da in circumstances that we got here and you know you don't want to like beating each other but stuff but the D.A may still charge him with violating the protective order because it is when did the incident happened the original you say about a year ago two years ago 2020. wow it's not common for for a protective order like this to be active for more than 90 days it's not common it's happened but that's during like other more serious circumstances so we're waiting on the district on the district attorney to tell us what's going on exactly I mean y'all y'all were really y'all weren't fighting or anything no I was just for what what were you pissed off about you need to be pissed off about we went out and we had a great time and he said something that was why we lost and he swears up and down he did not say that because he's drunk and he said um look have an open mind there's people over there so I can go be with somebody I want to be with uh okay yeah fair enough that's fair and I said really [ __ ] gonna be with somebody then like okay that's cool yeah like well I mean what the [ __ ] am I doing here anyway yeah and that's what started and then he's like come here I said nah man call somebody why you want to be over here go over there so like what that's fair don't touch me get get the [ __ ] away how long have you had this room uh we left the Hop probably about one oh so you left the Hop and got and came to the hotel okay and I didn't want to drive and I was not gonna drive him back to where he's at in Dickinson well so y'all had to meet right in the middle huh yeah so I was you know I don't want to drive and um that I mean we haven't even been here long we've been arguing she's like I wanna fight shut up okay I actually thought that maybe he did call somebody to come pick him up because I was like the way out it wasn't allowed now because I told him I said yeah I am not blocked now it sounds like something hey and I said Somebody's outside you call somebody it's a cops that's that's the reaction I get every time I show up oh [ __ ] I told him I wasn't surprised kind of wasn't surprised yeah well hopefully this gets sorted out he needs to follow up to get in trouble for being here so just so you're aware it's not his fault like I'm not even I don't know so just so you're aware regardless of the circumstance that you'll end up coming to contact as long as that order is valid even if you go and find him he would be in violation and there's two other people that are included in that in that protective order yes originally was because that's still family yes right because y'all are married right so what it really was so if for any reason he comes in he needs to contact the court and for any reason any three of you all come into contact with him for any reason he would be in violation and the type of protective order that y'all have an officer is required by the state of Texas to notify that agency Harris County and detain him we are required to we're required to separate y'all as long as that is valid separate y'all and make an arrest on him regardless of the circumstance so that's why we ended up coming back because we didn't have all the information and Harris County sent us over a hit that you're the protected person and he's the person that's not supposed to be around you so because of the type of protective order that it is there was some kind of violence I imagine like like a fist fight fist fight rather yeah okay yeah well that'll do it it's like a man it's probably nine times out of ten it's always mutual combat when it's two guys especially when alcohol is evolved [Music] I'm sorry I'm not laughing okay this is messed up but I'm laughing about something else in my head that I'm like you're awesome what me no no somebody else somebody else I'm just like you're awesome somebody's looking out [Music] so awesome couldn't be here with me but it's awesome [Music] and that's why he grabbed this [ __ ] he was like [ __ ] [Music] so do you think he knew that there was that protective order no there was no like it was donnery like he went and had his last court date was it a month ago no January yeah he had mentioned that he felt that it was expired as of two years ago oh well yeah in January because supposedly I'm sorry I'm cold it's okay um they said uh he told me well when the D.A caught me they said she had to like pick certain deals or whatever okay and that supposedly he told me that was Ill and he had to pay restitution has he finished all that he said the deal he said he did yeah they paid everything I actually already kind of makes me think he think he thought something was active with how he kind of gathered everything man were you involved in any type of criminal or civil matter with uh Donnie I mean I I mean that's when that thing happened back then but in January it was supposed to be done already this January yeah yeah okay yeah she was involved a criminal thing um civil so you said that your brother and his and him got into a fist fight and he was arrested for that um then he like paid restitution everything like he said it was Diamond are they are they finding it do they find it they didn't find it did they explain why we would have received that then no he just got back on and asked him he's been asking these questions you still on hold he said he found everybody yeah that's the problem that we were uh sign off and then signed back on but make sure the unit number is when you in the sign-on box 554 is in there I think that's the issue that we're running into sorry I'm cold no I understand yeah if you want to cover up by all means I'm gonna turn the heater on higher yeah yes right now we're on hold of the District Attorney's office um they're having technical difficulties to be honest and they're attempting to find the file they're having a hard time finding a date on it which means at least to me that somebody messed up on the court side like so that's like I explained to him the Cuffs come off just as easy as they go on and so uh I mean sometimes you got to like turn the key different ways but but uh if they if they're able to kind of get get to the bottom of it and and there was a mistake on the court side then it's not a good it's not a good uh protective order but on Face Value the protective order that we received said that he can't come into contact by any means whatsoever or within 200 feet of your business where you work where your kids are at any time and no contact by any means whatsoever whether it's telecommunication email face to face So based on what we're looking at that's why we we're doing what we're doing but Harris County may have dropped the ball in regards to the courts and if they can confirm that whether it's contacting the judge or contacting that specific Court they clarify it then it's not it's not a violation but so long as we see a violation order unfortunately that's where we're at it is an active protective order um uh the courts did not drop the ball that something that he needed to do he didn't do it's possible that it's a non-expiring one it's possible that he thought he did everything and he didn't but as of right now it's not expired and it is valid about this stuff about his about his property so unfortunately again because of the protective order we can't allow you all to contact each other at all um is this his um I just want to ask him if he wants me to take his stuff to David okay this is his property though yeah but it is money too oh yeah oh I'll tell you what I'll hold on to this I'm not gonna get in the middle of the money I'll ask him about the money and I'll ask him if he wants you to have any of this and if he does then I'll just bring it back to you okay take it to David okay you don't want to pursue charges in regards to the violation right yeah because I thought it was done yeah looks a good phone number for you [Music] his office decides they can't say right now yeah we told him that you don't want to pursue charges are they are they picking up the charge they said they would accept it what does that mean I've never heard that before which day is it that is okay what does that mean say it again say the last name again Rock rise so what exactly did he say he would accept charges for a BPO okay [Music] pretty much verbane I've never heard that that DA's name too I've never heard that is it like a requirement on what what he says it says it says don't rest are you solely based that's right he said it's at our discussion I've never heard that but I mean but what but what does the CCP say [Music] it's a shell for the DA's office but if it's not that [Music] he's gonna call me back I feel these officers confusion ultimately the status of the case was listed as defendant discharged which I have absolutely no idea what that means even chat GTP couldn't tell me what was going on if the computer overlords are confused how the [ __ ] are we supposed to know what's going on he's like he's gonna call you back you asking about it no not that not that dead I've never heard Rock wise though did you ask him well this is a shell what do you want me to do with that it's a show I've I've never I thought I don't trust you I think that I think I just need clarification because if it if it comes down to um like our discretion at the end of the day it doesn't bother me it doesn't bother me either way but the violation protective order I've never not doesn't make sense in my head because at least one judge and one officer agreed that at one point these subjects are to make no contact because somebody is in danger what's your discretion being your name say shot D.A I don't know do you think they were actually fighting I think it's incredible argument she said they're already laying down in separate beds so uh something else that I need clarification on is if if it's our discretion we're just going to put them back together so I'm good to just release him and they go back in the same room together and still be in violation and then another officer comes across and has been another and then another and then another and then another because it's going to be a constant violation regardless and that's how I'm gonna ask him okay so I'm gonna release him back into his room that they share that's okay because it doesn't seem okay but that's how far the discretion goes then why even issue the protective order [Music] and it doesn't make any sense they need to get rid of it if that's how it is then they need to get rid of it and the discretion should be on if there's another offense right so I mean I don't I don't have an issue uh really soon I don't see any issue if that's what the da wants but at least for future reference I I need any peace of mind because I've never heard of response like that [Music] vacation now now so you know how to find the odd ones what's that I said you know how to find the odd ones odd odd circumstances it seems like the last two or three conversations it has a positive I have had a puzzle look on your face you've been speaking to DA's that I'm not familiar with a lot of new DA's being hired there apparently I think the puzzle looked more often than not is about them accepting not do whatever you want back up it wouldn't let me run it by them they they said that if if it's already been ran by that one then they don't want to hear about it so yeah and I gave the same puzzled look Rises yeah you ready started looking at another charge he already answered the phone for another charge we're not waiting on the VA to show ask him if he wants to release the cash wallet or phone to her so that she could bring it to David you said David right David yes ma'am yes ma'am so it like I said the uh um the protective order the protective order is still active as long as it's active we are required we are upheld by the law to to act on that so I'll talk to him more in the jail but you need to be 100 certain before y'all come into contact whether you go and see him or he comes and sees you that that's no longer active and that that could be something as simple as just him contacting the court before y'all come into contact just asking if the he still has that valid protective order because y'all are going to fall into this position for the foreseeable future because it does not expire as of right now there's no expiration date set and that's probably because there was something that he needed to do that he didn't do Okay so whatever that looks like I don't I don't know what the order said did he tell you what it said take her take the cash yeah okay everything okay oh all right you said take it with them okay wow I have 20 bucks but okay I asked somebody said you want to take away wow give me one second yeah you need like 20 to get home oh really no I'm upset because we just had a conversation because I can't pay bills he's gonna blame you okay so you can't blame yourself and you can't let him blame you because he's the one that knew about it he just had our conversation he was going to help me because I have no one to help me I can't believe this is happening so I'm not mad at y'all I know I know you're not I know you're not but
