near like this just like flat you know you're going to keep your arms at your sides you're going to stare at that race PL you're going to count like this 1001 100002 100003 and so on until I get my on dii probation this is just another Fielding test but you can refuse to take this next test if you want you may have heard of it referred to as like a breathalizer test okay um it's not the implied consent test meaning it's not official so if you were ARR yeah you want to do that t what do you mean yes or no what do you mean you want to do it or no you can refuse it oh like it yeah okay turn around so you want to place me on yeah that's right go all right let's do it go over here to my car two minutes apart I'll tell you your results after that it's just another test to help me determine the actual alcohol content you're going okay you want to do it or no like I said you can reuse this but it's up to you you want to see where you're at you can blow into the machine all right so to do you're under the influence of alcohol uh you have a choice of taking a breath of blood test if you're on DUI probation you are required to submit to alcohol screen test which would deter your not if you refuse to submit to or fail to complete a chemical test your driving privilege will be administratively suspended for one year or administratively revoked for two or three years by the Department of Motor Vehicles a second within 10 years of a separate violation of driving under the implo including such a charge reduced to reckless driving or vehic manslaughter or a violation of California vehicle Cod section 23140 which resulted in a conviction or separate administrative determination that you were driving with the BAC of 0 one% or more while driving under the age of 21 or a separate administrative determination that you're driving with a PA 0 1% or more while on DUI probation or a BAC of 04 or operating a commercial vehicle or a BAC of 8 or more at any age or you refuse to test will result in a 2-year administrative relocation three or more offenses within 10 years of any combination of the above violations convictions or separate administrative determination bro will result in a threeyear administrative revocation refusal or failure to complete a chemical test may be used against you in court refusal or failure to complete a breath or year testing will result in a fine and mandatory viol you do not have the right to talk to an attorney or have an attorney present before stating whether you will submit to a test before deciding which test to take or during a test if you cannot or state you cannot complete the test you choose you must submit to and complete a remaining test will you take a breath test well like I said we got to do a test will you do a breath test
