what the Toronto police see on their mws which is their mobile workstation it's the computer in their car so as you can see here about the third or fourth line down it says M was yelling he can't breathe and to call 911 so Witnesses saw Audi and Canada get beat up and they called 911 and a lot of the witnesses that were there and it even says in the call here it says complainant advise they were punching dragging the mail and hitting his head security was in uniform so people and witnesses that were filming this incident actually called 911 to say that Regal security was beating up auditing Canada let's jump into this this is where the police arrive and figure out auditing Canada is handcuffed to a bench so what's your side what's what did you you tell me what happened I was recording on public sidewalk okay and what happened and they came outside IED on the video and they said oh you're tresp we going to AR they trashed me they tried to tou me three of them I pied up one that in Ontario security guards are governed by the private security and Investigative Services act 2005 PSN sa which outlines their responsibilities and limitations while the cesa does not explicitly address the act of handcuffing individuals to stationary objects such actions must comply with broader legal standards concerning the use of force and detention use of force and detention security guards are permitted to use Force only when it is reasonable necessary and proportional to the situation the criminal code of Canada particularly section 25 allows individuals acting under legal authority to use Force provided it is Justified under the circumstances excessive or unjustified use of force can lead to criminal charges under Section 26 of the criminal code take my advice take I or unreasonable especially if it poses a risk to the individual's safety or dignity you can't cuff people lying down and stuff man it's not going to end with I'm not talking about your the Blurred before that we are going to have a look at the struggle it took for these handcuffs to come off imagine there was some sort of evacuation for a life and death emergency I think we all know what would right to film issues with that whatsoever very much no worries don't no worries at all um obviously you know you're trespassed from that particular location um so going inside would be an issue this is what we're going to talk about this is what we all about so for right now um just in terms of uh understanding for everybody inside is not okay you're on a public sidewalk though there's no issue there okay um there was the there was the allegation at the time of the assault so when you swatted the security guard's hand away right that they took as an assault assault so they assaulted me first no no this is where I'm explaining all right so as per the video I understand where you're coming from in terms of uh you feeling like you've been assaulted however the initial action of where you SED the guys s the security the lead security guard's hand away they took that as assault of action ass first they are charging me is an assault let me let me explain let me finish and let me explain if you have any questions at the end I'm more than happy to ask them okay all right so in terms of criminality nobody's getting arrested today so you're you're free no handcuffs uh release No Charge um
