vehicle abruptly turned into a gas station before two female occupants exited the car and ran inside the store once the occupants of the vehicle were back outside the officer spoke with them as His driver the officer instead positioned his Patrol vehicle behind her car and reapo the suspect as his investigation proceeds can I have you step out for me yeah we're just going to step back here okay you to place your left foot on that straight line place your right foot heel to toe in front of your left foot remaining that nope don't start the test yet I'm nope you're fine so your left foot on that line your right foot heel to toe in front of your left foot go ahead and do that remain in that position with your arms down your side don't start the test yet yep so your left foot on the line your right foot heeled to toe in front of it just keep your arms down at your side don't start the test until you tell you to okay can you get back into that starting position for me left foot on the steps down that straight imaginary line it'll look something like this okay one two three all the way to nine this representing your ninth step leave this foot planted take small choppy steps until test I want you to watch your feet count out loud keep your arms down your side and don't stop the test until you've understand so I go there and then go back yep nine Heel To Toe steps with your arms down at your side the turn that was described to you and then another nine Heel To Toe steps back okay do you understand whenever you're ready go ahead and begin 2 4 5 68 fny my left foot again loud 1 1,000 2 1,000 3 1,000 4 1,000 5 1,000 6 1,000 until I tell you to stop counting if at any point in time you should set your foot down just go ahead and pick it back up and continue counting from where you last left off okay once again while you're performing the test I want you to watch the tip of your foot count out loud for me keep your arms down to your side okay do you understand signs of impairment okay so I am going to be placing you under arrest for offering while intoxicated your pvt result was a 0.94 okay so at this time you are under arrest foring while intoxicated go ahead and turn around place your hands behind your back how long what's that how long you just need a silver ride to come pick you up on my way can we just wait here there's some other testing that alcoholic beverages before speaking to the passenger to inquire on her plans moving forward so what what would you like done so we can get you you can either come with me and just hang out while we do the stuff that needs to get done with her or you can wait here and wait for her ride am I in trouble so you're going to be receiving an underage citation are you going to tell my parents how old are you 18 then no um can I get my phone the suspect was eventually taken to Grant Regional Health Center and read the Wisconsin informing the accused form to which she consented to providing an evidentiary chemical sample of her blood M will you submit to an evidentiary chemical test of your blood the blood alcohol sample yielded a result of 09 G ethanol per 100 m absolute sobriety must be maintained if driving well under the age of 21 in the state of Wisconsin in court Michaela was charged with operating well intoxicated first offense or OWI on September 30th 2020 3 months and 18 days after the arrest the suspect pled no contest and was convicted of ow she was ordered to pay a total of $830 in court assessments this amount has been paid in full Michaela was further sentenced to no time in jail a six-month license revocation and ordered to participate in an alcohol assessment 2 years and 28 days after Michaela's first oi conviction on October 28th 2022 at 88:13 p.m. a Crawford County Sheriff's deputy responded to a rollover accident on County Road X in Clayton Wisconsin once on scene emergency Personnel alerted the deputy to the smell of alcohol coming from the driver of the vehicle before transporting her to the Vernon Memorial Hospital furthermore the reporting party claimed that the driver had requested the passer by to not tell law enforcement about the accident after taking pictures of the damage to the purple 2006 Chevrolet HHR the deputy went to the hospital to interview the suspect to continue his investigation and the next thing I knew I was say then some girl was pulling me into her car okay were you the driver of the car yes sir was anyone else with you in the car you were alone okay looks like what you did is you crossed the center line of the road you left the roadway that big boom you heard was probably you hitting a a power pole um I believe you flipped one time do you remember the car rolling at all no I don't know you think after feeling the gravel okay where were you at tonight it was at I was at Country Gardens okay and what were you doing at Country Gardens I was having a few drinks in my coor gr okay do you know how many drinks you had like 6 if that even six okay if that even do you remember what time you got there 4:00 4:30 okay and do you remember what time you left 6:37 okay 730 at lat okay you said you had six drinks roughly yeah if that do you remember what you were drinking bardian and lemonade bardian lemonade yeah lardan yeah okay um do you feel like you're under the influence of alcohol I definitely felt fine to drive I mean I definitely felt like I had a f i definitely felt fine to drive that makes sense do would you say you like had a maybe a buzzed feeling but not drunk yeah definitely I mean even less than a buzz that's why I don't want understand how this happened mhm so you feel what do you feel like caused the crash I don't know maybe I overc corrected mhm which I definitely think might have happened because of that scared okay okay um so what I'm going to do now because you admitted having some alcohol okay um I I believe that the alcohol had a factor in this crash okay okay I think we could probably both agree with that if we were if we were completely honest with ourselves um so I'm going to go ahead I'm going to charge you with an ow um so what I'll I'm going to do is I'm going to need a blood draw from you um which we'll have the nurses do um I'll complete my paperwork here I'm going to read off a form to you and then at the end of that you'll answer yes or no if you'll submit to that blood test does that you will not go to jail um since you in a crash I'm not going to take you to jail for this that's for sure so you won't go to jail the suspect was eventually read the Wisconsin informing the accused form and consented to providing an evidentiary chemical sample of her blood will you submit to an evidentiary chemical test of your blood what would you Rec I cannot give legal advice is that a yes okay answer will be a yes at 10:08 p.m. the blood samp Le yielded a result of18 G ethanol per 100 m in court the now 21-year-old suspect Michaela was charged with unreasonable and imprudent speed and ow second offense on March 8th 2023 4 months and 8 days after the accident and arrest the defendant pled no contest to the OWI charge while the remaining charge was dismissed she was ordered to pay a total of $1,500 $29 in court assessments this amount has been paid in full Michaela was further sentenced to 10 days in jail a license revocation for 12 months an ignition interlock device for 12 months and ordered to participate in an alcohol assessment
