welcome back to the DUI Channel we are in Longport New Jersey where on October 1st 2020 at 11:22 p.m. a Longport police officer observed a black 2019 Nissan Sentra traveling at a much greater speed than the posted speed limit of 25 mph the officer pulled out from North 36 AV onto vetner AV and followed the vehicle before activating his emergency lights the officer pulled the driver over near Sunset AB before stepping out of his squad car and approaching the vehicle on the driver's side as his investigation begins seems to be the rush I just get back to the hotel off all right you know just come from the casino where that's both of our license where Rhode Island all right through the tourist through taus all right do you know what the speed limit is on that road uh 35 is said 25 uh returned to his Patrol vehicle he discussed the traffic stop with another officer on scene coming up 30 33rd did you see him from like I was probably at 33rd in Winchester I'm like wow that guy is moving like that's how far back I was but I saw that car go through the like not not wrongly through the light across that intersection I was on 36 so I couldn't clock him but he was move I mean and I had like if we if you ever needed to make a I saw that I'm like that I was going 55 it took me forever to catch up said by the time I you ever get up then when I heard you so I'm I'm up at like ventner at this time when you call out to 12 I'm like oh he has to be after this guy move like moving yeah yeah he was he was yeah like I said he must have gone like 50 easily caught my eye like like I said he crossed that intersection so quickly like that guy is yeah he was moving man while verifying the suspect's identity the officer discovered the out ofate license was valid but indicated a required interlock device restriction Mr uh here it says you're supposed to have a ignition interlock device yeah that just got put in okay literally my my lawyer said I could drive okay this was already ADM on court that I had the court date to drive in all right oer comes back on mind is that you're supposed to have a interlock device while operating motor vehicle say this was already admissible in court the judge knew about this this travel vacation was already well then I don't know why they would put that on your license I I just I just got it last week last week I just got it last week do you have any and my lawyer already knew it was report do you have any paperwork verifying that on you I have nothing I have nothing I mean if I just took people at their word all the time I only because this is a rental like it's a rental in my name I know so you should be driving though he can't the problem is he can't drive a vehicle that doesn't have an interlock device and I push the start yeah okay following the arrest the suspect Lawrence was taken to the Longport Police Department for further processing whereupon he refused to submit an evidentiary sample of his breath in court the defendant was charged with failure to install interlock device drive car without interlock device consent to taking of samples of breath careless driving and driving while intoxicated or DWI on January 12th 2021 3 months and 11 days after the arrest Warren entered a plea deal which dismissed the former three charges in exchange for pleading guilty to DWI including a $57 fine he was ordered to pay a total of $890 this amount has been paid in full he was sens to zero days in jail a license revocation of 2 years attend an intoxicated driver Resource Center program for for 48 hours community service for 30 days and an interlock device during suspension for 2 years of note 54 days before the arrest the suspect was arrested by the North Providence Police Department and charged with driving under the influence of liquor blood alcohol concentration unknown First Defense or DUI although the case was dismissed as an implied consent State per Road Island law an ignition interlock device can be administratively ordered if the driver is both investigated for UI and refuses to submit to chemical tests for the purpose of determining the chemical content of their body fluids or breath
