welcome back to the DUI Channel we are in Vail Colorado where on May 7 2020 at 11 45 PM Vail police observed a sedan Park perpendicular in the exit Lane of Marriott's Streamside at Vail the sedan was able to enter the traffic circle and began traveling eastbound on South Frontage Road the officer began following the vehicle and observed the driver abruptly pulled into the Conoco gas station after the officer instructed the driver to stay in the vehicle he approached the suspect as his investigation begins you can roll your window down does your window roll down Okay cool so my name is with the town of L Police Department reason why I stopped today is you're traveling the wrong way when you got out from the Marriott stream side is there a reason for that just trying to get home okay where's so so you you don't think this this this vehicle has commercial insurance or like I don't think you have insurance at all because you showed one that was expired back in February and we are in Maine ask you this all right so this is the suggested Express consent it says by driving in the state of Colorado you're required to take and complete into cooperate and taking completing of a chemical test of your blood or breath when requested and directed by a law enforcement officer who has probable cause to believe you have driven under the influence of alcohol and or drug which test do you choose a blood or a bread test all right what okay [Music] in that direction you're recording yeah okay yeah you said blood test okay okay so we're gonna go to Bell Health get a blood test and then uh see if we can get somebody to come get you yeah okay okay all right following the arrest the suspect Lance was taken to Vail Health Hospital whereupon the arresting officer again read the suggested Express consent statement really doing is signing here saying this all right I understand what you're telling me okay okay so my whole thing is that um I waved my legal rights on this right well you're required in the city let's tell you what let me read this this because I have no idea okay I have no idea no it's totally fine totally fun so let me read this to you again so this is the suggested Express consent so by driving the state of Colorado you're required to take and complete and to cooperate and taking and completion of a chemical test of your blood or rep or requested and directed by a law enforcement officer aren't you supposed to talk to my attorney not for this no officer who has probable cause to believe so you're telling me right now that my attorney is not supposed to be so hold on orphibious let me finish this okay okay all right so I'll start over all the way from the game so by driving the state of Colorado you're required to take and complete into cooperate until you've completed a chemical test of your blood or breath when requested and directed by a law enforcement officer who has probable cause to believe you have driven under the influence of alcohol which test do you choose and you chose a blood test okay now you're turning no I I didn't I didn't say a blood test you did tell me a blood test no I said that I would not take a test outside the car yeah the road size so you want to do the road size I'll tell you that's totally fine and I asked you again when I put you in handcuffs pushing the car as you blow it up okay so look look here's my confusion with this whole thing okay I understand what you guys want okay I understand that you guys want to cross cap prosecute me for whatever it is that I'm doing right okay I'm trying to like like say Hey listen I just want to walk home I'm a jail guy right okay you don't want that okay so my thing is that um Hey listen you know what the hell okay so here's the DOR refusal segment so this is the Department of Revenue I'm not I'm I'm not saying that I'm trying to figure this out I'm trying to figure the whole thing out so I determined you were driving the car and you told me to work I arrest you because I believe you're impaired by alcohol and your drug all right now I asked you if you want to do a blood or a breath test and the car utility blood test okay is that correct that's why I work no I'm not saying anything right now I I think that I want to refer everything right now to my attorney okay so here's the DOR refusal statement if you refuse testing your license will may be revoked you may be required I understand I understand in your car for at least two years and you may be required to have a DUI treatment for at least eight months in order to get your license back now will you take the test okay so you're saying that that I want to take that right I'm not willing to take that okay and if you don't want to take a blood test or a blood test that's fine I would rather talk to my attorney first okay you're not can I have your attorney for this one man okay so I'm just saying that like and I know you have this thing on right here yeah okay and I would like to have a copy of this because I know he has got me with it too okay so once this is all done starting over and I've got the the report finished you're welcome to get a copy of it but right now we're here at this point okay so I've already originated dor refusal statement I asked if you do you want to still want to do this web test I I don't know I have to talk to my attorney that's fine that's what I'm going to say to you I'm going to say because you're forcing my hand okay all right and and I'm sure from your family and your family with pandemic and as much as you guys have done right now and I I I'll take this off and I'll say this right now your family and your family you would take care of them okay so so no no I'm not done I'm going to read this to you okay so what I'm just gonna tell you is that I would like you to talk to my attorney okay okay so I talk to your attorney and we don't have the privy to do your as a kitchen attorney right now now is the time when you get to make your decision all right okay so you have three choices and we're driving in the state of Colorado you are required to take and complete and to cooperate in taking and completing of a chemical test of your blood or breath when requested and directed by a law enforcement officer who has probable cause to leave here driven under the influence of alcohol and or drug which test do you choose you told me blood okay that's why we're here now right I would like to talk to my attorney first okay so the dur refusal statement if you refuse testing your license may be revoked for six months we'll require you may be required to have a breath test device in your car in at least for at least two years and you may be required to have a DUI treatment for at least eight months in order to get your license back now we take the test I'm not going to take any tests okay so I'm going to set that as a refusal yeah okay not very good following the refusal to submit a chemical blood sample Lance was eventually charged with two counts of careless driving driving the wrong way on a one-way Street and driving Under the Influence or DUI on July 14 2020 the defendant pled guilty to the two counts of Carol it's driving and was ordered to pay a total of 367 dollars the DUI and driving the wrong way on a one-way Street charges were both dismissed by the district attorney ultimately the defendant was sentenced to paying fines and penalties only
