welcome back folks to the dui channel we are in bell brook ohio where on february 1st 2020 at 5 p.m bell brook police received an anonymous call that claimed a man was sitting in a white ford f-150 and drinking alcohol near a dollar general an officer soon spots the suspect and follows him through an alleyway nearby as he parks his vehicle near his home as the officer pulls up directly behind the driver he steps out of his vehicle just as her investigation can step back just sit back in your vehicles i'm just gonna have you sit back in your vehicle no i need you to get back in the vehicle we're actually going to be in the alleyway in between the post office and brookside garage just safety purpose i just want to sit in here do you have your driver's license with you sir i don't have a driver's license you don't have driver's license no okay where are you heading to today right here do you live here yes okay have you can i ask you a question if you had anything to drink today yeah somebody called our dispatcher said there's a guy in a white truck over dollar general drinking beers so she gets over there you're in the store well she goes investigates the vehicle comes back to you and you're fair to reinstate you can't you can't drive her okay so you get in the vehicle all right she sees you driving that's why she stopped you right now okay so we're investigating the complaint about the i can smell the alcohol on you okay and you were honest with me you said you had a beer like i said you were honest with me i just have to make sure that you're safe i know i just have to make sure you're safe because you were driving a vehicle just because you drink do you want to sit you want to sit down i can help you down or do you want to sit at home why don't you come in i need my insulin medicine this is your insulin stuff okay i don't have that hey man this is hiram yes okay firearms has been drinking some alcohol all right he's under investigation for ovi right now and he's due to medically redacted information no more audio is available for this incident following the initial investigation the suspect hiram was taken to miami valley hospital south for a medical evaluation at 608 pm hiram consented to a urine sample which yielded a result of 0.266 percent bac the suspect was eventually charged with operating under the influence of alcohol second offense or ovi driving with an open container and driving with a suspended license hiram was also charged with ovi alcohol urine 0.238 percent or greater in court the defendant pled guilty to a reduced charge of ovi second offense which turned into an ovi first offense a first degree misdemeanor in the state of ohio the three other charges were dismissed the defendant was ordered to pay 950 dollars and 56 cents the bulk of which came from the ovi fine of 500 additional charges were assessed after bench warrants were put out for probation violations while the suspect paid the original fines and fees from the conviction the costs associated with the probation violations are still outstanding hiram was ultimately sentenced to 180 days of jail imposed with 180 days suspended his license was also suspended for 365 days he received six points on his license and he was ordered to attend a driver intervention program or dip school hiram's current unsupervised probation is scheduled to last until january 18 2024 but there's beer over here spilled okay i don't see the key i don't see the key anywhere okay he might still have it on him he didn't throw it up there did he no all right no beer over
