welcome back folks to the DUI Channel we are in Saratoga Springs New York where on March 15 2020 at 1 35 a.m Saratoga Springs police observed a white Jeep Wrangler traveling south on Broadway without their headlights activated the officer pulled over and approached the vehicle as her investigation began okay we've been down any of the bars anything like that okay what bar were you at we're at topamero Tap and Barrel do you have anything to drink uh like one or two one or two when was that like about how long ago okay and would you have Jeff beer wine okay is there anything wrong with your don't move from the position until I tell you explain the rest of the test and tell you to start do you understand yeah okay so I'm gonna have you put your right foot in front of your left foot with your heel touching your toe hands at your side stay in this position and don't move until I finish explaining the test okay so you're the your right heel will touch your left toe okay and then from here I'm gonna have you take nine heal the steps Heel To Toe steps forward like so one two three you're gonna go to nine you're gonna take a series of small steps around to turn around and then you're gonna go nine Heel To Toe steps back one two three you'll go to nine I've demonstrated three while you're doing this test you're gonna look at your feet keep your hands at your side count your steps out loud loud enough so I can hear you and once you start this test do not stop until you have completed the test okay do you understand the instructions I've explained them to you okay whenever you're ready to start one nine nine one two three four five okay all right so for this next uh test I'm gonna have you while I explain the instructions you're gonna just start with your feet together hands at your side again okay and then so you can watch me so then I'm going to demonstrate the test to you so we're gonna do the one leg stance so either foot whatever one of your choosing I'm gonna have you raise it six inches off the ground with your foot parallel to the ground while your foot's raised you're going to keep your hands at your side you're going to look down at your foot and you're going to count out loud One Mississippi two Mississippi three Mississippi so on and so forth until I tell you to stop okay do you understand yeah the test okay yep so don't start yet so just while you're doing the test make sure you're carrying out loud loud enough I can hear you your legs are straight hands are down at your side your foot's looking your eyes are looking down at your foot okay so whenever you're ready to start One Mississippi to Mississippi through Mississippi six inches off the ground five Mississippi okay so you can stop okay so I'm gonna have you blow into this and you're gonna blow into it like you're take a deep breath okay so I'm just gonna have you promise you it's not gonna be what you wanted okay so I'm just gonna have you I know I know blow into this like could get her out okay she's gonna be released to a sober yeah party that's all she's not gonna need any bail money or anything she just needs somebody silver to come pick her up in a couple hours wait put me on FaceTime with the coffee okay so what does um your dad to go pick she just needs a silver third party to pick her up that's it no money no anything just a silver third party to come down here yeah I need to go pick her up can I call you in like yes of course no so she doesn't want anyone calling her parents I don't know if you are right no one should we're calling parents give me a second I'm gonna go to Instagram her yeah information for me and then she said that we can move her car to park it legally okay so it's one of us or she said is your life do you have a valid license or is it expired okay like it was expired like Thursday I can't drive what does she need out of the car all NFL I think her phone's right up there okay here's your phone does she have wrong in here so yeah yeah because we're gonna legally park our car for her so we don't have to tow it because we don't want to put that burden on her either okay yeah so if you could you want to tell your friend to meet you at Duncan we'll give you a courtesy ride up to Duncan you can wait in there until all your roommate comes would you mind bringing her over there okay so you can get your stuff out I don't have shoes can you get her information too for uh PG the suspect Megan was arrested for driving while intoxicated or DWI and transported to the Saratoga Springs Police Department for processing while there the suspect submitted a breath alcohol sample of 0.17 percent this is over twice the legal limit of 0.08 percent breath alcohol content to drive in the state of New York on June 4th 2020 she pled guilty to driving while ability impaired or dwai the defendant was ordered to pay a 300 fine as of sentencing the suspect has paid all fines fees and surcharges in full Megan was further sentenced to a conditional discharge of one year with her license suspended for 90 days she was sentenced to no time in jail and not put on probation
