welcome back folks to the DUI Channel we are in Rock Island Illinois where on January 1st 2020 at 2 18 a.m a Rock Island officer observed a Pontiac traveling without any activated headlights or tail lights while on routine Patrol the officer initiated the traffic stop in the area of 24th Street and First Ave with a Rock Island Arsenal PD Patrol unit providing cover the vehicle came to a stop just before the Arsenal Bridge as the investigation began true what's up boss hey man reason I stopped you okay you started driving without your headlights on okay oh it's automatic my bad it's automatic I can get a gauge about where how much alcohol that you have okay on your breath okay it's a portable bread tester it'll test the amount of alcohol that's in your breath from your lungs I don't understand why you said why you say that because right now I mean I'm a pastor if you feel like I'm I'm I'm I'm okay right now I'm cold out here so okay I got you right now I have like I have enough probable cause to arrest you okay for driving under influence of alcohol okay do you want to provide a breast sample what does that mean you want to blow in my room style machine to see what your blood your breath alcohol content is I mean why do you say you have another the recipe you I have enough indicators on my test okay do you want to provide a breath sample man thank you to do that's what I'm trying to figure out okay so you had enough indicators on my test that let me know that you is it's very 40 degrees out here okay but still it lets the test to give me a good gauge of a person that's under the influence of alcohol okay Okay so do you want to provide a breath sample for me I mean that's what I have to do I mean I don't know that's what I have to do I mean it's yes or no it's consent I can't I can't force you to do it I don't understand what's going on okay you got you it's either yes or no okay I don't know what other way to explain I'm asking you questions because you the police officer and I'm I'm the civilian I don't I'm I'm asking you like I just did everything you want me to do okay and you had enough indicators on my test that is very indicative of a person under the influence of alcohol okay so I'm asking you now do you want to provide a breath sample to gauge where your alcohol content is okay what I'm what I'm asking you as a police officer okay you want you asking me to provide a birth sample and I saying like what did I do to to so pretty much to you're asking me to do this right like I'm saying I'm freezing to death and I and I'm taking that into account but I also know that I have reason to believe that you are under the influence of alcohol okay um you have a breaths sampleized yeah I got one in the car you wanna you wanna do it I'm saying what I'm I'm trying to figure out is I didn't perish some tests he gave enough indicators on it that I have probable cause for an arrest I rest for what driving under the influence of alcohol okay you you can do this you can do the breathwise you sure I'm saying like I don't know what you said like I'm not a vote I'm not I'm not a um you know what I'm saying I'm about to I don't the PPT foreign following the escape a warrant was issued for the rest of the suspect Christopher on September 24th 2020 after nearly nine months the defendant was finally served with litigation beginning in mid-october of that year Christopher was charged with several traffic violations including the class A misdemeanor driving Under the Influence or DUI on June 4th 2021 the defendant entered a plea deal that would dismiss all outstanding charges except for the obstruction of justice charge this resulted in a class IV felony conviction which is the lowest level felony in Illinois the defendant was ordered to pay 1284 dollars which included a 500 fine this amount has been paid in full the suspect did not receive jail time and was sentenced to pay costs only
