Okay. No, I didn't. It's not. >> Yes, you did. >> Okay. >> You 100% did. Okay. >> Not. >> I'm just stating the fact. This is a fact. You were going well above the speed limit when you crashed into these cars. I can tell you for a fact you were. Um, >> but not like you acting like 100% speed. >> I'm telling you right now, you were speeding. >> You were not going 25 milesPH. You were not going 25. >> I'm not going to sit here and say I was going 25. Nobody goes Nobody goes 25 down this road. >> There's a speed limit on this roadway. So, I come down this this street. >> Okay. >> All the time. >> Could you could you take a step over here for me? Right here. Okay. Just turn around. Face me. All right. >> So, listen. The reason I'm asking these questions and everything, okay, is I can smell the alcohol coming from you. Okay. I can smell some alcohol coming from I told you that I had to, >> you know, I appreciate you being honest with me. Honest. >> So, like I said, you're admitting to me you're drinking. I can smell the afro on you and based on this accident, I would like to do some tests with you to make sure that you're okay to drive, right? Like I said, the purpose of these test >> going to be okay to drive. >> I'm saying that you were okay to drive. That's all it is. The purpose of these tests is to make sure that you were good to drive. That's all it's for. All right. So, like I said, do you have any uh medical problems I got to know about or anything like that? >> Medical problems? >> Yeah. >> Any medical problems? Diabetes, anything like that? I don't have diabetes. >> No medical issues though that I need to know of >> my eyes. >> What are you having with your eyes? >> My eyes are an issue. During the HGN test, officer Mcdana observed the lack of smooth pursuit, distinct and sustained nestagmas at maximum deviation, and the onset of nestagmas prior to 45°. The second exercise was the walk and turn test. During the walk and turn test, Justine did not touch heel to toe on each step, turned improperly, and took an incorrect number of steps when returning to the starting position. The third exercise was the one leg stand test. During the one leg stand test, Justine failed to raise her foot in the proper fashion and put her foot down before the test was complete. >> Okay. >> Do you have any uh pain anywhere? Any physical problems or anything like that? >> Yeah. In my back. Okay. >> In my shoulders. >> And you said you didn't want an ambulance, right? >> I mean, you call an ambulance. >> It's either yes or no for going to the hospital or not. Okay. It doesn't change what I'm going to be doing here. Okay. Um, so like I said, so if you would you be willing to do these tests for me? >> I'll do the test for you. >> Okay. If you could just stand first going to do just stand with your feet together, arms down at your side for me. Take your hands out of your pocket. Actually, let's go over here. I want you get out of the street. All right. Let's go up onto the sidewalk. I don't want us to be in the street at all. Okay. >> All right. Just stand there with your feet together, arms down at your side for me. So, like I said, for this first test, what I'm going to do is be looking at your eyes. Okay. During this test, you're just going to stand here just how you are and follow the tip of my pen. See this tip of my pen right here? You're going to f with your eyes and your eyes only. Okay. Eyes only. >> Yep. Do not move your head at all during this test. Okay. >> Okay. >> I said don't keep your eyes only. I'll tell you when to stop. Okay. Do you understand? >> Yes. >> Ready. Mhm. >> Should I focus on that? Okay. >> Mhm. I'm sorry I shiver right now. I'm just cold. >> It's okay. Smell cold, too. Yeah, they're going to come. They're just >> I'm going to go up now. Okay. Ready? it up. Okay. >> Could you guys just turn your camera facing this way? >> This way? >> Yeah. Thank you. Okay. So, for this next test, what we're going to do, we're going to see how this is nice and smooth all right here and level. We're going to use this stretch right here. Okay. All right. So, for this test, I'm just going to take your pocketbook off real quick, and I'm just going to leave it right with my partners right here. Okay. >> Oops. I got you. It's just me right on the hood of our car. Okay. Okay. So, like I said, do you have any issues with your legs or anything like that? Any problems with cold? >> Okay. No, I got you. Listen, I understand it's cold. So, that's into it. Okay. I understand it's cold. >> Trust me, I get you. >> All right. So, for this next test, when I tell you to get into the starting position, >> we're going to have you to imagine there's a straight line running down the sidewalk. Okay? You're going to put your left foot on that line with your right foot in front of your left foot with your right heel touching your left toe. See how I am right here? >> Yep. When I tell you to, just wait. Okay. >> When I I tell you to get into the starting position, you're going to stay in the starting position with your arms down at your side. >> Yep. Just how I am. Here's how I'm standing. You're going to stand in this position and stay in that position >> until I tell you to begin the test. >> Okay. You may get into that starting position now. >> You said the right foot first. >> Left foot on the line. Right foot in front of your left foot. >> Okay. >> All right. Arms down at your side. Okay. I'm going explain everything to you and I'm going to demonstrate it to you. Okay. You're going to take nine heel to toe steps. Okay? >> Taking nine heel to toe steps with your arms down at your side and your eyes are going to be focused on your feet. Okay? >> As you're doing it, >> I can look down. >> I'm going to do I'm going to I'm going to explain everything to you. Don't worry. >> You're going to be counting out loud. One, two, three, until you get all the way to nine. Okay? Once you reach your ninth step, you're going to take a series of small steps. Turn around and take nine heel to toe steps back. Counting out loud. One, two. >> So, I got to take nine here and nine back. >> Yep. It's going to look just like this. Okay. You ready? It's going to look just like this, right? Obviously, going the other way, it's going to be ready. One, two, three, and you're going to keep going to nine. Okay? Once you reach your ninth step, you're going to turn just like this. And nine helto toe steps back. One, two, three, all the way to nine. Okay? Do you understand the test as demonstrated and instructed you? >> Okay, you can begin the test. Okay. >> So, I thought you was going to count. No, you count. >> 4 5 6 7 8 >> n >> as instructed and demonstrated. >> 1 2 3 4 5 6 7 8 9 So, >> just in case I messed up, I didn't know if I did it right. >> For this next test, I'm going to have you do just like how I did with your guys. You're just going to stand together, feet together, arms down at your side. Okay? >> Okay. >> All right. So, when I tell you to begin, you're going to pick up one foot either foot off the ground. Okay? >> And raise the clock 6 in off the ground. I'm going to demonstrate to you, too. Don't worry. While it's in the air, the foot that's raised in the air, your eyes are going to be looking at the foot that's in the air. Okay? Make sure you keep your arms down at your side. All right. >> I'm going to look at the foot that's raised in the air. >> Yep. Yep. I'll show it to you, too. All right. So, like I said, while you're doing it, don't worry. While you're doing it, you're going to be counting out loud. 1,00 1,002 1,003 and so forth until I tell you to stop the test. Okay? >> So, it's going to look just like this. >> Ready? Men either foot. Doesn't matter which one you raise up here. Okay? It looks like it's straight. 100,00 one 1002 1003 1004 and so forth until I tell you to stop. Okay. I said during the test you're going to keep your arms down at your side. If you happen to put your foot down for any reason, just pick it right back up into the air and start off where you left off. >> Okay. Do you understand the test as demonstrated and instructed to you? >> All right. Give me one second. >> I'm sorry. We're just >> I just I'm trying to I'm trying to cool down. Hold on. >> Let me know when you're ready. I'll tell you. >> Just let me know when you're ready. I'll tell you to begin. >> You ready? >> Yes. >> All right. You can begin the test. >> Count out loud. 1,00 1,002 1003 100,005 1006 1007 1008 1,2345 I said 15 seconds. >> It was until I told you to stop. Um 16, 17, 18, 19. >> Based on the motor vehicle crash, the odor of alcohol, and her inability to perform the field sobriety exercises satisfactorily, Justine was placed under arrest for operating under the influence. Her vehicle was impounded by for a mandatory 12-hour hold under J's law. The standard statement for motor vehicle operators was read to her at the scene and she agreed OT to submit breath samples before the officers placed her in the patrol car. >> So like I said, you already gave him your license, your registration, your insurance and everything like that. >> I gave everything. >> Okay.
