Is there anything in your pocket that's going to poke me, stick me, cut me, hurt me in any way? >> Um, I put knife in my bra. >> In your bra? Am I? >> No. No. Nothing is going to stick you. >> Okay. So, I have to take the knife out. You're not going to release one of your hand. You're going to reach into your bra and remove that knife. >> I'm not. Do you think I would fight you right now? >> You're under arrest. I'm not putting you in my car with a knife. Okay. >> What's up, everybody? Hope you're doing great. Today's video is a DUI stop that should have been a warning until the driver turns it into a full-on arrest and then drops a weapon surprise nobody expects. Stick around. This escalates fast. >> Hi, how are you? I'm officer Shling for police react body camera. >> Do you have a driver's license, registration, insurance card? >> Thank you. This is the current address of your driver's license. Yeah. Yeah. Where you coming from tonight? >> Work. >> Work. Where's work? >> John De Mo. >> Okay. You were coming straight from John Mo. >> Uh, no. I took a friend home. She was dating a guy and wanted to get a ride with another one and Yeah. >> This is not a good good call for her. >> No. No. >> What time have you guys closed? It's late. >> Uh, 11:00. >> Oh, okay. All right. Do you know why I stopped you today? >> No. >> So, you've been swerving initially. Yeah, I saw you came out of like uh on a branch street over there. You crossed over the center line. >> Then when you came down here, you were doing 36 and a 25 and then you failed to maintain a lane. You cross into the right shoulder as well. >> I'm sorry. I've been talking. >> Okay. Anything to drink tonight? >> No. >> When's the last time you had anything to drink at all? >> Uh November 4th. >> That's very specific. >> Yeah. No. Dry November, babe. >> Okay. All right. So, >> I just want to run you through a couple basic tests, make sure that it's safe for you to drive. So, what I'll have you do, I'll have you pop out. Just come in the back of your car here for me. Okay. It's not that bad. It's just a drizzle. Come on out with me. So, we'll run you through a couple tests. We'll make sure we get you out of here. All right. As long as you do good on them, it's just going to be a warning. Okay. >> I got you. >> Understood. I just come to the back of your car. Try to do some adult. Do you have a jacket or something? No. >> Do you have a sweatshirt? Anything you want to put on? Okay. All right. Just wait at the back of your car here. I'm going to turn off these flashing lights. >> Thank you. >> Where you coming from? >> Dry November sounds great on paper, but the officer is looking at driving cues and the time of night. That's enough to legally move into field sobriety tests. >> No. All right. So, let me have you stay with your feet together. You bring your hands down to your side. That's the position for this test. I want you to maintain that position while I perform the test. What I'm going to have you do is follow the lighted tip of this pen with your eyes and your eyes only without turning your head. Do you understand? >> Do you understand that? >> Yeah. Yeah. Yeah. >> Okay. All right. So, you bring your hands down your side. Again, you're going to follow the light of tip of his pen with your eyes and your eyes only without turning your head. Without turning your head. There you go. >> Okay. I'm sorry. >> I I know that you're nervous. I understand. >> I'm weird people. There's lights. Okay. >> Okay. Is the light bothering? I could do it different way. >> No, no, it's fine. >> No, no, no. It's all right. I'll pull out a flashlight and I'll kind of shine. I just need to be able to see what we're doing. >> We're in the rain. Okay. Oh my god. That's worse. All right. >> No, I'm not trying to write and I know it feels uncomfortable. We're going to do that a couple times. >> Keep your eye on my finger. >> I am. >> Yep. >> Look straight ahead. You're turning your head. >> I'm sorry. No, >> just look straight ahead. I got you. I'm >> looking. Don't >> look at me. >> Okay. Okay. >> Keep your eyes on my finger, please. I know it's uncomfortable, but I can't evaluate this test. >> So, I got a couple more tests for you and we're going to get out of here together. Okay. All right. So, for this first, this next test is the walk and turn. I'll have you put your left foot on that line and you're gonna put your right foot in front of your left foot. So they're touching heel to toe just like this on the line. Yep. You'll put your left or your right foot in front of the left so they're touching heel to toe and bring your hands down to your side. This is the starting position for this test. I want you to hold this position while I explain and demonstrate the test. Don't begin until I tell you to do so. Do you understand? Can you come back to that starting position for me? So it's the right foot in front of your left touching heel to toe. Your right foot in front of your left foot touching heel to toe. >> I'm sorry. >> And your hands down to yourself. Hold that position while I explain and demonstrate the test. Don't begin until I tell you to do so. Do you understand? >> When I tell you to begin, you're going to take nine heel totoe steps in a straight line. Okay. All right. This next test is the one. Excuse me. Put this back. It's a bit camera angle on that. So, I have you stand with your feet together so that they're touching and bring your hands down to your side. This is the starting position for this test. I want you to hold this position while I explain and demonstrate the test. Don't begin until I tell you to do so. When I tell you to begin, you're going to pick a foot, either foot, and you're going to elevate that foot about 6 in off of the ground. It's going to look like this. Keeping both legs straight and your arms out at your side. You'll look down at the elevated foot and count out loud. 1,001 1,002 1,003. And you'll continue counting until I tell you to stop. Do you understand? Do you have any questions? When you're ready, you can begin. >> Just keep your foot off the ground. >> And your arms down at your side. Keep that foot off the ground. >> Keep going. Keep going. And keep your hands down at your side. >> Okay. All right. You can stop. I got one more test for you. And like I said, we'll get out of here together. >> Turn back towards me. Come back towards me. All right. And stand with your feet together. Your hands down to your side. From this position, when I tell you to begin, you're going to close your eyes. You're going to tilt your head up towards the sky. With your eyes closed and maintaining that position, you're going to say your ABCs without stopping or singing. It will look like this. A B C I did ABC. You're going to do the entire alphabet without stopping or singing. >> Okay? >> Do you understand those instructions? >> Yes. >> When you're ready, you may begin. U B C D E F G H I J K L M N L P. >> Yep. The whole alphabet. >> Q R S T U V W X Y Z QRS T UV W. >> This is the point of no return. Hands behind the back means the investigation phase is over. From here on out, it's about control and safet Y. >> X Y Z. >> Okay. All right. Turn away from me. Put both your hands behind your back. Turn away from me. Thank you. And you're under arrest for driving on the influence. Relax. All right. Let me just lock these out so they don't tighten up on you. >> Okay. >> All right. Come to the front of my car here for me. >> Mhm. >> Is there anything in your pocket that's going to poke me, stick me, cut me, hurt me in any way? >> Um, I put knife in my bra. >> In your bra? >> But it's not like open. >> Where in your bra is that knife? >> But it's closed. I'm supposed to do it for 325. >> Am I? >> It's No. No. Nothing. It's going to stick you. >> Okay. So, I have to take the knife out. You're not going to the back of my car with a knife in your bra. I need to figure out what the best way to get that out is. Is it Is it accessible if I unzip your shirt so that I don't risk violating you in any way? >> I would have told you about it, but you like I >> I'm asking you. >> Okay. >> Okay. So, I'm going to unzip your shirt. Is it directly between your breasts? >> Where is it? >> Which side? Your left side or your right side? This is crazy. >> Where under your breast is the knife seem I mean we got to get surfing out of here. Am I [ __ ] Where is this knife? >> To the right. I just told you about it. >> Is it under your bra or is it on your shirt? >> It's like on the edge, dude. It's not even in that. >> Let me feel here. >> It's on the edge. >> On the side here. >> Not even that deep, bro. It's like right there. >> Do I disarm? I'm just trying to figure out the best way to access it. >> This is what I get for saying something. >> Well, no. We're going to search you anyway. All right. So, here's >> How am I even under arrest? >> I don't understand right now. >> You're under the influence. I'm going to check your pockets. >> I am not, but okay. >> And then I'm going to release one of your hands. You're going to reach into your bra and remove that knife. >> I am not. Do you think I would fight you right now? >> You're under arrest. I'm not putting you in my car with a knife. Okay. >> Get it out. >> So, give me a second. Okay. And is it this here? This padded area here that I feel the knife. >> I don't know. I have a padded bra. Like it's a lot of bra. I don't know. >> I'm going to take which hand is easier for you to get your right hand or your left hand. >> My either one. >> What? So, is it easier for you to get it with your right hand or your left hand? >> Either one. >> Okay. On the right side, I'm going to take your left hand out. You're going to reach in and slowly remove that. >> Okay? >> And you're going to put it on the hood of my car. >> I'm sorry. I'm freezing right now. >> Slowly with that left hand, reach in. You're going to remove that. >> I think Okay, I'm taking Oh my god. I'm taking it out. >> I got you. I've seen too many videos. I don't like knives. I'm putting it on. >> Don't like knife. >> When a weapon gets mentioned, everything changes instantly. He slows it down, explains each step, and keeps control because a closed knife can still turn dangerous in 1 second. >> I'm so cold though. Can I get the [ __ ] out of the cold, please? I'm so cold. I'm freezing. >> I understand that. It's nice and warm in the car, so just relax. Get you. >> What's that? I put it in here. >> Okay. What's the night for? >> Because I just Oh my god. I'm freezing. >> Okay, we're going to go to my car. >> All right, come to the back seat here. Got him. Yep. Can you just go to the other side now with the belt? >> So cold. >> All right. >> Oh god. >> Just got to step up some. He's going to help you out with the seat belt. >> I have hair in my hair. My mouth. I'm so sorry. Can you get it out? I'm so sorry. >> I see hair up here. Oh, I see. Okay. >> All right. I'm going to pass the seat belt over to my partner. >> And I'm sure you've heard this on TV a thousand times before. I just got to read it to you anyway. >> I'm so cold. >> Obviously, you're aware that you're under arrest. You have the right to remain silent. Anything you say can and will be used. If you cannot afford to hire a lawyer, one will be appointed at no cost to represent you before any questioning if you wish one. If you agree to talk to us, a decision to wave these rights is not final and you may withdraw your waiver whenever it doesn't belong in the car. I'm gonna start >> nothing. Okay. And you >> nothing in the car. >> What do you have the knife for? >> Because my girlfriend called me and said I'm at Jay's and I never go to Jay's. >> Okay. >> And I went there for a beer after work. >> Okay. >> I don't like it there and I don't trust it. So, I put that in my bra. >> Okay. >> But like I literally am not I had rolling rock while I was there. Like I >> I got you. We're going to get you home. >> Um >> No, but I'm just saying like >> we got some things I got to do. We're going to go over to the police department and we'll get you going from there. I want you to start thinking about who might be able to pick you up. >> Pick me up. >> So, someone's got to come and pick you up. >> So, you don't have to tell me right now. I just want you to start thinking about who might be able to come and get you. processing. They will not be related to anything incriminating. But I do have a form that I have to read you. It's called the attorney general standard statement for motor vehicle operators. It explains the legal requirements and your responsibilities in this situation that you are not entitled to an attorney for. At the end of it, I'm going to ask you a yes or no question. So, please just listen carefully. [sighs] You have been arrested for driving while intoxicated. NJSA 394-50. The law requires you to submit samples of your breath for the purpose of testing to determine alcohol content. A record of the taking of the breath samples, including the test results, will be made. Upon your request, a copy of that record will be made available to you. After you've provided samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take in ask you again. Will you submit to breath testing? >> Is that a no? >> Okay. You do you understand what I just read you? >> I >> No, I'm not. >> Just listen to me for a second. >> No. >> Just stop and listen. You're >> I can't even wipe my >> Listen to me. You're going to get another charge that is more severe than the DUI if you don't provide breath samples. >> That's fine. I'm not doing it. I'm not >> samples. >> No. >> Okay. I'm going to charge you with refusal. Understood. Hang tight for a second. I just need to talk to my supervisor. Let him know what's going on. >> 78 extension. Yeah. >> This is crazy. After that, you come back here, we'll get you the paperwork to get your car back. That aside, do you know who is able to come and pick you up? >> Sure. >> Who Who can we call to pick you up? >> My husband. >> Okay. All right. And where is he at? Home. >> All right. This is Officer Younger. He's going to hang with me for a couple minutes while I go out and speak with the supervisor. Uh while he does that or while he's here, he'll help you make a phone call to your husband uh and tell him to come and pick you up. Okay. Uh she's a refusal. Uh she's still handcuffed. There was a knife in her bra. I'm trying to get a female officer to search her. >> It's not in my bra. >> I said there was. >> I told you it was. >> I know we have it. But until I have someone here that could do a more thorough search, the handcuffs are going to stay on. >> All right. Uh, >> she's now looking at a DUI case that got worse the moment she refused the breath test because refusal can become its own charge with its own penalties. Add in the driving violations that started the stop. And this goes from maybe a warning to a court problem fast. The takeaway is simple. Be polite, follow lawful instructions, and save your arguments for a lawyer in the courtroom. If you found this breakdown helpful, hit like, subscribe, and I'll see you on the next one. >> Literally call every night on my way home. He doesn't answer. It's 91 Union Street in Meford Township. Um, and I'm not sure how far away you live, but I'm thinking about a half hourish or something like that. >> No, right. Shamal. >> So, yep. So, when you get here, um, you can just go up front, hit the box, and say, you know, you're here to pick up um the subject here and everything and and they'll, uh, they'll let you in. Okay. >> Can you write down that number again for me? >> Sure. The address me. >> I'm sorry. >> Yeah. So, it is Tell me when you're ready. >> Yeah, I'm ready. It's 91. >> Yeah. >> All right.
