Late at night in New Mexico, a domestic call pulls police to a house where tension is ready to snap. A man has fresh scratches across his face and neck, and inside a bedroom door has been kicked in. But what flips the whole situation on its head is one hard-to-believe detail. The Wi-Fi was unplugged, the cameras went dark, and a wallet and along with a stack of cash suddenly vanished. So who's telling the truth? Why does a 15-year-old become the key witness? And what moment makes officers [music] decide to put someone in handcuffs right there on the spot? Let's get into it. >> Are you his son? Are you his son? >> Yeah. >> Okay. Hi, ma'am. >> Hi. >> What's going on today? >> Uh we're just having a not domestic, you wouldn't say, but it's cuz he's drinking. >> Okay. >> trying to leave, so I went and got the truck cuz I actually He actually did take off. >> Okay. >> So I followed him, and then he's left the truck at Walgreens cuz the truck is in my name. >> Okay. >> So he left the truck at Walgreens, so obviously my son, you know, he honestly he doesn't have a driver's license, but I was like, "Okay, we have to get the truck home. We can't just leave it here." So we drove the truck home, we locked it. He took my wallet, he took my money out of my wallet. So I just want my money. Like we're leaving, we're waiting for them to come pick him up and then his nephew cuz we locked the fence. He went inside. He went back inside. >> Okay. >> I could open the door. I have the key, but >> That's fine. Um so what what started the whole >> Because he's drinking. So we went out to eat with my sister and her boyfriend, and he's trying to say that I was flirting with my sister's man. >> Mhm. >> We were all sitting there laughing. Like he was [ __ ] saying jokes or whatever. He was um my sister was like laughing, and then I was obviously laughing at them because they were laughing at me cuz I'm telling him, "Dude, like shut the [ __ ] up. Like you're pissing me off, you know?" >> And then the smell is inside the residence right now. >> He's inside. Um >> and so that's what started it cuz he was like, I was disrespecting him like because I was laughing with everybody. Like there was four of us, you know. >> And you guys were where again? >> We were at um first at um Farlie's. >> At Farlie's, okay. >> Yeah, and then we Farlie's closes I guess early. I didn't know that. >> Yeah, they close at 10:00. >> No, they close before that. >> Oh, wow. Okay. >> guess right before like in the fourth quarter of the last the game that was playing um San Francisco and Chargers. >> Okay. >> So, they're like when that game is over like we're done. And I was like, all right, cool. So, then we ended up going to um Buffalo Wild Wings and we're sitting there. And obviously he was drinking. And then um >> [clears throat] >> And then um he like >> you guys started the argument at Buffalo Wild Wings, right? >> Not till we literally got home literally like my I want to say 10 minutes after we got home. >> Okay. >> So, he was already upset when we got in the car and I didn't know why. And then we were driving home he was like, "Yeah, you were out flirting with him." And I was like, "Flirting with who? What What the [ __ ] are you talking about?" And then he was I The only other person with us was my sister and her man. >> Uh-huh. >> I'm like, "We're all laughing. What do you mean?" So, I just ignored him. We just drove home. I drove. And then um I parked the truck. I went inside. He went inside. I changed. And then he came back out and he left. >> Uh-huh. >> So, I was like he's going to pick me up. So, he went here to go get more >> On foot, right? >> No, he took off in the >> Oh, he drove. Okay. >> And then um so, I went down I jumped in the truck and I went down there. >> Okay. >> And so, yeah, he was at Circle K but they were already closed. So, he was pulling me out and I blocked him and I was like, "What the [ __ ] are you doing, bro?" >> Uh-huh. >> And then he came out. He drove down Main to what is it? Three crosses? The hospital? >> Okay. >> Went in there. Turned around. Came back up. Went to pulled into Walgreens. >> Uh-huh. >> And then I pulled into Walgreens and he parked and I blocked him in. And I was like, "What the [ __ ] are you doing, dude?" And then >> Controller 1411 263. >> I'm like, "Bro, what are you doing? Like what are you doing? Like you're drinking. You shouldn't be driving. Like it's done. Like it's a night, you know. It's it." And then he was like, "Get the [ __ ] out of here." And I was like, "Actually, I said I'm not because that truck's in my name. I'm liable for any accidents in that [ __ ] truck. Because I am the only person on >> Yes, you're on the insurance? >> That vehicle belongs to me. >> Mhm. >> I said so if you cause an accident, they can sue me, not you, me. And then he was like, "Here's your [ __ ] truck." Then he gave me the keys. >> Okay. >> So I turned it off cuz it's a push start. >> Okay. >> I turned it off and left it parked there. Then I came and I grabbed him and I was like, "Come outside so we can go get the truck real quick." So I followed him and then he just got home. He got home and then he was like, "Get the [ __ ] out of here." Like, "Pack your [ __ ] get out of here." He was like, "Take your [ __ ] truck." And I was like, "Dude, we're leaving in the morning. Like it's really late. The kids are asleep. Like I'll leave it I'll gladly leave in the morning." He said, "But if you don't want to be here, you can go sleep downstairs or call your sister to come get you." >> Mhm. >> And then he I don't know he [ __ ] got my purse and he took off. He took off that way whenever he was on the phone with you guys. >> Yeah. >> I was like I I broke the door. The door that's in the house, I broke it. I kicked the [ __ ] door cuz I was I was >> Which door was it? >> In my room. >> Okay. And that's when you're that's where you guys were arguing. >> Yeah. And then um he came I ran out he just come out he just literally went back inside when I was putting the kids in cuz he's like, "You're not taking them cuz So we're foster parents." >> Okay. >> The The kids that we have are his nephews. Cuz their moms are [ __ ] up. It's two sisters. Their moms are [ __ ] up on drugs. So I already knew it was going to be a fight so I called the sister and I was like, the other sister I was like, "Hey, you want to come get the kids because this fool's drunk." I said, "But you got to come get them before the cops get here." >> Yeah. >> [clears throat] >> I said cuz he's drunk. I said that way they don't see the cops get here. >> Right. >> But I kept telling him I was like, "I'll leave in the morning, fool. The cops are going to come. They're going to come. Like you don't understand they're going to come." >> Okay. So at any point tonight was it ever physical? Did you put your hands on him? Did he ever put your hands on you? >> honestly I jumped on his back cuz I thought he had the keys to my car. >> Okay. >> But he had sold took off with my wallet which he took the money from my purse and there was $300 which is not even mine. It's my son's for my son's lawyer because Long story short, my son was involved in a shooting at the park. So we have to pay his >> I see. Okay. >> took that money and I that's the only thing I want. Like, he could stay here. Me and my kids are going to leave. I just want the [ __ ] money. That's it. But, he he even started talking [ __ ] to him. And I was like, "Don't." I said, "The minute you tell him anything, he's going to call the cops." And he was like, "Go [ __ ] yourself. Don't tell me anything." >> Okay. >> And he was like, "You guys just need to leave. This is private property. You need to >> Okay. And you guys are husband and wife, boyfriend and girlfriend, fiance? >> No. No. >> Boyfriend and girlfriend. How long have you guys been together for? >> 2 years. >> 2 years. Okay. And both of you guys live here? >> Yeah. All of us live here. >> Okay. All right. >> He took my wallet, and I had money in here cuz it's my son's wallet, and he threw it over there on the side of the truck. Which he's not stupid. So, what he did is he came home and he unplugged the cameras. >> He unplugged the Wi-Fi so >> The Wi-Fi so you guys can't see the cameras. So, you can't see him throw my wallet. >> Okay. >> Cuz there's a camera right here on the front, and there's a camera right down the side of the house. >> But, you already have the money? >> Yeah. No, he has it. He has my money. It's like three or four hundred dollars. And I want to say in twenties. And he's going to use, "Oh, I just got paid. It's my money." No, it's not. He did get just paid, but it's not his money. >> Okay. Give me just one moment. I know you're upset. I'll be right back with you, okay? >> Uh-huh. >> Sounds like So, you just want your money. >> Yeah, that's all I want. It's like three It's like three something almost four hundred dollars. >> And if he refuses to give the money and says that he just got paid, what do you want us to do about it? >> Then he needs to leave. Then I'll stay here. The cops are here in my house. >> Okay. All right. Sounds good to me, okay? >> Okay. >> [music] >> He's throwing it, man. >> No. >> Hello. Hello. What's going on with you? >> So, I came back with >> Do you want to talk about the issue? >> Here, I'll close I'll close it up. >> That way both of them don't go in. >> I came back with my girlfriend, okay? We had a few drinks. Uh we made a disagreement on conversation. >> Okay. >> And she ended up taking my truck, okay? Is it the truck that >> Which one? The black one? >> one. >> Okay. >> Is it the truck I pay on? I pay on both, actually. >> Okay. >> And she said it was hers. So, she wanted to take off on me. So, I walked back home. I told her, "Honestly, I want you guys to pack up your stuff. Get the [ __ ] out of here." >> Where were you guys at when this argument started? >> This happened at Walgreens. >> At Walgreens. Okay, so how long ago would you say? It's It's 11:57 right now. >> Like 40. >> Like 40 minutes ago? 40 45? Okay. >> So, this has happened over and over again. >> Yeah. >> So, honestly, I told her, "You know, like I look out for you, your your kids, and everything. I pay everything around here." >> Yeah. >> You have no respect for me. So, I told her, "Get out." She wouldn't leave. So, she ended up [ __ ] getting physical with me. I told her, "I need my stuff." She didn't want to give it to me. She slapped me. She scratched me. And that's what That's when I I went outside. I told I told her I was going to call the cops. I want you guys to leave. >> Okay. Okay. >> She tried taking my nephews. They don't belong to her. >> And is that both the kids? >> and the and the baby. [clears throat] >> younger one? >> Both of them. >> Okay. >> So, right now, I want to file a restraining order. I want her to get the hell out of here. I don't want anything to do with her. I want >> So, as far as restraining orders, we don't file them. >> Okay. >> You'll have to go to the court. And then once they're in place, then that's where we can enforce them. Say she violates it or something. So, it started verbal. Where was it physical? In the house or or there was upstairs? >> Upstairs. >> Okay. Do you mind if I I'm going to look at your face? You said you got slapped in the face. >> Yes. >> Okay. And scratched. Okay. Okay. Do you mind if I take pictures? And all of this happened tonight, just right now? >> Yes. >> Anything else? Was Is that old? >> That's from um like a previous, I think. >> Okay. Let me see this other one. Let me see this other side. Okay. Do you mind pulling down your shirt? It's pretty bad. Do you want medical? >> No, I don't. I don't. >> Um, do you mind putting down your feet? Sorry, I didn't get a good picture. Does she have anything on her? >> Um, no. >> No. >> So, this side of his face, like I'm not sure >> I don't I don't want to precise anybody. I just >> Can you face that way? Yeah, just >> I just want to get your stuff and get out of here. >> How long have you guys been together? >> Um, we've been together like a little 2 years. >> 2 years? >> Yeah, that's kind of what she had told me too, so >> Yeah, it's just It's It's comes out all the way on just I'm going to download all this stuff. I didn't ask for her, I didn't ask for her kids. They have no respect for me. Um, I just want them out of here. >> Okay, so the None of these two are >> My little nephew is 5 years old. She has him. >> Okay, but they're not hers. They're >> They're not hers. They have nothing to do with another man, so >> I don't know what you're saying. >> What's your name, sir? Your voice doesn't always sound like that, bro. >> No, I've been sick. I've been sick for the past like 3 days. >> Okay. >> Yeah, I'm sorry. I'm just trying >> No, you're good. You're good. You're good. You're good. >> Yeah. >> I just want this to be over with. I don't want her to be here. >> How many cameras inside the house? >> Um, I do, but the only thing is I We don't pay for the Wi-Fi. >> Okay. >> So, I was I was just walking and the Wi-Fi went off. >> Okay. All right, and how did it go off? Was it unplugged? >> It was unplugged. Was it on purpose or accidental? >> They were on purpose, honestly. >> On purpose? Okay, who Who unplugged it? >> Uh huh? >> Who unplugged it? >> I unplugged it. >> Okay. >> Because I didn't want her to have access to my Wi-Fi. I don't want them to have, you know, their phones on or whatever. I just want them to get their stuff and get out of here. That's it. I prefer her things were in the room. So, if I prefer I don't want them to be using me. >> Yeah. >> And that's all you guys can do, you know? >> Yeah, just take unplugging it. Okay. >> All right, I'm going to let me speak to my partner real quick. I'll be right back with you, okay, sir? >> Okay. >> Yeah. Did you hear that? But she jumped down and lost her respect for him. >> And just to clarify, obviously I can see the the scratches right here. They're from her hand. The marks on your neck, how did you get those? >> Everything happened so quick. I don't know. >> Was she facing you? Like was she in front of you? >> of We were fighting. >> And how can you just explain to me like how she scratched you? Did she swing at you? >> I I don't know. >> No? >> I don't know. We were downstairs. We were talking and I told her to get out of the house. We were downstairs and then we went outside. I told her to just get out of here. >> Okay. But you don't remember like how you got the scratches? >> No. >> No? Okay. All right. Yeah, just cuz I'm we're trying to figure out what >> I don't care. I don't care about the scratches. >> No, I know, but we just we need to figure Yeah, but but for our report and everything because it's on camera, we see the the marks. We just need to figure out what they're from. Obviously we can see the chest, that's the hand, like you said. The face the hand, like you said. But this these ones because it's on both sides, was anything like around your neck that got pulled? Anything like that? >> a chain. I had two chains, but I don't know where they are. >> Okay. So that's the and that's why we ask because that's cuz that's where that could be from this from your chain. And it wasn't like >> I'm not hurt. I I don't want you to say anything like that. I don't I don't care. >> And and I know these are I You don't want to pursue charges or anything that. Um and you don't want anything done, but um in the state of New Mexico, it's not you that wants to pursue the charges. has to want to pursue the charges. Does that make sense? >> What do you mean? >> So, you're saying you don't want to pursue charges. Any other charge, if it wasn't domestic violence related, if you didn't want to pursue charges and you got beat up, we wouldn't do anything. But, in the state of New Mexico, when it comes to domestic violence, cuz you guys are household members, the state of New Mexico pursues on your behalf. Does that make sense? >> want to file now? Right now? I don't want to. >> So, it's it's sex. So, even if you don't want to pursue charges, I mean, we have the probable cause to say that she admitted to harming you. We do have the injuries consistent with it. So, tonight, she is going to be going to jail. But, here's what's going to happen. Because you don't want to pursue charges, and I'm not telling you to do it, but what happens most often than not in these kind of situations is the state is going to reach out to you. They're going to try to get information. What happens with victims who don't want to pursue charges is they just stop talking to the police. >> kids. I don't want her to go. >> Where are her kids at right now? >> They're with their That's all I'm saying. I don't I don't want you guys to >> Who Who are her kids? >> The older one and another two years old. >> Okay. Who do they usually stay with first? >> They stay with their grandmother most of the time. >> Okay. >> So, I I need her to stay with them. I just want them >> Okay. >> And if you don't want to pursue charges or whatever, >> Oh, there's your chain. I'm just I'm going to assume that's your chain. Does it look like it? >> Maybe. I don't know. >> You said there was two? >> There was another one, but I don't know where that went. I don't know. >> I mean, it might be inside. Maybe it just fell off out here. Cuz it doesn't look broken or anything. Kind of looks like it just with the way that is. >> Actually, what Hold on, let me see this. That's why he don't [ __ ] the Wi-Fi so you can't see the cameras. >> Okay. And do you know where she has somewhere to go tonight? >> Uh she has a lot of places. That's what I'm saying. He has gear, just go, and that's it. Wait. >> Okay. Does she have family here? >> Yeah, yeah, yeah. She has a lot of family here. >> Okay. Has she been drinking? >> Yes. >> Yeah. >> Yeah. >> Okay. Cuz we're we're going to have to do is try to figure out see who can come pick her up. >> Yeah, and if you guys don't think I'm legit for the kids, I mean, I have people that can come up. >> Okay. >> Okay. Oh, no. I mean, you're you're dad, but do they have somebody >> have an aunt here. >> In any case, in the event, I mean, that's not what we're trying to do right now. We we don't want to take them away from their house at midnight. >> Yeah, that's what I'm saying. >> Yeah. Okay. All right. Um we'll see if we can get that figured out, and then do you want to just hang out here, and then I'll come back >> Ms. Valenzuela, so I have a few more questions for you, okay? Um and has a lot of scratches on him. >> Yeah, cuz I jumped on him. What do you mean scratches on him? >> Like he's got a scratch mark. >> Yeah, cuz he had a necklace He had a necklace on. >> like a huge scratch from like one peck to the other peck down on his stomach. Like he's and it's fresh. >> No. Probably whenever we were on the bed, when you pulled the blanket, I pulled the blanket back off, and I picked up my feet and kicked like so that way he wouldn't get on him. He was in there. He saw everything. And then we were coming down the stairs cuz he my my in my room, I had my purse in the There's drawers, and I had my purse with the keys stashed in there. >> Okay. >> And I thought he grabbed the keys to the vehicle so he could take off. So when he was running down the stairs, I jumped on his back. And so he had he has neck I don't know if he probably doesn't the necklace on, but he had a necklace on. >> Okay. >> That's probably what scratched his neck. This is the necklace cuz I jumped on his back. >> Okay. >> And we put right here inside cuz he pushed us out cuz we literally came out the door. So, he was kind of like um trying to close the door. >> Trying to close the door. >> Yeah, and I pushed the door back open, but I never even touched him other than jumping on his back to get my keys because I thought he took the keys to the truck. Which when I got my purse, my wallet was empty. My wallet wasn't in there. >> Yeah. >> Which my purse I think is in his room on the thrown on the bed. >> Okay. >> And I could take you to where it's at where I threw it because I was like, "Fuck, I think he took the keys." But I have both sets of those keys to that truck. So, he >> Okay. >> Cuz they were all in my purse. >> When you when you jumped on his back, that was it? You just jumped on his back like that? >> Yeah, like I did Joe, come here. Cuz we're coming downstairs. >> Mhm. >> So, when we're coming downstairs, obviously he's a big guy. So, like I just like jumped on his back like that. >> Mhm. >> So, when we're coming down, he had a necklace on. >> Okay. >> Which he probably doesn't have it on him anymore. >> Okay. Can I just take a look at you really quickly, ma'am? So, let me see if there's any >> There's nothing other than my leg from where I kicked the door. >> From when you kicked the door? >> Yeah, I'm telling you I kicked the door into my room because he locked he locked it in there and I knew that's what he was looking for was my purse. Because first he went to the closet and >> Can I see your hands, look at this again? Can you flip them for me? What happened to you right here? >> Mhm. That's from the door. Because it >> Oh, that's from the door. >> Yeah, cuz I stuck my hand in there to unlock it to get in. >> Uh-huh. >> Then that's when he ran to the closet because he was looking for my purse. >> Okay. >> Where all my other purses are on because he even got into my my vanity. >> Mhm. >> And there's a blue wallet in there. >> Okay. >> It's not in there anymore because he took it out and he took it into the room >> Yeah. >> to look cuz he was looking for the key I thought he was looking for the keys. >> Okay. >> Apparently he's not. He was looking for the >> Okay. >> the what's it called? The my wallet I guess my wallet cuz he took my money. Yeah. >> Okay. And you said that your son saw everything? Are you okay if I speak to him? >> Yeah. >> All right. Let me walk down here, ma'am. How old are you? >> 15. >> You're 15. All right, ma'am. So, look, you're not in any kind of trouble. Nothing like that. All right, I'm not you know, there's no charges or anything like that. Okay. Um, are you willing to give me some type of >> Yeah, so he came home and she was really drunk. >> Okay. >> And I could tell he was drunk. Well, first she had to pick me up. She was like, um, get this spare key to the black truck. I was like, okay. And so I thought she needed to go pick it up from the work house. And so I was like, okay, should I come with me? Go we're going to go get the truck. Yeah. >> So you all >> I was like, okay. And then we go and get the truck and we come back and we I parked this one and she parked that one. Okay. So we parked it behind it so he couldn't get it like even if he was to take off, he couldn't get anywhere without hitting the truck. >> Okay. >> And so we're doing fine. We're I'm in my room. She's in her room. She's laying down. All the kids are laying down. The baby's sleeping. Everybody is asleep and I would hear like I hear a thump and I'm like I walk out of my room and I look and I I seen it was him and I stabbed him there. >> When you say you saw it was him, what exactly was he doing? >> He was walking into the room cuz when he when he >> Walking into their bedroom? >> Yeah, when he's drunk he does like he throws himself all [ __ ] >> Yeah. >> And so I I look out I I peep out of my room and I see it was him and when he's drunk he breaks a lot of [ __ ] >> Okay. >> So I stepped it like we have a like a wall right here. >> Uh-huh. >> It's half wall and then there's the stairs. >> Okay. >> Uh, my room is like right here. >> Uh-huh. >> And I stepped like this to get in front of the wall so I could like I have full vision of the room. >> Uh-huh. >> And they're arguing and then he was like, pack your [ __ ] and get out you and your kids, this and that. And I was and then he starts talking [ __ ] to me. I was like, don't talk [ __ ] to me cuz I will leave. Like like my dad he he just he came to get me. I was like, I will leave like I don't have a problem with leaving. >> Yeah. >> And then he was like, then I'll get your [ __ ] and get out. I was like, okay. And then so we started arguing and fighting and I'm like I'm like, dude, cut it out. Like you're doing the most and then he locks the door on her. >> Who's this? >> My dad. >> That's your dad? >> Yeah. >> Okay. >> So he locked the door on her. She kicked the door down because the the The and everything are in there. I have the keys as well, actually. I have both of And so he's kicking He almost kicked the door down and then he was like, "Package, you didn't get out." >> Which door? Is it the door from the bedroom? >> Okay. >> And he He He saw her do that? >> Yeah, I I seen her do it. And so I was like, "Package, did she was like but he was like, "Package, you didn't get out." And she was like, "We're leaving in the morning." And >> Good. >> My baby brother was in the room, so I got my baby brother and I put him in my other bedroom. And I was like, "You watch the baby for me." >> Yeah. >> They start arguing and he he starts walking downstairs. Cuz she seen he had something, so he jumped on it. And she jumped on it. And she was like, "Give me his stuff." And he was like, "Give me your stuff." As soon as I was like, "I'm calling the cops. I'm calling the cops." He was like, "You give it up and you leave. Go to your mom's house and do something." Who's this bro? Oh, that's her the kids are across the street at his. And so I just give it up and and leave. And then he was like, he was like, "Call him. I don't care. Call him." I was like, "Okay." So I called and then I had As soon as I like I They answered cuz I called like three times and they didn't answer till the third time. And I hear I hear him go out to the back the stacker side door. I don't remember what door he went out through. And I I had heard him and I was like, he took off walking cuz it sounded like he jumped the wall in the back. He jumped the wall in the back and it leads to the neighbor's yard and there's an opening inside. And I I told him I was like, he left. We thought he left. And then we went back upstairs to get our stuff and I called my dad and I was like, "Can you come for me? This is what's happening." >> And that's And that's where he is right now. Okay. >> So He was like, "Okay, I'll be right there." And I was like, "Okay." And then we hear I My mom went downstairs. >> Uh-huh. >> And I heard something and he had already had unplugged the cameras and the Wi-Fi so you won't see >> Yeah, you won't see anything. Right. >> Cuz once you unplug the Wi-Fi on the cameras, it clears everything. >> Okay. >> And so that's when I called you guys and then the super is down here. >> Okay. Got it. So when you say that your mom jumped on him did you physically see that? >> Yeah, I was behind her cuz I was tying I was tying him and stuff. >> And she kind of just gave him like a like a big old like >> She had Yeah, he had the keys to the truck so he wouldn't take off and wreck the truck. That's why I was saying that he wouldn't take the vehicle cuz then I was I was going to report it stolen vehicle. It's and not that he was drunk. >> I got you. Okay. All right, do you do you I'm sorry. Okay, sir. So my name's Officer Saffian, okay? I know you spoke with my partner a little bit while ago, okay? We're just trying to make sure that everyone's story is just kind of matching up right now, okay? Can you just tell me a little bit about what happened today, sir? >> Today me and her went out to a couple restaurants. >> Okay. >> Had a couple drinks and came back. She started flipping out on me. >> Okay. >> And we ended up at Walgreens. And um she ended up taking the truck. So I told her, "Okay." >> The black truck? >> The black truck. >> I got you. Okay. >> She took off on me so I ended up walking home. >> Mhm. >> And I came back. She started flipping out on me at the at the house. I told her, "You know what? You guys pack your stuff and get out of here. >> Mhm. >> I pay everything around here. I don't need you guys here or whatever. >> Mhm. >> And she flipped out. >> Mhm. >> So we ended up in the room. We ended up downstairs. We ended up out here. And we ended up out here. >> Okay. >> And that's when I told her, "You know what?" When she was leaving I was like, "You know what? I'm just going to call the cops." >> I got you. >> the cops. I told her, "You know what? Like I just want you guys out of here but you can't see my nephews, okay?" >> Mhm. >> So that's when I guess you guys showed up. >> Yeah. And um she had mentioned something about her kicking a door. >> Yeah, she kicked the whole door down. >> Do you mind if I go take a look at it? >> That's fine. >> Awesome. >> I but I don't want you guys to press charges against her. >> No, that's fine. That's fine. >> for her to get her kids and get out of here. >> Sure. Yeah, [snorts] that's fine, man. >> So if you guys see the door wet >> Well, I mean if I just see the door it's just going to be documented. So regardless of what happens tonight, okay, we have to document everything, okay? So at very at very minimum it's just going to be a more than it's going to be a a report and that's just per our policy, and that's not even just our policy, that's per DPS, which is the state. So, we have to we have to take a report for every single domestic. If it's verbal, if it's physical, it doesn't matter. We have to take a report. So, bare minimum, all this is going to be is I'm just going to document the fact that the that the door was was kicked down. >> Can you just take my statement and leave? >> I'm sorry, go ahead. >> Can you just take my like my >> Statement? >> Yeah. >> That's fine if you don't want to show me. >> Yeah, that's fine. >> Yeah, no, that yeah, that's that is that's that's perfectly fine. I was just asking cuz she has a few cuts and like stuff that nature. So, I just want to make sure that her her story >> She told you kicked the door, that's from her. That's from her kicking the door. >> I get it. I just want to make sure that that the story is consistent with her. That's all. >> That's it. >> Okay. Okay. So, you said you guys were in the um you guys were in the bedroom? >> We were in the bedroom, we came downstairs, came right here. She wanted to leave, and that's when you guys showed up. >> Okay. She She mentioned something about like her wallet and some cash or something of that nature? >> Yeah, her wallet is upstairs with her purse. >> Okay. >> Whatever she did with it, that's her. >> Okay. She said that maybe that She said maybe that you had it. >> I don't have it. >> And cash or something of that nature? >> I don't have my wallet, that's it. >> Okay. All right. So, you don't have any cash or anything like that that actually belongs to her? >> No, not to her. >> Okay. >> All I have is mine. I have like maybe like 50 bucks, that's it. >> 50 bucks? Okay. Okay. Um and then so, your neck, is that is that from your chain? >> it's from from my chain. >> That's from your chain. Okay. And that's And that's this chain right here? >> I don't know. I don't know, like maybe >> Okay. Okay. All right. Um And then your chest, what happened to your chest, bro? >> I don't know. I don't know. >> You don't know? >> I don't. >> Okay. >> If you guys could just tell her for for just to leave. >> to take the truck, take the kids. >> Okay. >> If the state wants to press charges later on, whatever. >> Okay. >> Call my mom, you know. >> Okay. >> But not right now. >> Okay. That's fine. Uh my partner's got your phone number and everything like that. >> Yeah. >> Okay. Right on, sir. If you want to go inside, you are more than you're more than happy to. I know she was telling me that she was planning on leaving anyway. >> Okay, that's fine. >> Um but, I will let her know your nephew I think they went with their aunt or something of that nature. Um and then, you said that her wallet is upstairs? >> I don't know her purse I don't know if her wallet is whatever. I don't know what she grabbed. I don't know what she grabbed. >> Okay. But, potentially her wallet might her wallet might be upstairs then. >> Yes, I don't know what she >> Okay. Okay, if you want to grab your chain man, you can and then I mean, if you want to go inside, you can, okay, brother? Thank you, sir. >> I keep the door and then I opened it so it was that's fine. Okay, yeah. >> So, ma'am, he's telling me that I guess that potentially your wallet might might be upstairs. >> [ __ ] I got my wallet because so when I came right now to put the kids in the truck, >> Mhm. >> I went around the door cuz he went that way all of a sudden. He went that way and he threw my wallet. I'm telling you he unplugged the cameras cuz we have cameras we have camera right here and we have camera on the side. So, right now I was looking back through the cameras so that we could see he threw my wallet and it was thrown over there. >> Okay. >> I grabbed it and he took all the money out because even the WIC card was where my money was at. >> Uh-huh. >> The WIC card was behind and like together. So, my WIC card was even thrown on the floor. >> Okay. >> Like you're that desperate, bro, you need the money. >> Right, right, right. >> But, like it's my son's money for his lawyer. >> Okay. PC, right? >> Yeah. >> Okay. Ma'am, can can can can can we do a favor? Um so, I want to ask you a few more questions. The only thing is I don't want the kids to hear and I know that they're kind of outside. Um do you mind if we just walk down over here with me, please? >> Ma'am, are you guys are you guys going to arrest him? >> I'm sorry. >> Cuz I have a five-month-old. >> I I at this point, I don't know. >> Well, I need to know so I can talk to somebody else. >> yet. That's That's That's exactly why I'm saying. I I have a two more questions. I just don't want the kids to to hear and things of that nature. >> It's not his truck. I have the papers to it. >> Well, that's fine. But, you guys are together, correct? Okay, have you ever allowed Have you ever allowed him to drive the vehicle? >> He drives it while I The condition with him not driving it was if he would get if he's not back within the white August spot. Well, the second he was not >> Okay. >> off in the truck while he was drinking. >> So, it's either you let >> And that >> let him drive drunk and him wreck somebody and I get sued for nothing that I don't have? >> Right. >> And hurt somebody else or >> And those conditions were just verbalized between you and him? >> Yeah. >> Okay. >> It's not the truck is not to be driven if he's drinking. I had already told him that I was going to call or when he started off before he started going and going and going >> Uh-huh. >> I told him cuz he was like, "Get the [ __ ] out of my house." Something like that. "Take your your truck since they're your trucks, take them." >> Okay. >> And I was like, "I'll leave tomorrow. Like, the kids are already asleep. I'll leave tomorrow." >> So, then that's exactly what I was going to ask you about. So, the little ones. >> They're the same. >> Did they hear Did they see anything like what >> was in the crib asleep. >> Okay. >> And then, um the 4-year-old was in his room asleep. And then, my 10-year-old was in his room asleep. So, everybody was asleep except my 15-year-old because >> Except for Josiah. >> Yeah, Josiah. >> Okay. >> Cuz he usually wakes He stays waiting um waiting up for us. >> Okay. >> So, he was already asleep. >> So, as far as the So, as far as the little ones are concerned, they didn't see anything, they didn't hear anything. They were >> I just went in there and woke him up. I was like, "Let's go." So, we came outside to wait for the app to come pick up the little ones. >> Okay. >> And that's when he followed us cuz I thought he Like I said, I thought he took my keys. >> Right. >> Which I'm telling you, if you go to my son's room, my purse is thrown in there because I obviously got my purse. So, my purse was in my room >> Uh-huh. >> under the There's a drawer like kind of It's not really hidden cuz he knows the drawers that are there. So, when he didn't find my purse in the closet, he went and he lifted up the mattress >> I got you. >> and he found the purse. So, he grabbed the purse and I thought he grabbed the keys to the truck. >> Okay. >> So, I was like, "You're not going to work. Give me the keys. Like, you're not taking off in the truck. >> Right. >> You're drunk, dude. You're not." >> Okay. >> And then, um that's when he was coming downstairs and I jumped on his back so he wouldn't leave. Like, I [ __ ] up. I shouldn't have jumped on his back, but I thought he had the keys. So, then when I went ran back upstairs to get my purse, it was the keys were in there. It was my wallet that he took. Cuz when my son was on the phone with dispatch, he took off. >> He took off. >> Yeah. We Well, we thought he took off. >> Right. >> So he was in the backyard going through my wallet >> Mhm. >> to get um the money. >> Okay. Do you need any Do you need any medical attention for your for your leg or anything like that? >> Are Are Are you sure? Cuz it's a it's a >> No, it's a it's a >> That's a pretty good little scratch. >> here. It's like um not wood. What is it called? That cheap [ __ ] >> Uh >> of look like wood, but it's not. >> I I >> You know what I mean? >> what you're talking about. I just I don't have it off the top of my head. >> [laughter] >> Um >> It's not real wood, but it's fake wood. >> to the P. But yeah. >> So it's just from where I kicked the door cuz I thought that's where I knew he was going for my looking for my purse. So I was like I had I had warned him. I was like, "Dude, open the door. I'm going to kick the door in." >> Yeah. >> And he So I kicked the door in. >> Okay. Okay. >> time they had already the my son had already gone cuz the baby's in our room. So my son had already got the baby out. >> Sure. Okay. Um one one last question, ma'am. When you jumped on him, it was just you jumping on him, nothing else happened >> No. I literally I showed Do I show you? I jumped on his back because he's big. So we were coming down the stairs. So I just jumped on his back. And then when I jumped on his back then we got down to the stairs, he like kind of threw me off like threw off like that. And then he came out cuz I thought he would have the keys. >> Mhm. >> So that's when he came out through the front door and I was like, "Fuck, he's going to take off in the truck." So we followed him and he turned around like right before this entrance. >> Uh-huh. >> So porch >> of the house? >> Yeah, like he like looked at me real quick and then went back in there and I was trying to close the door and I pushed the door me and my son were pushing the door cuz my son was kind of standing in the doorway. >> Okay. >> And I pushed the door open. >> Sure. >> And then he put his face like that. He's like, "Fucking hit me." And I was like, "Ooh, you're lucky I don't [ __ ] hit you, dude." I [ __ ] pushed the door harder. So then that's when he kind of like went back. >> Okay. >> And my son's like, "You're smashing me. I'm standing right here." >> Okay. >> [cough and clears throat] >> Okay, ma'am. Um well, based off of everything that we have today, all right, based off your statement, your son's statement, and also his statement, um unfortunately we are going to have to take him want you >> Him? >> You. For battery against a household member, okay? So, do me a favor and put your hands behind your back. >> Can I call somebody or can I not? >> let I will I will let you get that phone call right now, okay? >> I don't want him to have these. >> Okay. >> And that's what I told him to do. I explained to him cuz he was like, "Am I going to get my truck?" I said, "Listen, we don't deal with whose property, whose or what. That's a civil court issue if What? >> So, so we're So, we're So, we're actually going to go down to the station. Um so, I'll let you use the restroom there, okay, ma'am? >> I don't want him to take these. None of these. >> Okay. The only thing is What is this? Is this a vape or is this a >> No, they're keys. This key set. >> Okay. Okay. Let's go down this way, ma'am, okay? Level 66, 141 10-15. >> My My 10-year-old is in the >> Copy that. 10-21. >> That's fine. Um can you do a a quick search on him and then I'll uh >> He literally put this in your >> Yeah, you're good. >> Can I get >> Call 3366 and then call real quick. >> As soon as we get done with the search and everything, ma'am, then we will go ahead and >> I don't have nothing. I don't even have a bra on. >> Nothing that's going to >> I know. It sounds dumb, but I'm going to call. >> Yeah. >> And then I'll be released tomorrow, right? >> Um it's possible, yes, ma'am. >> Just so that way I could get somebody to come down here and get my stuff. >> Yes, ma'am. Yes, ma'am. All right, ma'am. So, just really quickly, okay? As you can see, there's nothing in the back of my unit. So, if we find anything back there, it's going to be belonging to you, correct? Okay. And have a seat for me, okay? And then like I said, we will let you make that phone call right now, okay? Let me just get you fastened in really quickly and then we will go from there, okay? >> You can't put these in the front. >> I can't put them in the front. I'm sorry. >> And that's how a late-night argument in New Mexico turned into a messy domestic call.
