tell you to begin you'll start from that position okay all right so when I tell you to begin you're going to take nine Heel To Toe steps down an imaginary straight line okay that's coming off of your left foot so imagine a straight line that's coming off your left foot and going on forever you're going to do nine Heel To Toe steps down that line counting out loud okay okay well and looking at your feet and keeping your hands at your sides okay sorry okay once you get to nine you're gonna do a series of small steps to turn around and you're gonna do nine Heel To Toe steps down back that line okay backward no you're gonna turn around and walk back or those nine Heel To Toe steps okay so I'll let you get back in starting position then I'll demonstrate for you okay okay no no I'll tell you off the ground almost imagine like a soda can underneath your foot legs straight parallel to the ground with your hands at your sides you're gonna count out loud one thousand one one thousand two one thousand three one thousand four until I tell you to stop okay okay and like I said you can pick up either foot you like if you'd like to take your shoes off you're more than welcome to for this test if you want to keep them on I know it's freezing cold that's fine I just want to give you that option okay uh what would you rather would you rather keep them on okay all right so don't do it yet let test is just a preliminary best test okay so it's just uh it doesn't replace the evidential value of the BAC machine back to the station it does not uh satisfy imply consent which is what you sign for when you get your driver's license okay so this is the last test and there's also a voluntary test as well are you willing to provide one tonight what's the consequence what do you mean does the concert like what happens if I fail pass so there's not a pass fail okay but it gives what it gives me is it gives me more information so that I can make a sound better and sound more Sound Decision of what I'm going to do tonight okay so this just helps add more to where I know what to do and make a better decision that's all so like I said is this a measurement look like I want to know what the measurement looks like what are you judging that you put on what do you mean like what am I judging it on so yeah yeah so the the state law says that you're 0.08 or more can constitute a DUI right so it's going to have that number basically on here of whatever you're at and I will tell you that number okay but it's up to you it's a voluntary test so no if what happens if I say no then I have to make a decision based off everything that I have so far that's it and if I consent to this then you make it judgment based on what that says not just what this says no it's just a part of it right well what else is your judgment based on well the voluntary field sobriety test we just did and then everything else that's happened tonight as well in my conversations with you so why would I consent
