understand like I said I have to I have to physically see it though requested that she have the police to accompany her so that she could remove personal items a woman followed her attorney's instructions exactly she called police waited outside and made no contact she was still arrested what law did she violate and more importantly who bears actual legal responsibility for this outcome standby she's supposed to park further away and wait for us to show up yeah um am I supposed to get a notification so we would show up and we would knock on the door and if you're not here we would tell look at they're not here I just rush for I got you no I I understand so she wouldn't cause she's not allowed to contact you we haven't been able to'cause we're stuck we're we're just busy that's why we hadn't come out to this court but the attorneys do all the all the conversating and then that's how we did her attorneys wanted to told her to come here and just not go inside to just stay outside and stop so the locks have been changed so I don't understand how she's she's she's broken in show it to him show it to him and then we'll do the rest yeah so there's a lot of little idiosyncrasies on this stuff look for yours I'm gonna see if she's got hers yet so for your counter one yes was he ever served with anything yes that okay was he served with you guys have a court date or served with this is a temporary um to be honest I'm not too sure who supposedly served him uh when I so when you filed for your counter he was served he was served when um by who that the next day on the it was the next day you know by who uh no but I think it was the the service with the uh me LA casa okay they sent someone to serve him okay so I need to see your copy so I can see what your stipulations say um and when did you uh move out of here um I guess it must have been on the 5th of 5th or 6th of December okay what stuff do you still have here um I clothes purses some clothes shoes all kinds of stuff and he just trade them officer she's already been picked up one she's been in prison already to jail already so I I completely understand like I said I have to I have to physically don't I don't know about but cause there's other small things that come with uh residency wise that affect what I can and cannot do what she can and cannot do and so forth so this is the latest restraining order awesome thank you nothing has changed since then um I I would like to press charges and if if you guys can book her again she's not supposed to be here or near me let alone let alone be inside my house this is the same reason why she was booked the last time for failure to abide by it while you're looking I'm gonna see if she got anything as well did you find paperwork I found this one but it's like the stipulated it's a stipulated for the for me to come here and drop her off and stuff and I didn't go inside the property line or anything he's got cameras so we can always look anyhow so it doesn't this does not say you can come here for exchange this says you get through get her from the release of school Friday uh on Mondays where is the respondent shall drop the child off at school on time and then so it does not say you come here to exchange okay it says that it it does change like I think your guys custody aspect but not where you can go do the exchange even back here okay uh you shall pick the so the respondent you shall pick the child up from school not here and you don't drop him off here I think he picks him up picks her up from school as well so the courts I believe so so you're in public anything visible from public is allowed yes if this is public am I okay then no because yours specifically says that you cannot come within 100 yards of here if this is 100 yards 100 yards is a football field your lawyer you need to talk to them they need to be aware and he might have told you and you misheard cause you can call for this standby like when an officer has probable cause that a Protection order was violated arrest is mandatory the statute uses the word shall not may not at officer's discretion shall so that word was chosen by the Legislature to remove all field judgment the Protection order included a specific geographic restriction the restrained party could not come within 100 yards of the protected address she parked directly in front of the property the violation required no legal interpretation it required only observation and a basic understanding of distance the foundational rule this case illustrates is widely misunderstood an attorney's advice does not modify a court order a dispatcher's instructions do not modify a court order only the issuing court can alter its own terms any third party guidance that conflicts with the written text of a judicial order is legally void from the moment it is given a person personally served with a court order is presumed by law to know its contents this is not a harsh standard it is the minimum condition for court orders to function at all claiming ignorance of specific terms in a document placed in your hands in open court is not a recognized legal defense in New Mexico or in any other jurisdiction the attorney acknowledged on camera that you said you his client probably did not understand the distance restriction under Model Rules of Professional Conduct Rule 1 dot 4 an attorney must keep a client reasonably informed and explain matters sufficiently for the client to make informed decisions when incomplete advice leads directly and demonstrably to a client's arrest that standard demands serious examination three practical legal rules apply here first before taking any action near a protected address read the exact terms of the order you are subject to not a summary from council second verify all external guidance against the written document third if any provision is unclear seek judicial clarification before acting the record of this case exists because none of those steps were taken the officer was correct on the law and the arrest was properly executed that is settled the open question is this how many people have been arrested in similar circumstances not because of bad intent but because the professional they paid to protect them legally failed to read the document that governed their freedom that question has no easy answer and applies to far more cases than this one
