It all began around 4:00 in the afternoon when police officers Louisie Franchie and Isaiah Housenap responded to a call about an unoccupied Jeep with the engine on and went to the front porch of that house. While one officer stayed at the front door and kept knocking, the other walked over to the driveway. >> Hey, what's up, man? >> What's up? >> Well, hang out right here for a second. Are you the only one inside? >> Hey, listen. I don't answer questions, and I'm going to need y'all to get the my property. >> No, sir. And then we heard some yelling when we were knocking on the door. Is everything okay? >> Yes, everything is okay. With no warrant and no reasonable articulable suspicion that a crime has been committed and family yelling is not a crime, legal experts say the police should have left as requested. Hey, Christina. Did you see an argument? >> I mean, we were all having conversations like not not anything even remotely worthy. [Music] >> McDonald's compound driving. >> So So what's happening with my officers today? Like why why are we all rolling around on the ground? >> No, I'm asking you. I know. I I I don't know. I I don't know why I'm in cuffs. Like Like I came around the back, right? Because my daughter came and she was like, "Hey, there's a cops outside." >> You see my car right there at the right side. >> Whenever I pull up, you're rolling on the ground with my >> At this point, the police body camera stopped recording. That's right. Just as the police supervisor was asking Terry why he was rolling on the ground with the cops when it was the cops who had thrown Terry to the ground, the police body camera was turned off. Legal experts say the police clearly violated the constitutional rights of Terry and his family against unlawful search and seizure without a warrant and without reasonable articulable suspicion of a crime. The very moment family members told police to leave, the police were obligated to depart. Furthermore, the courts have long held that yards and a driveway constitute private property with the same protections against unlawful searches as somebody's physical home. Terry and his brother were taken to jail, charged with resisting arrest, and then released. Terry himself was the first to obtain the police body camera footage and posted it on his YouTube page, the Terry stop. It's not clear if the charges remain, although legal experts say the charges will almost certainly get dropped if they have not been already. City leaders in Springfield, Missouri call the unlawful police actions and arrests embarrassing. The police department is not talking about the incident in part because of the potential litigation. Hopefully, Terry and his family will move forward with the lawsuit and would serve as another reminder that police are obligated to uphold and defend the Constitution, not trample on it because a cop gets hurt feelings. By the way, in Indiana, a police officer has been removed from the force after assaulting a peaceful teenager during a traffic stop in South Whitley, Indiana, near Fort Wayne. That cop just threw that teenage girl to the ground. >> How old are you? >> 18. >> Good job. You're going to jail. >> The officer said she had been speeding and took too long to produce her ID. Can you please grab my phone and my license for me? >> You're now going to jail. Do you understand? You don't get to sit there and tell me how I'm going to do my job. Do you understand? >> Moments later, the girl's father arrived. >> Uh, want to give me her ID? Want to give me a registration? So, she was assisted out of the vehicle. >> Assisted. >> About 5 minutes out, maybe four. >> Well, the cop has now been assisted off the police force. Check out that video at the link below. It generated a lot of comments on YouTube. One of the most popular is from Edward Atrobus who wrote, "Firing him was totally insufficient. He assaulted her. He should be in prison." I hear you. I look forward to reading your comments about the police in Missouri who harassed a peaceful woman and then arrested her boyfriend and his best friend when they showed up. I'm David Schuster.
