Officers notice a vehicle making sporadic lane changes. So, they get behind it, initiate lights and sirens, and then pull it over. And before long, things somehow go from bad to worse. >> How are you two doing today? >> We're doing okay. >> My name is Officer Beal, I work with Borden. Reason for the traffic stop, couple reasons. Number one, when you had the red light, you pulled pretty much all the way into the intersection and you backed up. Then you turned left from not the turning lane, so when I saw that when I saw you do that, I was like, "Is this person impaired or what?" >> I'm not impaired. >> I can tell talking to you. Yeah, I can tell talking to you you're not drunk or anything like that. >> Tim, where's his insurance? >> I don't >> This is his company car. >> Okay. Where are you guys heading this evening? >> We were just going home, but we came out to see a movie. >> Mhm. What movie you guys see? >> We seen Insidious 2. >> How was it? >> It was good. >> It was good. >> Yeah. >> I'm sorry, sir. This is not my company. >> No problem. Miss, do you have your driver's license on you? >> No, I don't. >> Okay. >> But he has a license. >> Do you have a license? >> No. >> Okay. What's your name, miss? >> Kylie, K Y L E E. >> What's your birthday? What state is your driver's license or your ID? What what state's your ID through? >> Yeah. >> Yeah. What's your middle name? So, what's going on with your license? >> So, I got a speeding ticket when I was 19 years old. Okay, I didn't stop driving because I've constantly always had to get myself to work. >> Right. >> Every single time I'm on my way, I get stopped and I constantly I'm I'm >> Okay. >> I just last month I paid $400 in fines. I don't have any warrants or anything like that. >> Okay. Sir, do you have your ID on you? To make sure that you're valid, that way we we we might be able to switch seats. >> That's in his wallet. >> Okay. >> He's going to take it out of his wallet and I'll give it The uh The reason why I'm driving is because we're just out in the Timb had a cute birthday. >> Okay. >> I'm going to step out for a second. >> Uh no, you can just stay there. I'll just look you up by your name. >> So, I'm going to start >> What's your first name, sir? >> I'm going to start off by telling you um T. Harris a warrant out for his arrest. >> Okay. What What's the warrant for? >> But um I sent a >> Are you able to close that door, boss? >> I sent a message out to um the police officer of Newcastle three times. >> I've been trying to get a hold >> W- W- What's the war- Hold on. Hold on. Hold on. Hold on. Yeah, no. I I I have a quick question. What's the warrant for? Because if it's if it's >> know specifically. That's why I'm explaining. >> Okay. >> So, specifically >> Well, well, a >> at a party together. >> Okay. If it's if it's Hold on. Would you hear me out real quick? If it's for some bull- little traffic charge or misdemeanor things like that, they might not even want him. >> It's misdemeanors. >> Okay. >> Um so, what it's What happened was uh you can read this here. >> So, Timothy, what's your last name? >> So, are you going to listen to me or >> Yeah, I'm going to listen to you. Just I I mean, I obviously got to get the name and everything like that. >> but you weren't trying >> 2051 by name and date of birth. >> So, are you listening in? >> Hold on one second. >> Sir. >> Sir. >> First name Timothy, 1988, code 6. I'll take a second. Break for a second. Name and date of birth. >> What happened was we were >> Give me one moment, ma'am. Okay? >> Okay. Yeah, whenever >> Hey. Hey. Hey. Hey. Hey. Relax. Relax. I'm being calm and cool and everything with you, but I I do have to But I I I do have to >> not listening to me, sir. All due respect, >> 2050. The second one's going to be Lincoln Edward Edward. Last name 2000. And both these are out of Pennsylvania. >> So, like I was saying, we were at a party. I got drunk. >> Okay. >> And I got in a fight with the girl. >> Mhm. >> I was so mad at my boyfriend for being with his >> Mhm. >> ex I actually told the police officer that it was him that I had a like that I had gotten into a physical altercation with >> Okay. >> But I tried I've been trying to contact Officer Biggs and I told him like the whole story that I made a false police report >> Mhm. >> to begin with. >> You know how it usually goes though. Once that warrant's out, you got to do that in court. >> know how it usually goes at all. >> I was trying to explain. So, so usually how that goes is was once they put out that warrant, even if you say after the fact, "Hey, I made that all up." you usually got to go through court and tell the court that, "Okay, this was a false report, false allegation." and they usually drop the charges. So, he's probably not going to be able to do anything. I can't necessarily speak for Pennsylvania. Sometimes it's a little different over there, but at least in Ohio, you would have to go talk to the prosecutor at that point. Once the warrant's put out for his arrest. >> on right now? >> So, I'm waiting here back from dispatch to see if those warrants are all good. I'm waiting to see if you have any warrants and I'm waiting to see whose license is valid. Okay? >> There's no license There's no valid license except for his. I already told you that. >> Mhm. Okay. And so that just just just settle down. It's not the end of the world. Okay. What do you do for uh a US, Mr. Brooks? >> So, what we do is uh basically we try to stop the water from what happened in Flint, Michigan from happening >> Okay. >> Mhm. in the tunnels and we try to find lead couple pipes. >> Okay. >> And we report them to the city and we patch them up, and we uh um >> Sounds like a pretty good job. >> Yeah, it's cool. >> You can have that proof of insurance back. >> Thank you. >> There's another cop showing up. Why? >> Because we usually have two cops on all traffic stops. Obviously not initially cuz I'm only one person, but also he's got a warrant. So, if the warrant ends up being good, then we'll obviously have to take him into custody. >> Of course, we know. >> Mhm. Okay, I don't know >> Sir, what else? >> Okay, I don't know why you why you're having such an attitude right now. >> because I already told you what the truth was and that the warrant is invalid and you're still talking about taking my man. >> Okay. >> I can not >> because if we have a warrant that's confirmed through leads, >> Mhm. >> Don't close that window. >> I'm allowed to roll my window down. >> do me a favor, step out. Step out. Yes. >> not stepping out of the car. No. >> Let me Ma'am, let me explain this to you. >> Let me explain to >> No, no, no, let me explain to This isn't your show, this is my show. I'm trying to be calm and respectful and explain everything. I'm trying to explain everything to you. >> Please. >> If a policeman tells you to step out of the car, you do have to step out of the car. >> Why? >> No. It's the US Supreme Court cases Maryland versus Wilson and Pennsylvania versus Mimms. That's the United States Supreme Court case gives us the right and the authority to order you out of the car. So, if you don't step out of this car, which you are going to, what we're going to have to do is we're going to have to pull you out of the car. >> How would you >> And then at that point, you'll be under arrest. >> Kylie, Kylie, I don't want to arrest you. But, with things are going right now, that is what is going to happen. So, do me a favor, turn the car off and step out. >> If I'm not going to be arrested, >> Kylie, Kylie, >> You're not under arrest right now. If you step out of the car, >> Don't step out of the car, you will be under arrest. >> Do you not understand that they're arresting you? >> Yeah. >> Give me a kiss. >> Oh, will you relax? >> I'm relaxed. But, you're getting arrested. >> Okay, calm down. >> That's the only reason why I'm upset because he doesn't have any reason to be up to be arrested. >> Good. >> He never He never hit me and it was the girl and I lied. >> First one, Timothy is valid through Newcastle. Showing not valid through Ohio or for code nine. >> Go ahead with it. >> But you have to understand I lied. >> I I I do understand that. >> 23 for extradition out of Pennsylvania. >> Timothy, do you have any weapons on you? >> No, sir. >> Holster? >> No, sir. >> [laughter] >> Holster? >> No, sir. >> Good. All right, Timothy, do me a favor. Come on. >> Kylie Venus >> All right. >> is suspended through here. >> Keep your hands like this, Kylie, [laughter] all right? Hey, Kylie, it's going to be all right. >> No, it's not. >> [laughter] >> He's He's been cool. Yeah, just You leave your phone there. I'll get it for you. Here, I'll get it. You want it, right? Come on, Kylie. Don't give me a hard time, all right? >> I won't. >> Turn around. Turn around. >> I won't. >> Turn around. You know what? Put your hands behind your back. Stay right there for now. >> [laughter] >> All right, Kylie. Do me a favor, hop out as well. Cuz I got to write you a ticket for the driving under suspension. Okay. You don't have any I'm not going to like search you or anything like that. I'm just going to pat down your pockets. Hey, hey, and I'm just going to Kylie, just And we can because Let me explain this to you. So Hey. Kylie, Kylie, Kylie, will you hear me out? Okay. Hey, you don't even know what I'm trying to say. If somebody's If we have a warrant a valid warrant for somebody's arrest then we have to take them into custody. If we don't take them in the car Okay, I'm going to pat you down for weapons based on your attitude right now. Okay. Turn around. Face face away from me. How much you had to drink tonight? Nothing. Okay. Is there any weed in that car? Okay, why does it smell like weed then? Beats me. to have a seat in the back of my car Stop it. You're going to stop it. Stop it. You're going to have a seat in the back of my car while I write you a ticket. I'll take him but just put him in your car for now. >> [laughter] >> Have a seat. >> Why is she so upset? >> Cuz she said she lied. >> What she lied about? >> About him beating her up. Yes, ma'am. >> I need to know where to tell my dad to come to. >> Um tell him to come to uh the Dunkin Donuts over at South Avenue in uh How are you doing, sir? >> Okay, >> Th- th- th- th- this is uh Officer Bill with Boardman Police. Uh if you could come to South Avenue the Dunkin Donuts right near South Avenue 224 in Boardman. >> On the left-hand side? >> Yes, if you're coming if you're if if you're coming um >> Across from Red Lobster? >> Yeah, across right across street from Red Lobster. You'll be able to pick your daughter up. >> There's one more thing I need to get out of the Kia, please. >> Okay. >> We'll we'll let you do that before you before you get out of here. It's not going to happen right now. Okay. No, I was talking to your daughter. She said she wanted to get something out of the car. >> Okay. Okay. >> Okay. Okay. >> So, no, wait, before you leave, sir, can you tell me what you're doing with my boyfriend? >> He's going to go to Montgomery County Jail, and then and then he'll have either a hearing or he can waive his extradition hearing and go to Pennsylvania. >> When? >> So, he's going to go there tonight, and then then he would either have his extradition hearing on Monday, or if he signed the waiver of extradition, where he didn't want to fight extradition, then he could go straight to Pennsylvania. Once he goes to Pennsylvania, I'm sure they'll allow him bond out. But, uh give me your wallet real quick. I got to check your pockets. I I patted him down, but now I'm going to search him. >> did. >> Hold on. I patted him down, now don't reach No, no, no, no, don't don't reach. >> Don't take his wallet. >> I'm not going to take his wallet. >> You're taking it. >> Hey. >> You're taking it. >> I'm setting it right here. You kicked me in my arm. >> getting into the car, sir. Come on. Get off of me. >> Stay. >> Get off of me. >> All right, we got your phone. Uh Do you know if she wanted her car? >> No, sir. >> Appreciate your cooperation. She's now in more trouble than she had to be. She should have just been quiet, cooperated. She kicked an officer. Now, she's looking at assault on a police officer felony charge. Car's getting towed, the whole nine yards. We had a ride coming for her, and she just won't cooperate. >> getting towed? >> Is that your vehicle? >> Yes, sir. >> Is that a company car? >> Yes, sir. >> You You allowed to have it here at a high? >> Yes, sir. >> Okay. >> The woman initially faced three charges, including fourth-degree felony assault, fifth-degree felony obstructing official business, and misdemeanor resisting arrest. However, the case was ultimately resolved through a negotiated plea agreement, where prosecutors agreed to dismiss the felony assault charge, while she pled guilty to obstructing official business and resisting arrest. Considering the felony assault charge was a more serious crime than obstructing or resisting, this was in her best interest. And as a result, the court found her guilty on both obstruction and resisting. Despite the felony conviction, the judge chose not to impose any jail or prison time, [music] finding that a non-prison sanction was sufficient. So, instead, she was sentenced to 2 years of community control. If you're not familiar with what community control is, it's essentially Ohio's version of probation. And given the 2-year community control sentence, the court imposed no fines or court costs. As always, let me know your honest thoughts on this case down below in the comments section. Stay safe out there, and I'll see you in the next video. >> You're taking it. >> Hey. >> You're taking it. >> I'm setting it right here. Stop. >> you screaming at me for? >> Stop. You're going to you're you're you're going to be detained in handcuffs. Stop. >> No. >> Because yes. >> Okay. Why? Because you're screaming at me? You have no reason to arrest me. So, this >> Stop. >> Easy. Please come and pick me up ASAP.
