An off-duty cop is taking a night-time jog when he comes across a car driving in the middle of the road. A few words are exchanged and the driver ends up pointing a gun at the off-duty cop. Within minutes, multiple units swarm the area and confront both parties to find the reasoning behind the assault. >> What's up, man? Come on down here. Got a complaint about you. Jeffrey, did you have a dispute with a jogger? >> He pulled over right here and pointed this little gun. >> Oh, well, I told him that it was a Let me pat you down for weapons. You got any weapons on you? >> No, sir. >> All right. Just grab your ID for me. >> gun. >> That's all right. Let me see your ID real quick. You got a toy gun in the car? >> Yes, sir. >> What's it look like? >> It's a >> It's like a revolver? >> It's like >> Color is it? >> Silver. >> Silver BB gun in the truck. He's saying he's got a silver BB gun in the truck. All right. Hang right here for me. Real quick, give me your side, kind of what happened with it. >> Yeah, absolutely, brother. So, usually I So, I was running, you know, this way. And tonight, I went, you know, just to cross it, you know, just to change the route. >> Okay. You have your light in your hand, just running down the road, okay. >> Yep, yep. And I started, you know, running I just like this. >> You were just kind of like like running kind of on the white line right there, the shoulder, okay. >> And if I hear a car, you know, coming like with the with the same, you know, direction line, I step off into the grass. If there's a car, you know, going opposite of me, I just see I just stay, you know, where I'm at. >> Yeah. White truck and that's a truck. It was lifted, had wheels on it? >> Yes. >> Okay. He did confirm it is going to be that white vehicle. It is going to be lifted. >> So, he was sitting in the driver seat. >> Okay. >> And and I mean, he had this like actually, you know, gun. >> A gun, okay. >> Yeah. Like I said, I mean, it looked like a magnum. >> Okay. >> Uh or maybe like some you know, long barrel, you know, revolver. >> Okay. >> And it was and it was like right here. >> Okay. >> Pointed right in my direction because he's like, "What did you say?" >> You might have crashed into your car, man. >> No, I mean, I I mean, you can show me, that's fine. I mean, whatever. >> So, I mean, he backed up. He passed me. The gun was just like I mean I mean it was like right here. >> Uh-huh. >> The barrel was you know like leaning like >> Do you have any charges right now? >> And I was standing like right there. >> Okay. >> And I was like, "Man, you need to put that gun away." He said, "What did you say?" I was like, "All I told you, man, is that my 146." And I was like and I mean it was just literally I mean like >> Why did he make contact with you? >> And he said, "What did you say?" I was like, "All I told you, man, is you're driving like in the middle of the road. I I didn't know whether you were coming my way or what." >> Okay. >> Did he threaten you or anything? >> Um >> No. No. >> He didn't threaten you? >> No. I mean I mean the gun was literally just in my hand. >> Okay. >> You know, right in my direction. >> Okay. >> Okay. So, he pointed it at you what you're saying. How did that make you feel? I mean, did you feel like he was >> I mean, I thought I was going to get shot, man, for no reason. >> Okay. Absolutely. Okay. Silver BB gun with a long barrel. Hey, you mind if I grab that and take a look at it? Where is it at in here? >> Uh I think back seat >> Seat on your side. I got it. >> So, what's going on? What happened? >> Well, I didn't know whenever he kept passing me, he hollered something and I didn't know what was going on or if he needed help or whatever. So, I backed up He was He was saying that he was in the middle of the road or something like that. like that. I said, "I don't know if he was a maniac or what." I said, "That's that's crazy, man." hollering at somebody, you know It's if if somebody is a maniac, you know, that that's >> This is somebody that was on foot? >> Yeah, they were Yeah. >> Okay. >> Did he ever present a weapon at you? >> No, neither Yeah. >> No. Did he ever make you feel like you were in safety of your life? Your were your life was in jeopardy? >> no idea like what was going on like who this dude was or what was going on to be honest. I mean, you know, he was laying down. So, it was like I backed up to see if he needed help. At the same time, you don't never know what's going on as far as you know uh who it was or you know, if something there was going to present a problem or anything like that. >> Would you kill me? >> Absolutely. >> You would? Come on. You're supposed to be nice to me. >> It's a real >> It's a real gun to me. Fully functioning. >> You didn't see any weapons on him? >> I didn't. >> He never presented any weapons at you? And he was on foot? >> Right. >> So, did you think he was going to try to hurt you while you were uh safely inside your vehicle and he was on the road with no weapons? >> I'm never even I've never presented that to him. I had that was just it was in my hand on the steering wheel. >> It was in your hand. Do you typically drive with it in your hand on the steering wheel? >> No, but I mean at the same time I was backing up, you know, I didn't know if if it was going to be a problem so it was going to be scary or anything like that, you know. >> Okay. Just to let you know, um they got it right now. >> So, like I said, man, and all I did was like this. I was like, "Hey, man, you're driving in the middle of the road." >> Yeah. >> So, car goes in reverse. He reversed back to me. The gun like I said, I mean, the gun is resting like right here, but the barrel was pointed straight at me. I kind of I mean, stepped off to the side for a second and uh he's like, "What did you say?" I was like, "Man, I was like, you're you're driving in the middle of the road." I was like, "I didn't know whether you were coming at me or what." >> Okay. >> And he goes, "Who are you?" I was like, "Dude, look, you need to put that gun away. I'm a cop." >> Okay. >> And uh he goes, you know, "Who are you?" I was like, "Man, I'm just out here trying to run." And I was like, "I don't know what you were doing." And that's all I said. And then he puts this like bright light in my face. I couldn't see it. I was like, "Hey, man, can you get the light out of my face and put that gun away?" >> When you pointed at him, what did he say? >> Uh he said that uh Uh I didn't point it at first of >> We >> get out. of the >> Okay. And he's seen it. He just seen it cuz I never pointed it at him. I never He just seen it. >> I mean he did. >> He just seen I was just I didn't I don't know why he cuz I told him that's dangerous, you know. But if I would have been a maniac, you know, that could have been really good, you know, with >> What what was he wanting? >> That's what I backed up for. I wasn't sure. >> Yeah, so what did he say when you backed up? >> Uh Really I had forgot about it whenever I just drove off and he told me and yeah, I thought everything was good cuz there's cars behind us. He said, you know, everything was good as far as you know, if there was a maniac in there. >> So he flagged you down. >> Right. >> And then you backed up and you don't remember what he wanted? >> He just said he was a jogger and he said that that I said, "What did you holler?" Cuz he said that's why he flashed his light. And I said, "What what did you holler?" And he said something about being in the Red Bull race. >> We get out with him quite a bit and I'm familiar with this truck. It's a nice Black Widow. There's not many. So as soon as we heard it going out, we figured it was going to be this guy cuz we always run into him. He drives around all the time on Doster and he always just drives around in that area for some reason. So when I when I heard it was a big white truck here, it might be this guy. No, I don't Not to my knowledge. He just Well, I just kind of just drives around. He just has a lot of stuff to do and he drives around. So >> It's really just up to what the guy wants to do now because his story is the same up until right there. He claims to have had that gun out, but he didn't point it. But where he said he had it and where the other guy saw it, same location. >> The fact that he presented it to the fact that somebody knew that you had a gun in the vehicle. I mean, that's intimidation. There's only one reason you do that. That's to intimidate people. So, the brandishing intimidation is there. >> Um but we don't have >> But it just changes it. Either it's going to be agg or it's going to be simple. >> He is very stern on the fact that he he pointed that gun at him and that he was in fear. But I told Rhodes to get um he needs to make sure see what the guy wants cuz we need to know what he wants to do and we'll go with that. >> thing is just obviously you were scared cuz you called. You were adamant cuz you called. You didn't just go home and forget about it. So, people want our help and they should pursue charges. Called the [ __ ] in and you want all this stuff done and we got all these resources out here. >> Cuz we stop this guy and he points that [ __ ] gun at us and he gets shot. Feel that. That's [ __ ] mental and heavy. You know what this guy says? I I [ __ ] up and I said, "Hey man, did you kill him or did you [ __ ] kill >> Would you be willing to press charges, fill out a witness statement form, things like that before we can go farther? >> Yeah, I'm leaning on pressing charges 100% now. >> Completely up to you. Whatever you feel is right. If you do, we have him. Um he will go tonight, but like I said um it's just up to you. Obviously if there's no victim, there's no crime. So, you know you know, so um >> want to let me get him, man. That's just what I want. Things, man, like I mean like what was his deal, man? >> Absolutely, yeah. Absolutely. >> You got road rage? You got problems, man? Come on, man. Like I just like and I was hoping that it would kind of like change his mood a little bit. Like, "Hey, that's a dude. Hey, man, just want to put the gun away, man. I'm a cop." Nothing. Didn't Didn't Didn't even phase him. >> Mhm. >> So, um >> I just don't want to have any issues at my house later, man. >> And he doesn't He He won't He He won't know, obviously, where your residence is or whatever like that. If If that's an issue, um he won't He won't know that, so. >> That's my biggest thing, man. It I mean, it ain't about me, man. I got two little kids at >> I understand. >> That's my biggest thing, man. And it's like, you know, I work night shift. >> Yeah. >> You know, so they're not here. >> Yeah, I mean, you got to look at the good and the bad. I mean, obviously, you know, maybe if I mean, not persuading you at all, saying that you should press charges, that you shouldn't, but you have to look at both sides, you know, one day he's going to get out, but if we let him go today, that, you know, obviously, he could be a little bit more. So, it I Like I said, I'm not persuading you in any way, but just kind of both ways that that could go with he could come back over here tonight, or you know, he could stay in jail and kind of figure everything out. So, um once again, though, I'm not persuading you at all. Um I just kind of need to know because we do have this guy, and um I kind of need to go if you want to go farther with it, and if you do, um I'll just have some basic info for you to fill out, and then um he'll take that ride. >> Can you give me like 2 minutes? >> Yeah, I'll give you about a minute or so. Let me I'm going to call my sergeant. Um so, he was able to confirm that that was him. He said that he had a blue shirt on. I don't know if he's thinking of like repercussions of what this guy might do if he does press charges or not, but he He said he asked if I could give him about a minute, and I don't know if he's on the phone with his wife right now or what, but um I'm going to figure that out, and if so, we'll um we'll go from there on that, but I was just keeping you updated. >> Man, I believe I'm going to go the route. >> Okay. >> I'm going to press charges. >> Absolutely. Nope. >> Cuz I just I mean, what's I mean, is I mean, are you able to tell me, you know, what he's saying, what's his deal? >> Without giving you too much, we do have history with the guy. Um I'll tell you that. Um I And once again, not persuading you in any way, not telling you anything, but it's not right. I know I would be very upset if I was on a run very close to my house and someone happened to point a gun at me for no reason. So, um once again, like I said, I'm not doing that at all. I'm just saying kind of a man-to-man talk. >> No, man. Just like I mean I'm the biggest man I like I literally like I mean I've been in foot chases, man. I've been in I've been doing this thing for 14 years, man. >> Mhm. >> And like I like I never felt like like so closer to death, man. Like if there was such a feeling. Like like like I'm literally not I'm just crumbling, man. Like >> Okay. >> I'll fill out a statement, dude. >> Okay. So, you do just to confirm you do Okay. Absolutely. Okay. Let me make a quick call. >> man. >> Um it Absolutely. Let me make a call real quick. Um I'll get everything figured out. Take him. >> Yep. >> Take. Um what's he want to do? What's he charging? >> Assault. >> All right. Hey sir, just put your hands behind your back for me. You're under arrest, buddy. >> For what? >> For aggravated assault. >> No way. >> Yeah, you are, pal. There's another deputy that's interviewing the other people, okay? He just called. So, he's making the case. >> Sir, how in the world I'm >> I didn't meet with the complainant on this, okay? I came and talked to you, so I don't have any information. I'm giving you all the information I have. >> Did he Did he Did he come up to you before you did this? I mean, really? >> They just spoke to him by the phone. >> Well, I mean, how was I supposed to know? >> Damn. >> Sir, damn. >> Damn. >> Cuz we're officers. That's That's what we do. That's how we work. >> Well, what are you saying? How would I >> Hey Billy. What's going on? You wanted to speak to me? >> Yes. >> Okay. Um I'm not going to ask you any questions or anything cuz um I have what I need. I'm not going to read you Miranda, ask you any questions, but you're obviously under arrest for aggravated assault, okay? So, once again, I'm not going to ask you anything incriminating or anything like that so cuz you're already under arrest. So, I'm not going to read you Miranda. I have what I need. I'm just letting you know cuz you wanted to speak to me. You're under arrest for aggravated assault, okay? >> [clears throat] >> Is there anybody I can talk to because how does a good Samaritan that turn into an aggravated assault? >> I don't I have my investigation completed and once again, I'm not going to ask you any questions about what happened because you're already under arrest. So, I'm not going to read you anything. I'm not going to ask you anything, but I was going to tell you that and I don't know, maybe an investigator will speak to you or something along those lines, but at least for tonight, you'll be you're arrested for aggravated assault, okay? >> I I just I mean, I understand what you're saying, but I just don't understand how that can turn into something so horrible. >> Okay. And you can take that up. I mean, obviously that's what court's for and you can that that's the whole situation for court. So, we can you can figure that out at a later date or maybe talk to an investigator or something and right there over there. >> I see. Here's the thing that you guys I know are doing your job and you think you should I mean, everything's but my mom just passed away 5 weeks ago and they gave my dad a 6 months to live. I mean, they gave my dad 6 months to live a year ago. So, I mean, he's this isn't I don't even know I don't even know who to call and I haven't done anything wrong. >> Okay. Okay. Well, like I said, I'm not going to ask you anything about it cuz I'm not going to read you Miranda. So, once again, it's what it is tonight and um >> Well, why is it why is it that what is it What are you saying as far as you keep repeating yourself? What does that mean? >> So you're already under arrest, right? You're sitting in a jail cell at the jail, which means you're under arrest. For me to ask you anything, I would have to read you your Miranda warning for that, which I'm not going to do because I already have completed my investigation as far as I go, okay? So I'm not going to go into any more detail than that, but for me to physically ask you any questions, I would have to read you your Miranda warning because you are already under arrest to ask you any questions about the incident that happened, which I'm not going to do. >> And will you tell me why >> Because I like I said, I've already completed my investigation and I have what I need from the deputies that were on scene that spoke to you. I have everything that I need, okay? >> I'm I'm I'm I'm I'm still confused. >> Oh, that's that's really all I can give you. I can't go in any more detail other than that. I mean, it's pretty cut and dry as it is. Um I told you what what what you're arrested for. I told you I'm not going to ask you any other questions because I have everything that I need, so. Um like I said, you can possibly uh talk to an investigator or um I mean, you'll obviously have to go to court and this will be turned over to them and it'll go to there, okay? >> [sighs] >> I'm I'm just I'm just dumbfounded and I don't know what to tell my dad. This is really hard. >> Okay. And And I'm sorry to hear that. I am. But um they'll they'll book you in and um you'll be able to make a phone call and stuff like that, okay? Okay. That's All right. Well, I'm going to get out of here, okay?
