Officers arrive at Walmart after two individuals on the sales floor get the attention of loss prevention. On the surveillance cameras, one of them is seen to be putting on multiple pairs of socks and then trying on unpurchased Walmart shoes. Next, he puts his own used shoes back in the Walmart box and actively conceals multiple other items on his person. So, the moment one of the pair heads towards the garden exit, a police officer is already waiting to greet him. >> He's a white shorts? >> How's it going, sir? >> What's going on? WHY YOU USING SO MUCH FORCE ON ME, THOUGH? I'm not running away. >> Are you going to get in the car? Do you need help getting in? >> Bro. >> Watch your butt. Watch your butt. >> Tell me what I did cuz I ain't do nothing, sir. Woo. Sir. >> Officers would shortly realize the man was telling the truth and furthermore possessed no stolen items on his person. Next, they collect his backpack that contains an unusually large sum of cash amounting to $2,575. And shortly after, Walmart urgently identifies that his cousin, who happens to be wearing a highlighter yellow shirt, is now ready to press his luck at the front Walmart entrance. >> Put that down. On the ground. >> ground. >> On the ground. >> On the ground. >> Put it down. >> On the >> On the ground. Lay on your back. Lay on your back. Hey, how you doing? How you doing? >> What? >> You know what happened. >> All the socks are >> They're all belonging to the >> What happened? >> You know what happened. >> What happened? >> What do you mean, sir? >> What do you mean by that? >> What do you mean? >> Do you have anything on you that doesn't belong to you? >> What do you mean by that? >> Do you have anything on you that does not belong to you? >> Uh no, sir. I have my phone. Um I was going to get my wallet and come back and pay for the the goods I stole here. >> Okay. That's fine. Yeah. >> Stick with the plan, though. >> Yeah. Here. >> Who's the supervisor? >> Huh? >> The only thing is I got to stick with the plan. >> What's your name? >> Uh Cornelius. >> Cornelius? >> Yes, sir. >> Just stay right You got anything tucked in your socks? >> What do you mean I got socks >> that belong to the store on my three pairs of >> What happened? >> Said you got like three pairs of socks that belong to the store on you. >> Say it again, sir. >> I said that you have like three pairs of socks that belong to the store on you. >> Oh, three pairs of socks? >> Three, four, there's there's a couple pairs of socks that belong to the store. >> Yes, sir. >> On you that you didn't pay for. >> Oh, I I was paying for them. She said I can go to the car, grab my wallet, and come back and pay for >> I was watching you on camera, dog. You didn't do nothing. >> It's Darnelius. >> Darnelius? >> Do you know me? >> Yeah. Now, I know exactly who this is. You got a warrant, bud. Stealing from your aunt. Yeah. Your dad got picked up on it. >> Oh, what am I arrested for? >> Theft. And a warrant. >> What is theft? >> Theft, you're stealing. >> What does that mean? >> It means you're stealing. Taking things that don't belong to you. >> Oh, no no, sir. I wouldn't I also I wasn't doing that. >> Are you taking it? >> I didn't I didn't take anything. >> Okay. Somebody else I want to read him his Miranda. >> What did I pay for? >> Okay. I think the one that you want to see is down there. He's got a laceration on his head. >> And everyone say you stole. >> They is. >> Okay, well I'm not talking to them, right? I'm talking to you. I'm coming straight to the source, right? Cuz I don't want to be influenced by what anyone else says, right? I want to hear it straight from you. All right? I might be new here, but I'm not new to the game. You know what I'm saying? So, you have the right to remain silent. Anything you say can and will be used against you in a court of law. >> All right. Damn, they done bruised me and all for no reason, though. >> Right. Um can I start with your name? >> Jamar. And they don't got no evidence that I stole, fam. >> Okay, hold on. Hold on one second, okay? What's your birthday? >> 1999. I'm saying all this cuz if I do or don't go to jail, it's like >> Well, listen. I always listen to someone's side of the story, right? And whatever you tell me, that's what I'm going to put in there, right? You did wrong and you messed up, you did wrong and you messed up. I'm not saying that's what you did, right? But I can respect someone who's like, "You know what? Maybe I didn't make the best choice." Right? And I'll put in there that, you know, if you didn't make the right choice or you didn't make the best choice, that you recognize that. So, as a judge sees, "You know what? Sure, maybe you didn't do the the best that you were supposed to do today, right? But at least we can see that you're growing from it, right? You're learning from that experience, okay? Um to the best of your ability, can you raise your right hand for me? Do you swear that everything you're going to tell me is the truth and nothing but the truth? >> I swear. >> Who are you here at Walmart with? >> My cousin. >> Your cousin? What's your cousin's name? >> Darnell Lewis. >> Okay. Well, how'd y'all get here? >> My wheels. >> Your car? >> Yeah. >> Got you. Where's it parked at? >> Oh, man. I don't need nobody going in my car, but uh it's parked over there. >> Over where? Like in which aisle? >> I don't trust nobody. I don't trust nobody. >> All right. I need to make sure that it's locked up and everything. >> Well, it's locked up. I need to call my people so they can come pick up my car. >> Yeah. So, and and we can arrange that, okay? Um but I need to know which aisle it's in. So, y'all get here and then what happens? >> We go in the store and shop. >> Mhm. >> I'm waiting I'm not getting nothing. I don't need nothing. I'm waiting on him to shop. He's taking hours. I'm telling him to come on, come on. He's taking hours. I come out the store several times with nothing in my pocket, nothing in my hand. >> Okay. >> Like what the [ __ ] I go back inside waiting on tell him to hurry up. I go still waiting. I come I come through this way. >> The garden center? >> Yeah. And he's And that police officer sitting right there like I don't stole something. But before I get out to him, I tell the the worker, "This is just a bag, sir. There's nothing in the bag. Nothing." I pull out this my pocket with my left hand side with my money. I said, "I don't I don't I don't need to steal nothing. I got money. Feel what I'm saying? There ain't nothing in my pocket." Then I come out, he "Sir, stop. What the charges are Come on, man. What did I steal though?" >> Did anyone ever tell you that you stole anything? >> Speak. So, why else would I be getting arrested or detained? >> There are plenty of reasons why, not just stealing. >> I'm not trespassing from here. >> Okay. So, so what was your cousin doing? >> Shopping. >> Shopping? >> Yes, ma'am. He was shopping. He didn't even get out the store yet. didn't even finish shopping. >> Okay. >> So, how can we purchase anything? >> Well, how do you know he didn't make it out the store? >> Because I was coming out. >> Mhm. And you appear to be by yourself at the time. >> Yes. He's shopping around. I'm waiting on him. >> I'm I'm straight shooter, right? I find when I'm a straight shooter with someone, right? I usually get to the bottom of what actually happened, right? And ultimately, that's what's important, right? So, I'm going to be honest with you. Right? Now, I haven't watched the video, so I'm going to give you the opportunity to tell me what I'm going to see in the video. Could it be a possibility that it looks like that you were standing by while your cousin is stealing? And that's why you're so adamant that you personally did not steal anything. Is that a fair assessment? >> Well, how is he stealing? >> Is that a fair assessment? It's a yes or no question. >> It's fair. >> Yes. >> Well, look, we didn't steal anything if we didn't come out the store, man. >> So, did you know that there is a statute under retail theft that says theft by concealment? >> No, I don't. >> So, that means, right? If you're inside a store and while retail theft says that it you have to pass all points of sale, there's another sub-statute >> Well, they didn't even let me or him get to the register, man. >> Right, but hear me out. >> And I didn't have nothing in my hand or picking them up. >> Right, but the subsection says by concealment, right? So, I don't necessarily have to wait for you to come out the store. You're right, you didn't steal anything. >> So, my association is stealing. >> Like I said, if it's a fair assessment to say when I watch the video, it looks like you're being a lookout, that puts you as an active member in it. I think you had an active part in that in the lookout. And I think that you were unaware of the fact that you could be just as guilty in the act itself. And that's okay. I think you made a silly choice today. >> But, look, he didn't steal anything, man. What? But, if anything, he got I will pay for it right now. What's the [ __ ] big deal, bro? >> Jamar. >> Like, what? Like >> Real [ __ ] though. >> And you say Kenny will be used against you in a court of law. You don't want to talk to me? Tell me, "Officer Algood, I don't want to talk to you." Or if you do want to talk to me and then at a later point you want to stop talking to me, just say so. >> Nah, I ain't got nothing to say, but I wouldn't have taken anything. I got I got the my my that box right there. >> Yeah. Okay. >> [music] >> Did you pay for that? Yes, sir. >> I was I was told my um my cousin he already paid for it. >> Where's your Where's your cousin at? >> What? He's already paid for it. >> Okay. >> He gave me the box and I walked out and came out with it and I had issues, too. >> Okay. So, he gave you the box, told you he had to pay for it. So, >> He already paid for it. >> Okay. All right. >> Look at me. Look at >> All that money and he they can take a couple hundred out. Take that [ __ ] >> Okay. >> Well, do you know at which which one he paid for it at? >> I'm not sure. >> Do you know at which register he paid for it at? >> Uh no sir. >> No? Okay. Well, why did he Why did he leave you? Why after he he paid for it did you guys stay around? Okay. [music] >> But look, did he steal anything? >> Do you want me to find out? >> Yes, ma'am, cuz >> Cuz I believe that they did find stolen property on him. >> Okay. >> Okay. >> They found stolen property? >> Mhm. >> Or property that's on him? >> Okay. They pulled him outside the store though, ma'am. >> Mhm. Because the registers are pretty far back, right? I could sit and wait for you at the door. Right? You know, the little holding area. >> Yeah, yeah. >> All right. Cuz then technically you still passed all points of sale at that point, right? I'm not saying you're a bad person. I think that it's a silly error error because you thought that as long as you weren't the one actively stealing, right? You don't get in trouble for it. >> Ma'am, I wasn't stealing though. >> No, I I'm hearing you. >> So, why am I being detained though? Why was Why was I detained and found with the system and everything? >> Well, because you're stealing. >> I was I was 60 short. I paid for them. >> You have a receipt? >> Yes, sir. >> Where? >> It's in the It's in there. I'll go get it in the truck. I have a gift card for that stuff. >> Remember that first half we talked about? >> Yeah, I'm bruised. My money's gone. >> Uh-huh. >> I'm about to go to jail for the dumbest charge I've ever seen in my life and get burned it right out. Like that's just a waste of my money and waste of my damn time. >> I agree. I agree, but that's unfortunately where we're at at the moment. >> You got nothing to say? >> Nope. >> Uh boots, those These are your original boots your original shoes? >> Uh yes, sir. When when I when I paid for these I took I took these off. >> You paid for those? >> Yes, sir. >> Come on, man. >> There's shoes in there. >> We watched you on time, bud. >> Yes, sir. >> So, we're going to take these off and give them back to Walmart and we'll put your normal shoes back on. >> Yes, sir. >> That way they get their property back. You paid for those? >> I thought I don't want to ruin >> No, no. Just give me your foot. >> I'll just I'll pull it I'll pull it off. >> Okay. >> I got I got it. >> All right. What is it no shoes that's going to come out when you take them off that you don't want to take them off? >> Nothing. Just kick the shoes off. >> Off that, man. They're probably too tight. I don't know why I have why we why we doing having to take them off. It's probably too >> You didn't >> I paid for them. If I have the receipt, sir. >> You didn't pay for them. We watched you on video the whole time. >> Oh. >> Go ahead and take off your socks, too. Those socks ain't yours, right? You put them on? >> Yes, sir. >> Right. So, don't take them off. >> I'm going to take socks off, sir, with with handcuffs on. How do I take off How am I going to take my socks off with handcuffs on, sir? >> Give me your foot. Give me your foot. Give me your foot. >> Yes, sir. >> All three of them are those? >> Yeah, but there's >> So, I'm going to jail? >> I believe so, yeah. >> For what? What's the charge for? >> Um, I believe it's still going to be under retail theft because you guys worked together as a team. >> Ma'am, ma'am, I didn't steal Ma'am, please, ma'am, I didn't steal nothing. They don't got no proof of me stealing no item. >> Come on. First of all, remember the one thing I asked? Just don't yell at me. >> I know, but it's just >> But And Jamar, didn't we just I know. Didn't we just talk about how if you're the lookout >> I wasn't no [ __ ] lookout. How the [ __ ] am I looking? Look, no, how am I looking out, though? How am I looking out, though? >> So, when I watch the video, it's not going to be >> Let me Let me watch the video cuz I'm not looking out. I go to the bathroom and all. >> Yes, that's what it would look like. You already said that. >> mean I'm looking out for him, no. Like, why would I be looking out for somebody stealing, no? Like, that's stupid as hell. And I'm going to Can I call my people, please? >> Uh, yeah, cuz we're going to have to deal with your car situation. Um, and just so you're aware, I believe there's a seized tag order on your vehicle and your license is actively suspended as of October. >> A seized order on my stuff? >> Yeah, a seized tag order, which means you're no longer allowed to have that tag. >> Yeah, I got to pay for my tag renewal, too. >> That's right. >> You got the money. I had the money to pay for it. Y'all know Should have paid for it, then. I got the money. I got it, sir. I got I got it. >> You don't got it. Come on, you're wasting my time. Wasting time right now. >> I understand what you're saying. Y'all be trying to act so sweet and stuff, but I ain't >> Oh, no, I'm a street shooter. I'm usually not nice. >> I know. Well, I ain't do nothing, but can I call my people, please? Tell them I'm going to jail for So, what? For something petty that I ain't do. And can they come pick up my car, please? >> Yeah, but I'm going to tell them that they'll probably need to bring a tow truck. >> A tow truck for what? >> Because your vehicle is no longer registered. It has a seized tag order. >> I understand, but a tow truck for what, man? >> Because they're not allowed to drive the the car without a tag, and you're not allowed to place a separate tag on it that you know is not the tag assigned. >> So, all that stuff and all the stuff he had on him. >> Yeah. Stolen. >> Okay. So, he'll go for this, and then the resisting? >> the He resisted. >> Okay. Oh, he's going for battery. >> Oh, yeah? >> Yeah. >> So, he I didn't know he didn't steal anything. He was just a lookout. >> Yeah. >> Nieto told him, he's like, "You're not in any trouble, man." >> All right. >> Now, I don't want your people to be arrested. >> They giving me all this runaround. You know, >> No, I didn't. >> So, you want to tell me I'm going to have to get my car towed to my auntie's house? >> Probably, yeah. Or we can leave it here in Walmart. >> I'm telling them people I do want to go to the hospital. Like, man, I'm just like stealing, bro. Stealing? >> Where you work at that you make that much cash? >> I was working at 7-Eleven. Like, I got a job. >> Cuz that's a lot of cash. Like, a lot. >> I know. I I work at 7-Eleven. You >> Cuz I need to switch my job if that's the cash that you pulling from 7-Eleven. >> Yeah. And I And I I had another job before that previously, but >> Okay, what was that other job? >> Coors. >> Coors? >> I don't got a lot about nothing. Yeah, Coors. >> Bro, you have 25 and some change. >> I know. >> That's a lot of money. >> that working at those jobs, man. >> Okay, well, I'm going to try to save that. >> Huh? This is mine. >> What? >> Yeah. >> So, all this I have on I had on for like an hour. >> Okay. right. >> So, so basically, press, once he press the charges, I can't pay it or do anything, right? >> Yeah. >> To to get out of it, like basically, if I would have said before, like I could have paid for it, like I could have paid for it, paid for it. >> I think the right thing, honestly, that would have >> The receipt was ticking. >> The thing that would have avoided this all together >> Right. >> is if you would have just made sure it was paid for. >> Before I walked out. >> And didn't throw your receipt away. >> All right. >> Cuz then you could have proved it, you know what I'm saying? >> Right, right, right. Yeah, yeah, yeah, so I see I see what you mean, man. I see what you're saying. >> I got you. >> During the arrest of the 24-year-old lookout, officers were struck multiple times during the takedown, and as a result of the man striking officers, that 24-year-old was given felony charges of battery on a law enforcement officer, as well as resisting an officer with violence. He posted $4,000 in surety bonds just 2 days later and was released. And for the resisting with violence on this Walmart incident, prosecutors would also drop that charge. The man was adjudicated guilty on the battery on law enforcement charge, [music] and as a result, he spent 196 days in county jail. Now, for the actual 23-year-old shoplifter who did conceal items unlawfully, he concealed a total of $250.90 in merchandise from Walmart. This included two pairs of Jaybird Minis at $39.88 apiece, socks, a Hanes t-shirt, sandals, work boots, sleeping pants, face masks, eyewear, gloves, and a few other items for a total value of $250.90. [music] As a result of his actions, he was given a $250 bond and charged with petty theft $100 or more, but less than $750. Ultimately, he was adjudicated guilty, and as a result, he spent 25 days in county jail. Let me know your honest thoughts on this case down below in the comment section. Stay safe out there, and I'll see you in the next video. >> I just showed him. >> You showed what? >> The receipt. >> I got what I got in my pocket. >> All right. Let's all stand up and do this real quick. >> On the ground. >> On the ground? >> On the ground. >> I didn't do nothing, bro. >> Get him down. >> What is theft? >> Theft is stealing. >> What does that mean? >> It means you're stealing. Taking things that don't belong to you. >> I didn't do nothing, bro. I didn't do nothing, bro. >> Hey, I told you to stay down. >> I DIDN'T DO NOTHING, BRO. I DIDN'T DO NOTHING, BRO. >> I TOLD YOU TO >> I DIDN'T DO NOTHING, BRO. BRO. I DIDN'T DO NOTHING, BRO.
