Looks like you came on the wrong day. >> My bad. I've been very nice to you. I didn't try to run from you or anything. >> Yes, but it seems it works the other way. >> What do you mean? >> What's up? >> I mean I feel like you can give me a warning. This is my first time doing this. >> That's up to me. That's up to me. >> I know, but what I'm saying is I'll pay for all the stuff that I have anyway. >> Again, that's up to them. What's your phone number? >> Sir, you said it's up to you. I don't be rude or want to be rude, but I know that I lost my job 2 months ago and I used to come in here all the time and spend like my whole paycheck basically. Um and to be honest >> What apartment did you say it was? >> I admit yeah, I know I was wrong and I have learned my lesson. Trust me, I would never do this again. I would never come back to your store. I would buy every item that I have in my bag literally. >> Well, you don't have to come back in anyway cuz you don't trust me. >> No, I'm saying I'm not coming back in anyway. No, no, I'm saying I'm not coming back in. Sorry. Yeah, excuse me, sir, I can't hear you. It's a what? Um, some of that stuff already had in my possession. No, I'm sitting down, sir. You act like I'm trying to be rude. I'm just trying to make sure you get what you're supposed >> Everything else I cannot confirm minus this L, but these guys are hers. >> Those are all They should be hers. These are the only ones that are hers. >> Okay. Thank you. So, yeah, I'm talking Can I speak with him cuz >> No. >> I can't speak with him anymore? >> No. >> You just said I It's up to him for me to speak to >> I'm conducting an investigation. >> No, I understand you're conducting this investigation, but I'm talking >> but you cannot speak to him right now. >> He just told me I could speak with him. He had no problem with that. I just don't want to lose my house and my name. I don't want to lose my house and I have four kids. I don't want to lose my house and >> Okay, so you were about the wrong thing. >> No, I'm just trying to speak to him and see if I can buy the items instead because it's the same thing. I didn't leave the store. They got all the items That's all that I'm saying. >> Are you familiar with the Miranda warning, ma'am? >> Yeah. >> All right. So, just do me a favor and just verbally confirm that you understand after each one, okay? You have the right to remain silent and not answer any questions. Do you understand that? >> I don't understand why you're being rude and you're man. Like, what are you being rude for if I'm trying to buy something? >> rude, ma'am. You have the right to remain silent and not >> I'm asking him another question. I'm asking could I speak with him because he has the authority >> time, you are not able to speak with him, ma'am. >> But he didn't say I couldn't speak with him. You're saying that I can't speak with him and I'm just trying to save myself from going to jail because my son is literally >> Literally, I'm no longer having this conversation. I'm going to have to come back to the investigation. >> No, I understand. I was just saying I buy it? That's all. >> I'm going to say no. >> Okay. >> Cuz if you were going to buy it, we would have done it the first time. >> Okay, but everyone makes mistakes, but okay. >> Of course we do. Yes, but I'm going to go ahead and I'm going to go ahead and take care of this. >> Okay. >> All right. You have the right to remain silent and not answer any questions. Do you understand that? >> Uh-huh. >> Yes? >> I'm listening to what you're saying. >> I need I need you to verbally confirm what I'm saying. >> I'm handicapped, so I can't like I'm mentally >> Okay, so you are physically Okay, so you are physically unable >> Okay, so you're saying you're mentally incapable of giving me a statement. >> I'm not. schizophrenic. >> Okay. Are you or are you not >> I am. I am schizophrenic. >> What is what is schizophrenic? >> Schizophrenic is when you hear voices. >> What is schizophrenic? >> Oh my god, whatever that. >> Okay. >> Yeah, that. >> All right, so do you wish to give me a statement? >> Um no, not really. What am I giving you a statement for when I can't recall exactly? I want to be cooperative. >> to give us You're refusing to give a statement. >> You're saying that it really don't matter at this point anyway, so you know. >> I'm asking you. >> You're saying it don't matter. >> refusing to give a statement? >> Okay, so. >> Yes? >> I'm just trying to let you know that >> May I read you your Miranda warnings and then I can talk to you? >> I don't understand them for you to be reading them. >> You have to let me read read them. >> Okay, but I don't understand what you're saying. >> to remain silent and not answer any questions. Do you understand that? >> Yes. >> Do you understand that? Yes or no? >> I am slow. Like you can call my mom. You want to call my mom so she'll be able to translate this to me? Cuz I don't have my full >> Okay, so what part of that don't you understand? You have the right to remain silent and not answer any questions. >> understand none of that. >> Okay, so you're refusing >> I'm I'm telling you that I I have a disability. >> Okay. >> So, how do you >> All right, then. Okay. >> When Officer Bell attempted Miranda warnings, the subject claimed bipolar disorder and schizophrenia and said she could not understand a word. Under Miranda versus Arizona, that creates an immediate problem. In Colorado versus Connelly, the Supreme Court held that mental illness alone does not invalidate a Miranda waiver unless police coercion is also present. Still, that is not a license to push through an advisement someone cannot engage with. The officer's obligation is to document the concern, stop interrogating, and honor any de facto invocation of silence. Officer Bell eventually accepted her refusal. Whether that came soon enough is what matters most here. >> I tried to talk to you and you didn't want to talk to me, so I'm not going to talk to you either. >> Thank you, sir. >> I'm not sure what >> I told you guys that. >> Yes, yes, sir, I have. >> Cuz I don't see too many people on Instagram and other places get caught stealing and y'all sit right down. >> to do that at all. We're switching out here. >> What do you call them? Y'all give them a warning. I'm asking you to pay for everything that I got. So, it's not even fair. Like, I learned my lesson. I'm blocked on the store's phone. I don't understand what's going on. >> Take your picture. >> Most places Most officers Could you call officer what you call it for me? >> Who? >> Um >> No. >> The what you got? >> [laughter] >> He is funny. >> Very funny. What are you going to ask for if you're going to say that? >> Ma'am, can I just take your wonderful picture, please? >> No. Ain't nobody >> Ma'am, I have one by name and date of birth. Good evening, ma'am. All right. >> You can take it like this though, but >> No, no, I got I got I got one for you. >> As long as you got one, I ain't going to take no picture in my hand. >> It's going to be a black female. >> And ain't nobody You know what I mean? I had loss prevention calling and saying, "Hey, like, don't You know what I mean? Whatever you do." >> I'm better than loss prevention. >> Huh? >> I'm better than loss prevention. >> No, I'm talking about what loss prevention I said. >> can give loss prevention trouble. You can't give me trouble. >> No, I'm not giving you trouble. I'm not trying to even give you trouble, sir. I understand that. >> you and your duty. >> Yeah, you You've been more than fine. You've been more than fine. >> department, not police. >> You've been more than fine. Who's your brother? >> You >> don't need to say who that >> Why you said it if you don't want to tell us? >> No, cuz I'm telling him he's saying like he's important than y'all, bro. >> When did I say I was more important? I didn't say I was more important. I said >> I'm superior than >> No, you said I wasn't giving anybody any trouble. I said you can give loss prevention trouble, but you're not going to give me trouble. That's what I said. >> He is bigger than us. >> Yeah, cuz I I would like for y'all to talk to our officer. He our supervisor. You're not the supervisor. The supervisor is who drives a white truck. You're not the supervisor. >> Okay. >> Trust me. I believe >> do you need the supervisor for? >> I need to speak to him. That's why. Bullard. I need to speak with Bullard, and if I can't speak with Bullard, I need to speak to Ryan Curtis. That's who I need to speak with. >> Yes, ma'am. >> She talked with a female born in 1994. Same first and last name. She is on 48 for grand theft. >> I'm on what? >> also has an active history of felony theft, 31 criminal mischiefs. Resist with 31 LEO, and active 1 >> 31 on the LEO? >> And I served my time for that years ago, 8 years ago. >> 10-26, ma'am. Can you 10-3 that to me, please? Come on, give me one. >> have a warrant or anything, do I? >> Yes, ma'am. >> So you're saying I'm not under arrest? All right, no problem. >> Thank you. >> I'll call them once we get outside. >> Thank you. >> He just wanted us to run a palms and personal. >> And when I read it when I just told you I paid for >> That's not up to me. >> Huh? >> I told you to sit back. >> No, you wouldn't even let me talk to the man. You >> He don't want to talk to you. >> He didn't want to talk to me until you started being a little >> No problem. >> Until you started being a little >> All right, no problem. >> Until you started being a little >> Yes, ma'am. >> Ain't kind of really got your ass. Please, but I ain't going to pay you. I'm trying to get out of here. I ain't got to my damn call you a fat [ __ ] >> I won't play with your life like that. >> Play with my life? >> Yeah. >> You must don't know. I don't know who you got to be a rookie. >> We're going to fix him. >> Yeah, could And could you call the sergeant me cuz I asked for the sergeant and I'm allowed to get the sergeant. You ain't got a man handling me cuz I ain't man handling you. If I'm telling you the cuffs too small, why you pushing my elbow to the front seat? >> unfortunately, I just so happen to be a man and I am handling you, but man handling you or not. >> Look how tight these damn cuffs is. I can't even move my [ __ ] wrist. >> Ma'am, I can put I can put my two fingers inside the >> telling you that they're hurting my arm. I ain't I ain't even nothing. >> Okay. >> See? My son is literally right down the street and I I >> He's where? >> Huh? >> He's where? >> He's right down the street. >> 12 mile 1105 >> His place right here? >> Let me start with 1101. >> You know come out of this driveway here by the Chase Bank? >> Yeah. >> the buildings across the street? It's um a a a a a >> doctor's office. >> Oh. >> They're getting his treatment. >> Okay. >> So, and I'm normally like this all the time. So, that's why I keep insisting on that cuz I don't want to leave him at the doctor's office and then You know what I'm saying? >> Yeah. >> DCF and all that going to get involved and come back and get my baby up and that's not even what happened. I got arrested. That's what happened. >> I got the medics coming for you right now. Hold on. >> Yeah, but what I'm trying to ask you is >> She's getting arrested and all of a sudden decides she has anxiety. So. Is that here? >> She's in the back of the car. How you doing? Huh? >> I didn't see you when you fell up. I thought you moved towns. >> You haven't seen me in forever? From where? >> Remember when they had the brawl up in Saddlebrook and you was there and I was telling you how you was crazy. >> Davis ran off? >> Yeah. >> Heart rate is >> Davis ran off or no? >> Huh? >> No, he went inside to grab something inside. 70. >> Oh, okay. >> Made you healthy. Made you perfect. >> Okay, but I'm having panic attacks. So, Oh, no. No, it's not having panic attacks today. >> Your oxygen saturation is 100%? And your heart rate is normal is 60 to 100. >> Okay. Something perfect. Okay. I'm just having I just told my heart had a anxiety I had a anxiety attack. So, I don't know what >> Do you have the vitamin C receipt? >> Yes. >> No problem. Along with the Was it all just makeup products or >> It's a mixture. >> Mixture? Okay. Is all Is it all this this stuff right here? Okay. And this is As far as we know this is everything that she took. >> As in the >> Okay. All right, cool. So everything is recovered. All right, I just have to I'll just get pictures of that stuff that I've listed in my report. And then you have footage from >> Do you want me Do you want to send it through like the Axon or whatever it is? That portal? Okay. >> Do you know if you So I can send the Axon community link? >> Yep. Thank you. >> My phone's in the car. >> It's okay. I can write it down there. >> On the charge itself, Florida statute 812.014 sets the grand theft threshold at $750 or more. At $977, this case clears that line by a significant margin. The subject argued she should be allowed to pay for the items after being caught. Under Florida statute 812.014, that argument fails. The theft is complete at the moment of concealment with intent to deprive. The merchant's privilege to detain is codified in Florida statute 812.015. That statute authorizes retail employees to hold a person reasonably believed to have committed retail theft in a reasonable manner for a reasonable time. When the subject asked for a female officer for her pat-down, Officer Bell initially said, "That's not true." That pushback was legally imprecise. Florida agencies maintain policies strongly recommending same-gender officers for pat-down searches. While no absolute constitutional mandate exists, agency policy fills that gap. And dismissing the request outright creates civil liability exposure. To his credit, Officer Bell ultimately waited for a female officer. The outcome was correct. The path there was rough. >> I don't know. I put $700. I don't know. $300. I don't know. But what I'm saying is about I'm going to pay for it. So it's no harm, no foul. I ain't coming back in here. I'm going to ban from here, so I'm not coming back in here. You know what I'm saying? Like, I literally only came to get lip liner, lip gloss, and a curling iron. That's what I came for. So, we can go take Valentine pictures, me and my baby after he leave and we go get dressed and stuff. That's all I came for. I didn't came for nothing else. >> Try not to talk a little bit. Let them finish what they're doing. >> Oh, my bad. I just feel like all this he doing he just drawing attention for no reason. Just no reason. And it's very embarrassing. Very embarrassing. >> Perfect. >> Why is my face like that? He already done saying some stuff in here and whatever. I don't know. He really said something else. >> I know you're on the wrong wrong phone. That is it. What is your extension? 305 >> Uh 5, sorry. >> Rescue 5? >> Yep. Some officer What was that? >> What is my butt? >> Okay. >> Yes, ma'am. >> Are you going to talk to him? >> I'm sorry? >> Did you talk to him? >> You guys have a wrong number? >> Yeah, he's got it. >> It's the wrong number. >> What is it? >> Would you like talk to him? >> 3927 >> For me, please. >> Yeah, he went inside, so we got to wait for him to come back. >> I know he went inside. Did you talk to him? >> He said 3539 3539 >> How are you guys getting the world How are you guys getting the world this year? >> Yeah. >> Huh? >> I'm signing that. >> I didn't even know that. >> Now you do. >> For what? >> Whatever you guys need. >> You got guns or something? >> I have no idea. Probably new equipment or something. They >> Hopefully it's new trucks. >> Yeah, yeah. We need that. >> What is it? 3530? >> Yeah, 3539. >> 35 >> 39 >> Listen, if you don't think you can raise your right hand for me, just want to tell the truth, the whole truth and nothing but the truth. >> Yes, sir. >> All right, you can put your hands down. Can you tell me what happened today? >> So, basically like the whole from the instructions? >> Yeah. >> Okay, so basically when she came in, she I noticed that she was carrying a big bag. She grabbed three of the pallets from Morphe. And you know, I was very suspicious of that because of the fact that when she grabbed it, she looked at me and then went all the way to the back of the store. >> Mhm. >> So, I found that a little bit suspicious. So, I hurried up and ran to the back of the store. >> Mhm. >> So, that my other managers know that just to keep an eye on this suspicious suspicious to be customer. And then once I told him that, I came back into the sales floor and then the from our managers in the camera room were noticing that she was concealing the items and I was in the sales floor and I was seeing it for myself as well, too. So, what we did is we just informed each other and just let her build the basket so it just could be a little higher price. So, once I you know, I repeatedly seen her put the stuff in her purse but I gave her you know space so she didn't think that we were on to her. >> Mhm. >> So, as much as I can I stayed away from her cuz there were other customers, came back. I think I only canceled her one time. Actually, no. Before all that, I gave her one of the orange Ulta bags cuz she had all the items in her hand. So, I gave her to her and said, "Hey, you seem like you got a couple items in your hand. Do you want an Ulta bag to carry them?" She said, "Oh yeah, thank you." So, she grabbed the Ulta bag but usually we do that just so we have a way to count the items that they have already in their hand. So, I gave it to the I thought she was going to say no but she took it. So, she took it and then what she did is she forgot she just after like I want to say like maybe 10 or 5 minutes took everything out the bag after she canceled it. After the Ulta bag then put the Ulta bag somewhere else. She literally hid it somewhere else and then pulled her own bag out. So, that's when I noticed when she pulled her own bag out and I didn't see the Ulta bag anymore but I didn't say nothing to her. Just let her keep concealing the items until until until they she they kept concealing concealing and then she just walked out. And then that's when everything happened. >> Come on, wait. Take the stuff off. >> You You can't take no stuff off me. You got to be a female officer to touch me. >> Okay, ma'am. >> Please call a female officer. So, thank you very much. >> All right. No problem. >> Yeah, call a female officer, please. You're not going to search me. You're not going to touch me. You told me I'm going to take off my clothes. What the [ __ ] I look like? >> Ain't nobody said you were going to take off >> take off your stuff. >> Ma'am, don't you have jewelry on? >> Yeah, but you said take off your >> Don't you have jewelry on? >> My earrings ringing? I just told you it's my it's my whatchamacallit. >> Okay, all right. You cannot have any loose articles on you. >> Right, but >> Don't worry about it. Don't worry about it. Don't worry about it. Don't worry about it. Don't worry about it. >> Yeah, call the female officer. >> Oh, trust me. We're not We're not taking me up to do that. >> No, I don't I don't really give a cuz guess what? I ain't killed nobody, so I will be out clear as day. >> That's fine. >> Yeah, what you saying? You You trying to hurt a female. You must ain't got no females in your life. You got kids? You can't help it. You got a daughter? You can't help it. You got a mom? You can't help it. You got a sister? You can't help it. You got a grandma? You can't help >> don't steal, sweetheart. >> And I don't either, but I ain't finna But like I said, I will pay for it, so that ain't stealing cuz I got the money to pay for it. Stealing is when you don't have the money to pay for it. >> Okay, all right. All right, no problem. You proved your point. >> Okay, yeah. I'm trying to prove my point. That's all I'm trying to prove my point. >> Okay. >> Will you roll my window up cuz I'm not trying to argue with you, sir, and make you feel >> No, you're not finna make me You're not finna run me. No. >> I'm not trying to run you up there. >> it down, so it's finna stay rolled down. >> Okay, sir. Whatever you say. >> You said you was claustrophobic, so now your window finna stay down with the AC on. >> Okay. >> So, you don't think I'm torturing you. >> You are torturing me. >> Okay. >> You are torturing me for no reason at all. >> Okay. All right, no problem. >> I would never >> All right, you want You want You want stuff from me? >> Yes. >> And I need stuff from you. >> Okay, all right. >> I do not readily have a female available. All right? But I need to get these items off of you so I can get you out of here. >> my earrings off. >> Okay. >> Well, can I put it in my car so nobody don't steal it? >> Where's your car? >> My car is down there, the white Tesla. >> I'd rather go with you so we can keep track of it. >> Oh my god. >> I can't speak for it if it's left in your car in a parking lot. I'm sorry. >> This necklace is $10,000. I don't want to do that. >> That's why we're going to take care of it. >> I don't understand why I just can't pay for the stuff. >> That's not up to me. I told you that. That's up to the store, and they decided that they were going to prosecute. You You asked me a question for a question. You didn't even address that. >> What? >> When the subject claimed a panic attack, officer Bell called EMS immediately without questioning the request. Florida agencies carry a duty of care toward individuals in custody. That response was exactly right. EMS measured her heart rate at 70 beats per minute and oxygen saturation at 100% both normal. Objective findings did not support active panic. But officers are not clinicians. Calling EMS was still the correct call. The loss prevention associate gave a sworn statement describing a textbook concealment sequence. The associate offered the subject an Ulta shopping bag, a standard technique to create a visible count of items, and the subject accepted it. The subject then transferred concealed items to her personal bag, discarded the store bag, and attempted to exit. That full sequence was captured on store surveillance. If preserved, it makes this charge substantially harder to contest. Officer Bell called medics when asked, honored the invocation of silence, and eventually accommodated the same-gender search request. Those are sound procedural decisions. Where he fell short was the initial dismissal of the search request and the friction during Miranda. The female officer conducted the pat-down professionally, no concerns with her portion. The subject was not complative and did not flee. She correctly identified the same-gender search standard. That is worth acknowledging. But her legal strategy, offering to pay after detection, claiming disability inconsistently, and attempting to negotiate outside the officer's authority, did not help her position under any of the relevant statutes. First, if you are detained and claim you cannot understand Miranda warnings, say it clearly, say it once, then stop talking. Under Fare versus Michael C, courts assess waiver validity from the totality of circumstances. Every sentence you add after that claim works against you later. Second, if you want a same-gender officer for a search, make that request clearly and early. It is a legitimate policy expectation in Florida. State it once calmly and let it go on the record. Third, Florida statute 812.014 makes clear that offering to pay after concealment does not reverse the charge. If you are ever in that situation, save that conversation for your attorney. It will not help you in the field. Let us know if there is an interaction or legal topic you would like us to cover in the comments below. Thank you for watching.
