Get online. Hey, everybody hold. Wagers got it. >> Walk to me now. >> Wager, you have command. >> Walk to me. Face away from me. >> Hey, put your hands up. 10-12. >> Hands up. Stop. Face away FROM ME. DO NOT RESIST ARREST. >> LAY DOWN THERE. >> YOU DOING THIS? >> GET ON THE GROUND. >> the ground now. >> Get on the ground. GET ON THE GROUND. YOU'RE GOING TO GET BIT. >> GET ON THE GROUND. >> HE IS 71 YEARS OLD. He is standing on his own front lawn on a Friday afternoon holding a cell phone. That is the only thing in his hands. A phone. Pointed at him from behind car doors and across the grass are rifles. And off to the side on a leash, there is a dog. In about 90 seconds, that man is going to do exactly what he is told. He is going to walk backwards. He is going to turn away. He is going to put his hands in the air and go down onto his knees in front of his neighbors. And then the dog goes on him. You are going to have an opinion about that. Hold on to it because the most important thing on this tape is not the bite. It is what four different officers say about it afterward into their own cameras when they think they are just filing a report. >> Correct. Not this SUV, the next one. >> This is 24, so that's 22. >> Is that him? >> Hey, you got something? >> PUT YOUR HANDS UP. >> HANDS UP. >> DO IT NOW. >> HEY, HOLD. Hold by the tree. >> Hey, GO TO THE DOOR. >> HEY, PUT YOUR HANDS UP. >> PUT YOUR HANDS UP NOW. >> HEY, HOLD. HOLD. HOLD. HEY. >> WATCH HIS HANDS. They are up before anybody touches him. Here is what you need to understand about how he got out here. Nobody kicked this door. There was no raid. A sergeant picked up a phone, called this man's house, and asked him to come outside and talk. He came outside. That matters later, so hang on to it. The man they are pointing rifles at is the man who walked out voluntarily because a police officer asked him to. Quick thing before we keep going, the sentence I just gave you and the two that go with it are written out in my know your rights playbook. Plain English for traffic stops, searches, and your own front door. Linked below. Now watch what happens next. >> Get online. Hey, everybody hold. >> Wagers got it. >> Walk to me now. >> Wager, you have command. >> Walk to me. Face away from me. Put your hands up. Hands up. Stop. FACE AWAY FROM ME. >> LAY DOWN THERE. >> GET ON THE GROUND. >> GET ON THE GROUND NOW. >> Get on the ground. GET >> ON THE GROUND. YOU'RE GOING TO GET BIT. >> GET ON THE GROUND. >> LAY DOWN. >> LAY DOWN. DO IT NOW. >> GET ON THE GROUND. HE hears it four times in 9 seconds, and in the middle of it, you're going to get bit. So, let us be precise about what is being asked because this is the whole case. He is on his knees, his hands are up. Uh under Florida law and under the Fourth Amendment, an officer can absolutely order a suspect fully prone. Kneeling is not the same as prone, but the question this video asks, and it is a real question, not a rhetorical one, is what you are allowed to do about the 18 in in between. >> Walk to me. Walk to me now. Walk to me. Face away from me. Put your HANDS UP. HANDS UP. STOP. FACE AWAY FROM ME. SIR, YOU'RE ABOUT TO GET DOG BIT. >> LAY DOWN THERE. >> ON THE GROUND. ON THE GROUND. >> GET ON THE GROUND NOW. >> Get on THE GROUND. GET ON THE GROUND. YOU'RE GOING TO GET BIT. GET ON THE GROUND. JUST TAKE HIM. JUST TAKE HIM. JUST TAKE HIM. STOP RESISTING. >> GET OFF MY GUN. >> TURN AROUND. >> STOP RESISTING. >> STOP RESISTING. >> STOP RESISTING. >> OKAY. OKAY. >> Stop resisting. >> Stop resisting. He's coming >> All right. All right. All right. All right. >> He's coming off. >> I'm going off. >> Take the female. Take the female. Take the female. >> Okay. Come off. Come off. >> Hey, you're going to get it again. You're going TO GET IT AGAIN. STOP FIGHTING. YOU'RE GOING TO GET IT AGAIN. Move again, you're going to get tased. Dog's going to go right back on you, man. >> Okay. >> [snorts] >> Okay. >> Stop resisting. Stop resisting. He's coming off. >> All right. All right. All right. >> He's coming off. >> I'm going off. >> They're not resisting. Yeah. Good boy. Good boy. Hey, you're going TO GET IT AGAIN. YOU'RE GOING TO GET IT AGAIN. STOP FIGHTING. YOU'RE GOING TO GET IT AGAIN. MOVE AGAIN, YOU'RE GOING TO GET TASED. Dog's going to go right back on you, man. >> Okay. Okay. I'm okay. I'm okay. I want to pay. I'm okay. >> Hey, we're handcuffing him now. >> I want to pay. >> Everyone stand forth. Do you have any weapons on you? >> No. >> Huh? >> I don't know. >> I know. >> Hey, uh put some gloves on when you search the car. >> I was sleeping in my office. What the hell are you guys doing? I'm going to sue you guys. >> Okay. Yeah. You want to stop talking or you going to keep talking [ __ ] >> Come outside. Ma'am, come outside. >> 90? >> That is a 71-year-old man being told the dog is coming back. And you are entitled to ask what he did. So, here is the report they were working from and I want to be careful with it because a report is not a finding. Earlier that afternoon, there was an altercation at a bar downtown. Officers were told a man had hit somebody in the head with a gun. That is what they believed when they set up on this lawn. Whether it was true is a completely separate question and it does not get answered today. It gets answered much later. >> Ma'am, you speak English? Okay, you're okay. Is anyone else inside the house? Ma'am, is anyone else inside? Ma'am, you're okay. It's bueno. Ma'am, do you mind if I come inside? Okay. Can I come in? Good, let's let's >> Quick note about something you are not going to see. Right at this point in the tape, 24 seconds are completely blacked out. That is not us and it is not a glitch. The department redacted it before they released the file. There is nothing on the screen, so I am cutting it out rather than making you sit and watch a black rectangle, but you should know it was there. When a piece of a recording goes missing, you are entitled to know who took it out. In this case, they did. >> Elderly? Yeah. Okay. That's what I thought. Did we verify if anybody else is inside? I thought it was just I know she came out. Okay. Lady Hold on a minute. I can't hear You are afraid to my lawyer, not to me. I know, I'm sorry, miss. Okay. Sorry. We're going to need you I can't understand. I don't think she's crazy or anything else. I don't think she's bleeding. It's a pretty good puncture. Okay. Go Yeah, we we need Okay. Okay. Sir, are you injured anywhere else other than your arm? >> Just my my hands and everything. >> Your hands? >> Yeah. >> What's wrong with your hands? >> My hand hurts, bro. >> It hurts? Okay. We're going to have somebody check you out. So, he came out? >> Yep. >> We were parked right where my car is right here. And >> I was small guy. Look at me, bro. >> house numbers go down by four, not by two. >> I know. I'm going to sue freaking eyes, bro. Believe me. Somebody's going to pay >> for this. I misjudged the numbers, but I thought we were more than one house off, but we're >> Call Marvin, please. >> A pretty good puncture. He goes to the hospital. He is there for several days, and he later needs surgery on his shoulder. That is what a bite is. A police dog is not a deterrent that stops at the skin. It is a set of jaws with several hundred pounds of pressure trained to grip and hold on a 71-year-old's arm. Now, everything you have seen so far is the incident. What comes next is the part almost nobody ever gets to see, and it is the reason I wanted to do this one. >> Call Marvin. Okay, tell him to come here. And they call the lawyer. >> All right. What a waste of resources, bro. No, I didn't see here. My knees hurt. I mean, he hurt me really bad. What do you think >> So, when he came out pulled that out I mean, that's crazy. My cop. 40 guys >> 40 years old. >> 40 guys I mean, eat the street on me. >> Uh, they're doing they're doing uh showing pictures Stop. Stop. Stop. Okay. 10-4. Um Okay, we've cleared the house. We've swept since we're all standing out here. >> Call the company. >> I know. That's a We have a 90-year-old lady. We can get her to come out and then yes, we're going to do a protective sweep. Yeah, just want to make sure that Can she She's mobile? >> She's mobile-ish. If I can sit her down in this front room, that'd be best. Yeah, I think that's fair. I'll have Jan come up cuz I don't think she's stable. Um Jan in park, we're going to do a protective sweep of the house. So, Sarge Kim Can we have somebody 10-12 there? >> The next thing that's going to happen is we have to secure the firearm that was used, okay? This the the gun. We have to secure the gun. So, there's two ways that can happen. Either we get a search warrant for the house or you tell us where it is with consent and we retrieve it. >> So, if >> If we get a search warrant, that's that's fine. If I just have to explain it. If it's a search warrant, that means your mother-in-law has to come out, sit outside while we wait for the search warrant. It could take a couple hours. So, >> But no, I can give it to you. >> Okay, I just I have to explain it. So, what I'll do if you if you don't mind not not grabbing it for us cuz it's going to for evidence, it's going to have fingerprints and stuff on it. You just walk with the officer, show him where it is with their gloves, they'll get it, put it in evidence bag. That way no one has to go in your house or do anything like that. We don't have to go in any of the cars or anything like that. >> Okay. No, it's it's on the counter. >> Okay. Just Just hang tight for me. Hang tight for me real quick. Hey. We can't have We're not going to have her go in and get it. Ma'am. Can you stay out here for us? Just stay out here for a second. >> But who's going to get the gun? >> We're going to get the gun if if you give us consent, that's what we're asking for is for for you to allow us to go get the gun. >> Okay. Somebody come with me and get it. We We don't have any problem with that. >> We're We're not going to have you go back inside though and get it for us. We're We would just like the >> But I don't know where it is right now. Maybe it's on the counter. Can I go and see where it is? >> No. >> So I cannot go inside the house? >> Not right now. >> Can I go with somebody? >> Let me Let me find out, okay? >> So what do you want to do? You want me to >> We We want to find the gun. So I don't I don't know if you don't know where it is, that's >> It should be in the counter. >> Okay. If it's on the counter, that's fine. >> It's in the black purse. >> In a black purse? >> Let me check if it's in the counter. >> No. I can't have you go back inside, okay? >> but I'm going to ask >> Stop. Rewind that cuz a right just walked past you, an officer tells this man's wife there are two ways this goes. They get a search warrant or she gives consent. And notice that is an accurate description of the law, he is not lying to her. But here what is underneath it, if you make us get a warrant, everybody sits outside, your mother-in-law comes out of the house, and it takes a couple of hours, that is not a threat. It is also not nothing, and here is the part you need. You are allowed to make them get the warrant. I do not consent is a complete sentence. It is not obstruction, it is not a crime, and it cannot be used against you. Making them do the paperwork is the entire point of the paperwork. >> Can he Can he put the purse on the counter? Just to >> We're not going to do that right now, okay? We're Just just leave him be. I'll I'll let you know what's going to happen in a second, okay? >> Palestinian guy. >> I don't know where he came from. >> In the house. >> No, all of this. >> That's from the dog. What happened? >> I don't know the guy. >> I just have to do this. Yeah. Um and then, like I said, I'm just going to do a post-fight interview with him. Are you good? Cuz I know he's fighting with you guys in the back. >> Yeah, I'm good. >> Hey, I need someone to replace Sima. If we're just going to sit around. >> We're We're Okay. >> Yeah, I'll try to get him to >> Because I need to get him to take this guy back. >> Okay. >> And I need to go back with him, too. >> Hey, bring him. >> All right. >> Go and replace Sima's spot, and uh Sima come back, please. >> No. Who's in charge here? Who's in charge? >> You were just speaking to him, sir, Lieutenant Mondello. >> Okay, Lieutenant. Let me explain to you what happened. >> I'm I'm not the lieutenant, sir. He was the gentleman you were just speaking to. >> I explained to him already. >> I'm coming right up here, cuz I want to I want to continue. >> I to him already. >> So, my only question is why did they brought the dog on me? That's the only problem that I have. Look at my neighbors. I mean, I'm chained here because the guy tried to kill me. And you defending the other guy because of video. He said I want to kill Americans. And he swinging me at the bus. And he have another guy with him that tried to kill me, guys. That's what I What I have to show you what a firearm and everything. All right. Why he swinging at me and then he tried to play some communist thing to kill Americans. And you take down the investigation? No. I spray Why the [ __ ] dog he kill me? That's I don't understand that. I don't have any >> What What happened up here with the dog? >> He kept walking up, walking up. Sounds like he said to go ahead and shoot me. Refusing lawful commands. They McCormick goes to push him on the ground. He starts fighting with him on the ground. So, then that's when I put the dog on. So, he's actively resisting on the ground with the officers. >> Why did Okay. So, All right. So, he was fighting with officers on the ground. >> Yes. >> Coupled with felony suspect, violent felony suspect. Okay. And Koda Koda responded to the I just choked him off. >> I went due to the level of his resistance even with him fighting officers with the dog on him. >> Okay. >> He was just choked off. >> Okay. Is Koda okay? >> Yeah, he's fine. But yeah, the dog only went on him when he was on the ground and he was still actively resisting with the officers cuz I don't know where the firearm was on his person. >> That's That's fine. That's fine. I'm good with it. No. No, I told them go hands-on because at that point he was on his knees with his hands up. So, I told them go hands-on. >> Oh, and then he started fighting. >> Yes. So, once he started further actively resisting that's when the dog was sent on him. I just have to do the routine is what I'm assuming. Yeah. Um and then like I said, I'm just going to do a post-fight interview with him. Are you good? Cuz I know he's fighting with you guys on the ground. >> Yeah, I'm good. >> Hey, I need someone to replace Sima. >> I I want to play that once more because if you take one thing out of this video, take this. That is the K9 handler. Nobody has accused him of anything yet. There is no lawyer in the room, no camera in his face. He is talking to his own supervisor on his own body camera, and he is explaining why the force was correct. And this is the sentence he chooses. "I told them go hands-on cuz at that point he was on his knees with his hands up." Because, not even though, because the kneeling and the raised hands are not the thing he is apologizing for. They are the thing he offers as the reason it was time to put hands on a 71-year-old man. >> Was your wife with you at the bar? >> No, I was there by myself. I hang out with Don Don Santini. Really? I Everyone knows me there. >> We'd like to get your side, okay? We're going to redo this so we can get your side of story, and we have some other questions that we want to ask you, okay? >> Ask me? Okay. Ask me anything. >> I have to read you your rights first, okay? So, it says you have the right to remain silent. Anything you say can and will be used against you in the court of law. You have the right to talk to a lawyer and have him present with you before and during questioning. If you cannot afford to hire a lawyer, one will be appointed to represent you at county expense before any questioning. If you give up your right to remain silent, or you wish to stop answering questions, no further questions will be asked. Do you understand everything I just read you? >> Okay. So, >> Miranda rights. >> Right. All right. Yes, sir. So, I explained why I explained the the origination of the call, right? That there was We got a call that two people were hit in the head with a gun in the bar. Okay? You already said that that happened, you were defending yourself. I told you on the phone the reason we came here is to get your side of the story. As far as the dog bite goes, I don't know. Okay? I wasn't here. Well, we can Well, we'll go, you know, forward with that. Right now, what I need from you or what I'm going to ask from you is this consent to have someone walk with your wife secure the firearm that was used. >> Mhm. >> Okay? >> Okay. >> If I have to explain the process to you. If we If you don't want to give us consent >> No, that's okay. You You can go. >> Let me do my Let me just explain the whole thing. I even know >> Do you know how many guns I have in my house? A lot. >> Okay. Well, do you know which one was used in this case? >> Yeah, the one I carried with me. >> Okay, which one's that and where is it? >> It's a It's a Kimber 9 mm. It's a white white my my black. >> Your Your Where's the Where's the uh >> In my In my back. It's right inside my >> What color is it? >> Uh >> What color is it? >> The Kimber is gray and black. >> Gray and black. So, it's in the office. It's in the office in a pouch. >> It's in my office, yeah. No, no, it's in a pouch. >> It's in a pouch. And you're You're giving us consent for you going in there. >> can get it. >> That's all we need. So, what we're going to do next is there's going to be the officer And uh >> Don't Don't worry about him, ma'am. >> He never shoot the gun. He just hit the guy. Both of them were going to hit him. >> Okay. >> Fill this out. Have her sign it. >> Yeah. >> Yep. >> You're awesome. How do you know? >> What? >> Okay. >> Sorry about that. >> I got to do something. >> Yeah, no. >> Um he got his phone. >> So, uh So, one parked where I'm parked now. Um thought that it was two houses over. >> Is that guy getting in 22 with somebody? >> This is This guy was in 22 with the victim, but he's He's just videotaping the victim. He was upset that he was videotaping us. >> Okay. I don't >> Hey, let's get him out of here. >> They're They're coming to pick him up right now. >> Who is? >> Warrants. >> See, no one backed you up there. >> Oh, okay. All right. >> Thank you. >> Um I'm parked where I'm parked. We're sitting in the car, Jen and I, waiting for Ash to say, "Hey, he's going to come out." I wouldn't have been that close if I knew. I thought it was two houses. So, uh when he comes out, he matches the description. And I'm like, "Wait, is that him?" And uh Ash is like, "Yeah, he's coming out now." So, I'm like, "Yes, that's him." Um I get out and I say, "We'll address him from here." Hands team kind of runs up, and we all kind of get online. I'm like, "Hold, hold, hold. Don't like just just make a line right here cuz we're already past our our point of cover. It'd be in my car. Um So, we're probably somewhere in this driveway, and he's not being compliant. He's on the phone. He hangs up the phone. >> Yep. >> Um and he says He says something in Spanish. Um We I'm trying to kind of hold the line back from chasing the rabbit. And uh but I'm trying to stay online so I'm not behind people, too. Um we get up maybe somewhere in front of this house right here. Somewhere in this yard. And we're addressing him, and I'm like, "Wager, this is you. Like give commands." Wager starts giving him commands. He's not compliant. He's doing the like semi-compliant thing where he's like up, down, reaches What? I said here you could Yeah. Reaches for his waist at one point, but no fanny pack on. Um puts his hands back up, but then we're saying get on the ground, um go to the ground. >> Hey guys, just so you know, we don't have body cameras on. He was bit by our K9 in the left shoulder. He's got a couple scratches and a couple wounds there. >> All right. >> You want us to Does he get transported with us or just >> He's going to be arrested. He's going to be arrested. >> I got to bandage him up and so he can go with y'all. I'm assuming. >> We're going to have to take him to the hospital to get medical care before he can go to jail. >> You want us to uh transport him? >> Yes, please. >> Okay. >> Um we're addressing him somewhere in the front yard of this house. He's a probably about where he is right now. >> Okay. >> Um Wager is kind of like kind of like inching the dog toward him, like you're going to get it. And then >> Yes, sir. >> His ID? >> Yeah. >> Uh I don't have his ID. His name is Miguel Martinez. >> Manuel? >> Oh, Manuel. I'm sorry. Manuel Martinez. That's all I got for you right now. >> the physical card? We can get it for you from inside. Um from Manuel Martinez? >> Martinez. >> I don't know off the top of my head. >> I'm trying not to go right up to him, but he's in that gray man zone where he's like 6 to 8 ft from us and I'm like man close. And um So, as we start kind of peeling out, he goes to his knees, but then he won't go to the rest of the way to the ground. He's just kind of staying there. So, I kind of go around behind him and I he's still non-compliant, won't do anything, go to the ground, or anything. That's when I kick him. >> No, his hands were up. So, I kick him um in the shoulder to just put him on his face. And then uh he turns around to fight and that's when Wager He I I kick him down and he rolls over and he puts his fists up. That's when Wager bit him. And then um I put my gun in his face because he punches hands towards his waist. He pushes the muzzle away at one point. And I I said, "Look, man, you're going to get shot." And then uh I kind of backed out because I I had the long gun. I kind of backed out for a minute. He's getting dog bit. They're trying to get him to comply. He's still non-compliant. Wager pulls >> And there is the other one, different officer, same tape, same unguarded moment describing his own use of force to an investigator. His hands are up, so I kick him in the shoulder to just put him on his face. His hands are up, so again, that word not despite. So, watch what that does to the sequence. He kneels, his hands go up, he gets kicked in the shoulder, he goes over, he turns, and that the turning after the kick becomes he turned around to fight, which becomes the resistance, which becomes the dog. Every link in that chain is real. The question is what started it? >> Put the dog off him. Seemo and I think Seemo and somebody else, I'm not sure who, jumped back on him. They bite him again. He's still actively physically resisting and um aggressively resisting. And they they wrestle him and the cuffs basically throw him out. Um I put my taser on his leg and say, "You're going to get tased." >> Okay. Wager? >> Yeah. >> All right. >> And then that was that was pretty much it. And then he's saying this how he was when you got here and then he just calmed down so. >> Everybody had their cameras on? >> To my knowledge, yeah. >> We Jan and I went home and started >> Um so it was me and Jan in my car. Partanen, Wager and I think Seaman behind us. >> So five and and use of force? >> Uh >> Five >> 18 >> I don't know about Partanen using force. >> He he complied to the ground on his knees, put his hands up? >> Uh he was he was like doing that like semi-compliant thing where he would like start to but then not. And then like we'd give him another command and he would like hey get on the ground. It took us I don't know seven eight times telling him that. How many times did we tell him to get him on the ground? Quite a bit. >> Yeah. >> Um fully comply. >> Then he got on his knees and then started doing this weird thing and then got back up and that's where he got taken down. >> What point did he get the dog bit? >> After >> I I kicked him down >> Yeah he kicked him down and he started resisting and then dog bit. >> Yeah. >> He he when I kicked him down he turned back over like this. >> I heard at one point he you said like oh my god something like that too. >> He pushed my muzzle away. So. >> A lieutenant listens to that entire account. His officers have put a dog on a 71-year-old man on his own lawn. His first question is whether the dog is okay. And when the handler finishes explaining, the supervisor's response is two words. That's fine. That is a review. That is the review. It happens on a lawn. It takes under a minute and it is the only one this incident is confirmed to have received. >> When they when he got close to them he started acting a fool saying shoot me shoot me. I don't know I don't understand that because on the phone he was cool. So that's >> I'm sure that he was surprised that all these people came over here. He he's he's It's the first time that he has a problem like this. >> Right. >> No, he's just a serious man. >> I like your car, by the way. We got all our rifles that are sitting in our thing. >> I think he was really upset that that all these people came around here surrounding him when he They didn't have any problem. This guy almost hitting them. >> Right. Well, like I said, all I needed him to do was just come out, be cool with the client, and then that didn't happen. That's why he got dog bit. But if he hadn't, if he had just come out and sat down like we told him, then he None of this would ever happen. >> And nobody could have hold him without >> I called him. >> What without hold having this dog in front of in in top of him? >> anytime we have an armed an armed felon, the dog comes because it's a tool. So, what would If he hadn't have come out, what would have happened is we would have had the whole SWAT team out for a uh SWAT call. Just because of the charge. Because it's aggravated battery with a with a firearm. So, I know it seems very of a severe response, but based on the crime we had, that's why we have it's just protocol. We have to go that way. >> Anytime we have an armed felony, the dog comes because it is a tool. I want to take that seriously rather than mock it because he is describing something real. A policy applied automatically, armed felony in, dog out. He is not inventing that on the lawn, but listen to what he is actually saying. The dog is not a response to what this man did in front of them. The dog is a response to the category he was put in before anyone ever laid eyes on him. Which means the entire justification rests on the category being right. >> Because >> going to our house. >> Because if he just hit somebody in the head with a gun and then didn't call 911 and came here, I don't know what his intentions are. So, if we would have walked up and knocked on the door and he shoot and he shoots my officer from outside, can't have that happen. >> Okay, I understand. >> So, that's why that's why I Yeah, that's why I called him and tried to get him to come out because So, uh like I said, he's he's going Osceola, and he's going to get taken care of, and then >> And then after that, what's going to happen? >> He's going to go to jail. Because uh the the original investigation, and then the resistance and the battery of officers we have here. So, if he if he had not fought with my officers here, they would have gotten his side of the story, and he might not have gone to jail. They would have sent it to the state attorney, or requested that a judge see if there's an arrest warrant, anything like that. But, because of the way he acted here and fought my officers, he's going to go to jail for that. >> And then the supervisor says the quiet part to the man's own family standing on the grass. If he had not fought the officers here, they would have taken his side of the story, and he might not have gone to jail at all. Read that twice. The plan was a conversation. He goes to jail for what happened in the 80 seconds after he walked out of his front door at their invitation with his hands up. So, let us go back to the category, the armed felony, the thing that made the rifles, the perimeter, and the dog protocol. Uh a supervisor on this tape calls it aggravated battery with a firearm. According to Fox 35 Orlando, the state attorney's office looked at that case and dropped it. Not enough evidence to prosecute. Um I will be straight with you about the limits here. That is one outlet, and the same outlet later reported that no charges were filed at all. Those two things cannot both be literally true, and I could not obtain the court file to settle it. But, it it it lands in the same place either way. Nobody was ever convicted of the crime that put a dog on that lawn. Quick word, then straight back to the tape. Everything I am explaining here, what you say, what you do not say, and what actually holds up afterward is laid out in plain English in my know-your-rights playbook. What to say at a traffic stop, word for word, what an officer can and cannot do, and the three sentences that protect you. It is linked in the description, and it is on sale right now. Now, let us get back to it. So, the last question, did anyone answer for it? Here is everything I can actually confirm. In October of last year, Manuel Martinez and his wife filed a federal civil rights lawsuit against the city of St. Cloud and against Officer William Wager. It is live right now in the Middle District of Florida. A jury trial is set for the October 2027 term. Nothing has been decided. Nobody has won, and nobody has lost. As for the officers, when Fox 35 asked the city of St. Cloud whether anyone had been disciplined over any of this, the city declined to say. Not no, not yes. They declined to say. There is no firing here. There is no criminal charge. There is no settlement. What there is is a tape of a man being kicked and bitten while kneeling with his hands up, four officers explaining on camera why that was correct, a supervisor saying, "That's fine." and a city that will not tell the public whether it ever looked at any of it. I will leave you with the 18 in He was on his knees. They wanted him flat. Everyone on that lawn agrees on that. It is the one thing nobody disputes because they are the ones who said it. The whole argument, the the kick, the dog, the the surgery, the jail, the lawsuit that will not be tried until 2027, all of it lives in the distance between a man's knees and the ground. Ask yourself what you would have wanted them to do with those 18 inches. Then tell me in the comments cuz I genuinely want to know.
